M. 19 72 1 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on March 27, 1972. Present: Mayor-Commissioner Lee P. Moore Commissioner A. A. McClanahan Commissioner Gordon T. Meyer Commissioner John G. Morris Commissioner Julian L. Stenstrom City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler The meeting was called to order by the Chairman. The first order of business was a public hearing to consider annexation of property in accordance with notice authorized by the City Commission to be mailed to owners of property described, as follows: (a) Begin 29 chains South of NE corner of Section 2, Township 20 S, Range 30 E, Run W 21.3 chains, North 10.54 chains, East 9.5 chains, South 1.92 chains, East 11.8 chains, South 8.62 chains to beginning. (b) Begin 29 chains South and 778.8 feet West of Northeast corner, run West 612.48 feet South 1017.7 feet to NWly right of way of Ridgewood Avenue, North 45 degrees, East 291.5 feet, West to NWly right of way of Ridgewood Avenue, North 45 degrees East to a point which is 2319.5 feet South and 778.8 feet West of Northeast corner, North 405.24 feet to Point of Beginning. Section 2 Township 20 South Range 30 East. (South of 25th Street and abutting High School property) The Chairman announced that the Commission would hear from anyone in favor of, or against, the proposed annexation. Those persons appearing in opposition were as follows: Mr. and MrS. Fred O. Ferris, 2700 Ridgewood Avenue. Mr. Ferris stated he had been authorized by officials of the church property to appear in opposition. Clara Browder, 2704 Ridgewood Avenue. Mr. and Mrs. Donal Jenkins, 2708 Ridgewood Drive. Commissioner Meyer moved to delete the area described as item (b) from the proposed annexation. Seconded by Commissioner Morris and carried. Commissioner McClanahan moved to authorize the City Attorney?to prepare the proper ordinance upon certification of the petitions by the Seminole County Tax Assessor. Seconded by Commissioner Stenstrom and carried over the dissenting vote of Mayor Moore. The next order of business was a public hearing to consider closing, vacating, and abandoning a portion of an alley in accordance with notice published in the Sanford Herald on March 10, 1972, as follows: NOTICE OF PROCEEDING FOR VACATING AND CLOSING A PORTION OF AN ALLEY TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on March 27, 1972, in the City Commission Room at the City Hall in the City MINUTES City Commission, Sanford, Florida___March 27 at 8:00 P. M of Sanford, Florida,-will consider and determine whether of not the City will close, vacate and abandon any right of the City and the public in and to a portion of the north-south alley running North of Southwest Road and lying between Roosevelt Avenue and Persimmon Avenue, being more particularly described, as follows: That part of Alley lying between Lots 7, 8, 13, 14, 15 and 16, and lying 15 feet South of the North lines of Lots 7, 13, Cates Addition, Sanford, Florida, according to the Plat thereof as recorded in Plat Book 3, page 64, of the Public Records of Seminole County, Florida. Person interested may appear and be heard at the time and place specified. City Commission of the City of Sanford, Florida By: H. N. Tamm, Jr., City Clerk The Chairman'announced that the Commission would hear from anyone in favor of, or against, the proposed alley closing. Commissioner Meyer moved to authorize the City Attorney to prepare an ordinance to close, vacate and abandon the portion of alley as described in the aforesaid notice of public hearing. Seconded by Commissioner Stenstrom and carr~d. The next item of business was the consideration of a progress report to be submitted by Harry Robson, relating,to the fire damage to Robson Sporting Goods Store at 304 East First Street. M~ Robson did not appear'and the City Manager was instructed to inform Mr. Robson that the Commission would discuss the matter at a Workshop Session on April 3, 1972, at 4:00 P. M. and to request his presence. John Dragash and Richard Matz of Gutmann, Dragash, and Matz Architects, Inc., pre- sented the preliminary design of the site plan, ground floor plan and elevations, and a colored rendering of the proposed Police Security Complex. The building would be of 23,000 square feet and occupancy date was set for April, 1973. The Commission requested the architects to con- sider the addition of jury facilities in the municipal court room. William T. Baker, Jr., and Richard Davis of Wilco Construction COo, purchasers of land in Geneva Terrace Replat, appeared to inform the Commission that development plans would not deviate from those of former owner, L. W. Lord, Guilford Construction Co., Inc., and out- lined to the City Commission by Mr. Lord on February 28, 1972. On motion of Commissioner Meyer, seconded by