May 27 at 2 O'Clock P 9-2 The City Commission of the City of Sanford Florida met in Regular Session at the City Hall in Sanford Florida at 2 O'Clock P M May 27, 1929• Present: Commissioner Nelson Gray, Mayor S.O.Chase. " Frank L Miller " R A_Newman „ Vivian A Speer City Manager, G H Cairns. City Clerk, F S Lamson Chief of Police, R G Williams. Clerk presented letter from W E White , Municipal Judge, recommending that Robert Dangerfield, now serving sentence in jail on a charge of possessing whiskey, be allowed to pay out for the balance of the un- served sentence. Thereupon, Commissioner Newman moved that the prisoner be allowed to pay $50.00 and be released. Seconded by Commissioner Miller and unanimously adopted. Mrs S D Gillion appeared before the Commission with the request that her husband , serving a sentence in jail on a charge of driving an automobile while intoxicated, be released in order to support his family. After considerable discussion, and in view of the seriousness of the offense and the fact that Mr Gillion has only been in jail but a short time, Commissioner Newman moved that the matter be laid on the table until the next meeting. Seconded by Commissioner Chase and the roll being called, the vote stands as follows: Commissioner Gray Aye to Chase Aye It Miller Aye " Newman Aye " Speer Aye Mr E F Housholder next presented a request, in writing on behalf of the owners of Lockhart's Subdivision, and the American Fruit Growers Inc. that the City Commission pass an ordinance or recommendation to the representatives of the County of Seminole in the State Legislature for the passage of a local bill in said Legislature, excluding from the corporate limits of the City of Sanford, the following described lands owned by his clients: Lockhart's Subdivision Blocks 57 -61 Incl, 71 -79 Incl. 98-90 Incl. of M M Smith's Subdivision Blocks 12 -14 Incl. 23 -26 Incl. and 35 and 36 of M M Smith's Subdivision. After some discussion as to the legal right of the Commission to take such a step, Commissioner Newman moved that the matter be referred to the City Attorney. Seconded by Commissioner Speer and adopted by the following vote: Commissioner Gray Aye " Chase Aye " Miller Nay` Newman Aye " Speer Aye Mr Housholder then stated that he would file an additional petition asking the Commission to exclude this property from the City Limits without having to go to the Legibla- ture. 671 MINUTES CITY COMMISSION, SANFORD, FLORIDA, J_ May 27 2 P M 1929 The Clerk next reported having conferred with 8 G Gray, of the firm of Hall & Pentland, City Auditors, with reference to handling the matter of the payment td the Sanford Atlantic National Bank for the time warrants issued to the National Cast Iron Pipe Company and purchased for the account of the City of Sanford by said bank in July 1929. Thereupon , Commissioner Miller offered Resolution No. 391 and moved its adoption, said resolution being in words and figures as follows: (See P. 71 for Resolution j Seconded by Commissioner Chase and adopted by the following vote: Commissioner Gray Aye " Chase Aye " Miller Aye " Newman Aye " Speer Aye City Manager Cairns next reported as to investigation at Mount Dora with reference) to the use, where, desired, of separate water meters and different rates for each, one for water used in the house and the other for water used in beautifying the premises. No action. Minutes of Regular Meeting of the City Commission of May 13th, Adjourned Session of May 14th, and Adjourned Session of May 20th. 1929 read and approved, with the addition of the following amendment to the minutes bf the Regular Meeting of May 13th. " The City Attorney was instructed to amend the Act heretofore authorized limit- ing the time up to which interest on delinquent taxes and paving assessments will be remitted, to June 15th, 1929, so as to grant authority to the City Commission to extend this limit from time to time, if it sees fit, provided it can be extended no later than December 31, 1929•" The Clerk submitted additional security received from the Sanford AtAlantic National Bank to cover City of Sanford deposits in said bank, and same was ordered ref err to the City Attorney. The Clerk next read report from the Library, covering one year from May 1, 1929 to May 1, 1929• Commissioner Miller moved that the report be accepted and that the Clerk ac same, thanking the ladies in charge of the Library for their interest and commending them for their splendid report. Seconded by Commissioner Newman and unanimously adopted. Clerk submitted bill from Mr Fred T Williams, for Engineering Services in con- nection with Street Paving program, amounting to $291.23, and on motion of Commissioner Gray, Seconded by Commissioner Chase and unanimously adopted, same was approved and the Clerk directed to draw check in payment of same. Clerk submitted billf Hall & Pentland, Certified Public Accountants, approved by George A DeCottes, Special Counsel, for services rendered in connection with taking of testimony in the suit of the City of Sanford Vs. the Chase National Bank of New York, amounting to $5+6.97, and