MINUTES
CITY COMMISSION, SANFORD, FLORIDA, Qc Ober. 2-3 at 7 a 3 "19-3-9--
The City Commission of the City of Sanford, Florida. met in Regular session at
the City Hall in the City of Sanford, Florida, at 7 :30 o'clock P.M. October 23, 1939•

In the absence of the Mayor, Commissioner Coleman was designated as Chairman and
took the Chair.
Meeting called to order by the Chairman.
Minutes of adjourned meeting of October 11, 1939 read and approved.
On motion of Commissioner Gut, seconded by Commissioner Lodge and carried, the

Commission next authorized the purchase from Beynard Brothers Realty & Insurance Company
Inc. St. Petersburg, Florida, of one Refunding Series "B" Bond No. 467 with coupon due
March 1, 1940 and subsequent attached, at a price of $440.00 and interest.
The Clerk next reported Mr. M.J.Lodge to be the only candidate to qualify for
the position as City Commissioner in Group No. 2 for the Municipal Primary Election to

be held November 7th. 1939, and that in accordance with the law governing primary elections,
his name will not be placed on the ballot.
Thereupon , upon motion duly carried, Mr. Lodge was duly certified as the.nominee
in Group No. 2 for the position of City Commissioner and his name ordered printed on
the ballot for the General Municipal Election to be held December 5th. 1939.
On motion duly adopted the Mayor was next authorized to issue an election procla-
mation calling a General Municipal Election to be held December 5th. 1939, for the
purpose of electing two City Commissioners for terms of three years each, to fill the
vacancies to be created by the expiration of the terms of office of Commissioners
Edward Higgins and M.J.Lodge, the following being designated as officials of said election:

For Inspectors Mrs. F.E.Roumillat, Messrs N.,O.Garner and W.E.A atson..
On motion of Commissioner Gut , seconded by Commissioner Lodge and carried,
the Commission next authorized access by the Clerk and B.C.Moore, Auditor of Pentland,
Gray & Moore to the safety deposit boxes at the Sanford Atlantic National Bank for the
purposes of verifying the bonds deposited therein.
Commissioner Gut next intorduced Ordinance No. 287 entitled:
AN ORDINANCE AMENDING SECTION 186 OF ORDINANCE NO. 133 ENTITLED
" AN ORDINANCE CREATING A BOARD OF PLUMBING COMMISSIONERS ESTABLISHING
A PLUMBING CODE FOR THE CITY OF SANFORD, FLORIDA, PROVIDING RULES AND
REGULATIONS FOR THE INSTALLATION OF PLUMBING AND PRESCRIBING A PENALTY
FOR THE VIOLATION OF ANY OF THE PROVISIONS OF THIS ORDINANCE" ADOPTED
JULY 28, 1926.
and same was placed on its first reading and read in full by the Clerk.
Thereupon Commissioner Gut moved that the rules be waived and said ordinance No.
287 be placed on its final passage and adoption.
Seconded by Commissioner Lodge.
Thereupon the question recurred upon the weivure of the rules . The Roll was called
and the vote stands as follows:

Thereupon said ordinance No. 257 was placed upon its final passage and adoption.

Thereupon the Chairman announced that the City Commission of the City of Sanford,
Florida, by unanimous vote had passed and adopted said Ordinance No. 257, entitled:
AN ORDINANCE AMENDING SECTION 156 OF ORDINANCE NO. 133 ENTITLED "AN ORDINANCE
CREATING A BOARD OF PLUMBING COMMISSIONERS ESTABLISHING A PLUMBING CODE FOR THE CITY OF
SANFORD, FLORIDA, PROVIDING RULES AND REGULATIONS FOR THE INSTALLATION OF PLUMBING
AND PRESCRIBING A PENALTY FOR THE VIOLATION OF ANY OF THE PROVISIONS OF THIS ORDINANCE"
ADOPTED JULY 25, 1926.
On motion duly adopted, Ordinance No. 257 was then ordered POSTED at the front
door of the City Hall in the City of Sanford, Florida, in accordinence with the terms of
the Charter, as amended.
Consideration next given to the request of the Sanford Herald that the City place
an advertisement in a " Mail Away" edition to be published on October 30th., and on motion
duly adopted, a. one -half page advertisement was authorized to be placed in this edition of
the Sanford Herald at a cost of $34.44.
The Commission next authorized the payment of $250.00 to Reel & Sons for one
Used 1935 Model Dodge bus, this purchase having been authorized at the meeting of August
14, 19 39.
Request next received from Heyward Walker that the City install a two inch
water main on 20th Street from 'Washington Ave. East to the City limits to furnish water
to his dairy.
Thereupon after considerable discussion and in view of -the fact that this dairy
is located outside the City, it was the decision of the Board that Mr. Walker pay for the
cost of this installation.
On motion of Commissioner Lodge, seconded by Commissioner Gut andcarried, the
Commission next authorized payment to Mr. Ernest Krupp of the percentage of cost on
partial payments of personal taxes collected by him whj.le employed as Deputy Tax Collector,
in amount of $17.46
Commissioner Gut next introduced Resolution No. 561 and after being read in full
by the Clerk moved its passage and adoption.