Commissioner Morris and carried, Ordinance No. 1066, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMEND- MENT PLACING CERTAIN TERRITORY IN THE DISTRICT AS DELINEATED BELOW. was introduced and placed on its first reading and read in full. CommiSsioner Meyer then moved on the waiver of the requirement of the second reading of Ordinance No. 1066, and that same be placed on its final passage and adoption. Seconded by Commissioner Morris. M. .19 72 Thereupon, the question recurred on the waiver of the second reading, the roll was called and the vote stands as follows: Mayor Moore CommissionerMcClanahan Commissioner Meyer Commissioner Morris Commissioner Stenstrom Yea Said Ordinance No. 1066 was then placed on its final passage and adoption, the roll was called and the vote stands as follows: Mayor Moore Commissioner McClanahan Commissioner Meyer Commissioner Morris Commissioner Stenstrom Yea Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote, had passed and adopted said Ordinance No. 1066, entitled: AN ORDINANCE OF THE CITY OF SAb~ORD, FLORIDA, AMENDING ORDINANCE NO. 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMEND- MENT PLACING CERTAIN TERRITORY IN THE DISTRICT AS DELINEATED BELOW. Philip Zeuli, Developer, appeared to request joint participation with the City to open and pave Hartwell Avenue south of 25th Street, north of Lake Jennie Highlands development in Dreamwold, 4th Section. Mr. Zeuli submitted estimated cost of $30.00 a foot for 1,380 feet of paving, with the City being requested to fund $20,000.00. He further submitted that this street is the west boundary line of the new police security complex building. After discussion. Commissioner Meyer moved to deny the request. Seconded by Commissioner McClanahan and carried. Mack Cleveland, Jr., attorney for the owners of approximately 160 acres of land loca- ted north of Lake Mary Boulevard and east of the railroad right of way, appeared to submit an annexation petition with a corrected description for said property and to request annexation to the city. After discussion, Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordinance upon proper certification of the petition by Seminole County Tax Assessor, for annexation of property described as follows: The West 1/2 South of the Sanford Grant Line and East of railway (less West 1/2 of the SW 1/4 of the SW 1/4) and West 1/2 of South 1/2 of Gov't. Lot 2, all in Section 10, Township 20 South, Range 30 East; the North 1/2 of Gov't. Lot 2 (less the East 660 feet and the West 665.2 feet); from the intersection of the East line of the West 565.2 feet of Gov't. Lot~2 with the Sanford Grant Line as a point of beginning, rUn thence South 65 degrees East along said Grant Line 353.4 feet more or less to the existing City limits of the City of Sanford, thence run North 90 feet, thence run North 65 degrees West paralleling said Grant Line 353.4 feet more or less to point 90 feet North of the point of beginning, thence run South to point of beginning, all in Section 10, Township 20 South, Range 30 East. Seconded by Commissioner Meyer and carried. Request next submitted for annexation of property located east of Sanford Avenue MINUTES City Commission, Sanford, Florida__ March 27 at 8:00 P. M. between 26th Stre'et and Lemon Avenue, and after discussion, Commissioner.Meyer moved to authoriz a public hearing to be held on April 10, 1972, and a notice~to owners for annexation of Property as follows: Lots 8, 9 and 12, Block 5, A. D. Russell's Addition to Fort Reed. Seconded by Commissioner McClanahan and carried over the dissenting votes of Mayor Moore and Co~nis sioner Morris. Commissioner Meyer moved to authorize the Mayor to execute a Contract with Lee Brother Construction Company for the construction.of the Secondary Sewage Treatment Plant addition to the primary sewage treatment plant. Seconded by Commissioner Morris and carried. After consideration, Commissioner McClanahan moved to authorize the City Clerk to advertise~a public hearing to be held on April 24, 1972, to consider a request to vacate and abandon a utility easement described as follows: The South 7~feet of Lot 1; southwesterly 7 feet of Lot 2; north 7 feet and the northeasterly 7 feet of Lot 3; Block 8, Highland Park. (Re: east of French Avenue between Colonial Way and Katherine Court) Seconded by Commissioner Morris and carried. Recommendations next submitted from the Board of Adjustment to increase variance application fees from $5.00 to fees as follows: $25.00 - for residential,, and non-profit organizations $50.00 - for commercial, and all others. After consideration and on motion-of Commissioner Meyer, seconded by Commissioner Morris and carried, same were apProved. Recommendations next submitted from the Zoning and Planning Commission as follows: (a) (b) (c) (d) Authorize:' the Building Official'to enforce the Minimum Housing Code, as adopted. Adopt Workable Program and submit same to Department of Housing and Urban Development. Approve a preliminary plat of West 25th Street Subdivision, J. Brailey Odham, Developer. Authorize an expenditure of $1,200.00 to Gerald Dake, Gerald Dake Associates, Jacksonville, planning consultants, for the preparation of the Neighborhood Development Program applicatiOn. Commissioner. Meyer moved to approve said .recommendations. and carried. Seconded by Commissioner Stenstrom Consideration next given to recommendations ?submitted by the Citizens Advisory Commit- tee, as follows: (a) (b) (e) Approve a Workable Program. Implementation of the Minimum Homsing Code. Authorize the City Manager to notify members who have been absent three meetings to submit their resignations. On motion of Commissioner Meyer, seconded by Commissioner Morris and carried, same was apprOved. Request submitted by City employee, Danny Martin, to purchase four grave spaces in MINUTES City Commission, Sanford, Florida March 27 at 8:00 P. M. ,19 72 the municipal cemetery at a cost of $600.00 on time with a salary deduction of $25.00 per month. Commissioner Meyer moved to approve sameand deed to be-withheld until payment is made in full. Seconded by Commissioner Stenstrom and carried. Ordinance No. 1065, entitled: AN ORDINANCE OF THE CITY OFSANFORD, FLORIDA, ESTABLISHING PROCEDURES FOR EXTENSION OF THE CITY'S SEWERAGE AND WATER SYSTEM; PRESCRIBING DESIGN AND CONSTRUCTION STANDARDS FOR SUCH PROJECT; IMPOSING A WATER, SEWER, DRAINAGE CONNECTION AND CONTROL CHARGE; PROVIDING FOR EXCEPTIONS; PROVIDING FOR METHODS OF PAYMENT AND UTILIZATION OF FUNDS. placed on its first reading and read in full at the meeting of March 13, 1972, was next placed on its;~siecond~reading~.; After being.read in full, Commission~r~.Meyer moved on its passage and adoption. Seconded by Commissioner Stenstrom and carried. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1065, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ESTABLISHING PROCEDURES FOR EXTENSION OF THE CITY'S SEWERAGE AND WATER SYSTEM; PRESCRIBING DESIGN AND CONSTRUCTION STANDARDS FOR SUCH PROJECT; IMPOSING A WATER, SEWER, DRAINAGE CONNECTION AND CONTROL CHARGE; PROVIDING FOR EXCEPTIONS; PROVIDING FOR METHODS OF PAYMENT AND UTILIZATION OF FUNDS. On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, minutes of March 13, 1972, were approved. Letter next submitted from John A. Breithaupt, Briskey Engineering Company, Orlando, requesting the Commission to consider annexation of 50 acres located east of US 17-92 on the Old Orlando Highway and not contiguous to the City limits. After discussion, and on motion of Commissioner McClanahan, seconded by Commissioner Meyer and carried, the request was denied. Consideration next given to an agreement, dated September 27, 1971, of the Seminole Zoological Society to lease the concession stand at the municipal zoo fora rental fee of $50.0G per month. After discussion, Commissioner Meyer moved to waive the said rental fee. Seconded by Commissioner McClanahan and carried. Consideration next given to a request submitted by Amos Walls to operate a paddle wheel excursion boat at the City pier, and on motion of Commissioner McClanahan and seconded by Commissioner Meyer.and carried, same was denied. Request next submitted by the Recreation Director for authorization to hire a clerk- typist in the Recreation Office for part-time work for a period of twenty weeks from April 15 to August 15, 1972, at a salary of $75.13 per week with payment from Recreation Salary Account No. 4201; and on recommendation of the City Manager and on motion of Commissioner Meyer, second- ed by Commissioner Stenstrom and carried, same was approved. On motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, the City Manager's Administrative Report of March 24, 1972, was approved as follows: MINUTES City Commission, Sanford, Florida IV[arch 27 at 8:00 P. M. . 19 72 (1) Salary reclassifications: Harry Smith, Recreation Superintendent, from Grade C to D Mack LaZenby, City Engineer from Grade B to C Linda Bennett, Police Clerk, from Grade C to D William Wallace Smith, Police Lt., from Grade C to D Jimmie Davis, laborer, Recreation Department, from Grade C to D (2) Authorized a salary advance to Willie Robinson of $200.00 with repayment at $25.00 a week through salary deduction. The Commission instructed the City Attorney to prepare an amendment to Ordinance No. 1039 to include fuel oil as covered by the utility tax. On motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, the City.Attorney was authorized to prepare a resolution to support President Nixon's national prayer week for those persons listed as Prisoner of War or Missing in Action.
