M..1970 DOTHEROW 0FFICF-~UPPLY COMPANY The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on December 14, 1970. Present: Mayor-Commissioner Lee P. Moore Commissioner James H. Crapps Commissioner Thomas S. McDonald Commissioner Gordon T. Meyer Commissioner W. Vincent Roberts City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E..Butler The meeting was called to order by the Chairman. The first item of business was a Public Hearing to consider amending the Zoning Ordinance in accordance with notice published in the Sanford Hera~l on December ~, 1970, as follows: NO~ICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. · Notice is hereby given that a Public Hearing will be held at the Commission Room in ~the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on December l~, 1970, to iconsider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as ifollows: That property lying south of West Eighteenth Street and between Pear Avenue~and:) Peach Avenue is proposed to' be zoned R-5 (One and Two Family Dwelling) District. Said properti being more particularly described as follows: Lots l, 2, 8, 9 and 1©, Block 9, Pine Level. All parties in interest and citizens shall have an opportunity to be heard at said hearing. ~ . By order of the City Commission of the City of Sanford, Florida, this 25rd day of November, 1970. H. N. Tamm, Jr. City Clerk of the City of Sanford, Florida The Chairman aBnounced that the Commission would hear from anyone in favor of, or against, the proposed amendment. There being no objections, Commissioner Crapps moved to authorize the City Attorney toprepare an ordinance to rezone the property as described in the aforesaid notice of public hearing. Seconded by Commissioner Meyer and carried. Consideration next given to a proposed lease submitted by the Harcar Aluminum Pro- ducts Company at regular meeting of November 9, 1970~ to lease a parcel of city-~wned property on Highway 17-92; and on motion of Commissioner Meyer, seconded by Commissioner Roberts and carried, the Mayor and City Clerk were authorized to execute same. Mayor Moore abstained from voting. Commissioner Roberts next introduced a Resolution authorizing the Mayor to execute an agreement with the Seaboard Coast Line Railroad Company. Seconded by Commissioner Meyer and carried over the dissenting vote of Commissioner Crapps. Said Resolution being in words amd figures as follows: RESOLUTION Be it resolved by the City Council of the City of Sanford, Florida, in regular meeting assembled lh~t the Mayor of said City be, and he hereby is, authorized to enter into an agreement with the Seaboard Coast Line Railroad Company, and to sign same on behalf of 340 MINUTES City Commission, Sanford, Florida December l& at 8:00 P. M. 19 70 DOTHEROW OFFICE SUPPLY COMPANY said City whereby said Railroad Company grants unto said City the right or license to install and maintain for the purpose of a sanitary sewer main, a line of pipe along and across the rights of way and underneath tracks of said'Railroad Company at Sanford, Florida, as particu- larly described in said agreement, which agreement is dated September ll, 1970, a copy of which agreement is filed with this City Council. Charles Henderson, 817 East 10th Street, appeared to request an exempt occupational license as a peddler due to being disabled, and on motion of Commissioner Roberts, Seconded by Commissioner Meyer and carried, same was approved. Application submitted from Michael Porter for the tranfer in name only of occupa- tional license No. 810 for the sale of beer and wine, consumption on the premises, from Lum's to Michael's Restaurant, at 2508 French Avenue; and on recommendation of the Chief of Police and on motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, same was approved. Request next submitted by Amos C. Jones, Executive Director of Seminole Community Action, Inc., for a representative from the City Commission to serve on their Governing Board, Commissioner Meyer offered to serve in this capacity if designated by the Commission, and on motion of Commissioner McDonald, seconded by Commissioner Roberts and carried, City Commis- sioner Meyer was appointed to said board. Commissioner Roberts introduced Resolution No. 1088 to designate depositories for the year 1971, and moved on its passage and adoption and to authorize the Mayor and City Clerk to execute same, seconded by Commissioner McDonald and carried. Said Resolution No. 1088 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, DESIGNATING BANK DEPOSITORIES FOR THE YEAR 1971. WHEREAS, it is necessary annually to designate depositories for funds of the City of Sanford according to the Charter of the City of Sanford, NOW, THEREFORE, be it resolved by City Commission of the City of Sanford, Florida, that The Sanford Atlantic National Ba~_k, Florida State Bank of Sanford, and United State Bank of Seminole be, and they are hereby designated as depositories for.city funds for the year 1971 upon such institutions furnishing the necessary reserves and security as is required by law. BE IT FURTHER RESOLVED that this Resolution be spread upon the' minutes of the City Commission of the City of Sanford, Florida~ and a copy hereof be delivered to the president of each of said