Spouts And Related Matters
�A�,k 2 Right Of Entry Agreement is made and entered into this `day of
�y and between Bishop Block Building LLC, whose local address is
113 Havilland Point Longwood, Florida 32779 -4577, hereinafter referred to as the
"Owner ", and the City of Sanford, a Florida Municipal Corporation, whose address is
300 North Park Avenue, Sanford, Florida 32771, hereinafter referred to as the "City ".
WITNESSETH:
In Consideration of the mutual promises contained herein and the payment of
One Dollar ($1.00), as good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged by the Owner, the Owner and the City agree as follows:
1. The Owner hereby grants to the City, its employees, agents, consulting
engineers, contractors and other representatives the right to enter upon the property
described as Lots 15 and 16 & East 2 Feet Of Street Adjoining on West, Block 3, Tier
1, Town Of Sanford, according to the plat thereof, as recorded in Plat Book 1, Page 58,
Public Records of Seminole County, Florida and identified by the Seminole County
Property Appraiser as Parcel Number 25 -19 -30 -5AG- 0301 -0150 upon execution of this
Agreement.
2. In order to allow the City to fix, as the City deems appropriate, the subject
property as it relates to down spout issues and matters as they affect the City's streets
and related matters, the Owner grants the City the right to perform "work" on the subject
property in a manner that the City deems appropriate under the circumstances of the
subject property and the needs of the City as determined by the City. The scope of work
is attached hereto as exhibit "A"

3. The Owner by granting this right to enter is not relinquishing any rights
whatsoever with regard to title, use, and possession of the described property, except
and stated herein and to the effect that the Owner shall not interfere with the City's use
of the described property for the purposes stated herein. The Owner has no, and shall
have no, right, title or interest in any City street.
5. The right of entry granted by the Owner to the City shall expire at the completion
of work by the City as determined by the City or at such time that the City determines
that the rights set forth in this instrument are no longer needed by the City, whichever is
deemed longer by the City; provided, however, that the City may terminate this
agreement at any time at its convenience.
6. The Owner does hereby covenant with the City, that it is lawfully seized and
possessed of the real estate above described as the subject property and that it has a
good and lawful right to grant the rights herein granted to the City.
7. The Owner hereby does, and shall in the future, indemnify and hold harmless the
City from and against any and all claims, demands, liabilities, disputes, damages, costs,
expenses (to include, but not be limited to, attorney's fees whether or not litigation is
necessary and, if necessary, both at trial and on appeal, incurred in enforcing or
ensuring compliance with the terms and conditions of this document) as well as to any
work accomplished, in the past or in the future, by the City on the subject property. It is
specifically understood that the City is not guaranteeing the appropriateness, efficiency,
quality or legality of the use or development of the subject property including, but not
limited to, drainage plans or quality of construction, whether or not inspected, approved,
or permitted by the City to include, but not be limited to, down spout construction and
matters relating or pertinent thereto. The provisions of this section shall survive
termination of this agreement.

herein expressed.

Subject: Copper Downpipe Modification on Building at SE corner of 1 St Street and
Palmetto Avenue. Rev. 1
EJM Gutters Inc. is pleased to quote the addition of five (6) 4" round copper downpipe
and elbow assemblies. Note: EJM Gutters will warrant its material and labor only to the
extent of the interface with the ceiling (soffit) of the overhanging roof system to the drain
in the concrete walkway. We inspected the roof system (which is in very poor condition)
and noticed that the drainage was constructed using steel sheets with rectangular steel
outlets cut at the downpipe locations and these outlet are not connected to the the 4"
round downpipe that extends below the ceiling so when it rains the rainwater works its
way under the steel sheets and spills out around the downpipe at each roof penetration.
These drains can't be connected to the 4" round copper downpipe unless the ceiling is
removed to afford access. Actually the entire roof should be replaced. This fix is not
permanent. It should correct most of the problem as we will make more of the existing
downpipe drains functional and thus allow this system to remove more water in a shorter
period of time thus reducing the ponding and standing water that that is occurring on the
roof.
Scope of work is as follows:
3 DP locations along 1 St Street
• Each DP to be 4" 16 oz round copper welded seam pipe and elbows as
required. Each upper assembly to include a cleanout connection consisting of
a 2" copper DWV Fitting (Full plug FTG X clean out) should the downpipe
ever get fouled.
• All necessary hardware and fasteners to complete the job.
3 DP locations along Palmetto Ave
• Each DP to be 4" 16 oz round copper welded seam pipe and elbows as
required. Each upper assembly to include a cleanout connection consisting of
a 2" copper DWV Fitting (Full plug FTG X clean out) should the downpipe
ever get fouled.
• On front location closest to 1 St street the City of Sanford is to add two 6"
DWV drain in concrete (one close to 1 St and the second between this one and
the rear DP location) and run this drain to the sewer at street same as drains on
1 St street.
• Rear DP on Palmetto drains into a 2" NPS fitting so reducer of 4" by 2" will
be employed.
• All necessary hardware including 4" pipe hangers to complete job.
Note: In addition to the 6 downpipes we will add a protective shroud at the sidewalk level
similar to the ones that already exist.
Total .............................$ 4,124.00
Thank you for allowing us to submit this proposal. If it is acceptable. We will bill you for
a 50% deposit. Final payment is due after completion of all work and satisfactory
acceptance by you. Prices are good for 30 days.
