M. 19 70 DO'I'I-I~/LI~OW OFFICE ,~O~LY COMPANY The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. The first item of business was a Public Hearing to consider the condemnation of twelve structures on Report Nos. 70-515 through 70-524, Group 17, in accordance.with notice authorized by the City Commission at regular meeting of January 6, 1970. The Chairman announced that the Commission would hear from any property owner or representative thereof. James H. Triplett, Vice-President, Bridges ~arniture Company, Inc., 2469 South Park Avenue, appeared and stated that the furniture company took title to the building on January 7, 1970, and intentions were that of repairing to conform to standard building codes. M. 19 70 DO~q~OW OFFICE SU-~'LY COMPANY repaired or demolished, and after ninety days to authorize the City to demolish the structures and levy a lien against the property for said removal under authority invested in Ordinance No. 768; and further, that it is recommended and urged by the Commission that the owners, iprior to any expenditure for repairs, discuss with the City Building Official regarding the economical feasibility of extensive repairs and expense. Seconded by Commissioner Meyer and ~arried. The Chairman next introduced Resolution No. 1067 and after being read in full, Com- aiSsioner Roberts moved on its passage and adoption. Seconded by Commissioner Meyer and carried by the unanimous vote of the Commission. Said Resolution No. 1067 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, COHMENDING DON E. TAETEL FOR HIS OUTSTANDING SERVICE AS AN INDUSTRIAL SPEC IALIS T. WHEREAS, DON E. 'RATHEL has since June of 1967 served the City of Sanford, Florida, as an industrial consultant and specialist leading toward the industrialization of the former Sanford Naval Air Station; and WHEREAS, his knowledge, experience and judgment have materially aidedthe City of Sanford in the industrial process to the degree that the former naval air station property is now self-sustaining and it is the desire of the City Commission that proper recognition be expressed to DON E. RATHEL for his contribution to the comm~uity; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford that DON E. RATHEL be and he 'is hereby commended for his contribution and service to the industrial process of the City and that this resolution be a token of the commendation and appreciation of the City Commission both for itself and the people of this City. BE IT FURTHER RESOLVED that this Resolution be spread upon the minutes of the City Commission and a copy hereof delivered to DON E. RATHEL. M. on January 26, 1970, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: hearing. To amend the Zoning Ordinance to adopt Airport Zoning Regulations and Map. There being no opposition, Commissioner Roberts moved to authorize the City Attorney to p~epare an ordinance pertaining to same. Seconded by Commissioner Meyer and carried. A Public Hearing was next held to consider amending the Zoning Ordinance in accord- ance with the notice published in the Sanford Herald on January 12, 1970, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on January 26, 1970, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: hearing. Rezoning from M-1 (Light Industrial) District to C-2 (General Commercial) District for that lake- front property, as follows: Area of Lake Monroe Industrial Park and adjacent areas being encompassed by Fulton Street on the south; Seminole Boulevard on the north; Mangoustine Avenue on the west; and French Avenue on the east. M. 19 70 pertaining to same. Seconded by Commissioner Meyer and carried. A presentation of the completed Sanford Beautification Plan~was next made by A. B. Peterson, Jr., Chairman of the.City's Scenic Improvement Board; George Hoffman, associated with the Tri-County Planning Commission, Orlando; and Thomas H. Wallis, Jr., landscape con- sultant with the firm of Wallis, Streasau Associates, Inc., Winter Park. The contract covers five specific projects for the City of Sanford as selected by the Scenic Improvement Board and presented by Mr. Wallis, as follows: 1. MEMORIAL PARK/Holiday Isle Marina Property of the bandshell-pier at the .end of Park Avenue and Seminole Boulevard 2. SENIOR CITIZENS NEIGHBORHOOD PARK Existing. park at the location of Park Avenue and Fourth Street 5. CROONS HIGH SCHOOL West 13th Street intersecting at Southwest Road and Persimmon Avenue (a) Intersection of French Avenue, US Highway 17-92, and Orlando Drive (south entrance/exit) (b) Intersection of French Avenue west to I-4 Interchange (north entrance/exit) The Scenic Improvement Board recommended that Item No. 1 (Memorial Park) be given priority upon implementation of the plans. The City Commission commended the efforts of the groups and accepted the plans as a completion of the Contract. John Dragash and Richard Matz of the firm of John A. BUrton, IV, Architect, Sanford, under Contract authorized August 25, 1969, for an in-depth study on space needs for a new city hall and city jail complex for the City of Sanford, presented a written report to each Commissioner and the City Manager containing i~fOrmation:~¢regarding research methods, results, projections, and recommendations for a new administration center City Hall on a proposed loca- tion in Lake Monroe, west of the bandshell pier. Photos and a model of the recommended build- ing, depicting a round six-floor structure, were displayed, and illustrations of the proposed design of all