M. 19 71 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on January ll, 1971. Present: Mayor-Commissioner Lee P. Moore Commissioner James H. Crapps Commissioner Gordon. T. Meyer Commissioner W. Vincent Roberts Commissioner Jul£an L. Stenstrom City Attorney W. C. Hutchison, Jr. City Manager W. E. K~owles City Clerk H. N. Tamm, Jr. Absent: Police Chief Ben E. Butler The meeting was called to order by the Chairman. Mrs. Lou Woodruff, Chairman of the Scenic Improvement BOard, presented a recommenda- tion to submit an application for a federal grant to the Department of Housing and Urban De- velopment for 50% of the cost to implement the City's Master Beautification Plan, in the total amount of $106,530.00, over a five-year period for the five projects; and further, the City's 50% portion could be computed in the furnishing of materials, labor, and equipment. After discussion, the City Commission tabled the matter until the meeting of January 25, 1971, to permit a review of the beautification plans and costs. Mrs. J.,L. Horton, 705 Palmetto Avenue, presented a petition sigrSd by owners of property objecting to the dwelling located at 703 Palmetto Avenue being utilized as, what appeared to be, an alcoholic rehabilitation establishment for approximately twenty persons, both male and female. Mrs. Horton cited that no occupational license has been issued; the zoning was for only one and two ~amily residential occupancy; and persons supposedly responsi- ble claimed no knowledge of same. After discussion, the Commission~:.authorized the City Mana- ger to investigate the matter. Jim Alford appeared to support an application for a permit for sale of beer and wine for consumption off premises, at Phillips 66 Service Station at Ninth and French, in conjunc- tion with a proposed remodeling to a drive-in grocery dispenser and gasoline sales concept. On an opinion rendered by the City Attorney, Mr. Alford was advised that the application must first be acted on by the State Beverage Department. Request by Raymond Walker for street lighting in the area of 26th Street and Oak Avenue, for a three-block area, was next considered; and on motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, authorization was given for the installation of four &,500 lumen street lights. On motion of Commissioner Crapps, seconded by Commissioner Stenstrom and carried, Mrs. Frank ~. Woodruff, III, B. L. Perkins, and James R. Jernigan were reappointed to the Scenic Improvement Board for a three-year term, effective from October 23, 1970, to October 2; 1973. Consideration next given to request from Otto Kukowski for an extension on perSonal note, in amount of $&3&.O0 with 8% interest, due November 28, 1970, for Elm Avenue paving; and on motion of Commissioner Meyer, seconded by Commissioner Crapps and carried,.same was extended until July l, 1971. The City Manager next submitted a report on the City's refuse operation and the MINUTES 355 City Commission, Sanford, Florida January ll at 8: O0 P. ri. 19 71 OFFICE SUPPLY COMPANY recommended new refuse fee scale for commercial accounts and increase in residential rates in order that both fees will bring in sufficient revenue to overcome the deficit. Seconded by Commissoner Meyer and carried. After discussion and-an opinion rendered by the City Attorney regarding an appoint- ment of a City Commissioner as a member of the Sanford Industrial Commission, Commissioner stenstrom withdrew his motion made at the meeting of January 5, 1971, to appoint Commissioner Gordon T. Meyer to the Sanford Industrial Commission as a replacement for Thomas S. McDonald, retiring City Commissioner. City Commissioner Gordon T. Meyer withdrew his name as nominee for an appointment as a member of the Sanford Industrial Commission. Clinton Westbrook, Director of Seminole County Civil Defense, presented a recommenda tion for preparation and adoption of Resolutions to assure continuity of elected officials in city government during an emercency in time of disaster and, also, that consideration be given to incorporating radioactive fallout protection into all proposed construction of city build- ings or additions. On motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, the City Attorney was authorized to prepare the appropriate resolutions for same. Letter from Granville Alley, Jr., Attorney-at-Law, Tampa, referrin'g to. pending leg- islation for public employees collective bargaining system which would require public employer to recognize labor unions as representatives of said employees, and further, recommending that the City oppose or request to be