The City C9mmission of the City of Sanford, Florida, met in regular session at the
City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on May 27, 1968.

The meeting was called to order by the Chairman.
The first item of business was the continuation of a Public Hearing to rezone from
R-5 (One and Two Family Dwelling) District to C-2 (General Commercial) District that property
bounded On the north by railroad right-of-way; south by McCracken Road; west by the present
boundary line of the City limits; east by Pomegranite Avenue, as advertised in the Sanford
Herald on April 12, 1968.
John L. Sauls, Trustee for Southern Methodist Church, appeared and reiterated the
intended use of the vacant property and the agreement to deed to the City a street right-of-
way on the south boundary line of the property for ingress and egress by residents abutting
same.
Jesse Jones, 1905 Nest Ninth Street, and Eugene Vann, Jr., 1815 West Ninth Street,
appeared to voice objection to the rezoning.
After discussion, Commissioner Moore moved to approve the rezoning as advertised,
with a deed of the street right-of-way to the City of Sanford, and to authorize the City
Attorney to prepare an ordinance for the change in zoning. Seconded by Commissioner Higgin-
botham and carried over the dissenting votes of Commissioner Raborn and Commissioner Wilson.
A Public Hearing was next held to consider the recommendation of the Zoning and
Planning Commission for the rezoning of property from R-2 (One and Two Family Dwelling)
District to R-3 (Multiple Family Dwelling) District, as advertised in the Sanford Herald on
May 17, 1968.
NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND
AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF
THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA.
Notice is hereby given that a Public Hearing will be held at the Commission Room
in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on May 27, 1968, to
consider the following changes and amendments to the Zoning Ordinance of the City of Sanford,
Florida:
That property 16cated west of Mellonville Avenue between Ninth Street and Celery
Avenue, presently zoned R-2 (One and Two Family Dwelling) District, is proposed to be rezoned
R-3 (Multiple Family Dwelling) District. Said property being more particularly described as
follows:
S 89 ft of Lot 4, all of Lots 5 and 6, Ella A. Pace's
Subdivision; and All of Eldorado, except Block A, and
except Lots 14 through 18, Block 3, and the E~ of Garden
Street abutting Lot 14.
All parties in interest and citizens shall have an opportunity to be heard at
said hearing.
By order of the City Commission of the City of Sanford, Florida, this 13th day of

The Chairman annmunced that the Commission would be glad to hear from anyone in
favor of, or against, the rezoning as advertised in the foregoing notice.
Garnett White, realtor, and Paul Jones, projects development officer, Medical Care
Facilities, Inc., Tavares, Florida, appeared and outlined utilization of the property for a
proposed nursing and convalescent center.
There being no opposition, Commissioner Higginbotham moved to authorize~the City
Attorney to prepare an ordinance to rezone the said property as set forth in the legal notice
Seconded by Commissioner Raborn and carried.
Commissioner Higginbotham next introduced Ordinance No. 945, entitled:

and same was placed on its first reading and read in full.
Commissioner Higginbotham then moved on the waiver of the requirement of the
second reading of Ordinance No. 945, and that same be placed on its final passage and
adoption. Motion seconded by Commissioner Moore.
Thereupon, the question recurred on the waiver of the second reading, the roll was
called and the vote stands as follows:

Said Ordinance No. 945 was then placed on its final passage and adoption, the roll

Thereupon, the Chairman announced that the City Commission of the City of Sanford,
Florida, by unanimous vote, had passed and adopted said Ordinance No. 945, entitled:

Consideration was next given to a request of Thomas L. Largen, M.D., Luis M. Perez,
M.D., and Gonzaalo Huaman, M.D., for the paving of Lake View Avenue between East First Street
and East Second Street. The National Guard Armory, State-owned facility, as an abutting
property owner had declined to enter a one-third paving cost Participa~i6n~:~of said street.
After discussion, Commissioner Higginbotham moved that the City pave Lake View
Avenue from First to Second Street on a 50% participation agreement with the three doctors,
as the State of Florida would not agree to paying the one-third share of a normal property
owner. Seconded by Commissioner Moore and carried.
Fred R. Rutledge, CATV Division, Burnup and Sims, Inc., West Palm Beach, Florida,
appeared to discuss an application for a proposed franchise for the installation of a CATV