departments arranged around a center core containing commonly used facilities of copy machines, vault storage, communications, including elevators. The plaza level contains a city commission meeting room, historical museum and exhibition spaces. A projection on square feet to serve the present 20,000 population, up to lO0,O00 population utilizing 78,000 square feet. Also, proposed that earnings from the leasing of space be applied directly to the construction and maintenance costs for the facility. Included were parking facility for 215 cars and a revolving restaurant on the dome. Location and estimated cost factors were discussed between the Commission and the Architect and the presentation was concluded. The Reverend Bobby G. Welch, Pastor of the Church of God ~f:Prophecy, 2509 South Elm Avenue, appeared and outlined the desire of the trustees to pave Elm Avenue from West 25th Street south to Park Drive. The City Manager explained the present policy of $2.17 per lineal foot to each abutting property owner, or under a Special Assessment plan each abutting propertl owner would pay 50% of the estimated cost of $12.50 per foot. Mr. Russell Harned appeared and stated he owned l~ vacant lots situated on both the west and east side of Elm Avenue and that he would be willing to cooperate on the portion of his property lying opposite the church building if ~he City would approve doing the paving at a cost of $2.17 per lineal foot. On motion of Commissioner Meyer, seconded by Commissioner Roberts and carried, the matter was tabled until the next City Commission meeting. High, member of the Central Baptist Church, appeared to appeal a denial by the City Manager of a request for the church to pave the parkway to the curb and utilize same for off-street parking at the corner of West 13th Street and Oak Avenue. Mr. High indi- cated an entrance off of l~th Street and no exits on 13th Street. The plan utilizing the pub- lic parkway and the private property would provide 90 parking spaces with the paved 'parkway designated for a driving area only. The City Manager stated that his denial was not on this revised plan, but that the denial was on the original plan submitted by the Reverend Smith and it was on the basis of creating a traffic hazard, also the church was not paving the alley and this would present a maintenance problem to the City, in addition the paving would compound the drainage problems existing at the intersection of West 13th Street and Elm Avenue. The City Attorney pointed out that West 15th Street is a state road right-of-way and the City has no exclusive right for the granting usage of same. Commissioner Meyer moved that the church representatives meet with the City Manager and attempt to resolve the matter and to then bring same back before the Commission at the next regular meeting for further consideration. Seconded by Commissioner Roberts and carried. George Digiovanni, owner of Lots 6, 7, 8, l0 and ll, Block 15', Dreamwold, located between French Avenue and Hiawatha Avenue south of Santa Barbara Drive and annexed into the City on December 22, 1969, by Ordinance No. 977, appeared before the Commission and requested that said p~operty be disannexed from the City on the basis of his misunderstanding the annexation procedure; and on motion of Commissioner Meyer, seconded by Commissioner Roberts and carried, the request was tabled until the next regular meeting to permit the City Attorney to research the matter. Appearing next was Alton P, Bowers requesting that the Commission review a prior request that was denied on August 26, 1969, for the vacating and abandoning portions of Franklin Street, Lilly Court and part of a certain north-south alley abutting'his property described as Lots i through 6, Lots 25 through 29, Gardenia Subdivision; and after discussion Commissioner Meyer moved to deny the request. Seconded by Commissioner Roberts and carried. B. C. Conklin appeared to submit a Contract from the firm of Clark, Dietz and Asso- Ciates, Sanford, Florida, for the engineering work for the proposed addition of secondary treatment facilities to the existing sewage treatment plant, and after discussion and on recommendations of the City Manager and City Attorney, Commissioner Meyer moved on the ap- proval of the Contract and to authorize the Mayor and City Clerk to execute same. Seconded by Commissioner Roberts and carried. Raymond E. Lundquist, owner of property condemned under Report No. 68-275, Group 15 located &n the rear of 1412 West 13th Street, appeared and requested permission to use the structure for storage of personal belongings retained by him in the furnishing of rental homes. The property was condemned on October 14, 1968, and the owner given 90 days to either repair or demolish, subsequently the City had given final notice for the structure to be de- molished on February 10, 1970. The City Manager stated that on inspection of the property today that the outside premises was littered with debris. After discussion, Commissioner Meyer moved that permission be granted for use of the condemned structure for private, per- sonal storage purposes of household belongings of Mr. Lundquist, with the stipulation that the structure be repaired to meet standard requirements to be set forth by the Building Official for said usage versus the residential use and that the premises be cleaned up. Herring, representing con- demned property of Henry Delaney heirs, Report No. 68-260, Group 15, 1500 Lake Avenue, for a