M. 19 72 MIDS'I'ATE LEGAL SUPPLY COMPA/q~ The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on July 10, 1972. Present: Absent: Commissioner Gordon T. Meyer, Acting Chairman Commissioner A. A. McClanahan Commissioner John G. Morris Commissioner Julian L. Stenstrom City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Mayor-Commissioner Lee P. Moore Police Chief Ben E. Butler The meeting was called to order by the Acting Chairman. The first order of business was a public hearing to consider annexation of property in accordance with notice authorized by the City Commission to be mailed.~to owners of property described as follows: Lots 8 through 27, Lots 30 and 31, Block 24; Lots 5 and 6, Block 25, all in Dreamwold. The Chairman announced that the Commission would hear from anyone in favor of, or against, the proposed annexation. Clemens Baumeister, 2620 Mohawk Avenue, and his son appeared to state that City water service was received at said property and he had signed an annexation petition. After consideration, Commissioner Stenstrom moved to authorize the City Attorney to p~epare the proper ordinance for annexation of the above described property upon the proper certification of the petitions by the Seminole County Tax Assessor. Seconded by Commissioner Morris and carried. The next order of business was a public hearing to consider closing, vacating and abandoning a street in accordance with notice published in the Sanford Herald on June 16, 1972, as follows: -NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING A PORTION OF A STREET TO WHOM IT MAY CONCERN: You will take n~tice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on July 10, 1972, at the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the Public in and to that portion of a street hereinafter described, to wit: The East 138.7 feet of Rose Street. Also pre- sented was a petition bearing eight signatures of abutting property owners who registered objection. Petitioner Raymond E. Lundquist, owner of Lot 11 and South 16 feet of Lot 10, Normany Square, abutting said street, appeared to support the request and stated he proposed to con- struct a duplex on this property and.would utilize the additional 25 feet of the vacated street to comply with zoning requirements. The City Manager reported the existence of a 30-inch drainage pipe within this right- of-way and recommended against the abandonment of line. After discussion, Commissioner Stenstrom moved to deny the request. Seconded by Commissioner Morris and carried. ~ The next order of business was a public hearing held to consider amendments in certain district and boundaries of the Zoning Ordinance, in accordance with notice published in the Sanford Herald on June 30, 1972, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND~ AMENDMENTS IN CERTAiN.DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P M. on July 10, 1972, to.con- sider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows (a) That property lying between Cypress Avenue and Pine Avenue and between Third Street and Fourth Street is proposed to be rezoned from R-5 (One and Two Family Dwelling) District to C-2 (General Commercial) District. as/follows: Said property being more particularly described Lot 3, Block 17, Chapman and TUCkers Addition. Tatum, Jr. City Clerk of the City of ~Sanford, Florida George Andrew Speer, attorney for Herbert Moreland, Jr. appeared to support the request as outlined in Item (a). The Zoning and Planning Commission submitted a recommendation to deny the request. No one appeared to oppose the request. After consideration, Commissioner McClanahan moved to authorize the City Attorney to prepare an ordinance to rezone from R-5 (One and Two Family Dwelling) District to C-1 (Neighbor- hood Commercial) District that property described in Item (a) in the aforesaid notice of public hearing. Seconded by Commissioner Morris and carried. Tony Nicholson, developer of the Lake Mary Groves, appeared to support the request for the rezoning of the prOperty listed under Item (b) for utilization for apartment construction. No one appeared to oppose the request. After consideration, Commissioner Morris moved to authorize the CitY Attorney to pre- ~are an ordinance to rezone the property as described in Item (b) in the aforesaid notice of public hearing. Seconded by Commissioner Stenstrom and carried. After discussion, Commissioner McClanahan moved to table consideration of the rezoning of Item (c) until such time that engineering and develo'~ment plans for the total acreage is sub- mitted. Seconded by Commissioner Morris and carried. Recommendation next submitted from the Zoning and Planning Commission, and after con- sideration, Commissioner McClanahan moved to authorize the City Clerk to advertise a public hearing to be held July 24, 1972, to consider rezoning from R-lA (Single Family Dwelling) Distri~ to R-3 (Multiple Family Dwelling) DistriCt, property described as follows: That part of the NW~ of Section 2, Township 20 South, Range 30 East, lying