RESOLUTION No. 561.
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA,
CONDEMNING AND ORDERING TO BE DEMOLISHED AND REMOVED A DILAPIDATED , UNSANITARY
AND UNSAFE BUILDING ON THE PREMISES IN THIS RESOLUTION DESCRIBED.
WHEREAS, there is located upon that certaim'.lot, piece or parcel of land situate
in the City of Sanford, Florida., and described as the 'Xest Half ( W 112) of Block 4, of
Tier 15, of E.R.Trafford's Map of Danford, a. certain building which is dilapidated, unsani-
tary and unsafe beyond sound repair and in the opinion of the City Commissioners of said
City of Sanford, said building should be condemned and ordered to be demolished and removed:
NOS: ", THEREFORI � BE IT RESOLVED BY THE CITY COkMISSION OF THE CITY OF SANFORD, FLORIDA:
That the building above described be and the same is hereby condemned end ordered

t3 be demolished and removed and that a copy of this resolution be delivered to all
parties interested in said building and that upon their failure to show cause at the
next regular meeting of said City Coirimission to be held on the 13th day of November,
1939, why said building should not be demolished and removed the sanitary insepctor
of the said City be and he is hereby required to demolish and remove-said building:
BE IT FURTHER RESOLVED THAT this resolution become effective immediately upon
its adoption.

As the City Commission of the
City of Sanford, Florida.
Request next received from the First Christian Church that another park bench
be placed in front of their church building on Sanford Ave., and same was granted.
On motion duly adopted the Clerk was next instructed to obtain bids for
furnishing uniforms for the -Police and Fire Departments.
The Clerk next reported that the Federal Communications Commission had served
notice that the City is violating the requirements of the Federal Radio Commission by
operating the Police Radio Call System without a frequency measuring device.
Thereupon in order to meet this requirement, the Clerk was instructed to obtain
bids for furnishing a radio monitor for the police radio call system.
On motion of Commissioner Gut, seconded by Commissioner Lodge and carried,
the Commission next authorized the employment of '`ilmer P. Lane as police patrolman at a
salary of $97.50 per month.
Further consideration next given to the lease to Harry E. Robson of property
in Fort Mellon Park.f or the purpose of constructing and operating a miniature golf course,
authorized at the meeting of September 29, 1939•
Thereupon after considerable discussion, Commissioner Lodge moved that the
Co:7imission rescind its action of September 29th., leasing Mr. Robsonn property in
Fort Mellon Park, and lease him the rest 125 feet of that part of Block 14 of Chapman
& Tucker's Addition lying south of First Street for a. period of five years beginning
November 1, 1939, at a renta`l of $15.00 per month beginning November 1, 1940
Seconded by Commissioner Gut and carried.
Thereupon the Commission authorized the Mayor and Clerk to execute this lease
on behalf of the City, and ordered that same be spread on the minutes of this meeting, as
f ollows:
THIS INDENTURE OF LEASE, made and entered into in duplicate by and between
CITY OF SANFORD, FLORIDA a municipal corporation of Seminole County, Florida, hereinafter
called " LESSOR" and HARRY E ROBSON of Seminole County, Florida, hereinafter called
"LESSEE, WITNESSETH:
That the said Lessor has leased, demised and let and by these presents does
lease, demise and let unto the said Lessee the following described premises, situate
in the City of Sanford, Florida, to —wit:
The "lest 125 feet of that part of Block 14 of CHAPMAN & TUCKER'S ADDITION
to Sanford, Florida, South of First Street of said City of Sanford, Florida.