excluded from any legislation to be enacted regarding same. After discussion, Commissioner Roberts moved that the appropriate resolution and-or letter opposing said legislation be prepared and that a copy be forwarded to the Orange-Seminole Legislative Delegation and to Governor Reubin Askew. Seconded by Commissioner Crapps and carried. A one-year lease for office facilities for the Sanford Industrial Commission in the Lakeview Plaza for $184.16 a month, plus $45.00 a month for utilities, approved by the Sanford Industrial Commission, was next submitted to the City CommissiOn for consideration, and on motion of Commissioner Roberts, seconded by Commissioner Stenstrom and carried, a formal lease was denied and renting of the facilities on a month-to-month basis was approved. After being read in full, Commissioner Crapps moved on its passage and adoption. Seconded by Commissioner Meyer and carried. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. lO11, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICT AS DELINEATED BELOW. After being read in full, Commissioner Crapps moved on its passage and adoption. Seconded by Commissioner Meyer and carried. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1012, entitled: AN ORDINANCE OF THE CITY OF SANFORD, F~ORIDA, AMENDING SECTION 23-8, OF CHAPTER 25, THE CODE OF THE CITY OF SANFORD, FLORIDA, 195~, AS Ai~ENDED, SAID AMENDMENT EXEMPTING GOVERNMENTAL AGENCIES AND CHURCH PROPERTIES FROM SUCH TAX. On motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, cur- rent vouchers and ~ayrolls were next approved as evidenced by General Fund, Florida State Bank, Nos. 6¢12 through 6981; General Fund, Sanford Atlantic National Bank, Nos. 18338 througt 18551; Water and Sewer Revenue Fund, Florida State Bank, Nos. 673 through 688; Policemen's Pension Fund, Florida State Bank, Nos. 263 and 264; Fi~emen's Relief and Pension Fund, Florida State Bank, Nos. 159 thrgugh 161; Sanford Airport, United State Bank of Seminole, Nos. 607 through 637; and Utilities Service Taxes Fund, ganford Atlantic National Bank, No~26 On motion of Commissioner Crapps, seconded by Commissioner Meyer and carried, minutes of meeting of December 28, 1970, and of January 5, 1971, were approved. After consideration, Commissioner Roberts moved to authorize the City Manager to attend the Florida League of Cities Seminar, Management Course, to be held at the Jacksonvill. University, Jgly 26-50, 1971, and to approve a transfer of $175.00 from Contingency Account No. 8150 to City Manager Travel Expense Account No. 1207, for same. Seconded by Commissioner Stenstrom and carried. Consideration next given to bid tabulation submitted at regulmar meeting of Decem- ber '28, 1970, for furnishing a pulvimixer, and tabled ~ending demonstrations; and on recom- mendation of the City Manager and on motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, the bid of Florida Equipment Company, JacksonVille, for a model REX, in the amount of $21,250.00, was accepted. Consideration next given to the present policy of 15 days sick leave for City employees, and on motion of Commissioner Crapps, seconded by Commissioner Roberts and carried accumulation of sick leave up to a maximum of thirty (30) days was approved. Seconded by Commissioner Roberts and carried. Consideration next given t:o the failure of certain property owners to correct hazardous marquees in the downtown business district in:~accordance with notice of September 14, 1970, and a second notice of November 10, 1970. On motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, the City Attorney was authorized to proceed with necessary legal action to enforce the notice to comply with Section 2201.2 of the Southern Standard Building Code. IROW OFFICE SUPI~L¥ COMF_a..N¥ Caren Gager, Chairman of the Sanford Taxpayers Association, stated that his organi- zation had requested permission from the Seminole County Commission to permit persons, in- cluding school children, to beautify the Seminole County Courthouse "construction fence" with individual picture paintings to be judged and prizes awarded,~ and had received favorable reception, provided that the City had no objections. AfDer discussion and on motion of Com- missioner Roberts, seconded by Commissioner Meyer and carried, the Commission offered no objections, provided that the paintings are tastefully done and properly maintained by the organization. Commissioner Crapps informed Mr. Gager that the City would not be held re- sponsible for any £Uture clean-up work relating to the project. There being no further business, the meeting adjourned.
