M. 19 72_ 555 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on January 10, 1972. Commissioner M~yer moved to designate Item No. 9 (c) as Item 18 on the agenda, re- ~arding the adoption of a resolution setting a $3.00 fee on delinquent utility accounts. ;econded by Commissioner Stenstrom and carried. The next item of business was a Public Hearing to consider closing, vacating and abandoning a street right-of-way, in accordance with notice published in the Sanford Herald on December 22, 1971, as follows: NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING A PORTION OF A STREET TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on January 10, 1972, at the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and' determine whether or not the City will close, vacate and abandon any right of the City and the Public in:::.and to that portion of a street hereinafter de- scribed, to wit: That portion of Elm Avenue lying between the south right of way line of Commercial Street and the north right of way line of First Street. - Persons interested may appear and be heard at the time and place above specified. TAMM, JR., CITY CLERK ~he Chairman announced that the Commission would hear from anyone in favor of, or against, the proposed closing, vacating and abandoning of the street as described in the fore- going notice. Irving Feinberg, President of Southern Chemicals, Inc., 204 North Elm Avenue, appeared and opposed the closing in~:that it would have an adverse affect on present and future operations of his business because Elm Avenue is the main access for his customers and trucks. However, he would have no objections to Elm Avenue being designated one-way f~'om First Street north to Fulton Street. A representative of the firm of Kerr-McGee Chemical Corporation, owners of Wilson & Toomer Fertilizer Company Division, 119 North Elm Avenue, appeared to'Oppose the closing. A letter was read from George W. Kennedy,'representing the owner of the Crown Paper Company b~ilding, in opposition to the street closing. 556 MINUTES City Commission, 'Sanford, Florida January. 10 at 8: 00 ?. M, 19 72 I. E. Estridge, Executive.Vice President of First Federal Savings and Loan AssoCia- tion, 312 West First Street, petitioner for said street closing, appeared to support the firm's request in behalf of an expansion program. A preliminary sketeh was presented regarding same and more particularly in relation to the Proposed traffic flow Utilizing drive-up windows. Carl Gutmann of Gutmann, Dragash and Matz, Architects, Inc., architects for First Federal, appeared to'review the plans for utilization of this street. A~ter considerable discussion, Commissioner Meyer moved to table the matter of vaca- ting Elm Avenue to allow Mr. Estridge and their architect firm to study alternate traffic plans to be brought back b'efore the Commission. Seconded by Commissioner Stenstrom and.carried. The next order of business was a Public Hearing to consider.amendments in certain districts and boundaries of the Zoning Ordinance in accordance with notice published in the Sanford Herald on December 22, 1971~ as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on January 10, 1972, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That prOperty lying east of Woodland Drive and north Of Onora Road is proposed to be rezoned from R-IA (Single Family Dwelling) District to R-3 (Multiple Family Dwelling) District. M. _19. 72 '557 & Investment Company, proposed to develop the property for apartments, and the Zoning and Plan- ning Commission had recommended approval, on the condition that the large, open ditch on the Onora Road boundary would be piped by the developer and the developer has concurred on same. After consideration, Commissioner Meyer moved to authorize the City Attorney to pre- pare an ordinance to rezone said property, with the stipulation that the developer would provide the material to pipe the open ditch. Seconded by Commissioner Morris and carried. TAMM, JR., CITY CLERK OF THE CITY OF SANFORD, FLORIDA The Chairman announced that the Commission would hear from anyone in favor of, or against, the proposed rezoning for the establishment of PUD zoning as described in the foregoing notice. A representative from Environmental Design Group, Planners and Architects, presented a site and layout plan. City Manager informed the Commission that the Zoning and Planning Com- mission recommended approval of the PUD zoning, and had approved the preliminary use plan. After consideration, Commissioner Meyer moved to authorize the City Attorney to pre- pare the appropriate ordinance for rezoning the property as described in the aforesaid notice public hearing. Seconded by Commissioner Morris and carried. Consideration next given to a proposal submitted by James M. Rhine~¥ I. E. Estridge, III, Cecil A. Tucker, II, Walter A. Gielow, and Douglas Stenstrom, to purchase for $100,000.00 14.12 acres of City property in the'Lake Monroe Industrial Park, south of Seminole Boulevard and west of French Avenue. Mr. Rhiner appeared to outline plans on the first phase of con- struction of 120 garden type, one and two and possibly three bedroom apartments on the first seven acres, at a proposed construction cost of approximately $1.3 million; and also that pur- chase is conditioned on the following: (a) Obtaining engineering and subsurface soil studies acceptable to the purchasers showing the property is adequate for apartment construction purposes. (b) Obtaining appropriate zoning for apartments. (c) Obtaining mortgage commitment acceptable to purchasers. (d) Provision by the City for utility, sewer and water service to the property with- out tap*in cha~ges. (e) Agreement of the City to grant to the purchasers '.the right to use City property MINUTES City Commission, Sanford, Florida 19__Z2 559 (f) Provision by the City of a survey of the above premises. · Rhiner presented a tentative plot plan and artimt's rendition of colonial type structures. He anticipated said construction would result in $15,000.00 annually on the tax roll. Mr. Rhiner agreed to delete "without tap-in charges" in Item (d). The Commission discussed the appraisal made in October by Mr. Stemper and Mr. Southward showing a market value of $275,000.00. After discussion, Commissioner Morris moved to table