The City Commission of the City of Sanford, Florida, met in regular session at the
City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on February 14, 1972.

The meeting was called to order by the Chairman.
The first order of business was a Public Hearing to consider amendments in certain
districts and boundaries of the Zoning Ordinance in accordance with notice published in the
Sanford Herald on January 18, 1972, as follows:

The Chairman announced that the Commission would hear from anyone in favor of, or
against, the proposed rezoning as described in the foregoing notice.
Jimmy M. Grisson, 418 San Marcos Avenue; Glen M. McKendree, 420 San Marcos Avenue;
Mildred McKendree, 420 San Marcos Avenue; Muriel Moss, 405 San Marcos Avenue; Edith M. Dutton,
403 San Marcos Avenue; Edith Beall, 406 San Marcos Avenue, Margaret Blood, 408 Mellonville
Avenue; and Metta M. Starke, 409 Mellonville Avenue, all appeared and offered objections as
follows: A11 exits and entrances to the apartment complex would be off of San Marcos Avenue;
rear of apartments would face San Marcos and would appear as an industrial alleyway; San Marcos
would be a heavily travelled, unimproved street, with the exception of five feet abutting the
property to be developed.

A petition bearing thirty-five signatures of home owners in the area stating objection
~o the rezoning was presented to the City Commission.
Gordon Toll, property owner and developer, appeared in behalf of his petition to rezone
Re presented site and floor plans for a $230,000.00 two-story apartment complex of twenty units;
.nd further, stated that the recommendation of the Zoning and Planning Commission was that no
,penings for entrances and exits be made on Mellonville Avenue, however, he wou~ cooperate with
the recommendations of the Commission.
The City Manager informed the Commission that the Zoning and Planning Commission recom-
nended the rezoning.
After consideration, Commissioner Meyer moVed to de~y the request for change in zoning
)ased on the response of the people living in the area. Seconded by Commissioner Stenstrom.
~otion failed to carry over the dissenting votes of Commissioner McClanahan, Commissioner Morris
~nd Mayor Moore.
Commissioner Morris moved to approve the rezoning with a provision that a one-way
~ntrance be made off Mellonville Avenue,if feasible from engineering aspect, and exit be made to
San Marcos Avenue; and, that the City.Attorney be authorized to prepare an ordinance to rezone
the property as described in the aforesaid notice of public hearing. Seconded by Commissioner
~cClanahan and carried over the dissenting vote of Commissioner Meyer.

After consideration, Commissioner McClanahan moved to authorize the City Attorney to
prepare an ordinance to close, vacate and abandon the street as deSCribed in the aforesaid notic~
of~¢public hearing. Seconded by Commissioner Stenstrom and carried.
Paul E. Porter of Clark, Dietz and Associates, consulting engineers, and Project
Engineer for the proposed construCtion of the City's secondary sewage treatment plant, appeared
to present final recommendations and cost figures for. awarding the low bid received on December
22, 1971, as follows:

