The City Commission of the City of Sanford, Florida, met in Regular Session at the
City Hall in Sanford, Florida at 7:30 O'clock P.M. January 26, 1931.

Meeting called to order by the Chairman.
Minutes of Regular meeting.of January 12, 1931 read and approved.
Commissioner Lehman moved that the Commission rescind the action taken on January
12th, 1931, holding in abeyance Resolution No. 398 pending further action by this Commission
Seconded by Commissioner Speer and so ordered
Commissioner Leffler next offered resolution no. 399 and moved its adoption, said
resolution No. 399 being in words and figures as follows:
RESOLUTION NO. 39-9
A RESOLUTION AMENDING RESOLUTION NUMBER 398 ADOPTED THE 2nd DAY OF JANUARY , 1931,
AS FOLLOWS:
A RESOLUTION AUTHORIZING THE PAYMENT WITH MATURED BONDS OF THE CITY OF SANFORD,
FLORIDA, BY THE OWNERS OF PROPERTY OR HOLDERS OF LIENS THEREON, OF TAXES ASSESSED BY SAID
CITY OF SANFORD FOR ANY YEAR PRIOR TO THE YEAR 1938.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that Resolution
No. 398 adopted the 2nd day of January , 1931, entitled as follows:
A RESOLUTION AUTHORIZING THE PAYMENT WITH MATURED BONDS OF THE CITY OF SANFORD, FLORI
BY THE OWNERS OF PROPERTY OR HOLDERS OF LIENS THEREON, OF TAXES ASSESSED BY SAID CITY OF
SANFORD FOR ANY YEAR PRIOR TO THE YEAR 1930.
be amended so as to read as follows:
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that any
owner of property or holder of a lien thereon assessed for taxes by said City of Sanford,
Florida, for any year prior to the year 1930 and which taxes have not been paid, may pay
such taxes with bonds of the City of Sanford, Florida, without restriction as to maturity
or kind, which bonds shall be accepted by the City Tax Collector or Deputy Tax Collector of
the City of Sanford, Florida, at par without accrued interest and proper receipts issued
therefor, provided that the 1930 taxes shall be paid in cash at the time any of said taxes
for any year prior to the year 1930 are paid with bonds as aforesaid.
Be It Further Resolved that this Resolution shall become effective immediately upon
its passage and adoption.

In view of the fact that due to litigation the 1930 tax roll would not be open
for the collection of taxes until February 1, 1931, Commissioner Lehman next moved that
the City allow Two Percent discount on all current taxes paid during the month of February
1931, and One percent discount on all current taxes paid during the month of March, 1931
and thit the date for the closing of the 1930 tax roll be extended to April 30, 1931.
Seconded by Commissioner Speer and so- ordered.
Communication next read from Mr. F.L.Miller, requesting that the present contract
with the Florida Power & Light Company be declared void.
No action pending further consideration.
Commissioner Speer next moved that the agreement heretofore arrived at between the
City of Sanford and the Bond Holders Protective Committee be formally approved and a
copy of said agreement be spread upon the minutes of this Commission.
Seconded by Commissioner Lehman and carried, said agreement being in words and figuref
as follows:
Memorandum
"1. The City is to withdraw its pleas and no longer oppose entry of judgments in the
pending common law actions on the coupons, certificates of indebtedness and bonds which
shall be produced by plaintiffs and filed in these oases. the Judgments are to beer interest
at six per centum per annum instead of the legal rate of eight per cent.
2. The City shall pay the Committee, under mandamus proceedings, for interest on
bo#d.s held by the Committee, the following amounts from the funds stated below:
Bond Interest Fund .................. $44,081.65
Water profits ( to be applied to water
Bond interest) ....................... 6,000.00
From surplus in general fund.......... 52918.35
Gas bond redemption fund ( to be applied
on interest on gas bonds.)-- ........... 1,016.00
From special assessment fund ( to be
applied to assessment bonds.) .......... 24,000.00
Coupons will be surrendered covering such payments.
3. A form of budget should be adopted whereby there shall be appropriated to
interest payments on bonds and certificates of indebtedness ( except for water bonds)
a fixed percentage of all moneys received by the City from any source ( now existing
or which may be hereafter created) except from the operations of the water plant.
The budget should be fixed as of October 1, 1930., and should not appropriate any part
of the surplus existing on October 1, 1930.
4. The City has expended $16,553.06 from the surplus in the general fund since
October 1, 1930, leaving a balance now on hand ( after deducting the $5,918-35 to be paid
to the committee under paragraph two hereof) of approximately $18,000.00. The city is
willing to agree that the $18,000.00 now on hand shall be paid to the bondholders, after
there are sufficient collections under this year's taxes to permit its payment without
jeopardizing the funds such aneare necessary to run and operate the city. The $16,553.06
alreadyd.expended, the city feels that it is impossible to return this money, but is willing
to agree to return whatever surplus of the general revenues there may be in the hands of
the City on October 1, 1931; that is, the city's surplus as of that date to be turned over
to the bondholders' committee during the fiscal year 1931- 1932,. at such time as there are
sufficient funds in the hands of the city to pay the same without jeopardizing the actual
running expenses of the city.
5. The budget should be revised so that it willbae based on an estimate of not lees
than an 80 per cent collection of current taxes instead of 59 per cent as was the case with
the budget previously set up in 1930.
6.. All receipts of the water plant over and above operating expenses should be ap-
propriated to interest on water bonds. Water bonds should be excluded from the appropriation
for interest on bonds and certificates of indebtedness as provided in paragraph three, un-
less the estimated revenues from the water works will provide less funds, proportionately,
for water bonds than the other bonds and certificates will receive under the terms of this
memorandum, in which event a proportionate part of the moneys appropriated for interest on
bonds and certificates should, under paragraph three, be set aside or appropriated to interes

