M. on September 13, 1971. Present: Mayor-Commissioner Lee P. Moore Commissioner Gordon T. Meyer Commissioner W. Vincent Roberts Commissioner Julian L. Stenstrom City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler Absent: Commissioner James H. Crapps The meeting was called to order by the Chairman. Sam Cowen and Cederholm of Corps of Engineers appeared to submit a Flood Plain Report. on Lake Monroe, as requested by the City two years ago. The next order of business was Public Hearings to consider amendments in certain ' districts and boundaries of the Zoning Ordinance in accordance with notice published in the Sanford Herald on September 1, 1971, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND 'AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on September 13, 1971, to consider changes and amendments to the Zoning Ordinance of the City of.Sanford, Florida, as follows: hearing. (a) That prDperty lying west of ~ohawk Avenue and between Santa Barbara Drive and Osceola DriVe is proposed to be rezoned from R-1AA (Single Family Dwelling) District to R-lA (Single Family Dwelling) District. Said property being more particularly described, as follows: Lots 5, 6 and 7, Block 24, Dreamwold. (b) That property lying south of Eighteenth Street and Between Peach Avenue and Strawberry Avenue is proposed to be rezoned from R-1AA. (Single Family Dwelling) District to R-5 (One and Two Family Dwelling) District. Said property being more particularly described, as follows: Lots 8 and 9, Block 8, Pine Level. M.19__ 71 After consideration, Commissioner Meyer moved to authorize the City Attorney to pre- pare an ordinance to rezone the properties as described in the aforesaid notice of public hearing. Seconded by Commissioner Stenstrom and carried. J. Brailey Odham, Developer, appeared to present a proposed plat plan of 140 acres for a Planned Unit Development for patio type apartments, with recreational facilities and commercial establsihments at the southeast corner of Sanford Avenue and Onora Road. The develop ment of the first 100 acres to start December 1, 1971, and requested annexation of property described as follows: The North ½ of the NW~ of Section 7, Townhsip 20 South, Range 31 East, lying West of the Seaboard Coast Line Railroad Right of Way, (less the North 430.5 feet of the South 600 feet of the West 300 feet thereof, and less Rights of way for Public Roads.) And also the North 629 feet of the South ~ of the NW~~ of Section 7, Township 20 South, Range 31 East, lying West of the Right of Way of Mellonville Avenue, (less the Right of Way of the Seaboard Coast Line Railroad, and less Rights df way for Public Roads.) After consideration, Commissioner Roberts moved to authorize the City Attorney to prepare an ordinance for the annexation of said property upon proper certification by the County Tax Assessor, and further, that the developer will bear all costs of the project and will con- form to PUD zoning. Seconded by Commissioner Stenstrom and carried. Billy R. Meeks, 133 Hays Drive, spokesman for a group of residents of Country Club Manor, appeared regarding the past flooding of an open drainage ditch east of said subdivision, and the fear of compounding the problem due to the construction of 54 homes in the subdivision "Twenty West" on the east side of the ditch. The City Manager reported that the engineering and construction of the drainage was performed when the subdivision was outside the city and any temporary solution would only shift 'the problem to the north and that the ultimate solution would be to implement the 3.2 million dollar city-wide drainage plan as recommended by the engineers. Consideration was given to a special city election for a'bond issue to finance the project, and after discuSsion, the Commission proposed a special workshop session to further consider same. Ruthia M. Riggins, Executive Secretary, Seminole Joint Tenant CoUncil, appeared to recommend that the HUD be requested to release the $60,000.00 reserve funds of the Sanford Housing Authority to purchase new appliances to replace the worn out and hazardous equipment. Dr. George William "Bill" Edwards, President of the Seminole Zoological Society, appeared to request the following': 1. City contribute approximately $'27,000.00 of funds designated for zoo relocation. 2. City contribute.to the Seminole Zoological Society the total proceeds of the sale of approximately 14 acres located on French Avenue and Seminole Boulevard, area which was designated as a site for the re- location of the present zoo. 3.CitY contribute the present collection of zoo animals to the gooligical Society upon construction and completion of a new zoo site. 4. City to continue to operate the present zoo until the new zoo site is ready for the relocation move. MINUTES City Commission, Sanford, Florida September 13 at 8:00 P. M~9. 