The City Commission of the City of Sanford Florida, met in regular session at the City Hall in Sanford, Florida at 2 O'Clock P M April 8 1929 . Present: Commissioner, Nelson -Gray, Mayor. Chief_ of-Police, R G Williams Absent: Commissioner, R A Newma- Minutes of Regular Meeting of March 25th, and Adjourned Regular Session of March 28th, 1929, read and approved as amended. Proposed Ordinance No. 160 , entitled: " AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, MAKING IT UNLAWFUL FOR ANY PERSON, FIRM OR CORPORATION, TO ERECT IN THE CITY OF SANFORD, FLORIDA, ANY GASOLINE FILLING STATION WITHIN ONE HUNDRED FIFTY FEET OF ANY OUTER WALL OF ANY CHURCH OR SCHOOL BUILDING IN THE CITY OF SANFORD FLORIDA, AND TO PROVIDE FOR A PENALTY FOR THE VIOLATION OF THIS ORDINNANCE." was placed upon its second and final reading and read in full by the Clerk. The vote then recurred upon the passage of said ordinance, and the roll being called, the vote stands as follows: Commissioner Gray No " Chase No " Miller No " Speer No. Thereupon the Chairman annOunoed that the City Commission by its unanimous vote had REJECTED said proposed Ordinance No. 160 entitled: " AN ORDINANCE OF THE CITY OF SANFORD FLORIDA, MAKING IT UNLAWFUL FOR ANY PERSON, FIRM OR CORPORATION, TO ERECT IN THE CITY OF SINFORD, FLORIDA , ANY GASOLINE FILLING STATION WITHIN ONE HUNDRED FIFTY FEET OF ANY OUTER WALL OF ANY CHURCH OR SCHOOL BUILDING IN THE CITY OF SANFORD FLORIDA, AND TO PROVIDE FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE." The Clerk next submitted report from Attorney George A DeCottes as to the present status of the suit of the City of Sanford Vs Chase National Bank of the City of New York, and same was ordered filed. Commissioner Gray next moved that the expense bill for $220.00 submitted by Attorney George A DeCottes for expenses incurred on trip to New York City with reference to suit of City of Sanford against Chase National Bank of New York City, be approved and the Clerk ordered to draw check in payment thereof. Seconded by Commissioner Chase, and the roll being called,the vote stands as follows: Commissioner Gray Aye " Chase A ye " Miller Aye " Speer Aye City Attorney Wilson next submitted, for approval and in compliance with instructions heretofore issued by the Commission, the following entitled bills to be introduced for passage at the 1929 Session of the Legislature of the State of Florida, and read same in full. A BILL TO BE ENTITLED. "An Act to amend Section 105 of Chapter 9897, Laws of Florida, Acts of 1923, the I� 1 1 1 fl 1 1 1 MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 8 at 2 P M. 1929 the same being " An Act to Abolish the Present Municipal Government of the City of Sanford, Seminole County, State of Florida, and to Organize, Incorporate and establish a City Government for the same, and to Prescribe the jurisdiction, Powers and functions of said Municipality," Said Section 105 relating to time of payment of installments of Street Paving Assessments and the foreclosure of the lien of such Street Paving Assessments; Provided that nothing herein contained shall affect any Special Right of Payment of Installments of Street Paving Assessmente due Said City of Sanford, which may have been heretofore enacted or may be hereafter enacted by the Legislature of the State of Florida. A BILL TO BE ENTITLED: AN ACT to amend Section 93 of Chapter 9897, Laws of Florida, Acts of 1923, the Same beir " An Act to abolish the present Munioipal Government of the City of Sanford, Seminole County, State of Florida, and to Organize, Incorporate and Establish a City Government for the same, and to prescribe the Jurisdiction, Powers and Functions of Said Municipality,a Said section 93 relating to the issuance of Tax Certificates by the City Tax Collector of the Said City of Sanford, and redemption thereof, the appointment of the Clerk of the Circuit Court of Seminole County, Florida, as Deputy City Tax Collector, and Issuance to Tax Deeds based upon said City of Sanford Tax Certificates and the Foreclosure of Liens for Taxes, Provided that nothing herein contained shall affect any special right of redemption from delinquent Taxes as provided in any act heretofore or hereafter enacted by the Legislature of the State of Florida. A BILL TO BE ENTITLED: AN::`AOT to Amend Section Eight Eight of Cha#er 9897, Laws Of Florida, Acts of 1923, the same being, " An Act to Abolish the Present Municipal Government of the City of Sanford, Seminole County, State of Florida, and to organize, Incorporate and establish a City Government