The first order of business was a public hearing to consider annexation of property in accordance with notice authorized by the City Commission to be mailed to owners of property described as follows: Lots 8, 9 and 12, Block 5, A. The next order of business was a public hearing to consider closing, vacating and abandoning streets in accordance with notice published in the Sanford Herald on March 21, 1972, as follows: .NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING OF STREETS · TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on April 10, 1972, at the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the Public in and to those streets hereinafter described to wit: Ail of those streets in Plat of Sanora Unit 1, as recorded in Plat Book 16, Page 88, Seminole County Records. Seconded by Commissioner Stenstrom and carried. Consideration next given to the propos~ adoption of ~an ordinance to extend the utility tax to cover sales of fuel oil, in accordance with recent ruling by the Florida District Court ~roviding that cities levying a utility tax on gas and electricity must also levy the same tax ~n fuel oil. Ordinance No. 1067, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTIONS 23-8, 23~9, 23-10, 23-11 and 23-12, THE CODE OF THE CITY OF SANFORD, FLORIDA, AS AMENDED, SAID SECTIONS ESTABLISHING A TAX ON CHARGES TO UTILITY USERS AND THE METHOD OF COLLECTION AND PAYMENT THEREOF, SAID AMENDMENTS ADDING THERETO FUEL OILS WHEN PURCHASED OF USED AS A UTILITY. was introduced and placed on its first reading and read in full. Letter next submitted from Howard H. Hodges, president of Sanford Atlantic National ~ank, requesting the closing, vacating and abandoning of that certain north-south portion of an ~lley running north from Second Street to the intersection with an east-West alley between Park kvenue and Magnolia Avenue. The City Manager reported that the alley contains a 24-inch concrete :ombined sewer and an 8-inch sanitary sewer and recommended, that if built upon,, the developer ~e required to replace all lines in cast iron and encase in concrete and further that a utility ~asement be retained. Information was given that Mr. Hodges was aware of same and was agreeable to following the requirement. Commissioner Morris moved to authorize a public hearing be held on May 8, 1972,. for further consideration and the City Clerk to advertise same. Seconded by Commissioner McClanahan and carried. Letter of resignation from the Citizens Advisory Committee submitted by Manuel Jacobson and after consideration and on motion of Commissioner Stenstrom and carried, the City Manager was authorized to send a letter of acceptance of same, with regrets. Report next submitted from the City Engineer for syschronizing traffic signals and other traffic controls on First Street as follows: 1. Rebuild three traffic light control boxes exiSting on East First Street. 2. Install needed traffic light at intersection of East First Street and Palmetto Avenue. 3. Prohibit all left turn traffic at the intersection of First Street and Park Avenue. 6. Continue the review of one-way streets for the downtown area. After consideration, Commissioner MorriS moved on approval of said recommendations and to authorize a transfer of funds in the amount of $2,500.00 from Contingency Account No. 8150 to Maintenance Account No. 4644, Traffic Signals, to cover same. Seconded by Commissioner Stenstro and carried. Action of the Commission to authorize the enforcement of the Minimum Standard HoUsing code was next discussed as to~.personnel and equipment requirements in the Engineering Department Building Division, and on recommendation of the City Manager, Commissioner Stenstrom moved to authorize expenditures, as follows: (a) Employment. of one Minimum Housing Code Inspector at an annual salary of $5,857.00 with five months salary to September 30, 1972, pro-rated at (b) Present part-time clerk to be made a full time clerk with additional pay to September 30, 1972, pro-rated at (c) Employ one additional clerk-stenograPher at an annual salary of $4,688.00 with five months salary to September 30, 1972, pro-rated at (d) Purchase one vehicle for inspector (e) Gas, oil, etc., pro-rated for five months (f) One unit of radio equipment (g) Two desks, chairs, file cabinet (h) One typewriter (i) Two desk lights (j) Social Security Seconded by Commissioner Morris and carried. Blount, Jr. and Son Contracting Company, Jacksonville, requesting a change order in the agreement dated March 1, 1972, for construction of West Harbor breakwater and reconstruction of Pier A at Riverport Marina at additional costs as follows: ' $1,222.54 160.00 $1,382.54~ Breakwater - Hardware Timber Total Dock Contract - A-6 Junction Unit $934.27 288.27 Total . On motion of Commissioner McClanahan, seconded by Commissioner Morris and carried, same was approved. Recommendations next submitted from the Zonimg and Planning Commission to rezone areas annexed, from R-1AA (Single Family Dwelling) Districts as follows: 1. The City Manager reported that an alley easement had not been submitted in exchange for the proposed vacating of a portion of an alley west of Southwest Road between Roosevelt and Persimmon Avenues in the Cates Subdivision and Commissioner McClanahan moved to table considera- tion until the next regular City Commission meeting, April 24, 1972. Seconded by Commissioner Morris and carried. On motion of Commissioner Stenstrom, seconded by Commissioner McClanahan and carried, Ordinance No. 1068, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREAS .