The first.item of business was a.Public Hearing to consider an amendment in certain districts and boundaries of the Zoning Ordinance in accordance with notice published in the Sanford Herald on June 8, 1971, as~follows: . NOTICE OF PUBBIC!!~HEARING OF PROPOSED CHANGESAND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on June 28, 1971, to con- sider changes .and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property lying westerly of State Road 15 and 600 and abutting Onora Road is pro- posed to be zoned R-3 (Multiple F~mily Dwelling) District. Said property being more particu- larly described as follows: Alt.that part of the following described property lying North of Onora- Grapeville Road Extension: Begin at SE corner of Section 2, Township 20 South, Range 30 East, run N 0 deg 09'02" West along East line of/said. On motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, the City AttoDney was authorized to prepare an ordinance to rezone the property as described in the aforesaid notice oflpublic hearing. On motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, Ordi- nance No. 1025, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD,~ FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICT AS DELINEATED BELOW. was introduced and placed on its first reading aa d read in full. The next order of business was a public Hearing to consider a recommendation of the Zoning and Planning Commission to deny a request on changes and amendments in certain districts and boundaries of the Zoning Ordinance and in accordance with notice published in the Sanford Herald on June 18, 1971, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on June 28, 1971, to con- sider changes, and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: ~ That property on the east side of Park Avenue between 24th Street and 25th Street is proposed to be rezoned from R-3 (Multiple Family Dwelling) District~to C-l'-.(Neighborhood Commercial) District. Said property being more particularly described as follows:' The South 18 feet of Lot 38, and Lots 39, 40, 41, and 42, Pine Heights, Plat Book 3, Page 51, Public Records of Seminole County, Florida. All parties in interest and citizens shall have an opportunity to be heard at said hearing. - By order of the City Commission of the City of Sanford, Florida, this 14th day of June, 1971. Rosa M. Rotundo Deputy City Clerk of the City of Sanford, Florida The Chairman announced that the Commission would hear from anyone in favor of, or against, the proposed rezoning as described in the foregoing notice. Herbert E. Stenstrom, Realtor, spoke in behalf of the rezoning and stated the pro- posed use of the site would be for the erection of retail specialty shops and professional offices'. Martin Stinechiper, 2404 Park Avenue, appeared and offered no objection as long as the type of building and utilization as outlined did not change. 416 MINUTES CitY Commission, Sanford, Florida June; 28 at 8: O0 ?. M 19 71 Commissioner Crapps stated that Judge Miller and Mrs. Kratzert, abutting property owners, were in accord with statement made by Mr. Stinechiper; however, they desired the alley abutting said property to be paved. After discussion, Commissioner Meyer moved to authD~ize the C~y Attorney to prepare an ordinance to rezone the property as described in the aforesaid notice of public hearing. Seconded by Commissioner Crapps and carried, with Commissioner Stenstrom abstaining from vote. The Commis~ on affirmed that any work or costs involved in paving of the alley would not be the City's responsibility. M. on June 28, 1971, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property on the east side of Oak Avenue between 23rd Street and 24th Street is pro~sed to be rezoned from R-lA (One Family Dwelling) District to R-3 (Multiple Family Dwel- ling) District. Said property being more particularly described as follows: Lots 1, 3, and 5, Lanes Addition, Amended Plat. All parties in interest and citizens shall have an opportunity to be heard at said hearing. A. A. McClanahan, associated with C. A. Whiddon, Sr., Realtor, spoke in behalf of the rezoning and outlined that these three lots and three other lots already zoned R-3 would be the site for a two-story, 20-22 apartment unit complex with a swimming~po~l. Objections were registered by abutting property owners, as follows: John Sheppard, 2209 Oak Avenue Joseph C. Spa~'~ding, 2307 Oak Avenue, also representing Jean H. Jacoby, 2400 Oak Avenue Austin Knight, 2203 Oak Avenue . After consideration, Commissioner Meyer moved to deny the. requested rezoning. Seconded by Commissioner Stenstrom and carried. The next order of business was a Public Hearing to consider closing, vacating and abandoning an alley in accordance with notice published in the Sanford Herald on June 18, 1971, as follows: NOTICE OF PROCEEDING FOR VACATING AND CLOSING AN ALLEY TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on June 28, 1971, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to that certain north-south alley, being more particularly described, as follows: The East twelve (12) feet of the West 167 feet of Lot 44, Rose Court according to the plat thereof as recorded in Plat Book 3, Pages 3 through 5 of the Public Records of Seminole County, Florida, and the East twelve (12) feet of the lot described as beginning 984 feet South and 25 feet East of the Northwest corner of the Southwest ¼ of Section 31, Township 19 South, Range 31 East, run East 167 feet, South 86 feet, West 167 feet, North 86 feet to the point of beginning. There being no objections registered, Commissioner Meyer moved to close, vacate and abandon the alley as advertised and to authorize the City Attorney to prepare an ordinance per- taining to same. Seconded by Commissioner Stenstrom and carried. Request next submitted from Gary Martin, representative of_Tom Ellis, Inc., real estate broker, Winter Park, to purchase 14~;12~ acres~of City.owned property located on French Avenue and .Seminole Boulevard, and presently designated as a site for relocation of the municip~ zoo. After discussion, on motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, same was tabled subject to the~,Commission finalizing the zoo relocation question in conjunction with the adoption of the 1971-72 Budget. ~.~Seconded by Commissioner Crapps and carrie( Contract for the design of the Police Security Complex/Jail was submitted by Gutmann, Dragash and Matz, Inc., ArchitectS, and on motion of Commissioner Crapps, seconded.by Commission~ Stenstrom and carried, same was tabled to permit the City Manager or the architects to be presen~ to answer certain technical questions pertaining to same. Consideration next given to a request submitted at meeting of June 14, 1971, by David L. Heffelf&nger, President of Florida Urban Development Corporation, for the City to participat'e in the paving costs for construction of six homes on platted property south of 24th Street, abutting Chase and Lake Avenues, and citing subdivision regulations that paving of said streets would be required. After consideration, Commissioner Meyer moved that in this particular case a variance be granted for the requirement of street paving only. Seconded by Commissioner Stenstrom and carried. Recommendation of the Zoning and Planning Commission that the City Commission approve a contract with the firm of Gerald L. Dake Associates, Jacksonville, City Planner, for the preparation of a new city of Sanford Zoning Ordinance at a fee not to exceed $3,500,00, next considered, and on motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried same was tabled until the next Commission meeting. . Recommendation next submitted by the Zoning and Planning Commission to rezone Lots 1, 2, and 3, Block 13, Dreamwold 3rd Section, from R-lA (Single Family Dwelling) ,District to R-3 (Multiple Family Dwelling) District, and on motion of Commissioner Meyer, seconded by Commis- sioner Stenstrom and carried, a public hearing was authorized to be held on July 12, 1971, and the City Clerk was authorized to advertise same. Petition next submitted by Terry K. Alverson, president of Christian Benevolent Foundation of Florida, Inc., for annexation of 18.261 acres lying west of US 17-92 on the north side of Onora Road Extension (Sec. 2, T 20S, R 30E), and on motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, same was approved. On mo~ on of Commissioner Meyer, seconded by Commissioner Crapps and carried, Ordinance No. 1026, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. was,introduced and placed on its first reading and read in full. On recommendation of the City Manager, Commissioner Crapps moved to approve a salary reclassification, as follows: Dianne J. Smith, Finance Department From: clerk-typist C - $4,155.00, annually To: Clerk-typist D - $4,465.00, annually Seconded by Commissioner Meyer and carried. After consideration and on motion of Commissioner Crapps, seconded by Commissioner Meyer and carried, a transfer of $456.00 was authorized from Contingency Account No. 8150, to Finance Department-Office Equipment Account No. 1412, to provide for a replacement of a long carriage electric typewriter. OFFICE SUPPLY COMPANY MINUTES City Commission, Sanford, Florida June 28 at 8:00 P. M. _19 71 On recommendation of the City Manager .and department supervisors, Commissioner Crapps moved to authorize a salary advance in the amount of $200.0Q. to Danny B. Martin, Maintenance Division, repayable at $30.00 per week salary deduction. carried. .Seconded by Commissioner Meyer and On motion of Commissioner Crapps, seconded by Commis:sioner Meyer and c:arried, minutes of June 9, June 14, and June 24, 1971, were- approved. On motion of Commissioner Crapps, seconded by Commissioner Meyer and carried, the Mayor, City Attorney, and City Clerk were authorized to enter the City's safe deposit box at the Sanford Atlantic National Bank to remove matured certificates. Application next submitted by Fairway Market at Sanford, Inc., for a license for the sale of beer and wine for consumption off premises at Orlando Drive and DeSoto Drive, and on recommendation of the Chief of Police and on motion of Commissioner Crapps, seconded by Commis- sioner Meyer and carried, same was approved. Request submitted by James Jenkins, treasure~of Citrus Belt Builders, Inc., 106 West Commercial Street, Sanford, for an exemption of the license fee for a General Contractor, due to a disability; and after discussion, the City Commission declined consideration of same until such time that petitioner submits a Certificate of Competency.
