The City Commission of the City of Sanford, Florida, met in regular session
at the City Hall in the City of Sanford, Florida, at 7:30 o'clock P.M. September 25, 1939•

Meeting called to order by the Chairman.
Minutes of adjourned meetings of September 7th, 8th, regular meeting of
September 11th, adjourned meetings of September 13th, 18th and 19th, 1939 read and
approved.
Mrs. F.E.Roumillat next appeared on behalf of the Garden Club and requested
permission to use a space in the Chamber of Commerce building for an office stating that
they had obtained permission from the Seminole County Chamber of Commerce providing it met
with the approval of the City Commission.
Request approved.
Further consideration next given to the plumbing bill of 7V.J.King in amount
Of $7.70 covering repairs °to sanitary sewer line of R.L.Shinholser at 607 Oak Avenue.
Thereupon, after considerable discussion and upon a statement from Mr. King
that in his opinion the trouble was caused from negligence of the WPA workers in failing
to re- connect Mr. Shinholser's sewer when replacement was made of the City's sewer line,
the Commission agreed to pay the aforesaid plumbing bill for Mr. Shinholser.
Messrs J.A.Calhoun and R.L.White next appeared in connection with their
sanitary sewer line extending across the property owned by A.D.Rosier and connecting
to the City's sewer, stating that Mr. Rosier had notified them that he was going to
disconnect their sewer line and requested the Commission t,) take the necessary action
to prevent him from disturbing this sewer.
Matter referred to the City Attorney and Supt. Moughton.
Request next received from the Packer Advertising Company for a permit to
remove two sign poster boards and replace same with frame structures, one located on the
corner of Celery Ave. and Bay Ave. and the other at the corner of First Street and Jessa.-
mine Avenue.
Thereupon in view of this request not conforming with the ordinance regulati
erecting of sign and billboards, action deferred pending an opinion from the City Attorney,
Application next received from Harry Robson to lease sufficient land in Fort
Park
Mellon / to erect and operate a Miniature Golf Course, and same was referred to Commissioner
Gut and the Recreational Committee.
Bids next received for furnishing 500 feet of Municipal Fire Hose for the
Fire Department as follows:

Thereupon the Chairman appointed Commissioner Coleman, Commissioner Rollins
and Fire Chief Cleveland as a eommitee to tabulate the aforesaid bids and submit at the
next meeting.
The Clerk next reported that for the years 1933 thru 1938, Lot 7 Block 6 Tier A,
had been assessed as improved property, whereas, it is a vacant lot and reductions in the
valuation should have been made when the valuations on unimproved property were reduced.
Thereupon, in order to correct this error in assessment, Commissioner Lodge
Moved that the valuation on this lot be adjusted to $1,280.00 for the years 1933 thru
1937, and $1,025.OU for 1938, balance to be canceled.
Seconded by Commissioner Gut and carried.
On motion duly carried the Clerk was next authorized to instruct the Central
Hanover Bank & Trust Company, New York to pay the coupons due Sept 1, 1939, without the
executed ownership certificates attached thereto, from Refunding Series "A" and "B" Bonds
represented by R.E.Crummer & Company, Chicago, they having agreed to obtain ownership
certificates and forward direct to the City.:
Application next received from David Mitchell for permit to sell beer end wines
at 410 Sanford Ave., and same was referred to Chief of Police Williams for investigation.
Application next received from Moody Harden for permit to sell beer and wines at
300 Sanford Avenue, and same was referred to Chief of Police Williams for investigation.
The Clerk next reported that the Southern Bell Telephone Company is discontinuing
a number of their pole lines and transferring the wires to the Florida Power & Light
Company's pole line, and that they had offered to make the transfer of the Police call
system lines to said poles provided the City pay for the cost.
Thereupon, the City Attorney was instructed to notify the Southern Bell Telephone
Company that in accordance with the terms of their franchise, they will have to transfer the
Police call, system wires at their own expense.
Communication next read from Major George A.DeCottes, Post Commander of the
local National Guard, requesting the Commission to rescind its action of August 14th. placing
111aximum of $2.50 per month for free water furnished the Sanford Armory, and to continue d6j4ati
/water consumed.
Thereupon, after considerable discussion the Commission authorized the maximum
of free water increased from $2.50 to $5.00 per month, all water used in excess of this
amount to be charged to the Armory.
Application next received from Clarence Moseley for permit to tear down an.
old dilapidated frame building located on the N 1/2 of Lot 10 Block 11 Tier D which has
been condemned by the City, and on recommendation of Inspector Paxton, same was granted.

