The City Commission of the City of Sanford, Florida, met in regular session at the
City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on November 22, 1971.

The meeting was called to order by the Chairman.
Commissioner Roberts moved to appoint Commissioner Cmapps as the Acting Mayor during
the absence of the Mayor. Seconded by Commissioner Stenstrom and carried.
The first order of business was a Public Hearing to consider amendments in certain
districts and boundaries of the Zoning Ordinance ~n accordance with notice published in the
Sanford Herald on November 11, 1971, as follows:
NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND
AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF
THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA.
Notice is hereby given that a Public Hearing will be held at. the Commission Room
in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on Novanber 22, 1971,
to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida,
as follows:
That property lying between Sanford Avenue and Seaboard Coast Line Railroad track
and south of Onora Road is proposed to be zoned for a Planned Unit Development District. Said
property being more particularly described as?follows:
The North ~ of the NW~ of Section 7, Township 20 South, Range 31 East,
lying West of the Seabo~md Coast Line Railroad Right of Way, (less the
North 430.5 feet of the South 600 feet of the West 300 feet thereof,
and less Rights of Way for Public Roads.)
And also the North 629 feet of the South ~ of the NW~ of Section 7,
Township 20 South, Range 31 East, lying West of the Right of Way of
Mellonville Avenue, (less the Right of Way of the Seaboard Coast Line
Railroad, and less Rights of Way for Public Roads.)
Ail parties in interest and citizens shall have an opportunity to be heard at said
hearing.

against, the-proposed rezoning and development as described in the foregoing notice.

No objections were registered. J. Bm~iley Odham, Developer, appeared to present a
First Phase land use plan for a Planned Unit Development (PUD) consisting of 150 town houses,
150 pati° type houses, and 150 single family~residences on an area of 50 acres or 111 platted
lots.
After discussion, Commissioner Meyer moved to authorize the City Attorney to prepare
an ordinance for rezoning the property as described in the aforesaid notice of public hearing.
Seconded by Commissioner Roberts and carried.
Mr. Odham further stated the plans were for an open drainage ditch of 1,800 to 2,400
feet in a 50-foot easement with r.unoff to the east on H. L. Hunt property, which the owners have
authorized, with the ultimate flow to the south; and costs for requirements for piping of the
ditch would be at $70.00 per foot for 66-inch pipe, running in the neighborhood of a total cost
of $125,000.00 to $250,000.00 and woUld make the feasibility of the development uneconomical.
Other than piping, the City Engineer, Mack R. LaZenby, Offered ft~ther recommendations
of tiling and/or paving the open ditch; that there be some concrete block wall and some chain
link fencing as a safety measure for view by parents of small children; large gates in the fence
for access of ditch cleaning equipment; and the ditch be off-set to permit a ditch cleaner only
on a one-sided ditch or easement of both sides.
The City Manager offered an opinion that the open ditch would be satisfactory with
the paving of the interceptor runoffs and felt that same had been previously worked out to a
satisfaction of all parties involved.
After lengthy discussion, Commissioner Meyer moved to authorize the City Manager,
City Engineer, the developer's engineer, and the County engineer to get together for a study on
open ditch situation and to bring back a solution for resolving same. Seconded by Commissioner
Roberts and carried.
Application for an exempt peddler's license to sell used clothing from a moving vehi-
cle next submitted by Stanley Curtis, Route 2, Box 200, Apopka, Florida, based on 70 years of
age and disability factor. Petitioner stated he had received exempt licenses from Orange and
Seminole County. After discussion, Commissioner Stenstrom moved to table same until December 13
1971, for the City Attorney to review the Florida Statutes regarding same. SecOnded by Commis-
sioner Roberts and carried.
Application next submitted Ky Edna Pearl Smith for transfer of location of permit for
sale of beer and Wine for consumption on premises, as evidenced by 1971-72 state and county
license No. 69174, d/b/a Silver Tip, fr°m 1400 West 13th Street to 1309 West 13th Street; and
after consideration, and on mee~endation of the Police Chief, Commissioner Meyer moved t°
authorize same. Seconded by Commissioner Roberts and carried.
John Capko, owner of Pig N' Whistle at Park Drive and 25th Street, next appeared to
support a letter submitted requesting an amendment to the alcoholic beverage ordinance to permit
the sale on Sunday of beer and wine with the sale of food at said establishment, and stated
this business had a seating capacity for 50 persons inside the building, with ai~total of 100,

Commissioner Meyer ma~ed to permit the sale of alCOholic beVerages, including beer
and wine, inside the premises only at establishments serving on-site prepared food and with a
seating capacity for 50 or more, from the hour of 2:00 P. M. on Sunday to the hour of 2:00 A. M.

