M. 19 71 3w The City Commission of the City of Sanford, Florida, met in regular session at the 3ity Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on March 22, 1971. Present: Mayor-Commissioner Lee P. Moore Commissioner James H. Crapps Commissioner Gordon T. Meyer Commissioner W. Vincent Roberts Commissioner Julian L. Stenstrom City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles Deputy Clerk Rosa M. Rotundo Absent: CityfClerk H. N. Tamm, Jr. Police Chief Ben E. Butler The meeting was called to order by the Chairman. Allen F. Keeth, member of the Seminole County Board of Public Instruction, appeared to request consideration of an extension of the lease of the municipal stadium for a total of thirty to forty years, based on a legal requirement for the School Board to expend $90,000.00 to $100,000.00 for capital 'improvements at the stadium for football purposes. These improve- ments to include the erection of four new light poles; removal of a portion of the existing wall on the north end; erection of additional fencing; redoing the field; permanent irrigation system for the field area; additional bleacher'facilities; and locker facilities for both the visiting and home teams. The City Commission discussed with Mr. Keeth, under long term sta- dium leasing, the possibilities' of utilizing city property to the north of the stadium in addition to negotiating with the Sanford Naval Academy to utilize their abutting property of baseball fields and the School Board then coordinating usage of the stadium property for both football and baseball. Mr. Keeth stated he would take the matter back to the School Board for consideration. Request next submitted by John Dickey, d/b/a McRoberts Tires, 405 West First Street, for a variance to eliminate a requirement of a 10-fooD safety island in proposed driveway con- struction on Elm Avenue, and on motion of Commissioner Crapps, seconded by Commissioner Meyer and carried, same was approved. Letter next submitted f~om the Sanford Industrial Commission recommending that the City negotiate the purchase of all the land and property at the Sanford Airport other than the runway areas, and after discussion and on motion of Commissioner Meyer, seconded by Commis- sioner Stenstrom and carried, the matter was tabled until after a meeting of April 19, 1971, with FAA representative Gene Faulkner. H. H. Hodges, Chairman of the Bankers Committee of the Greater Sanford Chamber of Commerce, submitted a written request that the City of Sanford and Monroe Harbour, Inc., con- sider binding arbitration and, in the meantime, repair and replace docks and construct'neces- sary protection on west side of the marina. After discussion, Commissioner Meyer moved to authorize the City Manager to obtain from Monroe Harbour, Inc., annual audits of the marina operation as set forth in the lease agreement. Seconded by Commissioner Stenstrom and carried. After consideration, Commissioner Crapps moved that the City not consider arbitra- tion in the matter of the sunken docks under lease agreement with Monroe Harbour, Inc., marina operation. Seconded by Commissioner Stenstrom. Motion failed to carry. Commissioner Meyer moved that action on arbitration in the matter of the sunken dOcks be tabled until the City receives the annual audits from Monroe Harbour, Inc., seconded by Commissioner Roberts and carried over the dissenting vote of Commissioner Crapps. ,/37S MINUTES City Commission, Sanford,' Florida March 22 at 8:00 P. Request next submitted for permit for the sale of beer and wine for consumption off the premises by Bennie Brien, d/b/a 7-11 Store at 1808 French Avenue, and on motion of Commis~ sioner Roberts, seconded by Commissioner Meyer and carried, same was denied~ on th~ basis of the close proximity of the Sanford Middle School. Request next submitted for a transfer of occupational license No. 985, from Gazil, Inc., d/b/a Park & Shop Food Stores, to Michael Basila, d/b/a Tip Top Supermarket, llO0 West 13th Street, and on motion of Commissioner Crapps, seconded by Commissioner Meyer and carried same was approved. T. S. Allen, 803 East Second Street, appeared to protest about!~.the debris remaining from the contrOl burn by the City Fire Department of a building located in the immediate area. and on motion of Commissioner Stenstrom, seconded by Commissioner Crapps and carried, the City Manager was authorized to contact the owner to expedite the cleanup work. James Neiswander, 2520 South Laurel Avenue, appeared to register a complaint re- garding trash blowing and lights shining on his property from the commercial operation of Whataburger, 2524 French Avenue, located to the rear of his residence, and requested that the commercial owner erect a fence to ease the problem. Commissioner Crapps moved that the City Manager and the Building Official investigate the matter and report same back to the City Commission. Seconded by Commissioner Meyer and carried. Mr. M. Sivlerman, representing owner and developer Stephen Morrow & Associates, Orlando, submitted a plat for a residential subdivision development of $17,500 to $19,500 homes in Block 29, Dreamwold Fourth Section, and requested City participation in street con- struction of perimeter streets of Hartwell and Marshall Avenues; and the City Manager was authorized to work out cost figures and submit to the Commission for further consideration. Consideration given to street light petitions, signed by owners within the immedi- ate areas, and on recommendation of the City Manager, Commissioner Roberts moved to authorize the installation of 4,500 lumen street lights, as follows: 1. Elliott Avenue, north of Second Street - 3 lights 2. East llth Street, between Mellonville and Bay Avenues - i light 3. Myrtle Avenue, between 25th Street and Park Rrive - i light Laurel Avenue, between 25th Street and Park Drive - 3 lights Seconded by Commissioner Meyer and carried. Letter of resignation from the Sanford Industrial Commission, effective April l, 1971, from War~en E. Enowles, next considered, and on motion of Commissioner Roberts, seconde< by