~DESCRIBE~HEREINA~TER, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. was introduced and placed on its first reading and read in full. Statement dated March 25, 1972, in amount of $9,495.30, next submitted from T. W. Blount, Jr. & Son Contracting Company, for partial payment based upon 45% completion of the marina breakwater, west harbor, as authorized by Contract dated March 1, 1972; and after con- sideration and on motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, payment of same was authorized. Consideration next given to a letter from Ned N. Seconded by Commissioner Stenstrom and carried. On motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, current vouchers and payrolls were next approved as evidenced by General Fund, Florida State Bank, Nos. 156440 through 156672; Water and Sewer Revenue Fund, Florida State Bank, Nos. 903 through 922; Policemen's Pension Fund, Florida s~ate Bank, Nos. 307 through 310; Firemen's Relief and Pension Fund, Florida State Bank, Nos. 207 through 209; Utilities Service Taxes Fund. Sanford Atlantic National Bank, No. 38; General Fund, Sanford Atlantic National Bank, Nos. 1266 through 1327; Board of Bond Trustees, Sanford Atlantic National Bank, Nos. 405 through 412. On motion of Commissioner McClanahan,~seconded by Commissioner Stenstrom and carried, minutes of March 27, and April 4, 1972, were approved. On motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, transfer of funds were authorized from Contingency Account No. 8150 to accounts as follows: Engineering $6,050.00 to Salary Account No. 5001 110.00 to Gas and Oil Account No. 5002 1,102.00 to Furniture, Fixtures and Office Equipment Account No. 5012 3,700.00 to Equipmant-General Account No. 5026 Insurance $285.00 to OASI Account No. 7090 (for social security) City Attorney $255.00 to Furniture, Fixtures and Office Equipment Account No. 1312 Police $2,500.00 to Miscellaneous Account No. 2209 6,240.00 to Equipment Account No. 2256 (two police cars) and, transfer $3,500.00 from Finance Account No. 1406.1, Update Code, to Public Projects, Appropriated Surplus, to provide for recodification work Which will not be completed in fiscal year of 1971-72. On motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, the City Attorney was authorized to prepare a resolution in recognition on March 15, 1972, of thirty years of service by Lt. John R. Crow in the municipal Fire Department. Request next submitted by Arvin L. and Esther M. Mihm to vacate an alley easement and retain as a utility easement the North 168 feet of that north-south alley abutting Lots 1, 3, 5, and 2, 4, 6, Lanes Addition, Amended Plat, between Oak and Park Avenues and between 23rd and 24th Streets; and on motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, a public hearing was authorized to be held on May 8, 1972, for further consideration and the City Clerk authorized to advertise same. MINUTES City Commission, Sar_ford, Florida April 10 at 8:00 P. M. 72 F. Thomas Ustler, Ustler-Burst, Inc., Realtors, submitted a letter requesting the City to consider sale of approximately 1.3 acres located on the north side of Airport Boulevard and west of Highway 17-92 to include said property in the development of a shopping center. After consideration, Commissioner Morris moved to authorize the City Manager to~megotiate on a minimum sale price of $8,000.00 per acre. Seconded by Commissioner Stenstrom. Motion failed to carry over the dissenting votes of Commissioner McClanahan and Commissioner Meyer. After further con- sideration, Commissioner McClanahan moved to authorize the City Clerk to obtain from two quali- fied real estate appraisers the fair market selling price of the 1.3 acres. Seconded by Com- missioner Morris and carried. Statement submitted by W. C. Hutchison, Jr., law firm of Hutchison and Leffler, in the amount of $'10,125.00 for professional services rendered in Civil Action 72-84 and 72-85, covering bond Validation procedures for the police security complex and addition to the sewage treatment plant; and on motion of Commissioner Stenstrom, seconded by Commissioner McClanahan and carried, same was approved for payment.
