The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 13, 1972. Present: Mayor-Commissioner Lee P. Moore Commissioner A. A. McClanahan CommiSsioner Gordon T. Meyer Commissioner John G. Morris City Attorney W. C. H~tChison, Jr. City Manager W. E. Knowles CitY Cl'erk H. N. Tamm, Jr. Absent: Commissioner Julian L. Stenstrom Police Chief Ben E. Butler The meeting was called, to order by the Chairman. The Reverend Amos Jones, Director of Seminole Community Action, appeared, to submit petitions requesting the Commission to consider placing in the charter, to be voted on December 1972, a requirement for a candidate for the City Commission to reside in a specific district. Mr. Jones stated the petition contained 1,594'signatures and. approximately 300 had been elimi- nated as not being registered voters; however, that the Seminole County Supervisor of Elections had advised him that the signatures could not be certified prior to December 5, 1972. The City Attorney advised that the question could not be properly advertised, to be included as a Charter Amendment on the December 5th ballot. After consideration, Commissioner Morris moved to accePt the petitions and. that the City Commission, at the first regular meeting in January, take aCtion to set a date for a special City election to determine the question of "districting" for the CitY of Sanford. Seconded by Commissioner Meyer and. carried.. Request submitted by jaCk E. Rathmell, Vice President and. General Manager of Monroe Harbour, Inc., for a permit to sell beer and wine for consumption off the premises at the Marina and on motion of Commissioner McClanahan, seconded by Commissioner Morris and. carried, same was denied on the basis that the existing lease with Monroe Motels, Inc., d/b/a Holiday Inn, pro- hibits sales in conflict ~with their lease. Thomas Wilson, III, Executive Director of the Sanford Housing Authority, appeared to support a letter requesting the Commission to waiver or grant forbearance for the payment in lieu of taxes in the amount of $8,30L00. Mr. Wilson stated, the Authority is operating at a defi, cit of $8,000.00 per month and anticipated, funds from Department of Housing and Urban Develop- ment had. been delayed. After discussion, Commissioner Meyer moved, to approve the request to delay payment until April 1, 1973. Seconded by Commissioner Morris and carried.. The next order of business was a Public Hearing to consider closing, vacating and abandoning a street right-of-way in accordance with notice published, in the Sanford Herald on October 27, 1972, as follows: NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING A PORTION OF A STREET TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. M. on November 13, 1972, at the City Commission Room at the City Hall in the MINUTES City Commission,~ Sanford, Florida November 13 at 7: 00 P. Fi. 19. 72 City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the Public in and to that portion of a street hereinafter described, to wit: That portion of Sixth Street lying between Westerly right-of,way line of Laurel Avenue and the Seaboard Coast Line Railroad right-of-way and abutting Block 8, Tier 8, E. R. Trafford's Map of Sanford, on the North. Persons interested may appear and be heard at the time and. place above specified. CITY COMMISSION OF THE CITY OF SAN-FORD, FLORIDA BY: H. N. Tamm, Jr., City Clerk The Chairman announced that the Commission would hear from those persons in favor of, or against, the proposed street vacating. No one appeared in opposition. Lou Temple appeared to support the request and outlined comtemplation of enlarging his present commercial structure. The City Manager reported there existed a 10-inch water main on the south side of the right-of- way and power lines on both sides of right-of,way. After discussion, Commissioner Meyer moved to table the request to permit Mr. Temple to discuss the matter with representatives of the Florida Power and Light Company. Seconded by Commissioner Morris and carried. Tim Bannick, President of Drug Action Cou~ittee of Seminole County, 1100 East First Street, appeared to request funds for purposes of dr~g prevention, and after consideration, Commissioner McClanahan moved to authorize a contribution of $300.00 to said. organization and a transfer from Contingency Account No. 8150 to provide for same. Seconded by Commissioner Morris and carried. Kennis K. Dolgner, President of Seminole County Association for Retarded