for the Same, and to prescribe the Jurisdiction, powers and functions of said Municipality," said Section Eighty -Eight thereof hereby amended relating to the advertisement and sale of Real Estate for non - payment of taxes due said City of Sanford, Florida. Thereupon Commissioner Miller moved that the City Commission approve and endorse the proposed bills, as prepared by the City Attorney to be submitted for passage at the present Session of the Legislature, and that the Senators and Representatives from this District be notif ied. Seconded by Commissioner Gray, and the Roll being called, the vote stands as follows: Commissioner Gray Aye " Chase Aye " Miller Aye " Speer Aye. Commissioner Gray next moved the cancellation of the following 1927 and 1928 Personal and Real Taxes for the reasons given, and as recommended by Deputy Tax Collector, Tarbell; W C DeCoursey Hy. Amount $10.00 MINUTES �­54 CITY COMMISSION, SANFORD, FLORIDA, April d 2 P M 19_?9_ Seconded by Commissioner Chase, and the roll being called, the vote stands as follows: Commissioner Gray Aye " Chase Aye " Miller Aye " Speer Aye Commissioner Chase next moved that the fine of $5.00 assessed against Mr H P Whiddon, of Bartow, Florida, arrested on April 1st, 1929 for violation of "Stop Street" ordinance, be remitted, in view of the fact that Mr Whiddon was a visitor in Sanford at the time of his arrest, unfamiliar with local traffic regulations, and should not have been arrested at the time of the violation, but merely cautioned and notified of this ordinance. Seconded by Commissioner Gray and unanimously adopted. On motion by Commissioner'Gray, Seconded by Commissioner Miller and unanimously adopted,) the City Manager was authorized to construct bird cage at the City Zoo at a cost not to exceed $50.00 Commissioner Miller next made a motion that the City Attorney be instructed to prepare bill for passage at the present Session of the Legislature entitled: A BILL TO BE ENTITLED: Am ACT to Authorize the City of Sanford, Florida to borrow money in anticipation of the col- leotion of delinquent taxes and to issue negotiable notes of said City for money so borrowed; to require the payment of all sums so borrowed on the next maturing principal and interest of the Bonded Indebtedness of said City and to provide for the disposition of all funds received in collection of Delinquent taxes in anticipation of which said monies are so borrowed, and to provide for the payment of such note or notes for money borrowed hereunder in the event sufficient taxes are not collected for said purpose. Seconded by Commissioner Chase and the roll being called, the vote stands as follows: Commissioner Gray Aye " Chase Aye " Miller Aye " Speer No On motion duly adopted, the Commission went on record as approving and favoring the completion of the link in Volusia County of State Highway , this Highway connecting'Sanf ord and Titusville. Current invoices and payrolls for the month of March 1929, properly audited and voucher by the accounting department, were submitted, examined, approved and the Clerk instructed to issue checks in payment of same. Financiki Statement and Statement of Revenues and Expenditures for the month of March 1929, submitted and examined. Monthly statement of City Manager for Month of March 1929, submitted, examined and ordered filed. Bank statements in.all accounts for the month of March 1929, submitted, examined and ordered filed. On motion duly adopted, the Clerk was instructed to transfer $509000900 from the Or Fund at the First National Bank to the Interest Account at the First National Bank, and $50,000, from the Ordinary fund at the Sanford Atlantic National Bank to the Interest Account at the Sanford Atlantic National Bank. 1 1 1 1 1 MINUTES �5 CITY COMMISSION, SANFORD, FLORIDA, April 8 at 2 P M 19-?9— The Clerk next reported the receipt from the Charles B Hawley Engineering Corporation:, purchasers of the Sanford Gas' Plant, of Thirty City of Sanford Improvement Bonds, to apply against the purchase price of the Gas Plant, at par plus accrued interest to April 1, 1929; this method of payment being allowed by the terms of their contract; also check.for $9,692.56 representing interest at 5J% per annum on the unpaid balance of the purchase price of the gas plant for the six month's period from April let. to October 1st, 1929. The Clerk also reported the deposit of this check in the Interest Account at the Sanford Atlantic National Bank, and the placing of the Thirty City of Sanford Bonds in the Safety Box at the First National Bank.
