Those appearing to oppose were as follows: Harold Speers, Lakeland., representing ~loyd Enterprizes, d/b/a Sanford Auto Theater, Inc., operator of the Movieland Drive-In Theater; · Gillespie, Vice Presidant of Art Grindle Dodge; and Blanton Owen. Those appearing to support the annexation were as follows: C. Vernon Mize, Jr., for Northridge, Inc., proposed 40-acre condominium development; Harold. Fues, President, Dynamic Development CorporatiOn, developer of 47 family units in Shenandoah Valley; Bonnie Johnston, representative from Environmental Development & Planning Company, to develop for Royal Line Builders on 20 acres; Sanford Kay, Casselberry, proposed, to develop 40 acres south of the con- sidered area; and Jack Prosser, President, Jack Prosser Ford Company. The City Manager stated signatures represented the majority of property owners who desired to be incorporated into the City Limits. After consideration, Commissioner McClanahan moved to authorize the City Attorney to prepare an ordinance to annex the aforesaid property upon certification of the petitions by the Seminole County Tax Assessor. Seconded by Commis- sioner Morris and carried.. W. A. Adams next appeared to object to the proposed rezoning of the property on which his warehouse is located., thereby preventing an addition to be made to this structure. After discussion of the restrictions on further development of properties in the proposed zoning ordinance, Commissioner McClanahan moved to authorize an amendmendment of the Zoning Ordinance to add a section as follows: 9. GC General Commercial District B. Conditional usas permitted '. (1) Add: Or any use permitted in the RI-1 (Restricted. Industrial) District. Seconded by Commissioner Morris and carried. On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, final reading of Ordinance No. 1097 was tabled until December 11, 1972. Seconded by Commissioner Meyer and carried. MINUTE'S City Commission, s~nford, Florida November 27 at 7:00 P. M. 19 72 C. Vernon Mize, Jr., Attorney for N°rthridge, Inc., appeared to request rezoning from R-1AA (One Family Residential Dwelling) District, to MR-1 (Multiple Family Residential Dwelling) District, property as follows: That property lying west of Highway 17-92 and south of Lake Mary Boulevard, more particularly described as Lot 2 and Lots 4 through 12, Lake Minnie Estates. After consideration, Commissioner Meyer moved to authorize a public hearing to be held. on December 11, 1972, to consider said zoning amendment, and. to authorize the City Clerk to ad- vertise same. Seconded by Commissioner Stenstrom and. carried. Consideration next given to two appraisals of City property. Parcel 1. Appraisal prepared by John Sauls and Raymund Lundquist setting forth a fair market value in the amount of $23,400.00 on property as follows: Beg. at NE intersection of Myrtle Avenue and Water St., run north 303.95 feet south 69 degrees 17 feet east 125 feet south 259.54 west 117 feet to beg. and north ½ of street adjacent on south and. west ½ of vacated alley on east in Sec. 25-19-30, Seminole County, Florida. (located on the SE corner of the intersection of Seminole Boulevard and Myrtle Avenue) Parcel 2. Appraisal prepared by Everett A. Harper and. A. O. Roberts setting forth a fair market value in the amount of $36,675.00 on property as follows: 25-19-30 Beg. 559 feet N & 249 feet E of SE corner of Block 1N Tr 9, run E 163 feet N to lake, Wly on lake to point N of beg., S to beg. (less Blvd.) Town of Sanford, Seminole County, Florida. (located south side of Seminole Boulevard. and. east of Fkench Avenue) Letter submitted from Herbert E. Stenstrom, Realtor, expressing interest of his clienl in submitting an offer to!purchase Parcel 1. Letter dated November 22, 1972, submitted from Howard H. Hodges, Chairman of the Bankers Committee of the Greater Sanford Chamber of Commerce, expressing interest in the prop- erties under a packaged land development of the lakefront into a people-orientated commercial and retail center, and requested that the City not make a firm commitment to sell to an indivi- dual until said committee could meet with the prospective investors to develop its original total project. Letter dated November 20, 1972, submitted, from Walter J. Gardner, 121 South Scott Avenue, expressing an interest in purchasing said property. Consideration also given to letter dated October 12, 1972, from J. W. Hickman, M.D., Winter Park, to purchase said. property. After discussion, Commissioner Meyer moved to table consideration of the sale of the