M. on August 9, 1971. Present: Mayor-Commissioner Lee P. Moore Commissioner James H. Crapps Commissioner Gordon T. Meyer Commissioner W. Vincent Roberts Commissioner Julian L. The first item of business was a Public Hearing to consider an amendment in certain districts and boundaries of the Zoning Ordinance ~n accordance with notice published in the Sanford Herald on July 29, 1971, as follows: NOTICE OF PWBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTIAN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on August 9, 1971, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: mercial) District. That property lying east of State Road 600 (Highway 17-92) and south of Onora Road is proposed to be rezoned from R-1AA (One Family Dwelling) District to C-1 (Neighborhood Com- Said property being more particularly described, as follows: The West 230.34 feet of the East 339.64 feet of Lots 38, 39, and 40 (less the South 56.3 feet and road), Amended Plat Druid Park. There being no objections registered, and after consideration, Commissioner Crapps moved to authorize the City Attorney to prepare an ordinance to rezone the property as de- scribed in the aforesaid notice of public hearing. Seconded by Co~anissioner Meyer and carried. Next order of business was a Public Hearing to consider closing, vacating and aban- doning a utility easement in accordance with notice published in tbm Sanford Herald on July 22, 1971, as fo'llows: TO WHOM IT MAY CONCERN: NOTICE OF PROCEEDING FOR VACATING AND CLOSING AN;EASEMENT 440 MINUTES City Commission, Sanford, Florida August 9 at 8:00 P. M. 19 71 8:00 o'clock P. M. on August 9, 1971, in. the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City'will close, vacate and abandon any right of the City and public in and to that certain east-west public utilities easement retained in vacated East Street between Cypress Avenue and Pine Avenue. Said ease- ment being more particularly described as follows: Seven (7) feet on either side of the center line of vacated East Street from the east right of way line of Cypress Avenue to the west right of way line of Pine Avenue. There being no objections registered, Commissioner Meyer moved to authorize the City Attorney to prepare an ordinance to close, vacate and abandon the East 150 feet of the.ease- ment in exchange. Seconded by Commissioner Stenstrom and carried. The next order of business was a Public Hearing to consider the condemnation of thirty-three structures on Reports Nos. 71-326 through 71-358, Group 18, 'in accordance with notice authorized by the City Commission at regular meeting of July 12, 1971. Seconded by Commissioner Stenstrom and carried. Captain Charles Donald Knight, Commander, Seminole County Composite Squadron, Civil Air Patrol, and approximately twenty-five persons appeared to discuss the action of the City Commission taken on July 26, 1971, for the CAP to vacate Building No. 17 located on the Sanford Airport. The Chairman referred to a letter from Captain Knight dated March 20, 1971, in which he presented a schedule of repairs and maintenance of the building and regulations for CAP per- 442 MINUTES ..... Mrs. Dorothy Waller, R. N. West, Jr., and Mr. Duggan, ..recommended the CAP be per- mitted to keep Building 17 or possibly another smaller building requiring less maintenance After discussion, Commissioner Roberts moved to recind the acti°n of the City Com- mission on July 26, 1971, directing the Civil Air Patrol to vacate Building 17; and further, to permit the CAP a sixty-day period to allow the CAP executives to work out with the Airport Manager a repair program on Building 17, o~ if more feasible, to relocate in another building on the airport. Seconded by Commissioner Stenstr°m and carried. Philip Zeuli, ~Developer, appeared to present a. proposed Park and lake plan, with a request to remove approximately 7,500 yards of fill dirt from park area south of 25th Street between Marshall and Hartwell Avenues, to be used in the Lake Jennie Highlands project. Com- missioner Stenstrom moved to table the request until receipt of the soil probings report on this site for a proposed police security complex. Seconded by Commissioner Meyer and carried. After consideration, Commissioner Meyer moved to adopt a resolution to authorize the Mayor and City Clerk to execute a Maintenance Agreement with the Seaboard Coast Line Railroad Company for a 6-inCh cast iron sewer main across the right-of-way at Smith Avenue. Seconded by