M. 19 70 The City Commission of the City of Sanford, Florida, mat in regular session at the City Hall in the City of sanford, Florida, at 8:00 o'clock P. M. on September 28, 1970. Present: Mayor-Commissioner Lee P. Moore Commissioner James H. Crapps Commissioner Thomas S. McDonald Commissioner Gordon T. Meyer Commissioner W. Vincent Roberts City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Captain Earl Bourquardez The meeting was called to order by the Chairman. The first item of business was the consideration of applications for the transfer of permit for sale of beer and wine for consumption on premises, as follows: 1. License No. 833, from Mary Kenis to Mary K. or Charles S. Clostermery, d/b/a Mary's Bar, 1515 Celery Avenue. 2. License No. 1390, John Stubbs, Betty L. Stubbs and William Sandell, d/b/a The Green Door, from 2603 Park Drive to 2601 Park Drive. and on recommendation of the Police Chief and on motion of Commissioner Crapps, seconded by Commissioner Meyer and carried, same was approved. Consideration was next given to request of Garfield Walker for a Public Hearing to consider rezoning not recommended by the Zoning and Pla~ing Commission, to rezone from R-2 (Multiple Family Dwelling) District to C-1 (Neighborhood Commercial) District, property lo- cated at ll0 West 13th Street; and on motion of Commissioner Roberts, seconded by Commissioner Crapps and carried, the City Clerk was authorized to advertise for said hearing on October 12~ 1970, to further consider same. A petition next submitted requesting a street light in the middle of the block on Wilkins Circle,'Country Club Manor. The City Manager reported that under the proposed City- wide street improvement program the existing lights at each end of the block would be in- creased from 1,O00 to 4,500 lumen; however, the block is 560 feet in length; and after con- sideration, Commissioner Crapps moved to approve the request with a 4,500 lumen light. Seconded by Commissioner Roberts and carried. A Resolution next submitted from the Zoning and Plauning Commission recommending acceptance of the Sanford, Florida Neighborhood Analysis, a guide for long-range community pla~ing, as prepared by Gerald Dake Associates, Jacksonville, and on motion of Commissioner Meyer, seconded by Commissioner Roberts and carried, said resolution was accepted and the report approved. Consideration next given to a proposal, dated September 16, 1970, from Ardaman and Associates,'Orlando, for investigating soil conditions regarding the settling of the Sanford Civic Center Dressing Room Addition, to include two soil borings and an engineering evalua- tion and recommendation, at a fee not to exceed $700.00, and on recommendation of the City Manager, Commissioner McDonald moved to authorize same. Seconded by Commissioner Heyer and carried with Commissioner Roberts abstaining. A statement dated September 18, 1970, next submitted from Clark, Dietz and Assoiates in the net amount of $10,000.00, for preliminary engineering services completed on the sec- ondary sewage treatment plant, as authorized under Engineering Agreement dated January 26, 1970, and on motion of Commissioner Crapps, seconded by Commissioner Roberts'and carried, same was approved for payment from ReServe for Renewal and Replacement Fund. MINUTES City Commission, Sanford, Florida September 28 at 8: O0 P. M. 19 70 The City Manager reported that paving funds had been received from Seminole Gardens Housing Project for West Fifth Street improvements and requested the Commission to review the Street construction schedule, and a priority schedule was set as follows: (1) completion of the present slurry seal resurfacing program; (2) llth Street, between Mellonville and Bay Avenues; (3) West Fifth Streeb; (4) State Street improvements. Consideration was next given to a requirement of a bond for the County Tax Collector as collector for City tax funds, and the Commission set the amount at $15,000.00 and authorize the City Manager to discuss same with the Seminole County Tax Collector. After consideration and on motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, the resignation of Carl R. Schilke from the Sanford Industrial Commission was accepted with regrets and a letter of appreciation for past tenure authorized. Commissioner Crapps next