June.. 26 at 8:00 P.M. 19. 72 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on June 26, 1972. Present: Mayor-Commissioner Lee P. Moore Commissioner A. A. McClanahan Commissioner Gordon T. Meyer Commissioner John G. Morris Commissioner Julian L. Stenstrom Acting City Attorney Robert M. Morris City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler The meeting was called to order by the Chairman. First item of business was the consideration of the condition of a building located at 304 East First Street, owned by Harry E. Robson, and formerly operated as Robson Sporting Goods, which was severely damaged by fire on January 31, 1972. The Commission reported that complaints had been received from the abutting property owner about the condition of the building and of blocking the sidewalk and portion of the street Mr. Robson outlined cost of cleanup work and out of pocket expenses he had made while awaiting insurance settlement through the courts. He also stated that reconstruction plans had been prepared and anticipated calling for bids on same. Gerald Griffin, attorney, appeared in behalf of Mr. Robson. A report next submitted from the Building Official of the inspection of said building found to be in a dilapidated, unsanitary and unsafe condition. After discussion, Commissioner McClanahan moved to hold a public hearing on August 14, 1972, to consider said report to de- termine the condition of the structure for condemnation and to authorize a notice to be placed upon said structure; and, directed by registered mail to the last known address as shown by.the Tax Assessment Roll of the City, a notice to the owner of the property of said hearing. Second- ed by Commissioner Morris and carried. After review, Commissioner Meyer moved to approve a plat of Hidden Lake, Unit I, and to authorize the Mayor and City Clerk to execute same, subject to final engineering drawings being submitted and upon approval of the City Manager. carried. Seconded by Commissioner Morris and After consideration, and on motion of Commissioner McClanahan, seconded by Commis- sioner Morris and carried, the City Attorney was authorized to prepare an amendment to Ordinance No. 1065 as follows: Section 27.6 Motels: Water, Sewer~ Drainage Connection and Control Item (3) Commercial Five hundred fifty dollars for the first unit within each building or structure; two hundred seventy-five dollars for the second unit; one hundred thirty-seven dollars and fifty cents'for each additional unit. Mobile Home Parks: Same graduated scale to be utilized for parks as for motels, if park is under one land ownership. If under individual land ownership, $550.00 fee per trailer is applicable. .MINUTES City Commission, Sanford, F10~da ... June 26 at 8:00 P.M. 1972 Appraisal authorized by the CommisSion next submitted by W. Garnett White and Jim Hunt, realtors, in amount of $1,000.00 for Lot 13, Block D, Celery Avenue Addition. On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, the Commission next authorized to offer for sale said 'Lot at the appraised price in addition to the appraisal fee, for a total of $1,050.00. Report next considered from the Department of HouSing and Urban Development re- quiring the designation of a relocation agency for the recertification of the City's Workable Program, and on motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, the Sanford Housing Authority was designated as same. A $100.00'. donation from the Sanford Junior Women's Club was accepted, and on recom- mendation of the Director of Recreation and Parks and on motion of Commissioner Meyer, sec- onded by Commissioner Morris and Commissioner Stenstrom and carried, said funds were authorized to be set up in a nonlapsable improvement account and earmarked for park beautification. On recommendation of the division superintendent, department head and the City Manager Commissioner Meyer moved to approve the request of City employee L. Hugh Wynne, ' street division, for one year continued employment over retirement age of 65 years. Seconded by Commissioner McClanahan and carried. On motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, Ordinance No. 1079, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER IN'ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. was introduced and placed on its first reading and read in full. Commissioner Meyer then moved on the waiver of the requirement of the second reading of Ordinance No. 1079 and that same be placed on its final passage and adoption. Seconded by Commissioner Stenstrom. June ~6 at 8:00 P. M. 19 72 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. Annexation petition next submitted on Lot 10-A, Block 23, Dreamwold. After considera- tion, Commissioner McClanahan moved to authorize the City Attorney to prepare an ordinance to annex same, upon certification by the Seminole County Tax Assessor. Seconded by Commissioner Stenstrom and carried. After discussion, Commissioner McClanahan moved to hold a public hearing on July 10, 1972, to consider the annexation of Lots 8 through 27, Lots 30 and 31, Block 24; and Lots 5 and 6, Block 25, all in Dreamwold; and to authorize the City Clerk to notify the property owners by certified mail of said public hearing. Seconded by Commissioner Stenstrom and carried. On recommendation of Municipal Judge Roger L. Berry, and on motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, bond estreated on May 16, 1972, in amount of $112.00 was set aside in the case of Rufus Bradley, Jr., .Docket No. 103761, Disorderly Con- duct. On recommendation of the City Manager and City Clerk, Commissioner Meyer moved to increase the petty cash bank account from the amount of.