equal consideration.
7. The city commission will agree to prepare a bill to amend its charter to permit
foreclosure of delinquent taxes without grace after such taxes become delinquent, and
will present the same to the representatives of Seminole County and will ask for its in-
troduction and passage; the city will agree upon a reasonable and orderly method of strict
enforcement of collection of delinquent taxes and assessments.

8. Since the city is accepting assessment bonds of one district, say district 1, in
payment of assessments in another, say District 2, and is accomplishing this purpose by
purchasing for the sinking fund of District No. 2 bonds of District No. 1, no reason is
perceived why certificates of indebtedness and general bonds should not be likewise accepted
in payment of assessments. Therefore, general bonds and certificates of indebtedness should
also be accepted in payment of assessment liens.
9. The committee will interpose no objection to the city's accepting bonds in payment
of taxes for the years 1927, 1929, and 1929, which are covered by the Dofnos writ and prior
years, provided
(1) The bonds will be accepted without restriction as to maturity or kind,
and
(2) 1930 taxes shall be paid in cash at the same time.
10. These proposals are based and conditioned upon the appropriation of sixty per
cent of all taxes and all receipts from every source to bond interest and forty per cent
thereof to operating expenses; and the proportionate part of such receipts appropriated to
bond interest should be placed in a separate account and paid out quarterly.
11. The city commission agrees to furnish the

12. The committee is firmly convinced that the millage levy required by the order of
• the Supreme,�Court is collectible and that the argument that a lower millage will produce more
money is unsound. However, the city commission and certain citizens of Sanford have repre-
sented to the committee that in their judgment the largest amount of money would be col-
lected under a 30 -mill levy, and have earnestly contended that a higher millage would ser-
iously impair the city's stability and prosperity. Because of these views and representations
and with an earnest desire to cooperate with the commission and the citizens of Sanford in
bringing about a condition which the committee hopes will tend to the ultimate solution of the
city's problems, the committee will accede to a levy of only 30 mills upon the following
conditions:
(1) All other points contained in this memorandum are conceded
by the city commission, and
(2) Not less than 19 mills of such levy shall be appropriated to
interest on bonds and certificates of indebtedness.
13. If the City desires to create a fund which will be appropriated exclusively to
the purpose of purchasing bonds, the committee will have no objections to an = increased levy
to provide funds for such purpose, if arrangements satisfactory to the committee and the
oommission can be devised for the administration of such funds.
14. If in the judgment of the committee the undertakings of the city contemplated
by this memorandum are satisfactorily performed, and if the city Chatter shall be amend6d
at the 1931 session of the legislature in form satisfactory to the committee so as to
provide for foreclosure of delinquent taxes by bill in equity without any period of grace
after such taxes become delinquent ( the present period for payment 69 taxes remaining un-
changed, except that the period :br collecting taxes for the year 1930 -1931 may be extended
to June 1, 1931) instead of the present system of tax sales, and if there is no substantial
change in conditions or in the aggregate assessed value of the taxable property within: the
city, unless changed by foreclosure or tax enforcement proceedings, the committee will
interpose no objections to substantially the same levy for the fiscal year 1931,1932, if
all other applicable features of this memorandum are continued in force. The committee re-
serves the right to determine for itself whether or not the city's undertakings have been
satisfactorily performed.

15 If the city Commission should reach /conclusion that the total operating expenses
for the city Jbr the entire budget year 193071931 and the budget year 1931 -1932 ( including
publicity, contingencies and all other items except bond interest ) cannot be fully paid with
a levy of 12 mills under the budgetary and financial plans contemplated by this memorandum,
and, therefore, find it necessary to levy more than 12 mills for operating expenses, the
millage for bond interest should be proportionately increased, that is, in the proportion
of one and a half mills for bond interest to one mill for operating expenses.
16. If these proposals are accepted, the committee will join the city in requesting
a modification of the Dos Amigos writ of mandamus in the Supreme Court of Florida to
conform to these proposals. -

The Clerk was next instructed that upon payment of the money included /the foregoing
Agreement, that the following security covering deposits, furnished by the Sanford Atlantic
Bational Bank, be returned to the said Bank as being no longer required:

