The City Commission of the City of Sanford, Florida, met in regular session at the
City Hall in the City o'f Sanford, Florida, at 8:00 o'clock P. M. on December 13, 1971.

The Meeting was called to order by the Chairman.
The first order of business was a Public Hearing to consider closing, vacating, and
abandoning an alley, in accordance with notice published in the Sanford Herald on November 25,
NOTICE OF PROCEEDING FOR VACATING AND CLOSING AN ALLEY
TO WHOM IT MAY CONCERN:
You will take notice that the City Commission of the City of Sanford, Florida, at
8:00 o'clock P. M. on December 13, 1971, in the City Commission Room at the City Hall in the
City of Sanford, Florida, will consider and determine whether or not the City will close,
vacate and abandon any right of the City and the Public in and to that .east-west alley lying
east of Sanford Avenue and between 20th Street and Grandview Avenue, being more particularly
described as follows:
The north 12 feet of the east 155 feet of the lot described as beginning
984 feet South and 25 feet East of the Northwest corner of the Southwest
1/4 of Section 31, Township 19 South, Range 31 East, run East 167 feet,
South 86 feet, West 167 feet, North~86 feet to a point of beginning.
Persons interested may appear ~and be heard at the time and place above specified.

The Chairman announced that the Commission would hear from anyone in favor of, or
against, the proposed closing, vacating and abandoning of an alley as described in the fore-
going notice.
James H. Triplett, owner of propertY lying on the south side and abutting said East-
West alley, appeared to present agreement dated June 11, 1963, between the former owner, Edward
Higgins, and the City of Sanford, setting forth provisions as follows:
(1) This agreement to correct an unrecorded agreement dated April 24, 1950; and
(2) Granting unto the City the right to enter upon the North 12' of the West
155' of the lot described as beg. 984 feet South and 25 feet East of the
NW corner of the SW 1/4 of Sec. 31, Township 19 South, Range 31 East, run
East 167', South 86', West 167', North 86' to POB for purposes of sanitary
~quipment to collect garbage; and
1971, as follows:

(3) In the event the owner or his assigns desire the discontinuance of
use of the easement above described, the City will relinquish~and
discontinue use of said easement; and further provided,
(4) Upon City discontinuing the easement described above, owner or his
assigns grants, in lieu of, to the City an alley easement described
as the East 12 feet of the afOresaid lot and East 12 feet of the
aforesaid lot and East 12 feet of the West 167 feet of Lot 44,
Rose Court.
The City Manager informed the Commission that Mr. Triplett has submitted an executed grant of
easement for the said North-South alley; thereby providing a North-South alley for the block
from 20th Street, south to Grandview Avenue.
Approximately twenty residents of the area were present to protest a dead-end alley,
and Richard Barnett, A1 Lyons, Mrs. B. L. perkins, Mrs. Camilla Bruce, Hubey Speers, William
Kirchoff, Jr., stated they desired the Utilization of an alley within the block, whether it. be
east-west or north-south.
After. considerable,discussion, Commissioner Stenstrom moved on the basis of the
following:
(1) That Mr.~,Triplett has a legal agreement; and
(2) Although-in sympathy with Mr. and Mrs. Siskin~, according to City
records they were aware of the alley location in relation to their
property in applying for a variance; and
(3) Consideration given to the majority of property owners to be served
on the north-south alley;
therefore, the Commission abide by the agreement of June 11, 1963, and move to authorize the
City Attorney to prepare an ordinance ~o vacate said East-West alley.

