M. on April 27, 1970. Present: Mayor-Commissioner Lee P. Moore Commissioner James H. Crapps Commissioner Thomas S. McDonald Commissioner Gordon T. Meyer Commissioner W. Vincent Roberts City Attorney W. C. Hutchison, Jr. City Hanager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler The meeting was called to order by the Chairman. Mrs. Marguerite Zittrower, 2538 Magnolia Avenue, appeared to protest the operation by the City of a sanitary landfill on 26th Place, east of Sanford Avenue, and complained of the odor being emitted from same. She called attention to garbage accumulating in an adjacent drainage ditch. The City Manager explained that the surface drainage through the landfill was running into a ditch in which the culvert was higher than the bottom of the ditch and further various chemicals were being used to try to alleviate the odor. The City Manager recommended that the best solution would be to acquire ~a large tract of land~ approximately seventy-eight acres, away from all residences. Consideration was given to possible relocation sites on the property at the Sanford Airport and p~operty offered by William E. Kirchhoff, Jr., located south of Seminole Boulevard~ west. of the City limits. Commissioner Roberts recommended that the present landfill site be cleaned up and, if necessary, the proper drainage installed. The City Manager reported that within the next four months the capacity of the present site would be filled. After discussion, Commissioner Meyer moved to table the ~matter until further in- formation is obtained on acquisition of other sanitary landfill sites. Seconded by Commis- sioner McDonald and carried. Commissioner Meyer next introduced Resolution No. 1072, and after being read in full moved on its passage and adoption. Seconded by Commissioner McDonald and carried by the unani. mous vote of the Commission. Said Resolution No. 1072 being in words and figures, as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA DETERMINING TO MAKE A PUBLIC IMPROVEMENT WITHIN THE CITY OF SANFORD, DESCRIB- ING SUCH PUBLIC IMPROVEMENT; PROVIDING FOR THE PAYMENT THEREOF BY SPECIAL ASSESSMENT AND THE' MANNER IN WHICH SAID ASSESSMENT SHALL BE MADE AND PAID; DESIGNATING THE LANDS UPON WHICH SUCH SPECIAL ASSESSMENT SHALL BE LEVIED; AND DESCRIB- ING THE NATURE OF THE IMPROVEMENT PURSUANT TO CHAPTER 170 FLORIDA STATUTES. WHEREAS, the City Commission of the City of Sanford, Florida, as the governing body of said city, has determined to make a public improvement within said city pursuant to the provisions of Chapter 170 Florida Statutes and to finance said improvement by special assess- ment against the properties directly benefitedby said improvement. NOW THEREFORE BE IT RESOLVED by the City Commission of The City of Sanford, Florida, as follows: 1. That the City Commission has determined it necessary to make a public improve- ment within The City of Sanford. 2. That the nature of said public improvement is the construction and paving of certain streets to include curbs and drainage, to a width of twenty-four feet. 3. M. .19 70 OFFICE SUPPLY COMPANY (a) Cypress Avenue from Thirteenth Street Northerly to Tenth Street. (b) San Carlos Avenue from Seventh Street North to a point 312 feet South of the center line of Second Street. (c) Pine Avenue from Thirteenth Street North to Third Street. (d) Hickory Avenue from Thirteenth Street North to Third Street. (e) Willow Avenue from Thirteenth Street North to Fourth Street. (f) Orange Avenue from Thirteenth Street North to Fourth Street. (g) Bay Avenue from the South side of Eleventh Street North to Second Street. (h) San Marcos Avenue from Seventh Street Northerly a distance of 387 feet. ' 4. The total estimated cost of such improvement, including labor, materials, plans, specifications, surveys, engineering and other expenses is $274,418.11. 5. The portion,of the expense of said project to be paid by special assessment is 100%. Said special assessment shall be made upon a per front foot basis applicable to the lands abutting upon said improvement and such assessment shall be made and paid in five equal installments to be assessed on annual basis in five consecutive years~beginning with the first taxable year subsequent to the commencement of said improvement. No portion of said improve- ment shall be paid from the general fund of The City of Sanford, Florida except to the degree that the actual cost of said improvement and any other expenses shall exceed the aforesaid estimated costs. 