The City Commission next considered the bids received in accordance with the Invita-
tion to Bid published in the Sanford Herald on November 5, and 12, 1971.
After discussion and upon the recommendations of the consulting engineer, Clark, Dietz
and Associates, Commissioner .Meyer moved to award the sewage treatment plant bid to Lee Con-
struction Company of Sanford as the low bid in the amount of $1,463,240.00 and with the approval
of the state and federal~agencies involved. Seconded by Commissioner Stenstrom and carried.
David F. Kelley, director of Seminole county Development Authority, appeared to submit
a request for City funds to be set up on the amount of $2,500.00 to be used for traveling ex-
penses for purposes of industrial development in that the county does not provide such funds
under their budget allocation. Mr. Kelley recommended that the City retain the funds and re-
imburse him for incurred travel expenses, supported by vouchers and receipts.
After discussion, the Commission recommended that Mr. Kell~'y approach the Industrial
Committee of the Greater Sanford Chamber of Commerce with reference to City funds allocated to
the Chamber and earmarked for industrial promotions.
Consideration next given to proposals revising water and sewer tap fees and the estab-
liShment of a drainage fee. Commissioner Meyer moved to authorize the City Attorney to prepare
'an ordinance for fees for a Single Family Dwelling as follows: Water - $195.00; Sewer - $220.00
Drainage - $135.00; Total of $550.00 fee for a Single Family Dwelling Unit, and defined as one
house on one lot. Seconded by Commissioner McClanahan and carried over the dissenting vote of
Mayor Moore.
Commissioner McClanahan moved to authorize the City Attorney to prepare an ordinance
for fees for Duplex and Multiple Family Dwelling Units as follows: First unit within each
building to be $550.00; second unit to be 50% of the initial fee; and all additional units to
be 25% per unit of the initial fee. Further, that these fees be reviewed at the end of twelve
months. Seconded by Commissioner Morris and carried.

Commissioner Morris moved that on the recommendation of the Zoning and Planning Commis-
sion, in that the developer would not provide street improvements, the request be denied.
Seconded by Commissioner McClanahan and carried.
Commissioner Meyer moved to authorize a public hearing to be held on February 28, 1972
and a notice to owners for consideration of annexation of property, as follows: Lots 1/14,
Block 26; Lots 9 & 10, Block 23; Lots 13/20 and S~ of Lot 21, Block 25, Dreamwoldo Seconded by
Commissioner McClanahan and carried over the dissenting vote of Commissioner Morris.
After consideration, Commissioner Meyer moved to appoint W. Garnett White to the Board
of Adjustment for a three-year term to fill the vacancy created by the resignation of Gordon
Sweeney. Seconded by Commissioner Morris and carried.
After consideration, Commissioner Meyer moved to authorize the Mayor and City Clerk
to execute a Quit-Claim Deed pertaining to the abutting 10 feet of street of East 24fih Place,
vacated by Ordinance No. 562 and dated September 26, 1955, on the property as follows:

Invoice No. 3, dated January 25, 1972, in amount of $5,775.00, next submitted from
Gutmann, Dragash and Matz Architects, Inc., for services performed on the Sanford Police Complex
under Agreement dated June g, 1971, and on motion of Commissioner Meyer, seconded by Commissioner
McClanahan and carried, payment was approved.
Recommendation next submitted by Municipal Judge Roger L. Berry to set aside two bonds
estreated on February 1, 1972, in cases as follows: Herman Eplin, Docket No. 101764, Failure to
Have Vehicle Under Control, $112.00; and Docket No. 101765, Driving While Intoxicated, $202.00.
On motion of Commissioner McClanahan, seconded by Commissioner Morris and carried, same was
approved.
Recommendation next submitted by the City Manager for an emergency purchase to replace
two Chevrolet police cruisers, No. 27 and No. 29, due to the nature of repairs being considered
hazardous. Commissioner Meyer moved to waive the requirement of the bid procedures and to
authorize the City Manager to negotiate the purchase as recommended, and to transfer the required
funds from Contingency Account No. 8150. Seconded by Commissioner McClanahan and carried.
Reo~mmendation next submitted by the Zoning and Planning Commission to rezone from
R-iA to R-2, as follows: Lots 5 through 25, 35 through 42, 51 through 62, 72 thr~gh 75, and
81 through 91, Geneva Terrace Replat, provided that Lots 71 and 76 are deeded to the City for a
playground. Conm~ission~r Meyer moved to authorize a Public Hearing to be held Oh February 28,
1972, and the City Clerk to advertise same. Seconded by Commissioner Stenstrom and carried.