71 457 l~OTttmt~OW OFFICE SUPPLY COMPANY Dr. Edwards requested a letter of commitment of the above to support the Society's fund raising drive. After consideration, Commissioner Meyer moved to authorize the City Manager to write a letter, with the approval of the City Attorney as to the language, stating that the City Com- mission generally agrees with Items 1, 3 and 4. Seconded by Commissioner Roberts and carried. D. M. Whelchel appeared to request the City consider annexation of 14 acres of prop'- erty owned by him and located on the north side of Country Club Road and abutting the Tee N' Green subdivision on the west. He proposed to construct multiple family dwelling units thereon with initial construction of one $85,000.00 nine family dwelling unit. David Klingensmith, 148 Upsala Road, res~ent of Tee N'Green subdivision, requested information on cost of city services that would be provided and when they could be expected if residents of Tee N' Green Subdivision should agree to sign annexation petitions. The City Manager recommended that con- sideration be given to future annexation of areas in a more orderly pattern in order to provide services to the areas at a minimum cost, as numerous requests are creating a haphazardous pat- tern of growth, and possibly same should be presented to the Zoning and Planning Commission for consideration and recommendations. The Commission authorized the City Manager to provide a study regarding cost and availability of services to the area. After discussion, Commissio~::Meyer moved to authorize the City Manager to obtain proposals for furnishing data processing services to the City. ~:Sedonded by Commissioner Stenstrom and carried. On motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried, the tenure of office for the members of the Sanford Airport Authority appointed August 23, 1971, were established to be effective on October 1, 1971, as follows: W. Conklin, member of the Zoning and Planning Commission, and after consideration, and on motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, said resignation was accepted and Phillip H. Logan appointed as a replacement to serve on said board. Notice next submitted from Mrs. Eula McClelland, lessee of the zoo concession, that as of September 30, 1971, she would no longer operate same. Mrs. McClelland has operated the concession for twenty-six years and desires to retire. Mayor Moore requested Mrs. Ruth Swinney, President of SISTERS, to consider said operation. Mrs. Swinney stated that the SISTERS were not interested, but that the offer would be presented to the Seminole Zoological Society for consideration. Letter next submitted from Ida B. Seconded by Commissioner Stenstrom and carried. Request next submitted from Betty Creech, 720 South Park Avenue, for an exempt peddler license due to being a disabled veteran, and after discussion, same was tabled until the next regular meeting for a clarification of the law providing for same. Application next. submitted by Joe Bryant for a duplicate of Tax Certificate No. 61, dated May 31, 1968, which was destroyed, and after consideration, Commissioner Meyer moved to authorize the City Clerk to execute same.. Seconded by Commissioner Stenstrom and carried. Consideration next given to a request tabled at last meeting for the installation of STOP signs throughout the Goldsboro and Georgetown areas, and after discussion, Commissioner Roberts moved to table same for consideration of a complete study of the needs throughout the City. Seconded by Commissioner Stenstrom and carried. Commissioner Roberts next introduced Resolution No. 1103, and after being read in full moved on its passage and adoption. Seconded by Commissioner Meyer and carried. Said Resolution No. 1103 being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA., APPROPRIATING UNEXPENDED CASH SURPLUS ON HAND AT THE END OF THE FISCAL YEAR 1970-71 TO THE DEPARTMENT OF GENERAL GOVERNMNENT OF SAID CITY FOR THE FISCAL YEAR 1971-72 FOR USE OF ORDINA.RY)~ PURPOSES IN OPERA.TING EXPENSES OF SAID CITY. WHEREAS, the City Commission of the City of Sanford, Florida, deems it necessary, expedient and for the best interest of said City that any unexpended cash surplus as of Septem- ber 30, 1971, of the operating revenues of said City for the fiscal year 1970-1971 be appro- priated for the ordinary purposes and operating expenses of said City in the budget for the fiscal year 1971-1972. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that any unexpended cash surplus as of September 30, 1971, of operating revenues of said City for fiscal year 1970-1971 be and the same is hereby appropriated to the Department_of General Government of said City for the ordinary purposes and operating expenses of said City for the fiscal year 1971-1972, and said cash surplus shall be incorporated in the budget of revenues and expenditures of said City for said fiscal year 1971-1972 for the ordinary purposes and operating expenses of said City. WHEREAS, in accordance with Section 62 of the Charter of the City of Sanford, Florida, the City Manager of the City of Sanford, Florida, has made and submitted to the City Commission of the City of Sanford, Florida, an estimate for budget of revenues and expenditures of the City of Sanford, Florida, for the fiscal year.beginning October 1, 1971 and ending :September 30, 1972 such estimates or budget having been made with particular application to the'various departments of the City, a true copY of which is hereto attached and by reference made a part of this Resolution; and WHEREAS, each and every item contained and set forth in said budget prepared by the City Manager has been carefully considered bY this Commission, NOW, THEREFORE, BE IT RESOLVED-by the City Commission of the City of Saffi~rd, Florida, that. said budget as prepared and submitted by the City Manager to the City Commission be and the same is hereby adopted as the budget of the City of Sanford, Florida, for the'fisca1 year be- ginning October 1, 1971, and ending September 30, 1972. BE IT FURTHER RESOLVED that upon collection of any revenues of said City, the City ]lerk shall allocate from each dollar collected and received, the several amounts to the re- spective funds for purposes for which the same~ are hereby authorized and appropriated.
