CITY COMMISSION, SANFORD, FLORIDA, March 24 10 A, M. 19-10-
The City Commission of the City of Sanford, Florida, met in adjourned session
at the City Hall in Sanford, Florida at Ten O'Clock A.M. March 24, 1930.
Present: Commissioner H.'J.Lehman Mayor.
N W.A.Leffler
" R.A.Newman
Vivian A Speer.
City Clerk, F.S.Lamson.
Absent: Commissioner F.L.Miller.

The purpose of the meeting was to consider the advisability of issuing a license
for a Celery Festival to be held in conjunction with a carnival, it appearing that a license
has already been applied for by the Johnny Jones Shows covering the same time that the Celery
Festival is expected to be held.
After considerable discussion, the roll was called as to whether the license for
the Celery Festival should be issued, the vote being as follows:
Commissioner Lehman Aye.
Leffler Aye
Newman Nay

Thereupon the Clerk was instructed to issue the license applied for upon the
payment of the license tax applicable to carnivals, $300.00 per week or fW4on thereof.
The meeting then adjourned.

Minutes of Regular meeting of the City Commission, March 24, 1930.
The City Commission of the City of Sanford, Florida met in Regular Session
at the City Hall in Sanford, Florida at 7 :30 O'Clock P.M. March 24, 1930.
Present:- Commissioner H.J.I#bhman, Mayor.

Meeting called to order by the Chairman.
Minutes of Regular Meeting of March 10th. and adjourned meeting of March 24th.
1930, read and approved.
On motion of Commissioner Speer, seconded by Commissioner. Leffler and unanimous
carried, Superintendent Moughton was authorized to dispose of two mules now owned by the
City, at a price of $50.00 each, cash, it appearing that these mules are no longer needed.
On motion duly adopted, application of the Johnny Jones Shows for a carnival
license for the week of March 24, 1930, was approved, the vote being as follows:

Communication read from V. Schmelz requesting that muddy place in road ad-
joining his property in St. Joseph's Addition be filled.
No action in view of the report of Superintendent . Moughton that the road referr
to'is on private property.
On motion duly adopted, City Attorney Wilson waa directed to render an opinion
in writing, regarding the right of the City to accept, at par, past due interest coupons on
special assessment bonds presented in payment of street paving assessments.
The next matter for consideration , was application for permit by the Seaboard
Oil Company to repave portion of parkway in front of station located on the northeast corner
Elm Avenue and First Street, and to install gasoline pumps on the parkway so repaved and ad-
jacent to the sidewalk, action on this application having been deferred from the last regular
meeting of the Commission.
Commissioner Speer stated that he had investigated this matter and moved that
permit be granted.
Seconded by Commissioner Miller and unanimously adopted.
Communication read from Miss Mell H Whitner, Chairman of the Chautauqua Committe
requesting that-.the license tax for Chautauqua performances be completely removed, or else
reduced to a nominal tax of $5.00 per day.
This matter having been decided at a previous meeting of the Commission, no
further action was considered necessary.
The Clerk next presented invoice of A.P.Connelly & Sons for $500.00 being premi
due March 27, 1930 on USF & G Injunction Bond for $50,000.00 in the case of the City of
Sanford Vs. the Chase National Bank of New York.
Commissioner Speer moved that the City Clerk be instructed to draw check in
payment of this renewal premium, subject to the approval of the Attorneys handling the case
for the City.

Seconded by Commissioner Leffler and unanimously carried.
The Clerk was also instructed to find out from the Attorneys handling t4is case
for the City, whether this bond can be reduced, and also if it can be made for a portion

On motion of Commissioner Leffler, seconded by Commissioner Speer and unanimously
carried, the Clerk was instructed to transfer $30,000.00 from the checking account in the
Ordinary fund at the Sanford Atlantic National Bank, to the Interest Account at said bank.
Resolution presented for adoption by the Florida Power & Light Co.,co #eying the
installation of additional overhead street light on Palmetto Avenue between Geneva and Woo
Streets.

Commissioner Leffler made the motion, which was unanimously carried, that in view
of the fact that the City is payir4g the hospital bills and salary of Fred Hogan, policeman
injured in an accident between a City motorcycle and a school bus, that the City obtain a
release from this policeman from any further claim on account of this accident.