Bill of the Florida State Road Department in amount of $11.60 covering tests
made of the strength of concrete mixtures for sidewalk specifications as prepared by
Engineer Williams, next presented and on motion duly carried, same approved and
payment ordered.
In accordance with the regulations governing the holding of Primary elections,
and on motion of Commissioner Lodge, seconded by Commissioner Coleman and carried, the
Mayor was next authorized to issue an election proclamation calling a Primary Election to
be held on November 7th, 1939, for the purpose of selecting two nominees for the position
of City Commissioner, one to fill the vacancy to be created by the expiration of the term
of office of City Commissioner Edward Higgins and the other to fill the vacancy to be created
by the expiration of the tsrm of office of City Commissioner M.J.Lodge; the following being
designated as Clerk and Inspectors of said election:
For Clerk : E.F.Lane
For Inspectors: Mrs F.E.Roumillat, Mr. N.O.Garner and Mr. W'.E.Watson.
On motion of Commissioner Gut, seconded by Commissioner Lodge and carried the
Clerk was next authorized and instructed to transfer $1,000.00 from the Division of
Insurance, to the Insurance Fund Account in the Sanford Atlantic National Bank, this amount to
supplement funds already on deposit in this account and carried as a reserve to pay claims f
which the City may be liable as a Self Insurer under the Workmen's Compensation Act.
On motion of Commissioner Rollins, seconded by Commissioner Gut and carried,
the Clerk was next authorized and instructed to transfer $2,600.00 from current Debt
Service collections to the Sinking Fund for interest on unexchanged Series "A" Refunding Bo
$450.00 from the Department of Water Utility revenues to the Sinking Fund for interest on
unexchanged Series "B" Refunding Bonds; $2,814.52 from the Sinking Fund to the Ordinary
Fund to reimburse the Ordinary Fund for purchase of unref ended bonds and Debt Service ex-
penses paid by the Ordinary Fund.
Commissioner Lodge next introduced Resolution No. 559 and after being read in
full by the Clerk moved its passage and adoption.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA,
APPROPRIATING ANY UNEXPENDED CASH SURPLUS ON HAND AT THE END OF THE FISCAL YEAR 1938 -1939
TO THE DEPARTMENT OF THE GENERAL GOVERNMENT OF SAID CITY, FOR THE FISCAL YEAR 1939 -1940,
FOR USE FOR THE ORDINARY PURPOSES AND OPERATING EXPENSES OF SAID CITY.
WHEREAS, the City Commission of the City of Sanford, Florida, deems it
necessary, expedient and for the best interest of said City that any unexpended cash
surplus as of September 30, 1939 , of the operating revenues of said City for the fiscal
year 1938 -1939 be appropriated for the ordinary purposes and operating expenses of said
City in the budget for the fiscal year 1939-1940.
- NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford,
Florida, that any unexpended cash surplus as of September 30, 1939, of the operating revenues
of said City for the fiscal year 1938 -1939 be and the same is hereby appropriated to the
Department of General Government of said City for the ordinary purposes and operating expenses
of said City for the fiscal year 1939 -1940, and said cash surplus shall be incorporated in
the budget of revenues and expenditures of said City for said fiscal year 1939-1940 for the
ordinary purposes and operating expenses of said City.

WHEREAS, each and every item contained and set forth in said budget prepared by the
City Clegkhas been carefully considered by this Commission.
THEREFORE, BE IT RESOLVED, that saidBudget as prepared and presented by the City
Clerk to the City Commission be and the same is hereby adopted as the budget of the City
of Sanford, Florida, for the fiscal year beginning the first day of October , 1939, and
ending the 30th day of September , 1940.
BE IT FURTHER RESOLVED, that upon the collection of any revenues of said City
the City Clerk shall allocate from each dollar collected and received the several amounts
to the respective funds or purposes for which the same are hereby authorized and appro-
priated.