aforesaid parcels until December 11, 1972, to permit all interested parties to appear and submit details as to their development plans for the property, including type of project, valuation, and starting and completion dates; and further, to authorize the City Manager to notify all parties of same, Seconded by Commissioner Stenstrom and carried. Lou Temple next appeared to support his request to vacate a portion of West Sixth Street, considered at a Public Hearing held on November 13, 1972, and tabled. After discussion with petitioner and. Scott Burns, Manager of Florida Power and Light Company, Commissioner Meyer moved to authorize the City Attorney to prepare an ordinance to MINUTES City Commission, Sanford, Florid Novemb~O0 P. M. 19. 72 vacate and abandon Sixth Street lying between the west right of way line of Laurel and the Seaboard. Coast Line Railroad right of way, retaining utility easements in s aid right of way as follows: Fourteen-foot utility easement on the north side of the center line of West Sixth Street. Fourteen-foot utility easement lying 7 feet on each side of the City 10-inch water main located. 18.5 feet north of the south right of way line of West Sixth Street. Seconded by Commissioner Stenstrom and carried. Petition next submitted by Trustees of the St. Paul Missionary Baptist Church, Inc., 813 Pine Avenue, to purchase for parking area that property described as follows: East ½ of Lot 5, Block 10, Tier C, E. R. Trafford's Map of Sanford. After consideration, Commissioner Meyer moved to authorize the City Clerk to acquire an apprais al of the fair market selling price of said property, with the appraisal fee not to exceed $25.00. Seconded by Commissioner McClanahan and carried. The City Manager reported the City. refuse personnel preferred to receive salary pay- ment for holidays worked in lieu of the present extra week vacation. After consideration, Commissioner Meyer moved to accept~the change in policy ard to authorize the transfer of $2,819.75 from Contingency Account No. 8150 to Refuse Salaries Account No. 4901, to cover the five remaining holidays in the 1972-73 fiscal year. Seconded by Commissioner Stenstrom and carried. Consideration next given to tabulation of bids opened publicly at 2:00 P. M. on November 22, 1972, for the furn~hing of gasoline and diesel fuel oil, effective January 1, 1973, in accordance with Invitation to Bid published in the Sanford Herald on October 27, 1972. .BID TABULATION Company Gulf Oil Company Jacksonville, Fla. Seconded by Commissioner McClanahan and carried. After consideration and on motion of Commissioner McClanahan, seconded by Commis- sioner Stenstrom and carried, payment was authorized to A. C. Doudney Surveyors, Inc., Sanford, in the amount of $626.00 for a survey of the City limit boundary. On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, payment MINUTES City Commission, Sanford, Florida November 27 at 7:00 P. M. .19 72 was authorized to the Sanford Herald., Sanford, in amount of $2,063.36 for advertisement of the City Charter amendment; and to transfer funds in the amount of $1,690.00 from Contingency Account N°. 8150 to City Commission, Charter Committee Expense Account No. 1183. On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, a transfer of funds was authorized in the amount of $34,044.00 from Contingency Account No. 8150 to Police Detention Salaries Account No. ,2201.4 to cover the unbudgeted 8-month period in the 1972-73 budget for prisoner detention. After discuSsion, Commissioner Meyer moved to authorize joint participation with the Seminole County to widen and improve Airport Boulevard between US 17-92 and Sanford Avenue witk a pledge of Contingency funds of up to $10,000.00 for payment of materials. Seconded by Com- missioner Morris and carried. Commissioner Meyer next introduced. Resolution No. 1122, and after being read in full moved on its passage and adoption. Seconded by Commissioner Stenstrom and carried. Said Resolution No. 1122 being in words and figures as follows: RESOLUTION NO. 1122 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING A JOINT PARTICIPATION WITH SEMINOLE COUNTY IMPROVING AIRPORT BOULEVARD BETWEEN HIGHWAY 17-92AND SAN-FORD AVENUE IN SANFORD, FLORIDA. WHEREAS,' Airport Boulevard between Highway 17-92 and Sanford Avenue has become and will continue to be an important arterial connecting link handling traffic of the City of Sanford and. Seminole County; and WHEREAS, the CitY Commission has determined the importance of improving this road. and has designated the same as an appropriate joint project with Seminole County.. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida that Airport Boulevard between Highway 17-92 and. Sanford Avenue be designated as an appropriate joint participational project with Seminole County. BE IT FURTHER RESOLVED that there is herby authorized the expenditure of up to $10,000.00 for the payment for materials to resurface and widen said road. to a width of 24 feet and to install the appropriate drainage, said expenditure being conditioned upon Seminole Count~ Florida, furnishing toward, said project the necessary labor, equipment and. supervision. BE IT FURTHER ~RESOLVED that this Resolution be spread upon the minutes of the City Commission of the City of Sanford, Florida, and appropriate copies hereof being delivered, to Seminole County, Florida. Stenstrom and carried. Seconded by Commissioner Commissioner Morris moved to table to December 11, 1972, consideration of a~proposed Sign Ordinance. Seconded by Commissioner McClanahan and carried. On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, minutes of October 23, 1972, were approved. Ordinance No. 1098, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 26210, LAWS OF FLORIDA, ACTS 0F~1949, AS AMENDED, BEING THE CHARTER OF THE CITY OF SANFORD, FLORIDA. placed on its first reading and. read in full at the meeting of November 13, 1972, was next placed on its second, and. final reading. After being read in full, Commissioner McClanahan moved on its passage and adoption. Seconded by Commissioner Meyer and carried. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1098, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 26210, LAWS OF FLORIDA, ACTS OF 1949, AS AMENDED, BEING THE CHARTER OF THE CITY OF SANFORD, FLORIDA. Dick Williamson, d/b/a Cook's, at the intersection of Park Drive and Hiawatha Avenue, appeared to request consideration of extending the hours of operation for sale of alcoholic beverages on New Year's Eve. After discussion, Commissioner McClanahan moved to ,authorize all establishments serving alcoholic beverages, including those serving beer and wine, with con- isumption on the premises, with no exceptions keyed to seating capacity, be permitted to operate on Sunday, December 31, 1972, New Year's Eve, from the hours of 12:00 Noon to 2:00 A. M. the following morning, Monday. Seconded by Commissioner Morris and carried. After discussion, Commissioner Meyer moved to authorize the City Manager to confer the Florida Power and Light Company representatives to recommend a future policy for the Subdivision Ordinance regarding the requirement for all electric wiring to be installed under- ground, versus the necessity of main feeder lines to be suspended. Seconded by Commissioner Stenstrom and carried. On motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried, payment was authorized to Raymond Lundquist and John Sauls in amount of $50.00 each for appraisa services. After discussion, Commissioner Stenstrom moved to authorize an exchange of City prop- erty, Parcel A for Parcel B, owned by William L. Kirk, as follows: PARCEL A: From the Northeast Corner of Section 11, Township 20 South, Range 30 East, Seminole County, Florida, run Southerly 711.6 feet to the West line of Old State Road No. 3, now State Road. 15 & 600, thence run S. 24o34'' W. along the original right of way line of said. Seconded by Commissioner Meyer and carried. After consideration, Commissioner Meyer moved to authoCize payment in amount of $260.00 to Sanford Herald and. Radio Station WTRR to cover advertisement for five weeks of the city-wide refuse'cleanup. Seconded by Commissioner Mot=is and. carried. The City Commission authorized the acceptance of a check in the amount of $12,806.70 representing the~.sale to Branda Properties, Inc., of 1.3 acres west of US 17-92, on the north side of Airport Boulevard., for the development of a Zayre'.s Shopping Center. After consideration, Commissioner Meyer moved to accept the letter of resignation from City Attorney William C. Hutchison, Jr., effective when a replacement is determined., and to authorize a resolution be prepared commending the City Attorney for his devoted service and in appreciation by the Board.; and. in addition, to authorize an inscribed, plaque to be pre- sented to him; and that Mr. Hutchison be retained to finish any lawsuits new pending and. involving the City of Sanford. Seconded by Commissioner McClanahan and. carried over the opposing vote of Mayor Moore. There being no further business, the meeting adjourned. lm