time extension in that they are in the process of repairing said structure; and on recommenda- tion of the City Manager and motion of Commissioner Roberts, seconded by Commissioner Meyer ~nd carried, an extension of 90 days was granted to the date of April 26, 1970. The City Manager requested that a clarification be given to the action of the City Commission on January 12, 1970, of the policy for the furnishing of utility services outside the City limits that no utility extensions would be provided outside the City limits unless the property was annexed. An interpretation was needed in regard to reactivation of existing >ut discontinued service as in cases of a change of ownership of the property. An example ired is the Sunland Subdivision lying approximately four miles outside the City limits with the City providing utilities to 450 homes. CommisSioner Roberts related that his intention was in reference to "new" services. The City Manager recommended that on premises that have been or are being serviced by existing facilities when they are transferred to a new account that the owner be required to sign a contractural agreement. Commissioner Roberts moved that on the recommendation of the City Manager and after discussion with the City Attorney that prior action be modified that a utility extension to an area, lot, or any other parcel that is not serviced by a City utility at the present time and the reconnections of existing services be activated only after the signing of an annexation contract by the property owner, and the City Attorney is hereby authorized to prepare said contract and submit to the Commission for consideration at the next meeting. Seconded by Commissioner Meyer and carried. Consideration was next given tO a request by the Central Florida Chapter of the AmeriCan InstitUDe of Banking to lease the Municipal Civic Center on May 16, 1970, for an annual Spring Dance with privilege of serving alcoholic beverages, and on motion of Commis- sioner Meyer, seconded by Commissioner Roberts and carried, same was approved at the standard fee of $250.00. Consideration was next given to an application submitted by Donald A. Drury, 120 South Park Avenue, for the operation of two taxicabs, and on motion of Commissioner Roberts,~; no seconded by Commissioner Meyer and carried, the request was denied on the basis that/licenses were available under the quota established. The Commission apprOved an informal workshop session to study proposed CATV franchis~ ordinances at 12:00 noon, February 3, 1970, in the City Manager's office, City Hall. A discussion was next held on the recommendations of the firm of Fitzpatrick and Eartsock, city ~auditors, and on motion of Commissioner Meyer, seconded bY Commissioner ~oberts and carried, the following was approved: 1. Transfer in the Public Projects Fund of $16.81 from Florida State Bank to the Sanford Atlantic National Bank. 2. Transfer in the Debt Service Fund from Special Bond Coupon Redemption Account $192.50; and from Certificate of Indebtedness Account $34.00, a total of $266.50, to the Beard of Bond Trustees Series "A" Refunding Bonds Interest and Principal Account. 3.Transfer Industrial Park Fund, Sanford Atlantic National Bank, balance of $7.25 to General Fund. To retain in the Insurance Reserve Fund the balance of $16,6~9.86 and to retain in the fund all income from investments of the reserve. Consideration was next given to a letter dated January 15, 1970~ from J. Ed Straughn DO'£~OW OFFICE SUPPLY COMPANY MINUTES City Commission, Sanford, Florida January 26 at 8:00 P. M. 19 70 Executive Director, State of Florida, Department of Revenue, setting forth that on December2# 1969, the President signed into law an amendment to Section 5219 of the Revised Statutes (12 U.S.C. 548), authorizing a state or political subdivision to impose anY 'generally appli- cable tax on a national bank, and on motion of Commissioner Me~er~-~seconded by Commissioner Roberts and carried, the matter of setting a classification and occupational license fee for banking institutions was tabled until the next meeting. Shoemaker.Construction Company, Inc., next submitted application dated January 1970, for final payment in the amount of $8,911.00 for the period from September 19, 1969 to January 22, 1970,. covering the construction of the dressing room addition at the Sanford Civic Center, authorized under Contract of June 16, 1969, and on recommendation of the City Manager. Commissioner Roberts moved on approval of same. Seconded by Commissioner Meyer and carried. On motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, minutes of JanUary 12, 1970, were approved. After consideration, Commissioner Meyer moved to cancel lease for Off-Street Parkin Lot at Sanford Avenue and Second Street at the expiration of the period ending March 10, 1970 and to notify the owner of said action. Seconded by Commissioner Roberts and carried. Letter of resignation from the Sanford Industrial COmmission dated January 19, 1970 from C..Howard McNulty was next considered, and on motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, same was accepted with regrets and authorized an appro- priate resolution of commendation. Consideration was next given to a request of C. E. Merrill to lease the Municipal Civic Center on February 23, 1970, with alcoholic beverage privileges, to hold a Republican Banquet, and on motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, same was approved at the standard fee of $250.00.