On a request of the Commission for an opinion from the City Attorney as to the status
of the motion passing or nor passing on a tie vote, the City Attorney stated that the Commis-
sion had not adopted any Rules of Order and preferred to act under their own rules, which left
him at a loss to offer an opinion on the motion passing or not passing.
Letter submitted by Robert I. Marlowe, representing Carrie L. Smith, requesting an
extension of time to repair or demolish structure located at 615 Palmetto AvenUe, and ~overed
by Condemnation Report No. 71-328, Group 18, condemned on August 13, 1971. On motion of Com-
missioner Stenstrom and carried, an additional 90-day extension was granted.
Letter next submitted from Karl J. and Lois Y. Bierfreund, 418 Bay Avenue, owner of
the South 54 feet of Lot 6, BlOck C, Fellowship Addition, requesting the closing, vacating and
abandoning of the East Sixth Street abutting said property. After discussion, Commissioner
Roberts moved to authorize a public hearing to be held on December 13, 1971, to consider aban-
doning that portion of Sixth Street lying between the west right of way line of Bay Avenue and
the east right of w~y line of Orange Avenue, and to authorize the City Clerk to advertise same.
Seconded by Commissioner Meyer and carried.
Consideration next given to a check offered in amount of $1,165.18 from Jeannette E.
Laing, in full payment of liens filed in!1962 by the City for costs of demolition of certain
condemned structures. A~ter consideration, Commissioner Roberts moved to authorize the check
to be returned to Miss Laing with notification that both the principal of $1,165.18 and the
interest of $660.31 due in Nov~nber, 1971, are to be paid before the lien will be satisfied.
Seconded by Commissioner Stenstrom and carried. '~
Request next submitted by Herbert and Mattie L. Cherry for Lots 25, 26, 36 and 37,
Dixie, less north 50 feet of the east 140 feet of Lot 36, be designated as an area from which ar
annexation petition will be received; and after consideration, Commissioner Meyer moved to refer
same to the Zoning and Planning, Commission for study and recommendation. Seconded by Commis-
sioner Roberts and carried.
After consideration and on motion of Commissioner Meyer, seconded by Commissioner
Stenstrom and carried, the City Attorney was authorized to prepare a Resolution in cooperation
with a request from the Florida League of Cities, Inc., requesting the state legislature to
return fifty percent of the state corporate profits tax to the municipalities and counties;

and further, to postpone the enforcement of the 10 mill tax cap.
Requests to extend the mandatory retirement required for one year next received from
City employees, as follows:

Lowry Hugh Wynne, Truck Driver, Street Division, age 66.
After consideration:~of the recommendation for approval by respective division super-
intendents, department heads, and City Manager, Commissioner Roberts moved to approve the
requests. Seconded by Commissioner Meyer and carried.
Consideration next given to tabulation of bids opened publicly at 2:00 P. M. on
November 19, 1971, for furnishing gasoline and diesel fuel in accordance with Inviation to Bid
Gulf Oil Company

After consideration and on recommendation of the City Manager, Commissioner Meyer
moved to authorize the purchase of a used, 1960 Ford F-6000 heavy construction polecat truck,
with crane, from the Florida Power and Light Company, at a cost of $4,000.00 and a transfer
of funds from Contingency Account No. 8150, to Maintenance Division Account No. 4626,.Equipment-
General. Seconded by Commissioner Stenstrom and carried.
Consideration given to a Contract submitted by Thomas A. Edison Industries, McGraw-
Edison Company, Orlando, in the amount of $104.00 covering annual maintenance on recording ~'
equipment in the Commission Room, and on motion of Commissioner Meyer, seconded by Commissioner
Roberts and carried, same was approved and a transfer of:funds was authorized from Contingency
Account No. 8150, to City Manager.Account No. 1254, Service Contracts.
Recommendation of the City Manager for employment of needed additional stenographic
assistance in various departments of the City Hall, and particularly the Finance Department for
0murt records, next considered. A~ter. discussion, Commissioner Meyer moved to authorize employ-
ment of one clerk-stenographer at an annual rate of $4,363.00 with transfer of $3,640.00 for
10 months salary for balance of the year from.Contingency Account No. 8150, to Salary Account
No. 1401. Seconded by Commissioner Stenstrom and carried.
On recommendation of City Manager, Commissioner Meyer moved to accept the low bid of
Transtat Equipment, Inc., Orlando, Florida, for two 1971 Heil Mark III refuse packer bodies at
a cost of $11,050.00. Seconded by Commissioner Roberts and carried.