introduced Resolution No. 1084, and after being read in ful2 moved on its passage and adoption. Seconded by Commissioner Meyer and carried by the unani- mous vote of the Commission. Said Resolution No. 108# being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION BY THE MAYOR OF AN AIRPORT IMPROVEMENT AGREEMENT WITH THE UNITED STATES OF AMERICA ACTING BY AND THROUGH THE FEDERAL AVIATION ADMINISTRATION. WHEREAS, the City of Sanford has heretofore obtained from the United States of America the properties formerly known as Sanford Naval Air Station; and WHEREAS, the electrical system and telephone communication system pertaining to said properties are necessary for the effective maintenance and operation thereof but are in such state of bad repair that the City of Sanford is not warranted in retaining the same; and WHEREAS, Florida Power and Light Company and Southern Bell Telephone and Telegraph Company have offered to purchase the respective systems, and City feeling that it is the best interest to sell the same; and WHEREAS, the United States of America, acting through the Federal Aviation Adminis- tration has proposed an agreement to the City of Sanford wherein the proceeds of said sales will be utilized in airport development and improvement according to estimates and priorities set forth::in an agreement dated September 28, 1970; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, that MINUTES City Commission, Sanford, Florida September 28 at 8:00 P. Seconded by Commissioner McDonald and carried by the unani. mous vote of the Commission. Said Resolution No. lO81 being in words and figures as follows: RESOLUTION APPROVINGAPPLICATION FOR LOW-RENT HOUSING WHEREAS, it is the policy of this locality to eliminate substandard and other in- adequate housing, to prevent the spread of slums and blight, and to realize as soon as feasi- ble the goal of a decent home in a suitable living environment for all of its citizens; and WHERE,, under the provisions of the United States Housing Act of 1937, as amended, the United States of America (herein called the "Goveroment") is authorized to provide finan- cial assistance to local public housing agencies for preliminary pl~ing of developing low- rent housing units or for leasing dwelling units in existing privately-owned structures, that will assist in meeting this goal; and WHEREAS, the Act provides that there shall be local determination of need for low- rent housing to meet needs not being adequately met by private enterprise and that the Gov- ernment shall not make any contract with a publiC housing agency for preliminary loans for surveys and planning in respect to any low-rent housing projects unless the governing body of the locality involved~has by resolution approved the application of the public housing agency for such preliminary loan; and WHEREAS, leasing~of dwelling units under Section 23 of the Act requires approval of leasingunits by the local governing body; and WHEREAS, the Housing Authority of the City of Sanford, Florida, (herein called the "Local Authority") is a public housing agency and is applying to the Government for low-rent housing. NOW, THEREFORE, be it resolved by the City Commission of the City of Sanford, Flori- da, as follows: 1. There exists in the City of Sanford a need for such low-rent housing at rents within the ~meanBm of low-income families. 2. The application of the Local Authority to the Goverument for a preliminary loan in an amount not to exceed $120,000.00 for surveys and planning in connection with low-rent housing projects of not to exceed approximately 300 dwelling units is hereby approved. COmmissioner Roberts next introduced Resolution No. 1083,. and after being read in full, moved on its passage and adoption. ~Seconded by Commissioner McDonald and carried by the unanimous vote of the Commission. Said Resolution No. 1083 being in words and figures as follows: WHEREAS, the City of Sanford and other interested persons have proposed the location MINUTES City Commission, Sanford, Florida September. 