action on the propo~al:.until shch time as subsurface soil studies can be obtained. Seconded by commissioner Meyer. Douglas Stenstrom appeared and stated, that due to not having prior knowledge of the Appraisal of the property, the Petitioners were withdrawing their proposal. Commissioner Morris withdrew his motion, with the concurrence of Commissioner Meyer. The Good Samaritan Home Construction Committee next submitted a request to close and vacate one block of Ninth Street west of Mulberry Avenue and Commissioner Stenstrom moved to authorize a Public Hearing to be held on February 14, 1972, to consider the request and to authorize the City Clerk to advertise same. Seconded by Commissioner Meyer and carried. Consideration next given to an Annexation Report prepared by Gerald Dake, City Planner, and recommended by the Zoning and Planning Commission, setting forth~annexation recommendations of certain areas and to establish a capital improvement fee and water pollution fee with all such revenue for a capital improvement fund. The City Manager recommended a capital improvement fee be established per dwelling unit and that same fee be established per 1,000 square feet of any building other than a dwelling unit. Commissioner McClanahan moved to establish a fee of $400.00 per unit. Seconded by Commissioner Meyer. After further discussion, Commissioner Meyer moved to table further consideration until a Workshop Session, to be held on January 13, 1972, at 4:00 P. M. in the City Commission Room of the City Hall. Seconded by Commissioner Stenstrom and carried. On motion of Commissioner Stenstrom, seconded by Commissioner McClanaha~ and carried, consideration of constructing a 24-inch sanitary sewer gravity transmission line was tabled for further discussion on January 13, 1972, at 4:00 P. M. After consideration, Commissioner Stenstrom moved to authorize the lease of the Sanford Civic Center to the Seminole County Republican Committee on February 14, 1972, at the standard fee of $250.00, with alcoholic beverage privileges. Seconded by Commissioner Meyer and carried. Commissioner Meyer moved to authorize the City Clerk to advertise a Public Hearing to be held on January 24, 1972, to consider a proposed amendment to the Subdivision Regulations, requiring developers to provide underground services for electric Power and telephone, and to require the developer to install street lights with underground wiring and concrete poles; and that contractors be notified of said hearing. HIS OUTSTANDING .PUBLIC 'SERVICE CONTRIBUTION TO TIlE CITY OF SANFORD. WHEREAS, RANDALL CHASE, served as a City Commissioner of the City of Sanford, from January 1948 through December 1953, during which time he served as Mayor from January 1953 through December 1953; and WHEREAS, RANDALL CHASE, in addition to his direct service to the City of Sanford durin his entire adult life made an outstanding active contribution to civic and public affairs, working diligently and unselfishly for the betterment and welfare of this City and its people, devoting to such service time and effort far above and beyond the call of duty, ant it is the privilege and desire of the present City Commission to express proper recognition and appreci- ation for the conscientous service devoted to the City of Sanford. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that the sincere commendation and appreciation' of the City Commission, both for itself and the people of this community be and the same is hereby expressed in the respectfull.memory of Randal Chase for his outstanding contribution to public service. BE IT FURTHER RESOLVED that this Resolution be spread upon the minutes of the City Commission and copies hereof delivered to the family of Randall Chase. The City Attorney reported on the status of said alley. Commissioner McClanahan sub- mitted a proposal which would provide a north-south alley, and on motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, the matter was tabled to permit Mr. Triplett to confer with his attorney and bring the matter back to the Commission. On motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, Ordinance No. 1057, entitled: AN ORDINANCE OF THE CITY OF SAN-FORD, FLORIDA, CLOSING, VACATING AND ABANDONING STREETS AND ALLEYS IN THE CITY OF SAN-FORD, FLORIDA, AS DELINEATED BELOW. was introduced and placed on its first reading and read in full. Commissioner Meyer then moved on the waiver of the requirement of the second reading of Ordinance No. 1057, and that same be placed on its final passage and adoption. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1053, entitled: AN ORDINANCE SUPPLEMENTING AN ORDINANCE ENTITLED "AN ORDINANCE AUTHORIZING THE CONSTRUCTION OR ACQUISITION OF ADDITIONS, EXTENSIONS AND IMPROVE- MENTS TO THE COMBINED WATER AND SEWER SYSTEM OF THE CITY OF SANFORD, FLORIDA, AND AUTHORIZING THE ISSUANCE OF $1,175,000 WATER AND SEWER REVENUE CER- TIFICATES FOR SUCH PURPOSES," AND PROVIDING..FOR THE ISSUANCE OF $1,325,000 WATER AND SEWER REVENUE CERTI- FICATES, SERIES 1971. Said Resolution No. 1112 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, RELATING TO CHAPTER 25, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, AS AMENDED, ESTABLISHING A CHARGE APPLICABLE TO DELINQUENT WATER AND SEWER ACCOUNTS. WHEREAS, the City of ,Sanford heretofore when a water and sewer account is thirty (30) days in arrears has furnished to the customer a notice of delinquency; and WHEREAS, the administrative costs of handling delinquent accounts have increased and become'.'excessive to the taxpayers of the City of Sanford and the City Commission deems it ad- visable to establish a delinquent charge therefor; NOW, THEREFORE,'BE.IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that there is'herewith established a charge of Three Dollars ($3.00) to be applied to delinquent accounts pertaining to water and sewerage Services;'that when an aCcount is thirty (30) days delinquent a notice of such delinquency will be. mailed to the customer at his last known address as is shown upon the records of the City of Sanford; that if said account is not paid within (7) days of the date of mailing of such notice then there will be added thereto the sum of Three Dollars ($3.00) as a delinquency charge, which said charge is herewith established.