6. The lands upon which the special assessment shall be levied shall consist of all lots and lands adjoining and contiguous to or bounding and abutting upon the above de- scribed improvements and as are further designated by the assessment plat and the plans and specific~ations for said project which are presently on file in the office of the City Clerk of The City of Sanford, Florida, City Hall, Sanford, Florida, the same being open for public inspection by any interested person or persons. BE IT FURTHER RESOLVED that this resOlution be spread upon the minutes of the City Commission of The City of Sanford, Florida and that a copy thereof be forthwith published one (1) time in The Sanford Herald, a newspaper of general circulation published in The City of Sanford, pursuant to the provisions of Chapter 170.05, Florida Statutes. Crapps As the City Commission of the City of Sanford, Florida Consideration next given to a recommendation from the Zoning and Planning Commission for the proposed rehabilitation under an Urban Renewal Program with federal participation of that general area lying between Maple and Poplar Avenues and Eighth Street and portion of south side of 12th Street° After discussion, the City Manager was authorized to arrange for an on site inspection Of the area. Said Resolution No. lO71 being in words and figures as follows: RESOLUTION AUTHORIZING FILING OF APPLICATION WITH THE STATE OF FLORIDA, DEPARTMENT OF AIR AND WATER POLLUTION CONTROL AND THE ~ S. DEPARTMENT :~ OF IN- TERIOR FEDERAL WATER POLLUTION CONTROL ADMINIS- TRATION, FOR A FEDERAL GRANT FOR SEWAGE TREATMENT WORKS UNDER 33 U.S.C. 466 ET SEQ. WHEREAS, pursuant to 33 U.S.C. 466 et seq. the United States of America has author- ized the making of grants to public bodies to aid in financing the construction of sewage treatment works projects: NOW THEREFORE, Be It Resolved By The City Commission of the City of Sanford 1. That Lee Po Moore be and he is hereby authorized to execute and file an appli- cation on behalf of City of Sanford with the State of Florida, Department of Air and Water Pollution Control and the U. S. Department of Interior Federal Water-Pollution Control Adminis tration, for a grant to aid in financing the construction of secondary sewage treatemtn facili. ties at the existing City of Sanford site, and an assurance of compliance with the U. S. Department of the Interior, regulations under Title VI of the Civil Rights Act of 196~. 2. That Lee P. Moore, Mayor, by and he is hereby authorized and directed to furnish such information as the State of Florida, Department of Air and Water Pollution Control or the U. S. Department of Interior, Federal Water Pollution Control Administration may reasonably request in connection with the application which is herin authorized to be filed. Consideration was next given to a proposed occupational license fee schedule and on motion of Commissioner Meyer, seconded by Commissioner McDonald and carried, the City Attorney was authorized to prepare an ordinance for adoption of same. Commissioner Meyer next questioned the status of repairs to the sunken piers at the Marina and the length of time for storage of damaged piers on the bulkhead. The Chairman stated that a verbal proposal had been made to him by the Lessee that the piers be restored and that fifty additional slips be constructed in the west harbor and a breakwater constructed at the entrance, and further thatthe funding of the costs of said improvements be provided by increasing the annual lease payment by a sufficient amount to amortize said costs over a 30- year period. On motion of Commissioner Roberts, seconded by Commissioner McDonald and carried lover the opposing vote of Commissioner Meyer, the Mayor was authorized to ex~lore the p~oposal in depth with the City Manager and the City Attorney and to report to the Commission. The Commission authorized the City Manager to write a letter to the Lessee regarding the cleaning up of the beach area east of the dry storage building. After consideration, Commissioner Meyer moved on the reappointment of B. L. Perkins, Jr., to the board of the Sanford Housing Authority for a four-year term from May 20, 1970 to May 20, 1974. Seconded by Commissioner Crapps and carried. A request next submitted from the Seminole County Board of Public Instruction for a road right-of-way across the northeast corner of City property at Water Plant No. 2, adjacent to Lake Ada, for a south access from Onora Road to the Lakeview Junior High School, and