Commissioner Sten.strom and carried. Request next submitted from Garnett White, Realtor, for the Commission to sell three small parcels of land used for test well s~tes, ~loCated on' the O1d Lake Mary Road, total area approximately one-third acre of land. On motion of Commissioner Meyer, seconded by Commissior~ Stenstrom and carried, the City Clerk was authorized to obtain two statements of the fair mar- ket selling price; and fUrther, that costs of ~same be added to the selling price. Petition next submitted for two street lights, and after~ consideration, Commissioner Roberts moved to approve the installation of two 4,500 lumen street lights on E1 Capitan Drive, one at Santa Barbara and one 330 feet north. Seconded by Commissioner Meyer and carried. Consideration given to a request of the Airport Manager for the installation of thirteen 4,500 lumen street lights at the Sanford Airport, and on motion of Commissioner Crapps, seconded by Commissioner Roberts and carried, same was approved. The City Manager next submitted the estimated costs of $2,571.92 for repairs to railroad siding at the Sanford Airport, and after consideration, Commissioner Meyer moved to authorize same. Seconded by Commissioner Stenstrom and carried. Offer next submitted from Florida Power and Light Company to sell a 1960 Ford pole cat construction type truck with hydraulic equipment, with valuation of $4,500.00 to $5,000.00, and on motion of Commissioner Meyer, seconded by Commissioner Crapps and carried, the City Manager was authorized to negotiate a. purchase of same. On motion of Commissioner Crapps, seconded by Commissioner Meyer and carried, Ordi- nance No. 1032, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEINGA ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID 'AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICT AS DELINEATED BELOW. was introduced and placed on its first reading and read in full. Commissioner Crapps then moved on the waiver of the requirement of the second reading of Ordinance No. 1032, and that same be placed on its final passage and adoption. Seconded by Commissioner Meyer. On motion of Commissioner ROberts, seconded by Commissioner Cr:apps and carried, minutes of July 26, 1971, were approved. Florida League of Cities, Inc., next requested an ad for the October Annual Convention Issue of the Florida Municipal Record magazine, and on motion of Commis. si oner Roberts, sec6nded by Commissioner Crapps and carried, same was denied. RequeSt next submitted to Utilize an area of 31.82 acres on the sanford Airport for rent or lease of 50-foot trailer units, and after 6onsideratiOn, Commissioner Roberts moved to deny same. Seconded by Commissioner Crapps and carried. On motion of Commissioner Crapps, seconded by Commissioner Stenstrom and carried, pay- ment was authorized to the Seminole County Tax Assessor in the amount of $4,416.37 for the assessment and preparation of the 1970 tax roll. After consideration and on recommendation of the City Manager, Commissioner Meyer moved to authorize the preparation of bid invitations and to advertise for bids for the con- struction of a Secondary Sewage Treatment Plant. Seconded by Commissioner Crapps and carried. After consideration, Commissioner Meyer moved to authorize the purchase of a new General Electric radio unit from Miller Radio Company, Sanford, at a cost of $850.00 for re- placement in a motorcycle vehicle in the police department. Seconded by Commissioner Roberts and carried. Request next submitted from Doris Williams for a zoning variance for a pet grooming shop at 1915 South French Avenue, in a C-1 (Neighborhood Commercial) District. After dis- cussion, Co~missioner Meyer moved to approve the request, subject to regulations as set forth by the Board of Adjustment on August 31, 1970, in granting such variance to Campbell's Poodle Pad On West. 27th Street, as follows: 1. No an'imals to be housed or boarded overnight. 2. Ail services and activities to be conduCted within the building, with no yard use permitted. 3.Compliance with all sanitary and governing regulations currently in effect by the County Sanitarian. 446 MINUTES City Commission, Sanford, Florida August.9 at 8:00 P. M. The City Attorney submitted an Agreement for a public park maintained by the City and located on property of Michael J. Paulucci at corner of First Street and Sanford Avenue, and after consideration, Commissioner Meyer moved to authorize the Mayor and City Clerk to exeucute same.