Thereupon the Chairman announced that the City Commission of the City of Sanford,
Florida, by unanimous voted had passed and adopted said Ordinance No. 265, entitled:
ORDINANCE NO. 265.
AN ORDINANCE MAKING APPROPRIATIONS FOR THE CITY OF SANFORD, FLORIDA, FOR
THE FISCAL YEAR BEGINNING OCTOBER 1, 1939 AND ENDING SEPTEMBER 30, 1940.
On motion duly adopted Ordinance No. 265 was neat ordered POSTED at the front door
of the City Hall in the City of Sanford, Florida, in accordance with the terms of the
Charter , as amended.
Commissioner Gut neat introduced Ordinance No. 266, entitled:

AN ORDINANCE DETERMINING THE AMOUNT AND FIXING THE RATE OF TAXATION AND MAKING
THE ANNUAL TAX LEVY OF THE CITY OF SANFORD, FLORIDA, FOR THE YEAR 1939-

On motion duly adopted, Ordinance No. 266 was then ordered POSTED at the front door
of the City Hall in the City of Sanford, Florida, in accordance with the terms of the
Charter, as amended.
On motion of Commissioner Gut, seconded by Commissioner Coleman and carried, the
Commission neat instructed that the City take over the operation and maintenance of the
Diamond Ball Field and the Clerk authorized to charge -the balance of $1,538.26 due from the
REcreational Committee on the cost of construction, to the Division of Parks and Playgrounds
as a capital outlay of the City. Under the original agreement the City underwrote the cost
of installing the aforesaid diamond ball field and such cost was to be repaid from the net
receipts from games.
Consideration neat given to employing a Recreational Director for the City on a full
time basis.
Thereupon Commissioner Gut moved that R.M.Harda.ker be employed as City Recreational
Director at a salary of $100.00 per month, effective October 1, 1939. r
Seconded by Commissioner Lodge and carried.
On motion of Commissioner Lodge, seconded by Commissioner Rollins and carried, the
Commission neat authorized and instructed that G.L.Duncan be transferred from the Fire
Department to the Division of Inspection, and employed as assistant inspector at a salary

Application next received from D.M.Somerville for employment as manager of the Municipal
Golf Course, and same was ordered filed.
On motion of Commissioner Rollins, seconded by Commissioner Gut and carried, the Com-
mission next authorized payment to the Barnett National Bank of Jacksonville, the second
annual premium in amount of $463.99 due October 1, 1939, on the five year insurance premium
contract covering fire insurance on City property as provided in the Schedule Policy.
On motion of Commissioner Lodge, seconded by Commissioner Coleman and carried, the
Commission next ordered all insurance policies renewed with the same companies now carry-
ing such insurance.
Request next received from members of the First Christian Church that a park bench be
placed in front of their church on Sanford Avenue, and 'same was granted.
Bill of City Attorney Fred R. Wilson in amount of $47.09 covering expenses incurred
in handling legal matters for the City, next presented and on motion duly carried, same
approved and payment ordered.
Request next received from R.M.Blanf ord to be allowed to pay the paving assessment
and interest amounting to $326.74, under the adjusted basis amounting to $18.99 against
Lot 9 Block 4 Tier 9
Request approved, provided City taxes for years 1936/39 are also paid.
Request next received from R.C.Whitten to be allowed to pay delinquent taxes for
years 1927 thru 1939 amounting to $2,922.94, under the adjusted basis amounting to $923.09,
agaift-st Block 21 Neave's Addition.
Request approved.
Request next received from the Sanford Building & Loan Association to be allowed to
pay delinquent taxes for the years 1932 thru 1939 and paving assessments and interest
amounting; to $2,610.30 under the adjusted basis, amounting to $330.02 against Lot
146 Sanford Heights.
Request approved.
Request next received from D.E.Brubaker to be allowed to pay delinquent taxes for
the years 1931 thru 1933 amounting to $222.75, under the adjusted basis, amouting to
$14.93.
Request approved.
Request next received from George Huff to be allowed to pay delinquent taxes for