after :onsideration, and on motion of Commissioner Meyer, seconded by Commissioner Crapps and car- ~ied, same was approved with a stipulation that the right-of-way be for road purposes only and upon ceasing to be used as such, the land would revert to the City. On request of Municipal Judge Roger L. Berry and on motion of CommisiionerCrapp~, seconded by Commissioner Roberts and carried, a transfer was authorized in the amount of $100.00 from Account No. 8150, Contingency, to Account No. 2107, Municipal Court Travel Expense, to provide for attendance to the Municipal Judges Association conferencein Tampa, Florida, April 30, May ~a2, 1970. Consideration next given to a request for the employment of two temporary police officers for a period of three months for relief during vacation periods and state required school attendance, and on motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, same was approved with a transfer of $3,000.00 from Contingency Account No. 8150, to Police Department Salaries Account No. 2201. After consideration and on recommendation of the City Manager, Commissioner Roberts! moved to approve salary reclassifications for City employees, as follows: Ernest B. Wright, Fire C. C. Smith, Fire Charles Q. Shivers, Utility-Shop James J. McLaughlen, Repair Shop Dean L. Johnson, Maintenance Seconded by Commissioner Crapps and carried. Commissioner Roberts and carried, Ordinance No. 988, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPOR- ATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER, IN ACCORD- ANCE WITH THE PROVISIONS OF CHAPTER 57-1815 LAWS OF FLORIDA, ACTS OF ~957. was introduced and same was placed on its first reading and read in full. Commissioner Crapps then moved on the waiver of the requirement of the second reading of Ordinance No. 988, and that same be placed on its final passage and adoption. Seconded by Commissioner Roberts. W. Garnett White, realtor, appeared to request consideration for the purchase of City-owned land consisting of three parcels, 60 x 80 feet each, located west of Old Lake Mary Road and formerly used for test well sites, and further stating this land would be used in conjunction with the abutting land. On motion of Commissioner McDonald, seconded by Commis- sioner Crapps and carried, tentative approval was given for said sale at the appraiaed value to the purchaser of the large tract when it is transferred. Consideration was next given to recommendations of the Zoning and Planning Commissiol as follows: 1. On motion of Commissioner Meyer, seconded by Commissioner McDonald and carried, authorization was given for the City Clerk to advertise a public hearing date for May 25, 1970 for further consideration of the rezoning of Lots 32, 33, 34, Block 5, Second Section of Dreamwold Subdivision, from R-lA (Single Family Dwelling) District to C-2 (General Commercial) District, located on Elm Avenue south of 25th Street. 2. On motion of Commissioner McDonald, seconded by Commissioner Meyer and carried, the City Clerk was authorized to advertise a public'hearing date for May 25, 1970, for further consideration of adopting regulations applicable to Planned Unit Development. 3. On motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, the City Clerk was authorized to advertise a public hearing date for May 25, 1970, for further consideration of rezoning from R-1AA (Single Family Dwelling) District to C-1 (Neighborhood Commercial) District that property described as all of Lot 42, Amended Plat of Druid Park, less the easterly 150.20 feet al~ng R/W of 17-92 continuing from intersection of 17-92 and 27th Street run southwesterly along 27th Street 131.91 feet southerly lO1.30 feet easterly 150 feet to point of beginning, and all .of Lot 43, Amended Plat of Druid Park, less southerly 85 feet of easterly 170 feet. On motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, minutes of April 13, 1970, were approved. After consideration, Commissioner Meyer moved to approve the City Manager attending an annual conference of the Southeasern Regional Council of National Housing ·Authority in Atlanta, Georgia, June 7-10, 1970, with expenses for same to be transferred from Contingency Account No. 8150 to City Manager Travel Expense Account No. 1207. Seconded by Commissioner McDonald and carried. After consideration of a request from the Ministerial Association, Commissioner Meyer moved that ministers from the association be permitted to deliver the opening prayer at the regular City Commission Meetings.
