The City Commission of the City of Sanford Florida, met in Regular Session at the
City Hall, in Sanford Florida at 2 O'clock P M February 25, 1929•
Present: Commissioner - Nelson Gray - Mayor.

Absent: Commissioner, F L Miller
City Attorney Wilson presented request from the First Church of Christ, Scientist
that the City give them relief with respect to the paving on Union Avenue abutting on proper y
owned by this chruch; it appearing that at the time First Street Extension was platted, the
Church gave forty two feet from the Vest side of its property for the purpose of opening
Locust Ave. from Union Ave. north to First Street, and was to receive in exchange thirty
nine feet adjacent to the East line of its property , that they have never been able to
get a deed to this thirty -nine feet, and request the City to satisfy the paving lien
against the balance of their property on Union Avenue in exchange for the Forty -two feet
on the west side now used for Locust Ave.
Action deferred until the next regular meeting.
The contract with George A DeCottes and Lucien H Boggs as Special counsel of the
City of Sanford, was next brought up for consideration, and the changes as previously
requested having been made, and in conformity with action heretofore taken by the Commission
said contract was signed and the Clerk was instructed to deliver two copies to Mr DeCottes,
one for himself and one for Mr Boggs, and the other copy to be filed with the City Records.
Mr E F Housholder next presented a petition with about Four Hundred signers thereto
petitioning the Commission to pass an ordinance prohibiting the erection of a filling station
said petition,
within five hundred feet of anychurch or school building /exclusive of signers, being is
words and figures as follows:
" To The Honorable City Commission
Sanford, Florida
We the undersigned tax payers and citizens of the City of Sanford, believing that
our spiritual and educational institutions are paramount to all others in developing the
best form of citizenship, and thiis thinking, are certain that every possible safe -guard
should be thrown around them to the end that the best results may be obtained, and being
convinced, as have many other cities and towns which hate by ordinance already prohibited
the erection of filling stations at a minimum of 500 feet of such institutions, that the
operation of any filling station immediately near them has a damaging and annoying effect
far more so than any other form of business, therefore, we hereby petition your honorable
body to pass an ordinance prohibiting the erection of a filling station within one block
of our present churches or school buildings."
Thereupon, after considerable discussion and mutual agreement between the City
Commission and the Committee present that 150 feet would be preferable to 500 feet as stated
in petition.
Commissioner Gray moved that the City Attoney be instructed to draw up an ordinance
prohibiting the erection of a gasoline filling station within 150 feet of any church or
school building, and present same to the Commission at the next regular meeting for

adoption.
Seconded by Commissioner Newman, and the roll being called, the vote stands as

Mr Lee, representing Mr R J Gallespie of Jacksonville, appeared before the Commission
concerning balance due his client on the contract for construction of the City Reservoir, final
payment never having been made due to disagreement over the amount to be deducted for expense
incurred by the City in repairing reservoir on account of faulty construction.
After considerable discussion, and in view of the fact that the amount due to Mr.
Gallespie, as set upon the books of the City,1244.90,,is included in Official Refinancing
Document A -1 , Mr. Lee was offered one City of Sanford Refunding Bond, , Series A -1
bearing interest at the rate of Six per cent per annum,and $244.90 in cash, provided Mr
Gallespie would accept this as full settlementof the account owed him by the City of Sanford.
Mr. Lee agreed to communicate this offer to Mr Gallespie and notify the City if accept-
able.
City Manager Cairns presented request of Dr. C L Park that an additional "For Doctors

Only" parking space be provided on Park Ave near r
Thereupon, Commissioner Speer moved that the first parking $p ace on the East side
of Park Ave, south from First Street be set aside and designated It For Doctors Only."
Seconded by Commissioner Gray, and the roll being called, the vote stands as follows:

Chief of Police, Williams was then instructed to notify all doctors that these parking
spaces are not for any particular individuals, but are for the use of any doctors who may
need them.
City Manager Cairns next reported the possibility of selling the baseball bus to the
Orphans Home for $600.00, and requested the authority to do so and instructions as to what
terms could be given.
Thereupon, Commissioner Gray moved that City Manager Cairns be authorized to sell the
baseball bus to the Orphans Home for $600.00, the terms to be $150.00 cash and $50.00 per
month , the buyer to keep the bus insured against fire, damage and theft, until paid for.