Communication next read from the Associated Gas & Electric System, owners of the
Sanford Gas Company, requesting permission to close down the gas plant here and furnish gas
to the City of Sanford from their plant in Orlando.
Thereupon the Chairman appointed Commissioners Lehman, Speer and Leffler as a com-
mittee of three, to confer with the City Attorney and make a thorough investigation, re-
porting back to the Commission at the next regular meeting.
Commissioner Speer next offered Resolution No. 400 and moved its adoption, said
Resolution No. 400 being in words and figures as follows:

A RESOLUTION AUTHORIZING THE PAYMENT BY THE OWNER;:, OF ANY REAL PROPERTY OR HOLDER OF
A LIEN THEREON OF SPECIAL ASSESSMENTS MADE BY THE CITY OF SANFORD, FLORIDA, AGAINST SUCH
REAL PROPERTY IN SAID CITY WITH GENERAL BONDS, CERTIFICATES OF INDEBTEDNESS OR SPECIAL
ASSESSMENT BONDS WITH MATURED COUPONS THEREON OF THE CITY OF SANFORD, FLORIDA.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORDIP' FLORIDA, that the
owner of any real property therein or holder of a lien thereon, may pay any special assess-
ment thereon with General Bonds, Certificates of Indebtedness or Special Assessment Bonds
and matured coupons thereon, issued by the City of Sanford, Florida, without restriction as
to maturity or kind of bond or certificate of indebtedness.
Be It Further Resolved, that this Resolution shall become effective immediately
upon its passage and adoption.

Commissioner Speer next moved that the City enter into a six months agreement with
City Attorney Wilson and Associate Counsel Cary D.Landis beginning January 1st, and ending
June 30th. 1931, at the same rate per annum and under the same terms and conditions as that
entered into with Messrs Wilson and Landis on January 8, 1930, for the year 1930.
Seconded by Commissioner Lehman and unanimously carried.

The Clerk was then instructed to make payments to Messrs Wilson and Landis in accordance
with the aforesaid agreement.
The Clerk next notified the Commission of interest due on February 1, 1931, amounting
to $180.00 on notes held by the Nye Odorless Crematory Company.
Thereupon, Commissioner Speer moved that this interest be paid when due.
Seconded by Commissioner Leffler and carried.
Bill next presented by City Attorney Wilson covering miscellaneous expenses incurred on
City business from December 23 1930 to January 24, 1931, amounting to $51.89.
Commissioner Speer moved that this bill be approved and payment ordered.
Seconded by Commissioner Byrd and carried.
Commissioner Lehman next offered Resolution No. 401 and moved its adoption, said
Resolution No. 401 being in words and figures as follows:

A RESOLUTION RESCINDING RESOLUTION NUMBER 395 OF THE CITY OF SANFORD FLORIDA, ADOPTED
ON THE 1st. DAY OF AUGUST, 19302 ADOPTING THE BUDGET OF REVENUES AND EXPENDITURES OF THE
CITY OF SANFORD, FLORIDA, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1930 AND ENDING SEPTEMBER
30 , 1931•
WHEREAS, on the let. day of August, 1930, the City of Sanford, Florida, did adopt
Resolution Number 395 , adopting a budget of the revenues and expenditures of the City of
Florida
Sanford,/ for the fiscal year beginning October 1, 1930 and ending September 30, 1931,
and,
WHEREAS, the City Commission of the said City is of the opinion that said budget should
be revised and said resolution rescinded:
NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida:

WHEREAS, each and every item contained and set forth in said budget presented
by the City Clerk has been carefully considered by this Commission, THEREFORE,
BE IT RESOLVED that the foregoing estimates of expenditures for the fiscal year
of the City of Sanford, Florida, beginning October 1, 1930, and ending September 30, 1931,
be and the same are hereby adopted, ratified, approved, confirmed and accepted, and that
said estimates be and they are hereby established as fixed appropriations from the revenues
to be derived by said City of Sanford, Florida, from taxes to be levied and collected and
from.other sources as hereinabove set forth in said estimate of revenues for said period ,

and there is hereby appropriated to the foregoing items of expenditures by or for the
Department of General Government forty per cent (40 %) of the revenues of said City which
may be derived from sources other than the current taxes for the year 1930 and forty per cent
(40 %) of all moneys received by said City from current taxes for the year 1930. That there
is hereby appropriated to the payment of the items of expenditures hereinabove set forth for
Debt Service., except said Water Bonds dated January 1, 1924, and said bonds of Series CC
dated July 1, 1926) sixty per cent (6010) of the revenues of said City which may be derived
from sources other than the current taxes for the year 1930, and sixty per cent (60 %)
of all moneys received by said City from current taxes for the year 1930. That there is
hereby appropriated from the gross revenues to be derived from the operations of the Water
Department of said City for the year 1930 the sum of Sixteen Thousand One Hundred Ten and
no /100 Dollars ( $16,110.00) for the operating expenses of said Water Departmenxt, and the
balance of said funds which may be derived from the operations of said Water Department is
appropriated to the payment of past due and current interest upon said Water Bonds dated Janv
uary 1, 1924, and said bonds of Series CC dated July l; 1926.
This resolution shall become effective immediately upon its passage and adoption.
