The City OOmmlsslon of the City of Sanford, Florida met in adjourned session
the City Hall in the City of Sanford, Florida at 4:30 o'clock P.M.March 15,1948.

Meeting called to order by the Chairman.
Communication next received from N L Bryan Jr . Division Engineer of the State Road
Department, advising that the City would be held responsible for any damage to the concrete
seawall, the State Road or appurtenances thereto as a result of dredging operations,
and requesting a resolution from the City setting forth the City's responsi~ility
Commissioner Lesher next introduced Resolution No. 730, and after being read in full
by the Clerk, moved its passage and adoption.

RESOLUTION NO. 730
A RESOLUTION OF~THE CITY COMM_ISSION OF THE CITY OF SANFORD, FLORIDA AGREEING
THAT THE CITY OF SANFORD WILL BE RESPONSIBLE FOR ANY DAMAGE OCCASIONED TO THE SEAWALL
STATE ROAD 15, OR APPURTENANCES THERETO, BY REASON OF DREDGING OPERATIONS BY THE UNITED
STATES WAR DEPARTMENT IN LAKE ~ONROE BETWEEN THE POINTS HEREIN REFERRED TO, AND
AGREEING THAT SAID CITY OF SANFO~D, FLORIDA, SHALL MAKE SUCH REPAIRS TO SAID SEAWALL,
STATE ROAD 15 or appurtenances thereto, AS MAY BE DEEMED NECESSARY BY RESAON OF SAID
DREDGING OPERATIONS AND TO THE SATISFACTION OF THE STATE ROAD DEPARTMENT.
WHEREAS, the War Department of the United States of America is now engaged in
deepening the channel of the St. Johns River under the project" St. Johns River, Florida,
Jacksonville to Lake Harney dredging 12 feet project Astor to Sanford and Enterprise cuts
155, 161 and 162" and the State Road Department of the State of Florida has agreed that
the United States War Department may dredge and make spoil along State Road 15, between
French Avenue and Mill Creek Bridge, a distance of approximately 1200 feet on the south
side of State Road 15 and the dredged cut will be excavated to a depth of 12 feet below
water level and will extend to within 50 feet of the concrete seawall from some 200 feet
east of French Avenue to a point approximately 1000 feet west;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida,
that said City of Sanford, Florida, shall be responsible for any damage during the aforesaid
dredging operations at said point now at any time hereafter , to the concrete seawall
along the south shore of Lake Monroe ,ss id State Road 15 or appurtenances thereto occasioned
by said dredging operations, and said City of Sanford, Florida, agrees to make such repairs
to said seawall, State Road 15, or appurtenances thereto occasioned by said dredging oper-
ations, as may be necessary and to the satisfaction of the State Road Department.
BE IT FURTHER RESOLVED, that this resolution shall become effective immediately
on its passage and adoption.
PASSED AND ADOPTED this 15th day of March 1948.

On motion duly carried, the Commission next authorized the City Manager to direct
a letter to the Hill Dredging Corp. requesting the channel running parallel and within
50 ft. of the seawall for an approximate distance of 800 feet in the vicinity of French
Avenue, be dug to a depth of 12 feet without any slope on the south side thereof.
~urther consideration next given to the proposal of the Hill Dredging Corp. to
furnish the necessary fill for the City-owned property in the vicinity of French Avenue
as authorized by the Co~imisslon at the Adjourned Meeting of February 27, 1945.
Thereupon Commissioner Carraway moved that the City enter into sn agreement with
the Hill Dredging Corp. and that the City Manager be authorized to execute same on be-
half of the City.
Seconded by Commissioner Krider and carried.

Gentlemen:
The Hill Dredging Corporation hereby agrees to furnish the City of Sanford with
45,000 cubic yards of good fill material to be deposited on Spoil Area No.39, our
contract No.W-OS-123-eng-875, for the sum of $6,000.00, payable on or before December
31, 1948. The Hill Dredging Corporation further agrees to furnish the City of $~nford
with any additional fill material, over and sbove the agreed 45,000 cubic yards, that
may be removed from within 1,O00 feet of the starting point, without any additional
cost to the City of Sanford.
It is understood and agreed that the City of Sanford, assumes full resgonsibllity
for dikes, drainage and control of material and that the Hill Dredging Corporation
assumes no responsibility for any damages that may result to the property or any
adjacent property.

On motion of Commissioner Krider, seconded by Commissioner Carraway and carried,
the Commission next authorized the City Clerk to execute a Satisfaction of Paving Lien
against the property descrioed as: Beg at N E Pt. of Int. of Union Ave. and Chapman
Ave. Run E. 260 ft. N to Lake Nonroe W. to Chapman Ave. S. to Beg. Full settlement
and satisfaction of said pavlng lien having been made by John Russell in amount of
$111.04 as evidenced by miscellaneous recetpt No. 995 dated ~arch 27, 1920.
Consideration was next given to the appearance and condition of the exterior of
the grandstand and fences at the ~unicipal Ball Park.
Thereupon after considerable discussion, Commissioner Carrawsy moved that the
exterior of the grandstand and the fences be painted by City labor not to exceed a
cost of $500.00.