After further discussion, Commissioner Meyer moved to rescind all prior action of
the Commission regarding abandoning of the east-west and north-south alleys within this block;
and, that the City accept the executed grant of alley easement given by Mr. Triplett for said
north-south alley on his property; and, the City proceed to open.the north-south alley all the
way through from 20th Street to Grandview Avenue. Seconded by Commissioner Stenstrom and
carried over the dissenting votes of Commissioner Crapps and Commissioner Roberts.
Commissioner Crapps moved to table the motiOn. Seconded by Commissioner Roberts.
Motion failed to carry over dissenting votes of Commissioner Meyer, Commissioner Stenstrom and

abandoning a portion of a street and an alley, in accordance with notice published in the
Sanford Herald on November 18, 1971, as follows:

You will take notice,that the City Commission of the City of Sanford, Florida, at
8:00 o'clock P. M. on December 13, 1971, in the City Commission Room at the City Hall in the
City of Sanford, Florida, will ~ansider and determine whether or not the City will close, vacat
and abandon any right of the City and the public in and to the portions of streets and alleys
as follows:
(a) Maple Avenue lying south of Twelfth Street and north of Seabo~=d Coast Line
Railroad right of way, being more particularly described~as.follows:

Ira E. Southward, owner of abutting proPerty, and stated the closing would make the various
parcels contiguous for better~development..
After consideration, Commissioner Crapps moved to authorize the City Attorney to
prepare the necessary ordinance to close, vacate and abandon the street and alley as advertised
in the foregoing notice and to retain an easement in the north-south alley for utilities.
Seconded by Commissioner Meyer and carried.

vacate and abandon any right of the City and the Public in and to the utility easement lying
between Santa Barbara Drive, Twenty Seventh (Florida) Street, and E1 Capitan Drive, being more
particularly described as follows:
All of that certain utility easement lying between Lots 13, 14 and 15,
and Lots 9, 10 and 11, and as extended between Lot 11 and Lot 12, all

No opposition was registered. The City Manager reported that petitioner Raymond C.
Keller, Franklin Real Estate, Winter Park, proposed the construction of an apartment building
complex on the property, and further, there are no utilities in the easement.
After consideration, Commissioner Meyer moved to authorize the City Attorney to pre-
pare an ordinance to close, vacate and abandon the easement as advertised in the foregoing
notice. Seconded by Commissioner Stenstrom and carried.
The next order of business was a Public Hearing to consider closing, vacating and
abandoning a portion of a street in accordance with notice published in the Sanford Herald on
November 25, 1971, as follows:

William L. Kirk, owner of the abutting property, appeared to support the request and
proposedthe construction of an office building on the_property, stating the need of the addi-
tional 6-foot width as a minimum for construction; also, Mr. Kirk stated he would assume re-
sponsibility and cost of relocating of the existing sidewalk on the parkway.
After consideration, Commissioner Crapps moved to authorize the City Attorney to
prepare an ordinance to close, vacate and abandon a portion of a street as set forth in the
foregoing notice. Seconded by Commissioner Meyer and carried.

Commissioner Roberts stated"he would-not recommend de-annexation and felt..it would

Stanley Curtis, Route 2,~BoX 200, Apopka, Florida~ next appeared to support his
re~est, tabled at last meeting, for an exempt license to peddle used clothing from a vehicle;
and on motion of Commissioner Meyer, Seconded'by Commissioner Roberts and carried, same was
denied.

tion, appeared to support a request by his firm to vacate Elm Avenue north of West First Street

to Commercial Street, and outlined building~expansion plans. The City Manager informed the
Commission the Zoning and Planning Commission had recommended approval of said request.
Commissioner Meyer moved to authorize a public hearing to be held on January 10, 1972,
to consider the request and to authorize the C~ty Clerk to advertise same. Seconded by Commis-
sioner'Stenstrom and carried over the dissenting votes of Commissioner Crapps and Commissioner
Roberts.
Commissioner Crapps reported he had received a request from Elsie Menenaez for a 90-
day extension on condemnations dated August 13, 1971, Group 18, and moved to authorize the
request on properties, as follows: Report No. 71-350, 811 East 10th Street; Report No. 71-351,
815 East 10th Street; Report NO. 71-352, 817 East 10th Street; Report No. 71-353, 1000 Orange
Avenue; Report No. 71-354, 1002 Orange Avenue. Seconded by Commissioner Roberts and carried.