institutions. Tsmm, Jr. City Clerk MAYOR Request of Mike Whelchel, lessee of the City golf course, for assistance by the city in providing labor and equipment for the paving of a parking lot was next considered, and on motion of Commissioner McDonald, seconded by Commissioner Roberts and carried, same was denied. The City Manager next reported on the dilapidated and hazardous condition of build- ings on the old Experiment Station property, East Celery Avenue, deeded to' the City from the State, ~ud recommended demolition by the City personnel. Consideration next given to an _amendment to the 1969 State Statutes deleting the of churches from the payment of utility taxes. After discussion, Commissioner Roberts moved to authorize the City Attorney to prepare an amendment to Sec. 23-8 of the City Code to provide an exemption from utility taxes for church sanctuaries and related educational buildings. Seconded by CommiSsioner Meyer _and carried. Ordina_uce No. 1009, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING STREETS AS DELINEATED BELOW, IN THE CITY OF SANFORD, FLORIDA. was intmoduced and same was placed on its first reading and read in full. Commissioner Crapps then moved on the waiver of the requirement of the second readin of Ordinance No. 1009, and that same be placed on its final passage and adoption. Seconded by Commissioner Roberts. Ordinance No. 1010, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AI~ENDING ORDINANCE NO. 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICT AS DELINEATED BELOW. introduced and same was placed on its first reading and read in full. M..19__ 7O Mayor Moore Yea Commissioner Crapps " Commissioner McDonald ~ Commissioner Meyer " Commissioner Roberts " Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote, had passed and adoPted said Ordinance No. lOlO, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN ' WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICT AS DELINEATED BELOW. Retirement of E~hel Carver, Office Manager of the Utility Department, was next con- sidered, and on motion of Commissioner Crapps, seconded by Commissioner Roberts and carried, the Commission authorized payment of a pension in the amount of $31.75 a month to supplement the regular pension plan amount of $43.27 to make a total of $75.00 a month, and to approve the transfer of $286.00 from Contingency Account No. 9850 to Utility Pension Account No. 9195 to provide for the period of January l, 1971, to September 30, 1971. Eliza Pringle, lll4 Cypress Avenue, appeared to present an unsigned petition rela- tive to refuse pickups at the curbline. The City Manager outlined that a large number of the residents have deviated from the regulations and through "custom" place garbage eans at the curb line although given the privilege of placing tham behind the front line of the house and-or backyard where no alley exists. Commissioner Gordon T. Meyer, Chairman of the Zoo Committee, gave a short status report on the land study and layout work being carried out by his. committee on the relocation of the municipal zoo on the newly designated site on the lakefront, west of French Avenue. Commissioner Roberts stated that the City Commission should remove itself from the zoo business .and offer the animals in the zoo to the development of a Central Florida zoo and offer the City's cooperation to this point and moved to eliminate the zoo from the next budgel and apply those taxes back into something closer to the needs of the people in street lights, sewerage, garbage collection, and that the City take such steps as possible to phase out this zoo by the end of this fiscal year or if not before. Seconded by Commissioner McDonald. Commissioner Meyer moved to table any action on the zoo matter. Motion died for lack of a second. Thereupon, the vote recurred on the original motion, and was carried over the dis- senting vote of Commissioner Meyer. Commissioner Meyer requested a tally on the vote and the Chairman announced that the vote was four in favor and one opposed. On motion of Commissioner Roberts, seconded by Commissioner Crapps and carried, the minutes of meetings of November 23 and December 9, 1970,'were approved. On motion of commissioner McDonald, seconded by Commissioner Meyer mud carried, current vouchers and payrolls were next approved as evidenced by General Fund, Florida State Bank, Nos. 6368 through 6411; General Fund, Sanford Atlantic National Bank, Nos. 18115 throug] 18337; Water and Sewer Revenue Fund, Florida State Bank, Nos. 661 through 672; Policemen's Pension Fund, Florida State Bank, Nos. 260 through 262; Firemen's Reti~£'.~and Pension Fund, Florida State Bank, Nos. 156 through 158; Sanford Airport, United State Bank of Seminole, Nos. 574 through 606; Board of Bond Trustees, Sanford Atlantic National BaBk~ Nos. 595 througl 395; Water and Sewer Renewal and Replacement Fund, United State Bank of Seminole, No. 54. 343 After discussion, Commissioner McDonald moved to authorize a Public Hearing to be held on January 18, 1971, at the Sanford Municipal Civic Center, to consider a project of paving the East-West streets in the Georgetown area, and to authorize the City Attorney to prepare a resolution pertaining to same, and the City Clerk to so advertise..