ANNEXING TO AND INCLUDING WITHIN THE CORPORATE
AREA OF T~E CITY OF SANFORD, FLORIDA, THE AREA
DESCRIBED HEREINAFTER, IN ACCORDANCE WITH THE
PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA,
ACTS OF 1957.

After consideration and on recommendation of the City Manager, Commissioner Roberts
moved to authorize the City Attorney to prepare an amendment to the Subdivision Regulations
Ordinance to include the following: Require underground wiring for all house services and
underground wiring for street lights, and concrete poles. Seconded by Commissioner Meyer and
carried.
Consideration next given to an easement submitted by James H. Triplett to the City
for a north-south alley within the block east of South Sanford Avenue between 20th Street and
Grandview Avenue, in accordance with agreement in exchange for the City to abandon an
alley located on the north side of Mr. Triplett's property, described as follows:
The north 12' of the west 155' of the lot described as beginning 984 feet
south and 25 feet east of the northwest corner of the SW~ of Section 31,
Township 19 South, Range 31 East, run east 167 feet, south 86 feet, west
167 feet, north 86 feet to POB
After disCussion, Commissioner Roberts moved to authorize a Public Hearing to be held on
December 13, 1971, to consider said request and to authorize the City Clerk to advertise same.
Seconded by Commissioner Stenstrom and carried.
The City Manager reported that promissory note dated May 28, 1970, by Otto Kukowski
in amount of $434.00, for costs of paving Elm Avenue abutting his property is delinquent.
After discussion, CommiSsioner Meyer moved to authorize the City Manager to work out a payment
plan with Mr. Kukowski. Seconded by.Commissioner Roberts and carried.
Application next submitted by L. J. Perkins, d/b/a CHAR's for a permit for the sale
of beer and wine for consumption on premises at 2700 South Sanford Avenue, and after con-
sideration, and on recommendatiOn of the Police Chief, Commissioner Meyer moved to approve
same. Seconded by Commissioner Roberts and carried.
Letter next submitted from William L~. Kirk requesting the City to vacate the
westerly six feet of Palm~tt0 AvenUe~'abutting LOt 40, 'LakeView park, and on motion of Com-
missioner Stenstrom,' sec0nded by commissioner Meyer and carri&d, a public hearing was author-
ized to be'held on DeCember 13, 1971, and the~City~Clerk authorized to advertised same.
Recommendation next submitted by Clark, Dietz and Associates, Engineers, to extend
the date from December 8, 1971, to December 22, 1971, for receiving bids on construction of
the secondary sewage treatment plant, and on molion of OCommissioner Roberts, seconded by
Commissioner Meyer and carried, same was aPproved.
The holiday schedule for City employees was next considered, and on motion of Com-
missioner Roberts, seconded by Commissioner Stenstrom and carried, a schedule was authorised

J. B. Cain, d/b/a Super Trading Post, 2922 Orlando Drive, Lots 67 and 68, Druid Park,
Random Development, Inc., and Albert C. Phelps, d/b/a Phelps Restaurant, 2920 Orlando Drive,
east 90 feet of Lot 66, appeared to object to the annexation of said property.
After discussion, Commissioner Meyer moved to table the matter until the next regular
meeting of December 13, 1971.
On motion of Commissioner Meyer, seconded by Commissioner Roberts and carried, a
policy was adopted as follows:
That all property owners involved in future proposed annexation areas
will be mailed a "certified" letter of notification to make them aware
that their respective property is being considered for annexation inside
the city limits.
There being no further business, the meeting adjourned.