leges, and on motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried,
same were approved as follows: Beta Sigma Phi, Valentine Ball, February 26, 1972; and Police
Benevolent Association, Policemen's Ball, March 18, 1972.
Application next submitted for transfer of permit for sale of alcoholic beverage for
consumption on premises at 2508 French Avenue from Citizens Developers, Inc., d/b/a Michael's
Restaurant, to W. D. Buckley, Jr., 2508 Club Common Corporation, d/b/a Bahama Joe's RestaUrant;
and after consideration and on recommendation of the Police Chief, Commissioner Meyer moved to
approve same. Seconded by Commissioner Crapps and carried.
Requests next submitted from United State Bank of Seminole, Florida State Bank, and
Sanford Atlantic National Bank to be designated as depositories for City funds for year 1972,
and on motion of Commissioner Roberts, seconded by Commissioner Stenstrom and carried, same
were approved.
After consideration of petitions, Commissioner Roberts moved to authorize the in-
stallation of a 4,500 lumen street light at each of locations, as follows: (a) MohawR Avenue
and Santa Barbara Drive; (b) Iroquois Avenue and Santa Barbara Drive; (c) 29th Street and
Central Drive; (d) 29th Street and Empire Place.

Resignation next submitted from Gordon A. Sweeney as a member of the Board of Adjust-
ment, and'on motion of Commissioner Roberts, seconded by Commissioner Meyer and carried, same
was accepted with regrets.
After consideration,Commissioner Meyer moved to retain the engineering firm of Clark,
Dietz and Associates, Inc., Sanford for preparation of construction plans for a breakwater and
other improvements and to authorize necessary survey and plane table work, borings and sounding~
Seconded by Commissioner Stenstrom and carried.
Recommendations next submitted from the Zoning and Planning Commission, and after
consideration and on motion of Commissioner Roberts, seconded by Commissioner Stenstrom and
carried, a Public Hearing was authorized to be held on January 10, 1972, and the City Clerk

to authorize payment in the amount of $1,667.00 to cover expenditures of October and November,
1971, and at the end of each month thereafter, Chamber to send copies of the current monthly
bills to the City and a check sent for the amount expended within the budget allocation.

Consideration next given to a request for a transfer of funds to provide for the
purchase of a police boat at a cost of $2,000.00 and after discussion, Commissioner Meyer moved
to table same until next regular meeting. Seconded by Commissioner Stenstrom and carried.
After consideration:and on recommendation of the City Manager, Commissioner Meyer
moved to authorize the City Attorney to prepare a Resolution to establish a $3.00 charge for
utility accounts not paid within one week after delinquent notice date, to include /the meter
cut-on. Seconded by Commissioner Stenstrom and carried.
Application next submitted for transfer of a permit for sale of alcoholic beverages
for consumption on premises, License No. 1448, from John D. Carlton, d/b/a Your Mother's Parlor,
requesting the name of the establishment be changed to "The Fountain"; and on motion of Commis-
sioner Stenstrom, seconded by Commissioner Roberts and carried, same was approved.

of Commissioner Meyer, seconded-by Commissioner Stenstrom and carried, the regular City Commis-
sion Meeting of Monday, December'27, 1971, was designated to be held on Tuesday, December 28,
1971, at 8:00 P. M. in the City Commission Room at the City Hall.
On recommendation of the City Manager, Commissioner MeYer moved to authorize the City
Manager to proceed with proposals on recodification of City ordinances in size 8½ x 11", loose-
leaf book. Seconded by Commissioner Roberts and carried.
Request next submitted by Arvin and Esther Mihm to designate as an area from which an
annexation petition would be received, that property described as Lots 2 and 3, Block 26,
Dreamwold, 4th Section; and after discussion, Commissioner Meyer moved to deny the request as
property is not contiguous to the City. Seconded by Commissioner Roberts and carried.

Fleetwood Enterprises, Inc., next submitted an annexation petition for Blocks 53, 54,
55, 62 and 63, M. M. Smith's Subdivision, 27 acres located on the west side of Grapeville
Avenue, south of Jewett Lane. The Commission authorized to proceed with the petition contingent
upon certification by the-Seminole County Tax Assessor.
