HomeMy WebLinkAbout030964-Regular Session MINUTES City Commission, Sanford, Florida, March 9 at 8 P .- M. 19. 6/.[ The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on March 9, 196~. Present: Commissioner A. L. Wilson, Mayor Joe B. Baker " J.H. Crapps " Earl Higginbotham " M.L. Raborn~ Jr. City Attorney Wm. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Deputy Clerk Rosa M. Rotundo Polic~ Chief R. G. Williams The meeting was called to order by the Chairman. Mack N. Cleveland, Jr., Chairman of the Armed Forces Committee of the Chamber of Commerce, and John Krider, Manager of the Seminole County Chamber of Commerce, appeared and stated that the Chamber's budget was over $2,000.00 for participation in the Sanford Naval Air Station's 10th AnnUal Bombing Derby, and requested the City to appropriate $500.00 to help defray additional expenses. After consideration, Commissioner Higginbotham moved to authorize the transfer of an appropriation of $500.00 to Account No. 815~, Publicity, Chamber of Commerce, from Account No. 8150 - Contingency Account. Seconded by Commissioner Crapps and carried. O. Douglas Stenstrom, Attorney for Portia Duhart Spencer, owner of property at 909 Sanford Avenue, appeared and requested an extension of time on condemnation Report No. 62-2.2, covering Lots 7 and 8,* Block ll, Tier A, E. R. Trafford's Map of Sanford, and after discussion, Commissioner Higginbotham moved to delay action of condemnation or demo- lition until said attorney can contact his client and report back to the Commission. Seconded by Commissioner Raborn and carried. Request next submitted from the Sanford Male Chorus for free use of the Civic Center for a concert, for which an entrance fee would be charged, and after discussion, Commissioner Baker moved to deny the request. Seconded by Commissioner Raborn and carried. Consideration next given to the playing of baseball at night in the Municipal Stadium by the Junior League, and after discussion, Commissioner Higginbotham moved to approve the expenditure for utilities from Account No. ~125. Seconded by Commissioner Crapps and carried over the dissenting votes of Commissioner Baker and Commissioner Raborn. On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, a salary reclassification was authorized as follows: Willis Bacon from 5-C ($~9.71/week) to 5-D ($55.29/week) Request next submitted by the Recreation Director for a transfer of $700.00 to cover costs of materials for converting and repairing the stadium and facilities for use of the Mets Farm Teams. After discussion, Commissioner Baker moved to transfer $700.00 from Contingency Account No. 8150 to Parks Stadium - Account No. #170. Seconded by Commissioner Higginbotham and carried. Recommendations next submitted by the Zoning and Planning Commission to rezone to C-1 (Neighborhood Commercial) District, property described as follows: 1. (a) Commencing 150 feet E of the intersection of S r/w line of 27th St. and the W line of the NE~ of NE~ of N~A of SEB of Sec. 1, Twp 20S, Rg 50E, thence run S 225 feet, E 139 ft., N 225 fZ., thence W 159 ft. to POB. All of Lots 21 through 26, and that part of Lot 27 lying north of Dnora Road and within the City of Sanford, Amended Plat of Druid Park. Also to rezone from M-1 (Light Industrial) District to R-3 (Multiple Family) District, property described as follows: W ~ of Block 6, Tier ll, E. R. Trafford's. Commissioner Baker moved to authorize a Public Hearing to be held on April 196#, to consider same. Seconded by Commissioner Higginbotham and carried. Consideration next given to a proposed County-City agreement on a continuing comprehensive transportation plan, and after discussion, Commissioner Higginbotham moved to authorize an agreement designating the County as the City's agent, with no financial participation from the City, and to authorize the Mayor and City Clerk to execute said agreement. Seconded by Commissioner Crapps and carried. The City Manage~ next reported that G. Andrew Speer, Attorney for Virginia Langiotti, had submitted an offer to sell for $18,000.00 the property described as follows: N 32 ft. of Lot 10, Block 2, Tier 4, E. R. Trafford's Map of Sanford. After discussion, Commissioner Crapps moved to purchase the aforesaid property in the amount of $18,000.00, and to authorize payment upon approval of the City Attorney of proper title evidence and transfer, and further, stipulated that the seller to bear all closing cos$, documentary stamps and commission liability, and to authorize the Mayor and City Clerk to execute a note to the Florida State Bank in the amount of $18,000.00 for a period not to exceed three years at an interest rate of not over 3~ annually, and further, that said loan to be paid from parking meter revenue to the extent the same is available. Seconded by Commissioner Higginbotham and carried. Commissioner Baker moved to authorize the Mayor and City Clerk to sign liens for costs of demolition of condemned buildings or structures, as prepared by the City Attorney, and further, to authorize filing of said liens in the Public Records of Seminole County. Seconded by Commissioner Raborn and carried. After discussion, Commissioner Baker moved to lease for an off-street parking lot for a period of three years at an annual rental of $400.00, property owned by Herman Maier et al, described as Lot l, Block 4, Chapman and Tuckers Addition. Said lease to have an automatic renewal clause and a-:.provision for cancellation with 60 days notice. Seconded by Commissioner Crapps and carried. The City Attorney next informed the Commission that the 1963 State Legislature had enacted a law providing for free parking for vehicles operated by persons affected by certain types of disabilities upon their obtaining an exemption certificate from the County Tax Collector. On motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried over the dissenting votes of Commissioner Baker and Commissioner Wilson, Ordinance No. 829 was next p~aced on its first reading and read in full. M. .t964 Commissioner Crapps moved to authorize the City Attorney to prepare an Ordinance controlling the hours for sale of alcoholic beverages by bars within the City, said ordinance amending the City regulations to coincide with the regulations for same for bars outside the City and within Seminole County. Seconded by Commissioner Higginbotham and same failed to be carried over the dissenting votes of Commissioner Baker, Commissioner Raborn and Commissioner Wilson. On motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried over the dissenting vote of Commissioner Raborn, Ordinance No. 830 was next placed on its first reading and read in full. Said Ordinance No. 830, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, PRESCRIBING RATES TO BE CHARGED FOR WATER FURNISHED BY THE CITY OF SANFORD AND REPEALING ORDINANCE NUMBER 525, AND ALL OTHER ORDINANCES'OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. Commissioner Crapps introduced Ordinance No. 828, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. and same was placed on its I'irst reading and read in full. Commissioner Crapps then moved on the waiver of the require.ment of the second reading of Ordinance No. 828, and that same be placed on its final passage and adoption. Thereupon, The question recurred on the waiver of the second reading, the roll was called and the vote stands as follows: Commissioner Wilson Yea " Baker " " Crapp s " " Higginbotham " " Rab orn " Said Ordinance No. 828 was then placed on its final passage and adoption, the roll was called and the vote stands as follows: Commissioner Wilson Yea " Baker " " Crapp s " " Higginbotham " " Raborn " Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted Ordinance No. 828, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. On motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, the Mayor and City Clerk were next authorized to execute a Quit Claim Deed to Brookfield Mills, Inc., correcting description in that certain deed, dated November 16, 1960, as recorded in ORB 33~, page 322, transferring a portion of well-field property on Highway 17-92 to Seminole County Chamber of Commerce. Request next submitted by Dr. Charles L. Parks, Jr., for water service for a proposed new dwelling located outside of the City Limits at the intersection of Second Street and Crescent Boulevard, and after discussion, Commissioner Higginbotham moved on approval of the request. M. 19.6/4. _ The City Ms_uager next submitted the following tabulation of bids to demolish the old Woodruff building on Lot 9 and S 72.2 ft. of Lot 10, Block 2, Tier 4, E. R. Trafford' s Map of Sanford: a,, Leroy Robb--City to pay $5,000.00 and contractor to repay through sale of materials b. Reginald Brown (Lakeland)--City to pay $6,018.00 flat. If City removes slab, etc., cost drops to $4,618.00 c. Henry McAllister--City to pay $6,,J'J'~.O0,~ After discussion, the City Manager was authorized to negotiate with Leroy Robb Construction Company to include in the same contract for $5,000.00 the demolition of that building on the N 32 ft. of said Lot 10, and if same is acceptable, to proceed with the demolition of the structure on Lot 9 and $ 72.2:~ft. of Lot 10, Block 2, Tier ~, E. R. Trafford' s Map. The City Manager next submitted the following tabulation of bids which were opened publicly at 2:00 o'clock P. M. on March 6, 196~, for furnishing liquefied petroleum gas and materials in accordance with the specifications in the invitation for bids published in the Sanford Herald on February 25, 1964. Mellon swimming pool~ Senkarik Glass & Paint Co. $80~.96 After discussion, Commissioner Baker moved to accept the bid of Sanford Gas Company for furnishing liquefied petroleum gas for the refuse trucks at a price of 12~¢ per gallon, and for furnishing liquefied petroleum gas for the sewage treatment plant at a price of 12~¢ per them, with a yearly minimum of 19,200 therms. Seconded by Commissioner Raborn and carried. After discussion, Commissioner Baker moved on the bid of Senkarik Glass and Paint Company for furnishing 26 windows at a price of $804.96. Seconded by Commissioner Higginbotham and carried. The City Manager next submitted the following tabulation of bids which were opened publicly at 2:00 o'clock P. Seconded by Commissioner Higginbotham and carried. After discussion, Commissioner Baker moved to lease for an off-street parking lo~, for a period of one year at an annual rental of $400.00, property owned by Chase and Company, described as Lots 6 and 7, Block 4, Tier 4, E. R. TraffOrd's. Said lease to have an automatic renewal clause and a provision for cancellation with 60 days notice. Seconded by Commissioner Higginbotham and carried. Request next submitted by Harry Robson to install a driveway entrance at 504 East First Street, and after discussion, same was referred to the City Manager for further study. Request next submitted from William Kirk for two parking stalls in front of 204 East Commercial Street, and after discussion, Commissioner Raborn moved to deny the request. Seconded by Commissioner Higginbotham and carried. On motion of Commissioner Higginbotham, seconded by Commissioner Rab°rn and carried, current invoices and payrolls were next approved as evidenced by General Fund Florida State Bank Vouchers Nos. 7297 through 7497, General Fund Sanford Atlantic National Bank Vouchers Nos. 8862 through 8896, and Water and Sewer Revenue Sanford atlantic National Bank Vouchers Nos. 756 through 76~. On motion of Commissioner Baker, seconded by Commissioner Raborn and carried, minutes of regular meeting of February 24, 1964, were next approved.