Children, 203 East 15th Street, appeared to request secondary funding for TAFETA, a program for adult retardees; and after consideration, Commissioner Meyer moved to authorize a $300.00 contribution to said organization and a transfer from Contingency Account No. 8150 to p~ovide for same. Seconded by Commissioner Morris and carried. Consideration next given to requests.for.vacating, closing and abandoning alleys and streets, as follows: 1. SoUthern Chemical Company; to vacate all of that certain east-west alley in Block 1, Tier 7, E. R. Trafford's Map of Sanford. - 2. Hal Harris; to vacate that portion of east-west alley abutting Lot 12 on the north, Neave's Normany Square. 3. William Kirk and Ernest SOuthward; to vacate portions of streets, as follows: a, Mulberry Street from north line of Water Street to Seminole Boulevard. b. Pomegranite Street from north line of First Street to Seminole Boulevard. c. Tamarind Avenue from north lime of First Street.to a point 666.25 feet south of Seminole Boulevard. · d. On motion of Commissioner Meyer, seconded by Commissioner Morris and carried., a public hearing was authorized to be held on December 11, 1972, and. the City Clerk authorized to advertise same. Vernon Mize, Jr., Attorney for Hal Washburn, developer of an 88-unit apartment complex on 4.2 acres of property located on the west side of US 17-92, appeared to request an exception or variance from the GC-2 (General Commercial) District, under the proposed Zoning Ordinance. Mr. Mize stated that all final plans had been formulated on the multi-family re- quirements under the current Zoning Ordinance with a density of 21 apartments per acre and thal it would be a financial burden to change plans to correlate to a lower density of 17 apartment~ per acre under the proposed ordinance. After discussion, Commissioner McClanahan moved, to authorize the building department to issue a building permit on the project as now formulated as to density under the present Zoning Ordinance. Seconded. by Commissioner Meyer and. carried. Sid Vihlen, Jr., appeared, to submit preliminary plans prepared, by John Hudson, archi- tect, for a six-unit two-story apartment on Lots 6 and 7, Normany Square, and to request a variance from the ~J40I District under the proposed Zoning Ordinance, due to formulating plans as to density requirements of R-3 (Multiple Family Dwelling) District under the existing Zonin Ordinance. After consideration, Commissioner McClanahan moved, to authorize the building de- partment to issue a building permit based on the project as now formulated under the existing Zoning Ordinance. Seconded by Commissioner Meyer and carried. Attorney C. Vernon Mize, jr., representing Northridge, Inc., appeared to request consideration of~annexation of Lot 2 and Lots 4 through 12, Lake Minnie Estates, approximately 44 acres located on the west side of US Highway 17-92. Seconded by Commissioner Walter Weible, representing the Downtown Merchants Business.Association, appeared to request tM following: (1) Use of City Parking Lot No. 2, east of the Chamber of Commerce Build- ing for the week of November 27, 1972, for the purpose of setting up Kiddie Rides; (2) Exempt occupational license for said Kiddie Rides operation; and after consideration, Commissioner Meyer moved to approve the request. Seconded by Commissioner McClanahan and carried. The Commission authorized all taxicab licenses to be reviewed as to the hours of service being rendered and the police department to check the mechanical and operating condition of said taxicabs and to submit a report on same. M. on August 2, 1972, in'the amount of $202.00 in the case of Bennie Boozer, Docket No. 104717, charge of Careless Driving. Seconded by Commissioner Morris and carried.' After review by the City Attorney, Commissioner Morris moved to authorize the Mayor and City Clerk to execute an agreement dated April 28, 1972, with the Seaboard Coastline Rail- road Company and J. Brailey Odham for the installation and. maintenance of a sewer main and. a water main across the right-of-way and. under the main track of said. Railroad. Company near Sanora Subdivision and Hunt property, east of Sanford Avenue and. south of Airport Boulevard. Seconded by Commissioner Meyer and carried.. RESOLUTION Be it resolved, by the City Commission of the City of Sanford in regular meeting assembled that the Mayor-Commissioner of said City be, and he hereby is, authorized, to enter into an agreement