Commissioner Newman next moved the reduction of the license tax for bottling works
maintained and operated outside the corporate limits of the -',city of Sanford, Florida, who
sell bottled drinks in Sanford and deliver to purchaser by automobile or truck, from $200.00
per year to $100.00 per year, effective immediately.
Seconded by Commissioner Speer, and the roll being oe4led, the vote stands as followe

On motion of Commissioner Newman, which was seconded by Commissioner Chase and
unanimously adopted, the following 1927 personal taxes were cancelled due to error in assess-
ment, same being recommended by Deputy Tax Collector, Tarbell.

On motion duly adopted,.the Clerk was instructed to pay to the Nye Odorless Cremato
Company $240.00 , representing six months interest on note of $5,000.00 due August 1, 1929
said note being part payment for incinerator.
Commissioner Gray moved that the City Attorney be instructed to investigate the
liability of the surety Company on the bond trustee bonds of Forrest Lake at the time of the
closing of the Seminole County Bank, for losses sustained by the City at that time, and
report to the Commission at the next regular meeting.
Seconded by Commissioner Speer and unanimously adopted.
Commissioner Newman nett introduced Ordinance No. 159, entitled:
" AN ORDINANCE OF THE CITY OF SANFORD FLORIDA, FURTHER REGULATING TRAFFIC IN SAID CITY,
AND PROVIDING A PENALTY FOR THE VIOLATION OF SAID ORDINANCE."
and same was placed on its first reading.
Thereupon, Commissioner Newman moved that the rules be waived, and that said ordi-
nance be placed on its second reading and final passage.
Thereupon, the motion recurred upon the question of the waivure of the rules.
The roll was called and those voting in favor of the waivure of the rules were:

Thereupon, Said ordinance No. 159 was read in full, and placed upon its final pass -
age and adoption, those voting for the adoption of ordinance No 159, being:

Thereupon, the Chairman announced that the City Commission of the City of Sanford,
Florida, by unanimous vote had passed and adopted Ordinance No. 159 entitled:
"An Ordinance of the City of Sanford, Florida, further regulating traffic in Said
City , and providing a penalty for the violation of said ordinance."
Commissioner Gray moved that the following notice be placed in the local newspaper:
"Owing to obligations of the City maturing on July 1st, 1929, it will be impossible
to extend the payment of taxes over and beyond April 1st, 1929•

Seconded by Commissioner Chase and unanimously adopted.
Commissioner Chase moved that the City Attorney be instructed to immediately start
foreclosure proceedings on delinquent paving liens and taxes.

City Attorney Wilson was also authorized to get from the Abstract Office all info
ation necessary in the above authorized foreclosure proceedings.
On motion of Commissioner Gray, which was seconded by Commissioner Chase and unani-
mously adopted, City Attorney Wilson was instructed to prepare documents necessary to amend
the City Charter so as to be able to include taxes in paving lien foreclosure suits.
Also , to eliminate the two year clause whereby the City cannot foreclose on tax certificate
held by the City until two years old.
The Clerk presented financial statement and statement of revenues and expenditures
for the first half, of February , 1929, Report of total delinquent Special Assessment in-

stallments and interest to date,. Report of total bonds and interest due on July 1, 1929,
and statement of balance unpaid on accounts included in Official Refinancing Document A -1
together with number of bonds and cash on hand with which to pay these accounts.
Minutes of Regular meeting of City Commission of February 11th and Special Session of
February 18th, 1929, were read and approved.
There being no further business, the meeting adjourned:
