MINUTES City Commission, Sanford, Florida October 12, at 8:00 P. M. 19 70 OFFICE ~urPLY OOMPANY The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on October 12' 1970. The first item of business was a Public Hearing to consider amending the Zoning Ordinance in accordance with notice published in the Sanford Herald on October l, 1970, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AME~NTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Ronm in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on October 12, 1970, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property along the north side of west Thirteenth Street and between Oak Avenue and Park Avenue is proposed to be rezoned from R-2 (One and Two Family Dwelling) District to C-1 (Neighborhood Commercial) District. Said property being more particularly described as follows: hearing. East 52.5 feet of Lot 10, Block 14, Tier E. R. Trafford's Map of Sanford All parties in interest and citizens shall have an opportunity to be heard at said By order of the City Commission of the City of Sanford, Florida, this 28th day of September, 1970. H. N. TAMM, JR. CITY.CLERK OF THE CITY OF SANFORD, FLORIDA The Chairman announced that the Commission would hear from anyone in favor of, or against, the proposed amendment. There were no objections registered. Garfield Walker, ownez of the property, appeared in favor of the rezoning and presented the potentiality of a small commercial operation in the existing structure, and further agreed to demolish the existing garage located on the property in order to create additional off-street parking when needed. After discussion and on motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, subject to the stipulation that upon the use of the property being con- verted from residential to commercial that the garage structure will be removed to Provide off-street parking on the property, the City Attorney was authorized to"~prepare an ordinance to rezone the property described in the foregoing notice of public hearing. A letter next submitted from Carl W. Deeter, Vice President of Cobia Boats, Inc., a subsidiary of Monroe Harbour, Inc., lessee of city-owned marina property on the lakefront, requesting replacement of one dock section on Pier A in the west harbour. After discussion with the City Attorney, Commissioner Crapps moved that the request be tabled.until the matter is investigated and further information made available. A letter next submitted from Carl R. Schilke, Harcar Aluminum Products Company, 3500 South Orlando Drive, requesting use for parking of city-owned land located to the west of said address. The Ci-~y Manager pointed out that the land is a protective area for City Water Well No. 6. After discussion, Commissioner Crapps moved that the City Manager be authorized to negotiate further on the request on the basis of the following: (1) no moving of earth; (2) requirement of chai~ link fencing aroUnd the parking lot for well protection; (3) leasing period of five years; (4) lease price to be at two cents per square foot. Seconded by Commis- .sioner Roberts and carried. Request next submitted by Municipal Judge Roger L. Berry to set aside bond eStreatur in Docket No. 94078, Leroy E. Griggs, in the amount of $202.00, and on motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, same was approved. After consideration, Commissioner McDonald moved to accept with regret the resigna- tions of Clifford W. McKibbin, Jr-, Robert~Crumley and Robert E. Earns, members of the City Insurance Committee; and further that a letter of appreciation.for past services be written and to include the City Commission's apologies for recent oversight regarding the airport insurance coverage. SeConded by Commissioner Meyer and carried. Consideration was next given to a tabulation of bids opened publicly at 2:00 P. M. on October 9, 1970, for the furnishing of three police cars, four regular-standard cars, one 10ng wheelbase dump truck and one pickup truck, in accordance with Invitation to Bid adver- tised in the Sanford Herald on September 22, 1970. A summary of costs in amount of $436,323.49 was next submitted by Clark, Dietz and Associates, engineers for paving the east-west streets under the proposed Georgetown Paving Improvement Assessment, and indicating an overall paving cost of $10.26 per lineal foot for the combined project. After discussion and on motion of Commissioner Crapps, seconded by Commissioner Meyer and carried, that upon receipt from the parties objecting to the paving of the north- south streets of a Notice of Suit Withdrawal from the U. Cleveland, Jr., Attor- ney, for presentation of the City's opposition to proposed legislation affecting municipali- ties' utility rates outside'city limits, and on motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, same was approved. After discussion, Commissioner Roberts moved to authorize a letter to Leonard Hurst, Mayor of Apopka, Florida, in appreciation of his personal efforts exerted to locate the Florida Police Academy in Building No. 510 on the Sanford Airport. Seconded by C,mmis- sioner McDonald and carried. Commissioner Meyer next presented a need for a north bound holding or turning lane at the