with the SEABOARD COAST LINE RAILROAD COMPANY and. J. Brailey Odham, and to sign same on behalf of said City covering the installation and maintenance of a sewer main and a water main across the right of way and. under the main track of said Railroad Company at or near Hunt, Florida; as more particularly described and set forth in said agreement, which agreement is dated April 28, 1972, a copy of which agreement is filed with this City Commis- sion. On recommendation of the City Manager, Commissioner Meyer moved to authorize the Mayor and City Clerk to execute a Mutual Fire Aid Agreement with the City of DeLand. by Commissioner Morris and carried.. Statement next submitted from Sanford Electric Company, Inc., dated November 9, 1972 in amount of $5,000.00 for partial payment on agreement for electrical work in the restoration of Pier A of the Lakefront Marina; and on motion of Commissioner Meyer, seconded by Commis- sioner McClanahan and carried, same was approved. Estimate No. 6 next submitted in amount of $82,583.11 from Lee Construction Company for work completed through October 25, 1972, on the Secondary Sewage Treatment Plant constuc- tion; and on recommendation of the City Manager and. the Consulting Engineers, Commissioner Meyer moved to authorize payment of same. Seconded by Commissioner Morris and carried. Commissioner McClanahan further recommended that in the proposed Zoning Ordinance, Page 17, Item (3) - Density Controls, the following sub-items to read as follows: a. Minimum required lot area: To read: 6,000 square feet for single family and 7,500~:square feet for two-family dwelling. b. Minimum required living area: To read.: 900 square feet for single family dwelling unit and 700 square feet for each unit of two-family unit. Commissioner Morris moved to table the second reading of the proposed Zoning Ordinance No. 1097 until the next regular meeting. Seconded by Commissioner Meyer and carried. On motion of Commissioner Meyer, seconded by Commissioner McClanahan' and carried, Ordinance No. 1098, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 26210, LAWS OF FLORIDA, ACTS OF 1949, AS AMENDED, BEING THE CHARTER OF THE CITY OF SAN-FORD, FLORIDA. was introduced and placed on its first reading and read in full. On motion of Commissioner McClanahan, seconded by Commissioner Morris and carried, minutes of October 30, 1972, were approved. Harry Skop next appeared to request the Commission to consider establishing a second polling place for City Elections, and same was taken under consideration. The City Manager advised the Commission that there wOuld be a refund to the City from the General Employees Pension Fund with Travelers Insurance Company if the employees vote to abandon the existing plan and obtain coverage with State Pension Plan, and. requested the Commis- sion to pledge the City's refund to purchase past service credits of said employees who also pledge their refunds to purchase past service credits, and after discussion, the Commission approved same. Commissioner Meyer introduced Resolution No. 1121, and after being read in full, moved on its passage and adoption. Seconded. by Commissioner McClanahan and carried. Said Resolution No. 1121 being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, OPPOSING RELOCATION OF THE MARKET NEWS SER- VICE ON VEGETABLES FROM THE SANFORD STATE FARMERS MARKET TO ORLANDO, FLORIDA. WHEREAS, the Market News Service for many years has emanated, from the State Farmers Market at Sanford, Florida, serving vegetable growers and the vegetable industry of which Sanford is the hub; and WHEREAS, it has come to the attention of the City Commission of the City of Sanford, Florida that it is proposed to remove said service from Sanford, Florida to Orlando, Florida and it is the feeling of the City Commission of the City of Sanford, Florida that such move not only be costly but would not be in the best interest of the vegetable industry. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida that the proposed move of the Market News Service on vegetables from the Sanford State Farmers Market to Orlando, Florida, be and the same is hereby opposed and. all parties being involved therewith be and the same are hereby urged to reconsider such action·~ BE IT FURTHER RESOLVED that this Resolution be spread upon the minutes of the City Commission of the City of Sanford, Florida, and copies hereof delivered to all aPpropriate indi- viduals and agencies.