Commissioner Meyer and carried, same was accepted with regrets and the Commission extended appreciation for past services. After consideration, Commissioner Roberts moved to appoint Julian L. Stenstrom to the Sanford Industrial Commission to fill the unexpired term of Warren E. Knowles to July 1973, as recoCmended by the Industrial Commission. Commissioner Stenstrom took the Chairman' seat pro-rem and the motion was seconded by Mayor-Commissioner Moore and'carried by the unani- mous vote of the Commission. Eecommendations next submitted by the Central Examining Board on the adoption of MINUTES City Commission, Sanford, Florida March 22 at 8:00 P. M. 19 ?l ~current editions of codes, increases in board membership, and appointments to fill expiring terms. On motion.of Commissioner Meyer, seconded by Commissioner Crapps and carried over the dissenting vote of Commissioner Roberts, the matters of increasing the board membership and reappointments were tabled for further information from the Building Official, with considera- tion to appointments of qualified persons residing within the City limits and properly license~ On motion of Commissioner Meyer, seconded by Commissioner Roberts and carried, the City Attorney was authorized'to prepare the necessary ordinance for the adoption of current codes and-or revisions, as follows: (a) Southern Standard Building Code 1969 Edition with the 1970 revision. (b) Gas Code 1969 Edition with the 1970 revision. (c) Plumbing Code 1970 revision to the 1967 Edition. (d)Minimum Housing Code 1969 Edition. (e)Fire Prevention Code 1970 Edition. Request of Municipal Judge Roger L. Berry for approval to expend funds in the amount $25.00'to effect a notary public primarily for City Court proceedings, and on motion of Commis- sioner Roberts, seconded by Commissioner Meyer and carried, same was approved. On request of Municipal Judge Roger L. Berry, Commissioner Roberts moved to authorize the transfer of $300.00 from Contingency Account No. 8150, to Municipal Court Account No. 2190. Witness Fees. Seconded by Commissioner Meyer and carried. After consideration, Commissioner Crapps moved to approve transfer of funds, as' follows: 1. $385,00 from Contingency Account No. 8150, to Streets Account No. 4721, Building Repairs and Maintenance, for the conversion of an old airport building into an office for the street superintendent. $132.00'from Utility Surplus Account No. 9850, to Utility Administration Account No. 9112, Office Furniture and Fixtures, for purchase of a file cabinet for computer print-out records. Seconded by Commissioner Meyer and carried. Consideration given to tabulation of bids opened publicly at 2:00 P. M. on March 19, 1971, for paving of West Fifth Street, llth Street between Mellonville and Bay Avenues, and Fort Mellon Tennis Court; and bids on chain link fencing for Fort Mellon Tennis Court, in !accordance with Invitation to Bid published in the Sanford Herald on March 3, 1971, and .~arch 4, 1971, respectively. Seconded by Commissioner Meyer and carried. Consideration next given to salary reclassification for two employees, and on motion of Commissioner Crapps, seconded by Co~missioner Meyer and carried, same were approved as follows: Charles B. On motion of Commissioner Roberts, seconded by Commissioner Stenstrom and carried, minutes of March 8, 1971, were approved. The City Manager reported the sixty-nine applications received for the position of City Engineer had been screened to ten applicants for interviews, and on motion of Commissione: Meyer, seconded by Commissioner Crapps and carried, the City Manager was authorized to expend the necessary travel funds from Engineering Account No. 5001, Engineer's Salary, to bring the final applicants in for interviews. Recommendation submitted for a Sanford Airport Dedication Day in April, 1972, with the appearance of the Blue AngEls Precision Flying Team~ and after discussion, Commissioner Stenstrom moved to approach the Greater Sanford Chamber of Commerce regarding the possibility of their promoting said function~ With the City underwriting the cost, if deemed feasible; and the City reimbursed from any income that may be derived; and further, that the Chamber's recommendation be submitted to the Commission for further consideration. Seconded by Commis- sioner Meyer and carried~ After consideration, Commissioner Roberts moved to approve the request of the City Manager to do occasional teaching in Political Science at the Florida Technological University insofar as City ~ime permits. Seconded by Commissioner Meyer and carried. Request next submitted for transfer of funds in the amount of $210.00 from Engineer- ing Account No. 5012, Furniture, Fixtures and Office Equipment, to Street Department Account No. ~721, Buildin~ Repairs and Maintenance, for an air conditioning-heating unit for the new office of the street superintendent; and on motion of Commissioner Meyer, seconded by Commis- sioner Crapps and carried, same was approved. After consideration, Commissioner Meyer moved that the national holiday of Memorial Day, Sunday, May 30th, be observed by closing of the City Hall on Monday, May 31, 1971. Seconded by Commissioner Crapps and carried. Gerald Dake Associates, Jacksonville, next submitted a proposed contract in the amound of $3,500.00 for the revision of the City's zoning regulations, and on motion of Com- missioner Crapps and carried, same was tabled. Seconded by Commissioner Stenstrom and'carried. After consideration, Commissioner Roberts moved to approve the transfer of $100.00 from Contingency Account No. 8150,:to City Manager Account No. 12~8, Purchasing Department 3upplies, to cover purchase of needed forms for the pn~chasing agent. Seconded by Commissione~ 3tenstrom and carried. On motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, the Jity Manager was authorized to send a letter to the Sanford Taxpayers Association commending their coordinated, efforts with local school children and citizens for the tasteful paintings 0eing done~on the construction fence of the Seminole County Courthouse.
