M. on October 9, 1972. Present: Mayor-Commissioner Lee P. MoOre Commissioner A. A. McClanahan Commissioner Gordon T. Meyer Commissioner John G. Morris Commissioner Julian L. Stenstrom City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler The meeting was called to order by the Chairman. . The first order of business was a Public Hearing to consider the condemnation of buildings or structures on Report Nos. 72-382 through 72-407, Group 23, in accordance with notices authorized at the regular meeting of September 25, 1972. The Chairman announced that the Commission would hear from any property owner or rep- 'esentative thereof. A review;of each individual report~was as follows: Report No. Location Owner 72-382 919 Orange Avenue John C. and Naomi Moore Commissioner Meyer moved that finding the building to be unsanitary, unsafe and dated, that said structure be condemned and the owner given a notice of thirty days in which to .ir or demolish, or give just cause why same has not been repaired or demolished; and after 30 days to authorize the City to demolish the structure and levy a lien against the property for said removal, under authority invested by Ordinance No. 768. Seconded. by Commissioner Stenstrom and carried. Report No. Location Owner ~. 72-383 618 Laurel Avenue Garfield and Agnes Walker Garfield Wa}kef appeared, and stated that the Building Officiai had approved repairs ~hich had been made to the house approximately two years ago; however, he was aware that the ~orch had decayed wood and was in need of repair. On recommendation of the Building Inspector .nd the City Manager and finding that there were no outstanding violations of the City Code, Commissioner Morris moved that the structure on Report No. 72-383, 618~Laurel Avenue, be re- red from the list of property under consideration for condemnation. Seconded by Commissioner 'er and carried. ' Report No. Location Owner 72-384 ~700 Laurel~Avenue George DiGiovanni, deceased After consideration and on recommendation of the Building Inspectors and City Manager there were no outstanding violations of the Building Code, Commissioner McClanahan moved to the structure from the list of property under consideration for condemnation. Seconded Commissioner Meyer and carried. Russell Mrs. Russell appeared and stated that on October 4, 1972, permits to repair the structures had been acquired from the City Building Department and that repair material had been purchased. On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, finding the structures to .be unsanitary, unsafe and dilapidated, that said structures be condemned and the owner given a notice of ninety days in which to repair or demolish; or give just cause why same has not been repaired, or demolished; and. after the 90 days to author- ize the City to demolish the structures and levy a lien against the properties for said re- moval under authority invested by Ordinance No. 768. Mincy, Deceased Commissioner Stenstrom moved that finding the building to be unsanitary, unsafe and dilapidated, said structure be condemned and the owner given a notice of ninety days in which to repair or demolish, or give just cause why same has not been repaired or demolished; and after 90 days to authorize the City to demolish the structure and levy a lien against the property for said removal, under authority invested by Ordinance No. 768. Commissioner Morris moved that finding the building to be unsanitary, unsafe and dilapidated, that the structure be condemned and the owner given a notice of ninety days in which to repair or demolish; or give just cause why same has not ~been repaired or demolished; and after 90 days to authorize the City to de- molish the structure and levy a lien against the property for said removal, under authority invested by Ordinance No. 768.