City Commission, Sanford, Florida June 14 at 8:00 P.M. 19 71 The city Commission of the city of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on June 14, 1971. Present: Mayor-Commissioner Lee P. Moore Commissioner James H. Crapps Commissioner Gordon T. Meyer Commissioner W. Vincent Roberts Commissioner Julian L. Stenstrom City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles Deputy Clerk Rosa M. Rotundo Police Chief Ben E. Butler Absent: City Clerk H. N. Tamm, Jr. The meeting was called to order by the Chairman. Delbert Euga appeared to report that action of Western Union Company to close their Sanford office had been postponed indefinitely as a result of a public hearing before the Federal Communications Commission; and further, that U. S. Senator Gurney and U. S. Congress- man Chappell were lending support to keep the local office open. Gutmann, Dragash~and Matz, Architects, Inc., next appeared to review a space study for a security complex compiled by the firm in 1969 and submitted to the City Commission on May 4, 1970. Said study recommended 40,210 square feet of structure on a site of no less than two and one-half acres, and estimated construction costs of $28.00 per square foot. city Manager submitted a memorandum dated June 8, 1971, setting forth recommendations and information as follows: that the contemplated space be reduced in accordance with the construction budget as previously set by the City Commission; e a report be submitted from the selected architect regarding restrictive guides to keep costs under control; limits of space and budget be set forth by the Commission in order to eliminate overdesign 'and budget runover; 4. a list of architects interested in the project and indicating three firms with experience in such design; 5. site selection in order of priority: : a. SE corner of 25th Street and Mellonville Avenue on the a~port property be old experiment station site on East Celery Avenue at Summerlin AVenue · '- ;;.~ :.~ .. Ce SW corner of the airport on Onora Road just before the main entrance gate. The Commission also mentioned interest in sites on French Avenue at Ninth and at Fourth Street. After discussion, Commissioner Crapps moved to retain the professional services of the firm of GUtmann, Dragash and Matz, Architects, INC., to perform the architectural desig~ of the Security Complex-Jail, upon approval of a satisfactory professional contract. by Commissioner Roberts and carried. Seconded It was anticipated that preliminary design sketches for general~appearance would be available within thirty days for the Commission,s review. Said firm was informed of the action of the Commission of May 24, 1971, limiting the construction budget for the new security complex to a cost not to exceed $550,000.00. DOTII'm~OW OFFICE SUPPLY COMi~ANY ' The city Commission scheduled a work shop session for 12:00 Noon, June 23, 1971, to view and determine the site selection for the new security complex. After consideration, Commissioner Crapps moved to approve the assignment of the 99-year Lease of the Mayfair Country Club, from D. Michael Whelche!, d./b./a Mayfair Inn, Inc., to C. Howard McNulty, John E. Pierce and George E. Billups, d/b./a Mayfair Country Club of Sanford, Inc., and to authorize the Mayor and City Clerk to execute same. Seconded by Commis- sioner Roberts and carried. Commissioner Roberts next introduced Resolution No. 1101, and after being read in full, moved on its passage and adoption and to authorize the Mayor to execute same. Seconded by Commissioner Meyer and carried. Said Resolution No. 1101 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE ACCEPTANCE OF FEDERAL GRANT FOR SEWAGE TREATMENT WORKS UNDER 33 U.S.C. 466, ET SEQ.; DESIGNATING LEE P. MOORE, MAYOR OF THE.CITY OF SANFORD, AS THE AUTHORIZED REPRESENTATIVE TO ACCEPT SAID GRANT AND TO EXECUTE ALL DOCU- MENTS REQUIRED IN IMPLEMENTATION THEREOF. WHEREAS, the City of Sanford, Florida, has heretofore made application under the provisions of the Federal Water Pollution Control>Act, as amended, for a grant relating to the construction, extension and remodeling a secondary..wa~te water treatment plant, an offer of such grant having been received; and WHEREAS, the City Commission desires to' accept said offer and to designate Lee P. Moore, Mayor of the City of Sanford, as its authorized representative to execute such accept- ance and all other documents necessary to implement said grant and said program; NOW, THEREFORE, BE IT RESOLVED that the offer of federal grant for sewage treatment works hertofore received be and the same is hereby accepted; BE IT FURTHER RESOLVED that Lee P. Moore, Mayor of the city of Sanford, be and he is hereby directed and authorized to execute all documents in connection with said grant and specifically the acceptance of said offer as has heretofore been forwarded to the City of Sanford by Environmental Protection Agency. M. .19 71 After discussion and On motion of commi~si0ner MeYer, seconded by CommiSsioner CrapPs and carried, a public hearing was authOrized to be held on June 28, 1971, and 'the clerk authorized to advertize same; and further, indiVidual notices with regards to the proposed rezoning and public hearing were