M. 19 ?0, OFFICE SUPPLY COMPANY The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on April 13, 1970. Present: Mayor-Commissioner Lee P. Moore Commissioner James H. Crapps Commissioner Thomas S. HcDonald Commissioner Gordon T. Meyer Commissioner W. Vincent Roberts City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles Police Chief Ben E. Butler Absent: City Clerk H. N. Temm, Jr. A. B. PeDerson, Jr., member of the Zoo Committee, appeared before the Commission to support a proposed site for a zoo and botanical gardens on City-owned property located on the lakefront between Seminole Boulevard and Fulton Street west of French Avenue. The Chairman presented a schematic plan of the propoeed area as prepared by Architect. Eoghan N~.Kelley. After discussion of the acreage, parking, and of acquiring adjacent. property from Meadors Marine, Seaboard Coast Line Railroad, and Lee Brothers Plumbing Company, Commissioner Meyer moved that this area be considered as the future zoo site and negotiations be made with the aforesaid property owners as to acquisition costs. Seconded by Commissioner Roberts and carried. Consideration was next given to the Community Antenna Television proposals submitted on March 23, 1970, and after discussion, Commissioner McDonald moved that the two companies, Times-Life and Times-Mirror, be studied in depth with a determination to be made from the two systems. Seconded by Commissioner Roberts and carried. Attorney Thomas G. Freeman appeared to represent Murphy Oil Company, to object to the adoption of Ordinance No. 986 to rezone from industrial to commercial certain properties of his client, and referred to his statements made at the public hearing on March 9, 1970. And further, that said company had filed suit on April 8, 1970, regarding same. Attorney C. Vernon Mize, Jr., representing Standard Oil Company and Eastern Seaboard Petroleum Company, appeared and reiterated objections by the respective owners to the change in zoning as was presented at the public hearing on March 9, 1970. David Gardner, rep=esenting Cities Service Oil Company, appeared to voice objections to the zoning change. Ordinance No. 986, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN C-2 (GENERAL COMMERCIAl) DISTRICT. placed on its first reading and read in full at the meeting of March 23, 1970, was next placed on its second reading. After being read in full, Commissioner McDonald moved on its passage and adoption. Joseph Davis, Jr., representing Lum's Restau- rant, 2508 South French Avenue, requesting that Ordinance No. 849 be amended to permit restau- rants serving 120 or more patrons at tables to sell intoxicating beverages, including wine and beer, until the hours of 2:00 A. M. of each day and from 2:00 P. M. of each Sunday. The City Attorney reviewed the provisions of Ordinance No. 849 in that the serving of alcoholic beverages on Sunday, to begin at 2:00' P. M., is special exception keyed strictly to hotels with 100 or more rooms, and further exceptions to restaurants with 200 seating ca- pacity at tables and serving of full course meals regularly are permitted to make said sales until 2:00 A. M. on Su~_day. It was pointed out that such an amendment could open up the sale of beer and wine on Sundays; difficult to control; and, could not be keyed to particular businesses or loca- tions. After discussion, Commissioner Meyer moved that Ordinance No. 849 be amended to permit Lum's Restaurant to sell beer and wine as requested and to instruct the City Attorney to prepare the appropriate ordinance. Seconded by Commissioner Crapps. On roll call, the vote stands as follows: Motion failed to carry. follows: Commissioner Crapps Aye~ Commissioner McDonald Naye Commissioner Meyer Aye Commissioner Roberts Naye Petition next submitted from Thomas Ratliff, Sr., for annexation of property, as All of Lot 42 of the Amended Plat of Druid Park, less the easterly 150.20 feet along right-of-way of 17-92 continuing from intersection Of 17-92 and 27th Street, run southwesterly along 27th Street 131.91 feet, thence southerly lO1.30 feet, thence easterly 150 feet to point of beginning; and All of Lot 4~ of the Amended Plat of Druid Park, less the southerly 85 feet of the easterly 170 feet, Plat Book 7, pages 5 and 6 of the Public Records of Seminole County, Florida. Letter submitted from C. A. Whiddon, Sr., realtor, setting forth that this property was under purchase contract to E. B. Wells who~Aesired the annexation to obtain City water and sewer, and multiple family zoning for apartments. After consideration, Commissioner Roberts moved to authorize the City Attorney to~, prepare the proper ordinance for annexation. Seconded by Commissioner Meyer and carried. Commissioner Crapps reported that William Jack, d/b/a Sanford Heating and Air Conditioning Company, desired to construct a building on Sanford Avenue south of 27th Street, on Lots 47 and 48, Park View, Second Section, presently zoned R-2 (multiple family). The City Manager stated that the Zoning and Planning Commission had considered this request which would require M-1 (industrial) zoning, and as it would create spot zoning of an industrial area surrounded by existing residential, had informed Hr. Jack that said Board would not recommend this change. The action was taken to defray the cost of a public hearing to the petitioner. After consideration and on' recommendation of the City Attorney, the Commission requested Commissioner Crapps to refer the matter backto the petitioner and discuss same with him. After consideration, Commissioner Crapps moved to authorize Mayor and City Clerk to execute a Resolution and Agreement with the Seaboard Coast Line Railroad Company granting to the City of Sanford the right to maintain a pipeline under a railroad track on Mellonville MINUTES City Commission, Sanford, Florida April 15 at 8:00 P. Seconded by Commissioner