Ordinance No. 1097, entitled: An Ordinance amending Ordinance No. 771 of the City of Sanford, Florida, said Ordinance being adopted February 26, 1962, being a Comprehensive Zoning Regulation for the City of Sanford, Florida, dividing the city into districts and establishing the boundaries thereof; regulating and restricting the erection, construction, reconstruction, alteration, repair, or use of buildings, structures, or land or water; regulating and restricting the height, number of stories, and size of buildings and other structures; regulating and restricting the percent- age of lots that may be occupied; regulating and restricting the size of yards, courts, and other open spaces; regulating and restricting the density of population; regulating and restrict- ing the location and use of buildings, structures, and land and water for trade, industry, residence, agriculture, and other purposes; defining certain terms herein used: providing for the administration, enforcement, and amendment of this regulation: establishing and defining the powers and duties of the Board of Zoning Adjust- ment: setting a schedule of fees, charge and expenses; setting penalties for violation of these Zoning Regulations and authoriz- .ing resort to other remedies to prevent or abate violations; providing that these Zoning Regulations shall supersede any previous Zoning Ordinance or Resolutions providing a separability clause authority to codify, and for other purposes. placed on its first reading and read in full at the meeting of October 23, 1972, was next placed on its second and final reading. After being read in full, Commissioner Meyer moved ~n its passage and adoption. Seconded by Commissioner Morris and carried. M. ,19 72 23, 1972, as follows: TO WHOM IT MAY CONCERN: NOTICE OF PROCEEDING FOR VACATING AND CLOSING AN ALLEY You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. M. on December 11, 1972, in the City Commission Room at the City Hall in the City of San- ford, Florida, will consider and determine whether or not the City will close, vacate and aban- don any right of the City and the public in and to that east-west alley between Laurel Avenue and Elm Avenue and between Fulton Street and Commercial Street, being more particularly des- cribed as follows: Ail of that certain east-west alley in Block 1, Tier 7, E. Irving Feinber. g, Presiden Southern Chemicals, Inc., 204 North Elm Avenue, petitioner, appeared to support the request and stated that he was the owner of the entire block and the alley had never been opened to the public in 27 years that he had occupied this location, and, further, he proposed to connect th~ two buildings across the alley with floor level cross walks. After consideration, Commissioner Meyer moved to authorize the City Attorney to pre- pare an ordinance to clos&, vacate and abandon that portion of alley as advertised in the fore- going notice of public hearing. Seconded by Commissioner Morris and carried. The next order of business was a Public Hearing to consider closing, 'vacating and abandoning portions of street rights-of-way in accordance with notice published in the Sanford Herald on November 23, 1972, as folloWs: NOTICE OF PROCEEDING FOR VACATING AND CLOSING PORTIONS OF STREETS TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. William L. Kirk, petitioner, appea to support the request for proposed development of the area. After discussion, Commissioner Meyer moved to authorize the City Attorney to prepare an ordinance to close, vacate and abandon that portion of streets as set forth in the foregoing advertised notice of public hearing. Seconded by Commissioner Stenstrom and carried. Commis- sioner McClanahan abstained from voting. The next order of business was a Public Hearing to consider closing, vacating and abandoning a portion of an alley in accordance with notice published in the Sanford Herald on November 23, 1972, as follows: NOTICE OF PROCEEDING FOR VACATING AND CLOSING A PORTION OF AN ALLEY TO WHOM IT~MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. M. on December 11,: 1972, in the City Commission Room. at the City Hall in-the City of Sanford Florida, will consider and determine ~hether or not the City will close, vacate and abandon any right of the City, and the public in and to a portion of east-west alley between Second (Union) Street and Rose Street and between Locust Avenue and Lake'View Avenue, being more particularly described as follows: That portion of east-west alley abutting Lot 12 on the north, Neave's Normany Square. Mrs. Fairby Singletary, 812 East 4th Street, presented to the Commission a petition with signatures of ten property owners within an area of 300 feet of the alley, who opposed the closing. Price, 214 Lake View Avenue Hal Harriss, Architect, appeared to support the request and to represent Horace and