RESOLUTION AUTHORIZING ADJUSTMENT AND SETTLEMENT OF CLAIM OF BOARD OF PUBLIC IN-
STRUCTION FOR THE COUNTY OF SEMINOLE, STATE OF FLORIDA, ON ACCOUNT OF CERTAIN PURPORTED TIME
WARRANTS HELD BY SAID BOARD OF PUBLIC INSTRUCTION AS SECURITY FOR DEPOSITS IN SEMINOLE COUNTY
BANK, SANFORD, FLORIDA.
WHEREAS, The Board of Public Instruction for the County of Seminole, State of Flori
was a depositor of public funds in the Seminole County Bank, of Sanford, Florida, at the time
said bank suspended business on the 6th day of August , 1927, and said Seminole County Bank
had pledged as security for such deposits certain purported time warrants of the City of
Sanford, Florida, as security for said deposits, said purported time warrants being more
particularly described as follows:

as to all of which said purpotted time warrants said City of Sanford denies any liability
thereon and contends that said above described purported time warrants do not constitute a
lega4 obligation of the City of Sanford, Florida, for which its credit was pledged; and,
WHEREAS, There are assessments for public improvements agairs t property belonging
to said Board of Public Imstruction for the County of Seminole, State of Florida, and used
for school purposes, said special assessments amounting to the sum of $11,299.23 Principal,
and $2,117,79 interest, and against the following described property;
The East 1018 feet of the South Half of the North Half of the Southeast Quarter
of the Northwest Quarter of Section 36, Township 19 South, range 30 East ;
The West 302 feet of the South Half of the North Half of the Southeast Quarter of
Northwest Quarter of Section 36, Township 19 South, Range 30 East;
The East 165 feet of the South Half of the North Half of the Southeast Quarter of
Northwest Quarter of Section 36, Township 19 South, Range 30 East, Less the North 12J feet;
Lots 8,9,10,11,12,ind 13 of Block 3 in ELDORADO SUBDIVISION, according to Plat
thereof duly of record in the Public Records of Seminole County, Florida;
Lot 10 of Block 5 of Tier 9 of the City of SANFORD , FLORIDA, according to
E.R.Traff ord's Map thereof, of record in the Public Records of Seminole Counth, Florida,
in Plat Book 1, pages 56 -64.
and,
WHEREAS, Said Board of Public Instruction for the County of Seminole, State of F1
has offered to surrender all of said purported time warrants to the City of Sanford for the
sum of 06,668.75; and,
WHEREAS, the Special Assessment Fund of said City is indebted to the General Revenue
Fund of said City in excess of the amount of the aforesaid special assessments against the
above described property of said Board of Public Instruction;
NOW THEREFORE, Be It Resolved by the City Commission of the City of Sanford,Florida
that the aforesaid offer of said Board of Public Instruction for the County of Seminole, State
of Florida, to surrender the aforesaid purported time warrants to said City for the sum of
$16,668.75, be, and the same is hereby accepted without any concession or admission as to the
validity thereof and without any prejudice to the right of said City to assert the invalidity
of any other purported time warrnats of said City that may now or hereafter be questioned
or involved in any litigation and such acceptance shall not be- :deemed and considered as any
admission by said City as to the validity of said purported time warrants or any of them or
as to any legal obligation on the part of the City of Sanford, Florid, to pay and discharge
the said purported time warrants as obligations of the City of Sanford, Florida, and said
purported time warrants are accepted by the City of Sanford, Florida, in a compromise settle-
ment and adjustment of its financial affairs and that said settlement as hereinabove expressed
and set forth has been made after mature consideration by the City Commission in the interest
of the taxpayers and citizens of Sanford, Florida.
Be It Further Resolved that the aforesaid interest on said Special Assessments be
the same is hereby waived.
Be It Further Resolved that the Special Assessment Fund of said City be credited
with said sum of $11,299.23 as the amount of the aforesaid special assessments against the
aforesaid property of said Board of Public Instruction for the County of Seminole, State of
Florida, and that a voucher on the General Revenue Fund of said City for the sum of $5,369.52

be issued to said Board of Public Instruction for the County of Seminole , -4�S tate of Florida,
and that releases of the aforesaid special assessment liens against the above described
property be issued and delivered to said Board of Public Instruction.

Commissioners Miller and Newman next asked to be excused, which permission was given.
Commissioner Leffler next made the motion that the City dispense with the office
of Superintendent of the Cemetery, effective May 1, 1930, and that this work be placed under
the supervision of Mr. Moughton.

The Clerk next read report from City Attorney Wilson as to the status of various