East of ~nora-Grapeville Avenue and North and West of Lake Mary Road, less the North 666.60 feet; also less beginning from the Southwest corner of said NW~, run North along the West line of said NW~ a distance of 989.78 feet; thence run EJst 103.20 feet to the Easterly R/W line of Onora-Grapeville Avenue and a point of beginning; thence run South 79 07 59 East 423.79 feet to the Northerly R/W line of Lake Mary Road; thence run South 42o58'33'' West along said Northerly R/W line 400 feet to the intersection of the East R/W line of Onora-Grapeville Avenue; thence run Northwesterly along MINUTES City Commission, Sa'nford, Florida July.. 1~0 at 8:00 P. M. .:1.9 72 Statement dated June 26, 1972, next submitted from Clark, Dietz and Associates, Inc., for engineering services on the Sanford Marina Breakwater; and on motion of Commissioner Morris seconded by Commissioner Stenstrom and carried, payment was authorized in amount of $1,610.11. The Zoning and Planning Commission next submitted a recommendation to zone as R-1 (Single Family Dwelling) District the Linz property located south of the Sanford Airport on Silver Lake, upon annexation; as opposed to the developer's request for multi-family use. After discussion, Commissioner McClanahan moved to deny the request for the annexation of said property. Seconded by Commissioner Morris and carried. Recommendation next submitted by the Zoning and Planning Commission to annex 17 acres of land between Seminole Boulevard and West First Street and east of Terwilliger Lane, and to zone same as C-1 (Neighborhood Commercial) District. On motion of Commissioner McClanahan,sec- onded by Commissioner Stenstrom and carried, same was tabled to permit an overall annexation study of the area. The City Attorney next reported that a Cable Television operation was not considered a utility as applicable to the City's utility tax law. On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, Ordinance No. 1081, entitled: AN ORDINANCE OF THE CITY OFi~SANFO~, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957 was introduced and placed on its first reading and read in full. On motion of Commissioner Morris, seconded by Commissioner Stenstrom and carried, Ordinance No. 1082, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION 27.6 (a) (3) OF ORDINANCE NO. 1065, SAID SECTION RELATING TO THE AMOUNT OF WATER, SEWER AND DRAINAGE CONNECTION AND CONTROL CHARGES, SAID AMENDMENT CHANGING THE CLASSIFICATION RELATING TO MOTELS AND PROVIDING FOR MOBILE HOME PARKS. was introduced and placed on its first reading and read in full. On motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, current vouchers and payrolls were next approved as evidenced by: General Fund, Florida State Bank, Voucher Nos. 157131 through 147350; Water and Sewer Revenue Fund, Florida State Bank, Voucher Nos. 950 through 961; Policemen's Pension Fund, Florida State Bank, Voucher Nos. 319 through 322; Firemen's Relief and Pension Fund, Florida State Bank, Voucher Nos. 217 through 219; General Fund, Sanf0rd Atlantic National Bank, Voucher Nos. 1455 through 1522; Board of Bond Trustees, Sanford Atlantic National Bank, Voucher Nos. 414 through 416; Water and Sewer Renewal and Replacement Fund, United State Bank of Seminole, Voucher Nos. 58 through 61; Utility Service Taxes Fund, Sanford Atlantic National Bank, Voucher Nos. 40 and 41. Requests were next reported from the Seminole County Commission to consider: (1) a lease of the City jail facilities commencing January 1, 1973, to incarcerate juvenile and women ~ffenders; (2) the extension of utility lines outside the City to serve a proposed mental health building in the area of the County Road Department office. The City Commission instructed the City Manager to inform the County that the City is not interested in proposals as submitted. On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, the Administrative Report of the City Manager was accepted, as follows: Salary Reclassifications: Ronald Partridge, Certified Operator A - $6,445.00, annually Justin Martin, Certified Operator A - $6,445.00, annually Jimmie Freeman, Refuse Laborer D to E - $5,526.00, annually Louis Sheffield, Refuse Laborer D to E - $5,526.00, annually The Commission accepted the resignation of Dennis H. Brusnahan from the Citizens Advisory Board and instucted the City Manager to send a letter in recognition and appreciation for this service. After consideration, Commissioner Stenstrom 'moved to include in the proposed Charter that qualifying periods for candidates for the office of City Commissioner in the general elec- tion be similar to the County requirements as set forth in the State Statutes. Seconded by by Commissioner Morris and carried. After discussion, Commissioner McClanahan moved to authorize the City Manager to take bids on ten "judicial" type chairs for the City Commission Room. Seconded by Commissioner Stenstrom and carried over the dissenting vote of Commissioner Meyer. There being no further business, the meeting adjourned. lm MAYOR