~ Seconded by Commissioner Stenstrom and carried.. Commissioner McClanahan moved that finding the buildings to be unsanitary, unsafe and dilapidated, that said structures be condemned and the owner given a notice of ninety days in which to repair or de- molish, or give just cause why same has not been repaired or demolished; and after 90 days to authorize the City to demolish the structures and. levy a lien against the property for said re- moval, under authority invested by Ordinance No. 768. Report No. 72-405 Location 2489 South Orange Avenue Owner EliZabeth B Smith The notice sent by Registered Mail of the public hearing had been signed by a person other than Mrs. Smith. Commissioner McClanahan moved to table action until some additional contact had been made relative to the notice. Humphries The City Manager stated that Mr. Humphries had requested, the City to proceed with demolition of the.structure. CommisSioner Meyer moved that finding the building to be unsani- tary, unsafe and dilapidated, that said structure be condemned and the owner given a notice of thirty days in which to repair or demolish, or give just cause why same has not been repaired or demolished; and. after 30 days to authorize the City to demolish the structure and levy a lien against the property for said removal, under authority invested by Ordinance.. No. 768. Seconded by Commissioner Stenstrom and. carried. The next order of.business wasa. Public Hearing to consider amendments .in certain districts and. boundaries of the. Zoning Ordinance~in accordance with notice published, in the Sanford Herald on September 22, 1972, as follows:. NOTICE,OF PUBLIC HEARING ON. Notice is hereby given that a public hearing will.be held in the City Commission Room at the City Hall in the CitY of Sanford, Florida, at 7:00 o'clock P. M. on the 9th day of Octo- ber, 1972, to consider a proposed zoning ordinance for the City of Sanford, Florida, and. the Ail parties in interest and. citizen~ regulations, restrictions and. boundaries therein contained. shall have an opportunity to be heard at said hearing. Seconded by Commissioner Meyer and. carried. Commissioner McClanahan moved to amend the proposed, zoning map to designate that property being proposed for the construction of the Salvation Army from district RC-1 to districi SR-1, Lots 1 through 24, Bonaventure Subdivision, general location being west of Maple Avenue MINUTES October 9 at 7:00 P. M. City Commission, Sanford, Florida 72 between 22nd and 24th Streets. Seconded by Commissioner Morris and carried.. Commissioner Morris moved to amend the proposed zoning map to designate Lots 4 and 5, Normany Square, as RMOI District, general location in the area of Lakeview Avenue and south of Second Street. Seconded by Commissioner McClanahan and carried. After discussion, the Commission authorized amendments as follows: Page 28: RC-1-Restricted Commercial District (2) b. Private clubs and lodges: to permit consumption of alcoholic beverages on premises, subject to approval of the City Commission Page 31: Conditional Uses Permitted (2) g. "Sale of alcoholic beverages for consumption on or off the premises subject to approval of the City CommisSion, in accordance with Chapter 4 of City Code". Mrs. Stevens, owner of property on Persimmon Avenue,appeared to request GC2 (General Commercial) District for W~ of Block 4, Tier 22, E. R. Trafford's, and same was approved. Co~issioner McClanahan moved to authorize t'he City Attorney to prepare an ordinance to adopt the "Proposed. Zoning Regulations and Zoning Map" as amended; said ordinance to be placed on first reading at the regular meeting of October 23, 1972; mmd on final reading at the regular meeting of November 13, 1972. Seconded by Commissioner Morris and carried. Consideration next given to a contract dated May 10, 1972, submitted by Dan Acito Interior Design Consultants, Winter Park, Florida, covering decor services for the proposed Sanford Police Security Complex. On recommemdation of the City Manager, Commissioner Meyer moved to approve the contract upon amendment to reflect a payment schedule on percentage of work completed.. Seconded by Commissioner Stenstrom and carried. After consideration and on motion of Commissioner Morris, seconded by Commissioner Meyer and carried, payment was authorized of the annual membership dues in the Florida League Cities, Inc., in the amount of $1,200.00. After consideration, Commissioner Meyer moved to authorize the Recreation Department to sponsor State Tournaments for biddy and intermediate basketball teams in Sanford and to transfer $400.00 from Contingency Account No. 8150 to Recreation Account No. 4240 to provide for same. Seconded by Commissioner Stenstrom and carried. Request next submitted from the Seminole County Tax Collector to refund City portion of taxes, as follows: Year Amount 1970 Central Florida Foods, error in personal property tax return. $342.53 1971 Elsie Menendez, error in Realty Assessment $ 29.46 