on motion of Commissioner Gray, seconded by Commissioner Miller and unanimously adopted, same was approved and the Clerk instructed to draw check in pay- ment thereof. - Commissioner Gray next moved that the number of street lights now in operation tl 1 1 1 1 1 1 1 MINUTES CITY COMMISSION, SANFORD, FLORIDA,_ May 27 2 P g 19- 29 be reduced to the number in operation during the summer of 1929. Seconded by Commissioner Speer and adopted by the following vote: Commissioner Gray Aye " Chase Aye " Miller Aye " Newman Aye " Speer Aye The Clerk next read a report from the City Manager with respect to the Health and Sanitation Department and recommended that the salary of the City Physician be reduced to $900.00 per annum, and that the Food Inspection and Sanitary Inspection work be combined and done by one man._ Commissioner Newman moved that recommendations of the City Manager be accepted. Seconded by Commissioner Chase and adopted by the following vote: Commissioner Gray Nay " Chase Aye If Miller Aye If Newman Aye If Speer Aye On motion of Commissioner Speer, seconded by Commission Newman and unanimously adopted. the insertion of an advertisement in the Sanford Herald at a price of $15.00 welcoming the D.A.R. to Sanford, was approved, this expenditure to be charged to the Publicity Fund. The Next matter to come before the Commission was an examination of old gas and water bills with a view of determining whether collectible or should be charged off as a loss. Thereupon, Commissioner Newman moved that the bill be approved and that the Clerk be instructed to draw check in payment thereof; same to be charged to the contingent fund. Seconded by Commissioner Speer and unanimously adopted. The Clerk next reported as unpaid, State and County Tax Certificate No 154 for 1924 taxes against certain water works property, said certificate having been bought by Frank Evans, the total nemessary to redeem said certificate being $18.31. Thereupon, upon motion duly adopted, the Clerk was instructed to draw check in payment of said certificate. Commissioner Speer presented letter from Mr R' M Warrenlw requesting adjustment ors: assessed valuations for 1927 against certain property owned by John Musson and himself. No action. City Manager Cairns presented request from Mr P F Whigham for permit to erect a gasoline filling station at 2503 W. First Street, Commissioner Speer moved that the permit be granted. Seconded by Commissioner Newman and adopted by the following vote: Commissioner Gray Aye it Chase Aye " Miller Aye " Newman Aye " Speer Aye On motion duly adopted, the City Manager was instructed to erect a more prominent "Stop" sigh at the corner of French Avenue and Thirteenth Street. On motion of Commissioner Newman, seconded by Commissioner Miller and unanimously adopted, permission was granted to the Holy Cross Episcopal Church to construct a sidewalk across the alley between the Church and the Parish House. 11 C� I- r� 1 1 MINUTES 71 CITY COMMISSION, SANFORD, FLORIDA, May 27 2 P M _19__29 RESOLUTION # 391 WHEREAS, the City Commission of the .City of Sanford under date of July 24, 1929, requests the Sanford Atlantic National Bank to purchase for the account of the City of Sanford, from the National Cast Iron Pipe Co., City of Sanford Bond Trustees Time Warrants Nos. 10492 and 10493 dated May 12, 1927 at and for the sum of $16,422.52, plus interest at 6 per cent per annum on the face of the time warrants from January 2, 1925 to July 25, 1925, making a total of $172005.5' and, WHEREAS, The City of Sanford delivered to the Sanford Atlantic National Bank, certificate of Deposit for $17,005.57, properly endorsed, to be held by Said Sanford Atlantic National Bank as collateral until reimbursed by the City for the amount paid for these time warrants, and WHEREAS, Said Time Warrants Nos. 104922 and 10493 were included in Official Refinancing Document A -1 and proceeds from the sale of the unsold balance of the A -1 issue of City of Sanfo: Bonds were intended to be used to reimburse the Sanford Atlantic National Bank for the amount paid for these time warrants, and WHEREASZ, The City of Sanford has been unable to dispose of the balance of the issue of refunding bonds, series A -1 and, WHEREAS, The Sanford Atlantic National Bank has made formal request that this matter be adjusted and that they be reimbursed for the amount paid for the aforesaid time warrants, and WHEREAS, it appears that the Ordinary Fund owes the Capital Fund the sum of $30,910.01 THEREFORE, BE IT RESOLVED, That the Clerk be and he-is hereby instructed to draw check on the Ordinary Fun d for $17,005.57,` in favor of the Sanford 44tlantic National Bank, in Payment of the aforesaid time warrants, and to obtain from the Sanford Atlantic National Bank at the time of making said payment, the time warrants aforesaid together with the Certificate of Deposit for $17,005.57, delivered to the Sanford Atlantic National Bank as collateral, and BE IT FURTHER RESOLVED, that said Certificate of Deposit be deposited in the Ordinary Fund at the Sanford Atlantic National Bank, from which it was originally taken.