of a Neighborhood Development--Program that is now defunct under federal funding and originally
proposed as Project No. Florida R-39, Survey and Planning Application for Sanford Redevelopment
Area No. 1, West, consisting of approximately 35 acres and generally bounded by Maple Avenue on
the east, Twelfth Street on the south, Poplar Avenue on the west, and Eighth Street on the nortl
and on motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, same was
approved.
On motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried,
minutes of January 24, and February 7, 1972, were approved.
On motion ofCCommissioner McClanahan, seconded by Commissioner Meyer and carried,
the Administrative Report of February 11, 1972, submitted by the City Manager, was approved.
On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried,
current vouchers and payrolls were next approved as evidenced by: General Fund, Florida State
Bank, Nos. 7199 through 7202, 7205 through 7253; 156001 through 156229; Water and Sewer Revenue
Fund, Florida State Bank, Nos. 870 through 899; Policemen's Pension Fund, Florida State Bank,
Nos. 299 through 302; Firemen's Relief and Pension Fund, Florida State Bank, Nos. 201 through
203; Utilities Service Taxes Fund, Sanford Atlantic National Bank, No. 36.
On motion'of Commissioner Morris, seconded by Commissioner Meyer and carried, the
Commission approved the efforts of the Florida League of Cities, Inc., to support legislation
in the House Judiciary Committee to guarantee complete return of fines and forefeitures to
municipalities in the event that Article V, revision of the Judiciary Article of the Florida
Constitution, is approved on March 14, 1972.
On motion of Commissioner Meyer, seconded by Commissioner Morris and carried, the
City Manager was authorized to send a telegram to the Orange-Seminole Legislative Delegation
opposing legislation to establish state mandated guidelines for Public Employee Collective
Bargaining, referenced as "Public Employees Relations Act".
After consideration of costs, Commissioner Meyer moved to authorize the construction
of two half-size basketball courts. Seconded by Commissioner Stenstrom. Motion failed to car-
ry over the dissenting votes of Commissioner McClanahan, Commissioner Morris, and Mayor Moore.
On recommendation of the City Manager and due to installation of new 4,500 lumen
lights, Commissioner McClanahan moved to authorize the removal of the old whiteway, short,
metal standards, lighting system in the area of Park, Magnolia, and Oak Avenues from Ninth
Street north to Third Street. Seconded by Commissioner Morris and carried.
After consideration, Commissioner Meyer moved to authorize J. Brailey Odham, Develope~
to utilize concrete street light poles with underground wiring in Twenty West Subdivision, with
the provisions that the developer assume the cost of furnishing the materials and the City to
provide the installation. Seconded by Commissioner Morris and carried.
Internal Revenue Service ruling next submitted approving payment of wages lost during
federal government wage freeze period from October 1 to November 15, 1971, of a 5% pay raise fo~
Employees during said period. Commissioner Meyer moved to accept said ruling and to authorize

Request submitted by State Representative Robert C. Milburn to p~.oclaim March 7, 1972,
as "Project 7th March Day in Sanford" as a student duplication of the March 14th primary, and
on motion of Commissioner Morris, seconded by Commissioner Stenstrom and carried, the City
Attorney was authorized to prepare a proclamation for same.
Letter submitted from Seminole County Tax Assessor advising of an error in that Home-
stead Exemption was allowed on Lot 9 and should have been allowed on Lot 10, Block 7, Tier B,
Trafford's, for years of 1968, 1969 and 1970. After consideration, Commissioner Meyer moved to
authorize a refund in the net amount of $67.79 to Louise Foster Smith and First Federal Savings
& Loan Association. Seconded by Commissioner McClanahan and carried.
Commissioner McClanahan moved to log in and out the Commissioners as to time of
arrival in cases of tardiness and of leaving prior to adjournment of City Commission meetings.

After consideration, Commissioner Meyer moved to accept the Traffic Signal Survey,

Commissioner Meyer moved to authorize the Mayor to send a letter of commendation to
the City Firemeni:on their firefighting tactics and performance at the recent fire at Robson
Sporting Goods Store. Seconded by Commissioner Morris and carried.