On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, the City Attorney was authorized to investigate for approval of same. The next item of business was the consideration of Ordinance No. 1039, imposing a 10% utility tax and not specifying any exemptions. After discussion, ~Co~issioner Morris moved to replace the traffic signal light at the intersection of 20th Street and Sanford Avenue with a caution light only. Seconded by Mayor Moore. Motion failed to carry over the dissenting votes of Commissioners McClanahan, Meyer and Stenstrom. Consideration next given to the damage of Pine Avenue between First Street and Second Street by Contractor's equipment during construction of Btam TOWers. The City Manager reported that letters to Cooperating Parishes, Inc., owner of Brim Towers, and. to the mortgage holder requesting repair of said street had been to no avail in that they recognized the damage but accepted no responsibility for the repair. Commissioner Morris moved, to notify Cooperating Parishes, Inc., to repair Pine Avenue between First and Second Streets and give 30 days in which to perform said repair and. upon failure to do so, City forces to effect the repair and costs to be billed to the respective organization and on failure to 'pay, a lien be placed against the property. Seconded. by Commis- sioner Meyer and carried, with Mayor Moore abstaining from vote. Application next submitted for transfer of a beer and wine license, No. 106, for consumption off the premises, from Flavious Waddle and William R. Spillman, to William R. Spillman, d./b/a B & W Market, 1303 Sanford Avenue; and. on motion of Corf~issioner Meyer, secor by Commissioner McClanahan and. carried., same was approved. On motion of Commissioner Morris, seconded by Commissioner Stenstrom and. carried, current vouchers and payrolls were next approved, as evidenced by: General Fund., Florida State Bank, Voucher Nos. 157768 through 157984; Water and. Sewer Revenue Fund., Florida State Bank, Voucher Nos. 996 through 1017; Policemen's Pension Fund, Florida State Bank, Voucher Nos. 334 through 337; Firemen's Relief and. Pension Fund., Florida State Bank, Voucher Nos. 226 through 228; General Fund, Sanford Atlantic National Bank, Voucher Nos. 1630 through 1700; Water and Sewer Renewal and Replacement Fund., United. State Bank of Seminole, Voucher No. 65; utility Service Taxes Fund, Sanford Atlantic National Bank, Voucher Nos. 44 and 45; Construction Trust Fund, Florida State Bank, Voucher Nos. 1 through 6. ' Request submitted by the Sanford Herald. for the City to Place an advertisement in the annual Progress Edition at a cost of $326.80, $50.00 additional for color. On motion of Commis- sioner Morris, seconded, by Commissioner McClanahan and carried, the request was denied. On motion of Commissioner Stenstrom, seconded, by Commissioner McClanahan and carried, the aforesaid request was referred, to the Greater Sanford Chamber of Commerce for consideration to use, if necessary, Industrial Committee Funds for publication .of the City of Sanford ad in the Progress Edition. After review of costs, Commissioner Morris moved, to authorize the installation of a caution light at the intersection of Park Avenue and Commercial Street and. a transfer of $402. from Contingency Account No. 8150 to Traffic Signal Account No. 4644, to provide for same. M. 19 72 Statement next submitted from the Seminole County Tax Collector in the amount of $3,224.25 fOr commission on cOllection of the 1971 Tax Roll and Warrants from October, 1971, through June, 1972. On motion of Commissioner McClanahan, seconded by Commissioner Morris and. carried, payment of same was authorized. On motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, Thanksgiving Day and the Friday following were authorized to be observed in the Holiday Schedule Commissioner McClanahan moved that the Pledge of Allegiance to the United States Flag be given prior to each City Commission meeting. Seconded by Commissioner Morris and carried. Commissioner Stenstrom submitted a request from the Sanford Plaza Merchants that the speed limit on Airport Boulevard from US 17-92 east to the Sanford Christian Church be increased. from 25 miles per hour to 35 miles per hour and moved to approve the request. Seconded by Com- missioner Meyer and carried over the dissenting votes of Commissioners McClanahan and Morris. There being no further.business, the meeting ~adjourned. MAYOR