28 at 8:00 P.M. 70 of the Florida Police Academy in Sanford in the center of this great State; and WHEREAS, the center of the state is readily accessible by car, plane, train, and bus transportation; and WHEREAS, this area is a progressive, cosmopolitan area in the State of Florida representing the many business, agricultural, political and cultural aspects of life in all of Florida; and WHEREAS, it would seem that this area would serve admirably for the location of the Police Academy, NOW, THEREFORE, BE IT R~SOLVED by the City Commission of the City of Sanford, Seminole County, Florida, as follows: 1. That this Commission pledges full support of the Police Academy located at the Sanford Airport; 2.That our State Cabinet consider this location and all aspects when making a final decision~ 3. That a copy of this Resolution, evidencing the support of the Commission of the City of Sanford, be furnished to each member of the State Cabinet. Latham, Sr., for $50.75, represented as hospital charges relating to a fall of daughter Judith on the sidewalk on October 12, 1969, and on motion of Commissione McDonald, seconded by Commissioner Roberts and carried, the City Attorney was authorized to advise said party. Commissioner Meyer next introduced Resol'ution No. 1082, and after being read in full moved on its passage and adoption. Seconded by Commissioner Roberts and carried by the unani- mous vote of the Commission. Said Resolution No. 1082 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, COMMENDING ROBERT E. WHITE, SR., FOR HIS OUTSTANDING SERVICE AS A FIREI~N OF THE CITY OF SANFORD, FLORIDA. WHEREAS, ROBERT E. WHITE, SR., has served as a fireman on the Sanford Fire Depart- ment for a period of twenty-eight years; and WHEREAS, ROBERT E. WHITE, SR., is now retiring from the Sanford Fire Department on October l, 1970; and ~HEREAS, ROBERT E. WHITE, SR., in the performance of his duties as such fireman has worked diligently and unselfishly for the City of Sanford and its people, has devoted to such service time and effort far above and beyond the call of duty, and it is the privilege and desire of the City Commission t~ express proper recognition and appreciation to Fireman White for his long and meritorious devotion to duty as such fireman, MINUTES' City Commission, Sanford, Florida September 28 at 8:00 P. McDonald s/ Gordon Meyer As the City .Commission of the City of Sanford, Florida A proposal for liability insurance coverageson the Sanford Airport was next sub- mitted by Tony Russi, agent for the South Carolina Insurance Company, for an annual premium of $3,374.00, and after consideration and on motion of Commissioner Meyer, seconded by Commis- sioner Crapps and carried, same was approved, effective October l, 1970, The Commission authorized the City Manager to request said agency to submit a comparative proposal on all other insurance coverage for the City of Sanford. On motion of Commissioner Crapps, seconded by Commissioner Meyer and carried, the Mayor was authorized to execute a deed conveying to the Seaboard Coast Line Railroad city- owned Lot 9, Lake Monroe Industrial Park Amended Plat, subject to receipt of a deed from the railroad company conveying to the City a parcel of railroad right-of-way lying north of Fulton Street. On motiOn of Commissioner Meyer, seconded by Commissioner Roberts and carried over the dissenting vote~of Commissioner Crapps, Ordinance No. 1002, entitled: AN ORDINANCE OF THE CITY OF SA~FORD, FLORIDA, AMENDING SECTION ll-3, THE CODE OF THE CITY OF SANFORD, 1954, AS AMENDED SAID SECTION PRO- HIBITING CURB SIDE PICKUPS OF GARBAGE EXCEPT WHERE ALLEYS ARE ADFACENT TO THE PREMISES SERVED, SAID AMENDMENT PROVIDING FOR CURB SIDE PICKUP. was introduced and same was placed on its first reading and read in full. Commissioner Meyer moved to waive the requirement of the second reading of Ordinance iNo. 1002 and to be placed on its final passage and adoption. Seconded by Commissioner McDonald and carried. On motion of Commissioner McDonald, seconded by Commissioner Meyer and carried, minutes of September 14, 1970, were approved. Appraisals next submitted from John Sauls and William Kirk, in amgU~t of $5,000.00 MINUTES City Commission, Sanford, Florida September 28 at 8: O0 P.M. 19__ 7O DOTHEROW OFFICE SUPPLY COMPANY for a city right-of-way lying at the intersection of French Avenue, Sarita Street and Osceola Drive, and after discussion Commissioner Meyer moved to authorize an offer for sale on a Quit Claim Deed said land to Michael Porter, owner of Lum's Restaurant, at the appraised price.