$500.00 to $2,000.00. Seconded by Com- missioner McClanahan and carried. Consideration next given to a request that approximately 15 acres south of the Air- port on Silver Lake be designated as an area from which an annexation would be received, md after discussion, Commissioner Morris moved to table same until such time as the Sanford Airport Authority offers a recommendation regarding the development of said property and use of the sewer facilities on the airport property. Seconded by Commissioner McClanahan and carried. Consideration given to the recommendation by the Zoning and Planning Commission to deny the request to rezone from R-5 (One and Two Family Dwelling) District to C-2 (General Commercial) District, Lot 3, Block 17, Chapman and Tuckers Addition. On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, a public hearing was authorized to be held on July 10, 1972, and the City Clerk authorized to advertise same. George Andrew Speer, attorney, appeared to represent the petitioner. Recommendation next submitted from the Zoning and Planning Commission to rezone a portion of the proposed subdivision of Lake Mary Estates from R-1AA (Single Family Dwelling) District to R-3 (Multiple Family Dwelling) District and restricting multi-family use to be no more than 12 units per acre; and on motion of Commissioner Meyer, seconded by-Commissioner McClanahan and carried, a public hearing was authorized to be held on July 10, 1972, and the City Clerk authorized to advertise same. After discussion, Commissioner Meyer moved that the Minimum Housing Board of Adjust- ment and Appeals be composed of five members; and further, to appoint Victor E. Gieschler, John Lawson, and Mrs. John Mercer to said board with tenure of office to be held in abeyance until two more appointees are made. Seconded by Commissioner Morris and carried. After consideration, Commissioner Morris moved to table consideration of a proposal to modify the 10% Utility Tax Ordinance to include CATV (Cable Television) until a report is received from the City Attorney. Seconded by Commissioner Stenstrom and carried. On motion of Commissioner Meyer, seconded by Commissioner Morris and carried, minutes of June 12, June 13, and June 19, 1972, were approved. Commissioner Meyer moved to appoint Fitzpatrick and Hartsock, CPA, as auditors for the City of Sanford for a three-year period. Seconded by Commissioner Morris and carried. After consideration, Commissioner Meyer moved to waive the bid requirement and to proceed with the emergency purchase of a City vehicle for the newly authorized housing inspector in the building department, and that cost be negotiated with those companies submitting recent bids on similar equipment. Seconded by Commissioner Stenstrom and carried. Lee Construction Company next submitted Estimate No. 2 in the amount of $46,272.90, covering period from May 25, 1972 to June 26, 1972, for work on the Wastewater Treatment Improve ments contract; and on motion of Commissioner Meyer, seconded by Commissioner Morris and carried payment was authorized for same. Miles B. Austin next submitted a request for an extension on Condemnation Report No. 71-372, Group 19, 710 Pecan Avenue, condemned October 28, 1971; and on motion of Commissione Morris, seconded by Commissioner Meyer and carried, a 90-day time extension was approved. After consideration, and on motion of Commissioner McClanahan, seconded by Commission Stenstrom and carried, the Mayor and City Clerk were authorized to execute notes for a period of four years, with interest at the rate of 4 3/4%, to finance equipmen~ in amounts as follows: Item 1: No. 92 IHC model 175 series C, loader tractor number 000511 $26,400.00 Item 2: No. 102 1972 Ford LN8000 truck, serial number R804VP16862 $11,437.78 with mounted 1972 Heil Mark III 20 CY refuse packer 5,840.00 $17,277.78 On motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried, Ordinance No. 1080, entitled: AN ORDINANC~ OF ~RE CITY OF SANFO~D, FLORIDA, A_I~E~DING O~LDINANCE NO. 771 OF SAI~ CITY, AS AMENDED, SAID ORDINANCE: BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMEND- MENT PLACING CERTAIN TERRITORY' IN THE DISTRICTS DELINEATED BELOW. was introduced and placed on its first readingand read in full. Commissioner Stenstrom then moved on the waiver of the requirement of the second reading of Ordinance No. 1080 and that same be placed on its final passage and adoption. Commissioner Morris Commissioner Stenstrom Yea Thereupon, the Chairman announced that .the City Commission of the City of Sanford, Florida, by unanimous vote, had passed andadopted said Ordinance No. 1080, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. ~771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID A~iEND- MENT PLACING CERTAIN TERRITORY IN THE DISTRICTS DELINEATED BELOW. .~ · After consideration, Commissioner Stenstrom moved to hold a public hearing on July 24 1972, to consider the closing, vacating and abandoning of portions of streets and alleys, and to authorize the City Clerk to advertise same as follows: Ail that part or portion of Maple Avenue lying North of Eighth Street, East of Block 9 of Tier 10, South of the South Florida Railroad (Seaboard Coast Line Railroad) and West of Block 9 of Tier 9; all that part or portion of that certain North-South alleyway dividing Block 9 of Tier 9; and all that part or portion of Seventh Street lying North of Block 9-of Tier 9, East of the South Florida Railroad (Seaboard Coast Line Railroad) South of Block 8 of Tier 9; and West of French Avenue (State Road #15-600) all according to E. R. Trafford's.Map of the Town of Sanford, as recorded in Plat Book 1, page 62, Public Records of Seminole County, Florida. Seconded by Commissioner Meyer and carried.