authorized to be mailed to owners of property within 300 feet of said lands Lease proposal next submitted by Modern Air, Inc., to utilize approximately 8,000 square feet of terminal space at the Sanford AirPort for charter plane services. Don Rathel, representative of Page Airways, Fixed BaSe Operator, appeared to object to the proposal as submitted. Commissioner Roberts moved that the request be tabled until the next City Commis- sion meeting to permit the two companies to get together to discuss certain lease aspects. Seconded by Commissioner Crapps and carried. Robert Cox, d/b/a Eleanor Cox Fabrics, Sanford Plaza, appeared to 'request waiver of the requirement of paying license fee for going out-of-business sale as set forth in Ordinance No. 927, and after consideration, Commissioner Roberts moved to approve said request. Seconded by Commissioner Meyer and carried over the dissenting vote of Mayor Moore. After consideration, Commissioner ROberts mowed to authorize Page Airways, Fixed Base Operator, to sublease buildings on the airport, as follows: (a)Building 297, terminal building~ to Real-Aire, Inc., 300 square feet at $100.00 per month. (b) Building 147, to Orlando Aero Club, Inc./Real Aire, Inc., 7,200 square feet at 60¢ a square foot per annum or $4,320.00 annually. and to authorize the Mayor to execute same. Seconded by Commissioner Stenstrom and carried. David L. Heffelfinger, president of Florida Urban Development Corporation, appeared to request the CitY to participate in one-half of the costs of paving a portion of Chase Avenue and Lake Avenue south of 24th Street. Mr. Heffelfinger stated he planned to construct six homes on south side of West 24th Street abutting said streets and referred to the subdivision Ordinance No. 987 requiring the developer to pave the streets. After lengthy discussion, Commissioner Stenstrom moved to authorize the City Attorney to prepare an ordinance to amend Ordinance No. 987, Subdivision Regulations, Section 310, Required Publi~ and Other Improvements, as follows: Subdivision regulations do not apply except to land newly platted by the owner or the subdivider. Seconded by Commissioner Meyer and carried over the dissenting votes of Mayor Moore and Com- missioner Roberts. AppliCation next submitted for a transfer of license for sale of beer and wine for consumption On the Premises at 2601 Park Drive, from John and Betty L. Stubbs, d/b/a Green Door Tavern, to Willis D. Wright, and on recommendation of the Chief of Police, Commissioner Roberts moved to approve same. Seconded by Commissioner Meyer and carried. After discussion, and on recommendation of the City Manager, Commissioner Meyer moved to approve two pay programs for the police personnel, as follows: 1. Effective June 15, 1971: Police officers to be compensated for court appearances at the rate of $3.00 per case. 19 71 MINUTES City Commission, Sanford, Florida June 14 at 8.-00 P. M. 407< DOq'~=rl~l~ow OFFICE SUPPLY COMPANY 2. Each Police officer on active law enforcement duty to be required to fire sidearms at intervals of 45 days or not to exceed 60 days. Failure to pass qualifications score of 50 will require extra training. For each period, an officer firing 81.2 up to 91.1 will receive $5.00, and~an officer fireing 91.2 or better will receive $10.00. Badges to be issued denoting rank of qualification. On failure to maintain the qualification rank, the officer must turn in the badge for the next lower qualification rank. Seconded by Commissioner Crapps and carried. Petitions next submitted for installation of street lights, and after consideration, Commissioner Crapps moved to authorize installation of 4,500 lumen lights, as follows: (a) One at West llth Street and Mangoustine Avenue (b) Two on Gale Place, Woodmere Park Subdivision. Seconded by Commissioner Meyer and carried. After Consideration, Commissioner Meyer moved to authorize the Gulf Life Insurance Company to increse the hospital room coverage from $25.00 per day to $30.oo per day under the city Group Hospitalization Plan, at an estimated cost of $871.92. Seconded by Commissioner Stenstrom and carried. After consideration, Commissioner Meyer moved to authorize the Mayor to execute an Agreement with the Seaboard Coastlaine Railroad COmpany for maintenance of a pipe i~alled under railroad tracks on east City limits line from Summerlin Avenue and Washington Oaks area. 3econded by Commissioner Stenstrom and carried. On recommendation of the city Manager, Commissioner Roberts moved that an attendance ~olicy be established relative to absenteeism from regular meetings by members appointed to City boards, as follows: If any member fails to attend three consecutive regular meetings of a board, commission, or committee without being excused by the chairman of said board, commission, or committee, that the chairman notify the City Manager, then notify the proper appointing authority so that the vacancy will be filled. Seconded by Commissioner Stenstrom and carried. The Commission requested that members of all city boards be so advised of said policy. After consideration and on motion of Commissioner Crapps, seconded by Commissioner Roberts and carried, a transfer of $8,580.00 was authorized