McDonald and carried Consideration was next given to a tabulation of bids opened publicly at 2:00 P. M. o~ April 9, 1970, for furnishing one diesel tractor and one 15-foot rotary mower for the Sanford Airport, in accordance with the Invitation to Bid as advertised in the Sanford Herald on March 51, 1970. Report next received that C. F. Screens, d/b/a B & H Fence Company at the Sanford Airport, lessee of Buildings 99 and 100, is four months in arrears as of April l, 1970, in the lease payments in the amount of $568.45, and on recommendation of the City Manager, Commis- sioner Roberts moved to approve the termination of the lease and to authorize appropriate step. be taken to assure the collection of the past due rent. Seconded by Commissioner Meyer and carried. MINUTES City' Commission, Sanford, Florida April 15 at 8:00 P. M. 19 70 Recommendation of the Scenic Improvement Board for the appointment of Bert B. Hollingsworth to said Board to fill the vacancy created by.the resignation of Sidney Vihlen was next considered. Commissioner Roberts moved that same be deferred and another name recommendation made, due to Mr. Hollingsworth serving on two other City boards. Seconded by Commissioner McDonald and carried. After consideration, Commissioner MeYer moved to authorize the transfer of funds, as follows: 1. $100.00 from Account No. 8150, Contingency, for advertisement in the Police Benevolent Association yearbook. 2. $31.72 from Account No. 8150, Contingency, to Account No. 872, Civic C~nter Rent, to provide for the use of the Civic Center for Sunrise Easter Services by the Ministerial Association. 3. $204.00 from Account No. 8150, Contingency, to Account No. 2321, Building Repairs and Maintenance, Fire Department, to cover the unbudgeted cost of replacing gutters and down spouts on fire station No. 1. Seconded by Commissioner Crapps and carried. Recommendations next submitted from Zoning and Planning Commission, as follows: 1. Zoning of annexed properties: Lots 1-2-3-4 and 28-29, Block 24; Lots 15-16-20-21, Block 10; West ~ of Lot 8, all of Lots 9-10-il-12 and west ~ of Lot 28, Block 13, Dreamwold, to R-lA (Single Family Dwelling) District. Lots 1-2-3-4-5, A. B. Russell's Addition to Fort Reed, to R-1 (Single Family Dwelling) District. Lots 1-2, Block 8, Pine Level Subdivision, to R-5:..:~One and Two Family Dwelling) District. Lots 8'7-8-10-11, Block 15, Dreamwold, to C-1.-(NeiEhborhood Commercial) District. On motion of 'Commissioner Roberts, seconded by Commissioner Meyer and carried, a public hearing was authorized to be held on May ll, 1970, and the City Clerk authorized to advertise same. 2. Inspection control ,and procedures for off-site construction. After discussion, Commissioner Meyer moved to adopt a requirement that ~uy off-site construction, such.as modular homes, meet the applicable codes of the City and be inspected by City of Sanford inspectors or be inspected through receprocity with other qualified inspectors and acceptable inspection procedures. Seconded by Commissioner McDonald and carried. 3. A priority highway program for Sanford: Outside city limits 1. 25th Street Extension west to I-4 and interchange 2. Lake Mary Boulevard east and north to tie in SR 415 3. New Osteen Bridge SR 415 from city limits to 0steen Bridge 5. SR $15 from city limits to Osteen Bridge On motion of Commissioner Roberts, seconded by Commissioner McDonald and carried, Ordinance No. 987, entitled: AN ORDINANCE OF THE CITY OF SANFORD ADOPTIN~ REGULATIONS ESTABLISHING MUNICIPAL STANDARDS FOR THE SUBDIVIDING OF REALPROPERTYAND THE LOCATIONAND RE-LOCATION OF UTILITIES AND LAND CONTROL. was introduced and same was placed on its first reading and read in full. Commissioner Roberts then moved on the waiver of the requirement of the second reading of Ordinance No. 987, and that same be placed on its final passage and adoption. Seconded by Commissioner McDonald. Commissioner Roberts next introduced Resolution No. 1070, and after being read in full, moved on its passage and adoption. Seconded by Commissioner Meyer and carried by the unanimous vote of the Commission. Said ResOlution No. 1070 being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD ADOPTING REGULATIONS FOR SANFORD MUNICIPAL AIRPORT WHEREAS, the City of Sanford now has the ownership and control of Sanford Municipal Airport, and in connection therewith has determined that it is necessary to adopt regulations applicable to all parties and organiZations utilizing the same; NOW THEREFORE BE IT RESOLVED by the City Commission of.~he Cityof Sanford, Florida, that Airport Regulations as attached herewith and by reference made a part hereof be and the same are hereby adopted and made effective at Sanford Municipal Airport. After discussion, Commissioner McDonald moved to 'apDrove an expenditure of $5,058.20 from the Sanford Airport Reserve for Renewal and Replacement for the reactivation of taxiway-runway lights. Seconded by Commissioner Meyer and carried. After consideration, Commissioner Meyer moved to notify the Orange-Seminole Legisla- tion Delegation that the City CommiSsion supports the passage of proposed legislative bills, as follows: (a) The one cent gasoline tax proposed for return to cities. (b) The community development tax (SB 189) on transient rentals, food and beverage~ (c) The two-cent cigarette tax (liB 3391). (d) Municipal exemption of the state gasoline and fuel taxes (HB 3195).- (e) l0 Mill Limit to extend indefinitely, or at least one year, the time require- ment for rollback of all municipal millages to l0 mills. Seconded by Commissioner Roberts and carried. After discussion, Commissioner McDonald moved to authorize the City Attorney to de- fend the City of Sanford in the suit filed by the Murphy Oil Company, through Attorney Thomas Freeman, pertaining to the rezo~ing as set forth in Ordinance No. 986. sioner Meyer and carried.