TO HAVE AND TO HOLD the above described premises unto the said lessee for and
during the term of 5 years from the 1st. day of November , 1939, subject to the terms,
conditions and payment of rental as hereinafter stated.
The Lessee has leased and taken the above described premises of and from the
Lessor and agrees to pay as rental therefor the sum of $15.00 per month beginning on the
first day of November 1940, said monthly rental to be payable in advance on the first day
of each month during the remainder of said term , the first monthly rental to be paid on
the first day of November , 1940.
IT IS FURTHER UNDERSTOOD AND AGREED by and between the Lessor and Lessee and this
lease is made upon the following terms and conditions, to —wit:
1. The Lessee will only use the above described premises for and during the
-term hereof for the operation of innocent games of amusement and sale of refreshments,
including tobaccos.
2. The Lessee will complete within ninety days from the date hereof all improve-
ments necessary to be used for the conduct of his business on the above described land
and premises and upon his failure to complete said improvements within the time stated
this lease shall become null and void and of no effect and possession of land and
premises surrendered to the Lessor, its successors or assigns.
3. If at any time during the term hereof the Lessee shall not operate his
business on the above described land and premises for a period of ninety days contin-
uously during the term hereof, this lease shall become null and void and of no effect
and possession of said premises shall be surrendered to the Lessor, its successors or
assigns.
4. Any improvements placed upon the above described property by the Lessee
during the term hereof shall be assessible for taxes by the Lessor as personal property
and the Lessee shall pay before they become delinquent all taxes or other impositions
upon the above described land and premises or improvements thereon for State and County
purposes, during the term hereof.
5. The Lessee shall pay any and all license taxes that may be or become payable
the conduct of his business or businesses thereon.
6. The Lessee will not permit any unlawful or offensive business to be con-
ducted on the above described premises or make any unlawful or offensive use thereof.
7. The Lessee shall not assign this lease or sublet said premises or any portion
thereof without the consent of the Lessor.
8. The Lessee shall have the right at the end of the term hereof or earlier
termination of this lease to remove from the above described premises any and all
improvements that may be placed thereon by him, but shall restore said premises after
removal of said improvements to normal condition.
9. Default for a period of ten days in the payment of the monthly rental
hereinbef ore required to be paid by the Lessee or in the payment before they become
delinquent of an taxes u the above described land and

thereon shall immediately terminate this lease and possession of the aforesaid land
and premises shall be surrendered to the Lessor, its successors or assigns and violation
of any of the other covenants hereinbefore contained shall terminate this lease and
possession of said land and premises shall be immediately surrendered to the Lessor,
its successors or assigns.
10. The Lessor shall have the right to terminate this lease at any time during t
term hereof, but if terminated during the first year hereof shallp6y to the Lessee the
sum ofp °$1000.00; if terminated during the second year hereof shall pay to the Lessee
the sum of $800.00; if terminated during the third year hereof shall pay to the Lessee
the sum of"1600.00; if terminated during the fourth year hereof shall pay to the Lessee

the sum of $400.00 and if terminated during the fifth year hereof, but before the

Request next received from Chase & Company to lease from the City the seven acresof
improved farm land described as Lots 21 4 and S of Block X St. Gertrude Addition, for a peri
of one year beginning July 1, 1939 at:a rental of 4$150.00, and on :motion duly carried.
same was authorized.
Consideration next given to securing an easement from, A.D.Rosier for the sanitary
sewer line constructed across his property located between First and Second Streets
and Cloud Branch and Poplar Avenue.
Thereupon after cDnsidereble discussion, and on motion duly adopted, the
City Attorney was authorized and instructed to offer Mr. Rosier :50.00 for an easement to
maintain the aforesaid sewer line across his property, to be applied on delinquent City
taxes against the following property: Beg. 158 ft. E. and 100 ft. S. of northwest corner
of Block 3 Tier 12, run E. 40 ft S. 153 ft. 7;- 98 ft N. 153.2 ft .E. 5S ft to point of Beg.
Deputy Tax Collector Harold J. Powers next submitted statements of delinquent
pers_)nal taxes against persons who had made application for adjustment of the taxes and
which he had investigated and made appraisals of the value of the property assessed.

Thereupon after careful consideration andirecommendation of Deputy Collector
Powers, Commissioner Lodge moved that the Clerk be authorized to make the following