from Fire Department Equipment Account No. 2326 to Public Projects Fund to provide for purchase and future delivery of a new fire truck. After consideration, Commissioner Crapps moved to authorize payment of $15,127.00 plus interest from Account No. 8186, Special Funds, Georgetown Paving Project, for note to United State Bank of Seminole due November 7, 1971, for engineering fees for proposed drainage and paving of streets in Public Improvement Projects Phases I and II (Georgetown Area). Seconded by Commissioner Roberts and carried. After discussion, Commissioner Roberts moved to authorize a public hearing to be held on June 28, 1971, and to authorize the City Clerk to advertise same, to consider closing, 408 MINUTES City Commission, Sanford, Florida June 14 at 8:00 P.M. 19 71 vacating, and abandoning that certain north-south alley easement on the east side of Sanford Avenue between 20th Street and Grandview Avenue deeded to the City by James E. Lee. on April 14 1971, and recorded in ORB 844, Page 23. Seconded by Commissioner Meyer and carried. Request next submitted by the Seminole County Tax Assessor for the Circ.,to adopt a resolution authorizing the assessment of all property within the City limits, and on motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried, the City Attorney was authorized to prepare same. After consideration, Commissioner Roberts moved to reappoint Dr. John F. Darby to the civil Service Board for a two-year term, from July 1, 1971, to June 30, 1973. Seconded by Commissioner Meyer and carried. Said Resolution No. 1100 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, EXPRESSING THE INTEREST OF THE CITY OF SANFORD IN PARTI- PATING IN THE"TOPICg' PROGRAM JOINTLY SPONSORED BY THE FLORIDA DEPARTMENT OF TRANSPORTATION AND THE FEDERAL HIGHWAY ADMINISTRATION. WHEREAS, the Florida Department of Transportation has outlined to the City of Sanford its jointly sponsored TOPICS Program pertaining to traffic operation Studies and other criteria deemed of importance t° the City of Sanford and offering said City an opportunity to partici- pate; and WHEREAS, the City Commission of ~the City of Sanford feels that participation in such program is of importance to the public; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida that the interest and participation in the TOPICS Program as jointly sponsored by the Florida Department of Transportation and the Federal Highway Administration be and the same is hereby expressed;and BE IT FURTHER RESOLVED that this Resolution be spread upon the minutes of the City Commission and copies hereof delivered to the appropriate agencies. Commissioner Roberts then moved on the waiver of the requirement of the second reading of .iOrdinance No. 1024, and that same~be placed on its final passage and adoption. Said Resolution No. 1102 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, REQUESTING THE DEPARTMENT OF TRANSPORTATION TO EXPAND ITS CONTEMPLATED TRAIN STUDY. WHEREAS, the growth of the State of Florida and especially 'the area of Florida ex- tending from Volusia County southwesterly through Pineilas County Willilnecessitate systems of transportation which move large numbers of people in the shortest time; and WHEREAS, the Department of Transportation is presently planning to award a contract for a "Train Study"; and, ~ ~: WHEREAS, grave traffic and safety problems in the areas of Volusia and Seminole Counties, Florida, and in all counties situated in the corridor above described, are presently existent and will materially increase in the future; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford that the Department of Transportation be and it is hereby requested to expand its contemplated T~ain Study presently planned, pertaining to a corridor from Tampa to Orlando, to include the remainder of the corridor from Orlando to 'Daytona Beach, so that ~the Study will present factors and information from~both a rail and bus standpoint as to the potential use of such program. Moore, Mayor After consideration, Commissioner Meyer moved to authorize payment in the amOunt of $121.71 from Utility Administration Miscellaneous Account No. 9109, for expenses incurred by the City to host the annual meeting of the Florida Water & Pollution Control Officers Associa- tion, Ninth Region. M. 19, 71 DOT~*.]KOW OFFICE SuFPLY COMPANY I After discussion, Commissioner Stenstrom moved that all City CommissiOn meetings, including Workshop Sessions, be held in the City Commission Room with the door open. Seconded by Commissioner Meyer, with an addendum that all meetings be held at the City Hall in the City Commission Room. Motion failed to carry over the dissenting votes of Commissioner Crapps, Commissioner Roberts and Mayor Moore, Commissioner Meyer stated he had received a request in behalf of the Board of Trustees of the Seminole Zoological Society to waive'the standard fee of $250 00 for use of the Civic Center with alcoholic beverage privileges around July 1, 1971, for a kickoff fund raising dance and after discussion moved to approve same. for the proposed relocation of the Zoo,./ Seconded by Commissioner Stenstrom and carried over the dissenting votes of Commissioner Crapps and Commis~oner Roberts.