intersection Highway 17-92 and 27th Street, outside the City limits, regarding the present traffic Congestion generated by the access road going west into the Seminole High School, and after discussion, and on motion of Commissioner Meyer, seconded by Commissioner McDonald and carried, the City Manager was authorized to write a letter to the Seminole County Commission and the Florida State Department of Transportation requesting consideration and support of same. Consideration next given to two appraisals submitted at last meeting of the Commis- sion in the amount of $5,000.00 for parcel of City property located at the intersection of French Avenue, Sarita Street and Osceola Drive, and after discussion, Commissioner Meyer moved to offer for sale in said amount to the interested party, Michael Porter, owner of Lum's Restaurant, 2508 South French Avenue. Seconded by Commissioner McDonald and carried. The City Manager reported that the Seminole County Tax Collector is presently covered by a bond requirement in the amount of $50,000.00 and the City Commission concluded that same would be adequate to cover his activities as a collector of City taxes under pro- visions of the Florida Statutes. The City Manager next submitted a proposed five-year road maintenance and con- struction program for the City in accordance with provisions of new state requirement, and on motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, same was approved for submittal to the Florida Department of Transportation. Request next submitted for annexation into the City of Lots l, 2, 8, 9 and 10, Block 9, Pine level, located south of West 18th Street between Pear and Peach Avenues, and on motion of Commissioner Meyer, seconded by Commissioner McDonald and carried, same was approved as an area from which an annexation petition would be approved. Ordinance No. 1002, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA AMENDING SEC. ll-3, THE CODE OF THE CITY OF SANFORD, 195~, AS AMENDED, SAID SECTION PRO- HIBITING CURB SIDE PICKUPS OF GARBAGE EXCEPT WHERE ALLEYS ARE ADJACENT TO THE PREMISES SERVED, SAID AMENDMENT PROVIDING FOR CURB SIDE PICKUP. Commissioner McDonald moved to amend the ordinance to provide as an alternative on residential accounts, to permit a garbage pickup behind the front line of the structure, upon the resident signing an appropriate request and on payment of an additional 50¢ per month refuse fee or a total of $2.50 per month. Seconded by Commissioner Roberts and carried over the dissenting votes of Commissioner Roberts and Commissioner Meyer. After consideration, Commissioner Meyer moved to authorize the City Attorney to prepare the appropriate resolution relative to the forth coming retirement of CitYemployee Ethel Carver, Utility Administration Office Manager. Seconded by Commissioner Crapps and carried. Mrs. Jewell Riser withdrew her request for the vacating and abandoning ten feet of right of w~y on the south side of East 24th Street from Mellonville to Summerlin Avenue, and Commissioner McDonald moved to cancel the public hearing authorized to be held on October 26, 1970. Seconded by Commissioner Meyer and carried. P. N. Davis, 2435 Princeton Avenue, next submitted a request for the City to open a platted "easement for alley" north of 25th Street between Princeton and Yale Avenues, and after discussion with the City Attorney and notation of exiSting power poles and fence lines in the middle of the easement, the Commission declined same. Petition, certified by the County Tax Assessor, next submitted for annexation of property as follows: North 1/2 of Lot 21 and all of Lots 22 and 23, Block 25, Dreamwold, according to plat thereof recorded in Plat Book 3, pages 90 and 91, Public Records of Seminole County, Florida; Lot i and Lots 3 through 40, Block 28, and all Block 29, 4th Section, Dreamwold, according to plat thereof recorded in Plat Book 4, page 99, Public Records of Seminole County, Florida; Lots l, 2, 8, 9 and 10, Block 9, Pine Level Subdivision, according to plat thereof recorded in Plat Book 6, pages 36 and 37, Public Records of Seminole County, Florida. On motion of Commissioner McDonald, seconded by Commissioner Roberts and carried, the City Attorney was authorized to prepare the appropriate ordinance for annexation of said properties offer next submitted from Florida Public Utilities Company in the amount of $17,400.00 for purchase of four-inch steel pipe and easement extending along Seminole Boule- vard and south on Mellonvilte Avenue to the property line of the SanfordA~rport south of Twenty-Fifth Street, approximately 15,384 feet total length. After consideration and on motion of Commissioner Crapps, seconded by Commissioner Roberts and carried, the Mayor and City Clerk were authorized to execute Bill of Sale and Easement for same. A letter next submitted from G. Andrew Speer, Attorney for the Sanford Housing Authority, requesting the City to vacate, close and abandon certain streets and alleys and to rezone parcels of property relating to Public Housing Projects 16-5 and 16-6 and part of Oleander Avenue, as follows: Street Violet Street from Locust Avenue to Chapman Avenue MINUTES City Commission, Sanford; Florida October 12 at 8:00 P.