cable system in the City of Sanford. He informed the Commission that the Company would be
agreeable to operating under the proposed CATV Ordinance as set forth by the City of Sanford.
After discussion, the Commission informed Mr. Rutledge that the matter would be taken under
advisement.
A discussion was next held regarding the present agreement between the City of
Sanford and the Seminole County Humane Society for the control and pickup of stray dogs.
Commissioner Higginbotham moved that the letter of termination received from Bonnet Carter,
President of the Humane Society, be accepted and to authorize the following transfer of funds
to cover cost of a City dog control program:
Within the Public Health and Sanitation Accounts transfer $1,~58.00 from
Account No. 3054, Humane Society, as follows:

After consideration of request for same and on recommendation of the City Manager,
Commissioner HigginbOtham moved to grant a time extension of 90 days to September l, 1968,
on Condemnation Report No. 68-212, Group 13, on structure owned by Sephen Simms, 917 Willow
Avenue. Seconded by Commissioner Wilson and carried.
The City Manager informed the Commission that Seminole County had increased the
County landfill rates after the adoption of the current budget and with the present use by
the City of said landfill the $5,000.00 allocation was insufficient, and on motion of Commis-
sioner Wilson authorization was given to transfer the amount of $1,600.00 from Contingency
Account No. 8150 to Refuse Account No. 495~, County Dump, to cover same. Seconded by Commis-
sioner Moore and carried.
Consideration was next given to a request of the Downtown Merchants Association
for a "Sidewalk Sale" with all sale items to be displayed on the public sidewalks on the
dates of May 30 and 31, and June l, 1968, and on the recommendation of the City Manager,
Commissioner Wilson moved that same be approved in that the merchants will provide sufficient
clearance for a pedestrian walkway. Seconded by Commissioner Raborn and carried.
A discussion was next held on a proposed site for the Goldsboro Neighborhood
Facilities-Recreation Building. The City had been given notice that the County of Seminole
would offer by bid at public sale at the Courthouse on May 29, 1968, county-owned property
legally described as Lots 8, 9, 10, F. H. Rands Addition to Sanford.
After consideration, Commissioner Higginbotham moved to authorize the City Attorney
to represent the City at the public sale and to bid for said property. Seconded by Commis-
sioner Raborn and carried.
A registered survey plat was next submitted to the City of Sanford by William L.
Kirk of property described as follows:

30 East, Seminole County, Florida, run Southerly 711.6 feet to the West

After discussion, Commissioner Higginbotham moved that the plat be approved and the
Mayor and City Clerk given authorization to execute the Quit Claim Deeds for said land
exchange.

S~conded by Commissioner Moore and carried over the dissenting vote of Commissione~
Discussion was next held on fourteen active fire hydrants located outside the City
in the Sunland Estates Water System and a payment of $50.00 per hydrant is required by ordi-
nance of the City to the Waker and Sewer Fund. The City Manager recommended that funds be
transferred from Contingency to cover the cost of past months and that further services of
the hydrants be discontinued.
After discussion, Commissioner Raborn moved that the matter be considered in the
1968-69 Budget and the fire hydrants remain active. Seconded by Commissioner Wilson and
carried.
Consideration next given to the water requirements of Allied Control Company, Inc.,
at a proposed site on New Upsala Road one mile north of Country Club Road, located outside
the corporate City limits. After consideration, Commissioner Moore moved that the City
Attorney be authorized to write a letter to Allied Control Company, Inc., specifying the in-
tent of the City of Sanford to deliver to the south property line of the proposed site, at
or near its intersection with New Upsala Road as it comes from the south, sufficient water
through a proposed 10-inch main to meet their present minimum requirements and anticipated
future requirements, upon the firm paying the monthly outside City limits water rates and
agreeing to the signing of a standard annexation petition to bring said site into the bounda-
ries of the City limits upon said annexation becoming legally possible. Seconded by Commis-
sioner Wilson and carried over the dissenting vote of Commissioner Raborn.
There being no further business, the meeting adjourned.