Thelma Rouse and J. A. Jarrell who proposed to build a two-story 24 unit apartment building on four lots divided by said alley, and further agreed to meet the City's requirements to protect the 12-inch sewer line in this alley. After discussion, Commissioner McClanahan moved to table action on the request to permit the architect to meet with the Zoning and Planning Commission to attempt to work out plans for multiple story construction without the closing of the alley. Seconded by Commissioner Morris and carried over the opposing votes, of Commissioner Meyer and Commissioner Stenstrom. Consideration next given to two appraisals on City property submitted at regular meeting of November 27, 1972 and tabled, as follows: PARCEL 1. Located on the Southeast corner of the intersection of Seminole Boulevard and Myrtle Avenue; appraised at $23,400.00 PARCEL 2. Located south of Seminole Boulevard and east of French Avenue; appraised at $36,675.00 Proposals for purchase and use of the property were considered as follows: William L. Kirk--PARCEL 1. Proposed a 2-story office building at an investment of ?$500,000.00; pay appraised value; construction to start by April 1, 1973, contingent upon soil borings report, with completion in June, 1973; 100 employees. Bm J. W. Hickman~ J'D.D.S. Disclaimed interest in PARCEL 2, due to Bankers Group interest in same for an "over- all lakefront development concept"; offer $35,000.00 for PARCEL 1. Proposed a four-story office building of 40,000 square feet with an investment of $700,000.00 as a joint venture with W. I. Holt & Sons, Nashville, Tennessee. Con- struction to start within six m°nths. Dr. Hickman proposed to lease off-street park ing areas to provide the required number of spaces for a four-story building. Herbert E. Stenstrom, Realtor and Trustee offered $40,000.00 for PARCEL 1. Proposed a four-story office building of approximately 12,000 to 16,000 square feet. Invest- ment of $360,000.00 to $450,000.00. Construction completion date on or before July 1, 1975. De Walter J. Gardner Relinquished his offer to purchase PARCEL 1 but indicated interest in PARCEL 2, no offer submitted. Col. Jim Dyson, President of the Investors Group, appeared to state that no development plans had been formed for property west of Myrtle Avenue but the group was interested in the future development of PARCEL 1. Copy of a letter to William Kirk from Howard H. Hodges, Chairman of the Bankers Committe of the Greater Sanford Chamber of Commerce, stated that as a result of a joint meeting between the Bankers Committee and the Investors concerning the lakefront property, they would leave PARCEL l~out of their plans, With Mr. Kirk's intent t© conform architecturally to the total concept for the area. After consideration, Commissioner Morris moved to declare PARCEL 1 to be no longer of public necessity and of use to the City and made available for sale. Commissioner Morris then moved on the waiver of the requirement of the second reading of Ordinance No. 1099 and that same be placed on its final passage and adoption. Seconded by Commissioner Meyer. APpraisal next submitted by W. Garnett White, Real Estate Broker, setting forth a fair market value of $475.00 for City property described as.follows: EaSt~ of Lot 5, Block 10, Tier C, E. R. Trafford's Map of. Sanford. ~The Trustees of the St. Paul Missionary Baptist Church, Inc., 813 Pine Avenue, submitted a proposal on November 27, 1972, to purchase said property to be utilized as~a parking area. .After discussion that this parcel was not contig- uous to the church property,~.and;that there were approximately seven residences within the block, Commissioner Meyer moved to table action on the matter to permit the City Manager to Seconded by Commissioner Stenstrom and Attorney C. On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, same was approved. Statement dated September 15, 1972, next submitted from T. W. Blount, Jr. & Son Contract ing Company, Jacksonville, Florida, for final payment in the amount of $2,376~33, for reconstruc. tion of Pier A, Riverport Marina. After consideration, Commissioner McClanahan moved to with- hold payment until work has been satisfactorily completed in accordance with the Contract. Seconded by Commissioner Meyer and carried. Periodic Estimate No, 7 next submitted from Lee Construction Company in the amount of $85,316.65 for period of October 25, 1972 to November 27, 1972, for work completed on construc~. tion of secondary sewer treatment plant. After consideration, Commissioner Meyer moved to autho rize payment of same. Seconded by Commissioner Stenstrom and carried. Application next submitted by Freddie Sweet for a permit for sale of beer fOr consump- tion off premises, at The Fishing Hole, 1218 South French Avenue, and o~/~otion of commissioner Me~'~r, ~econded by Commissioner McClanahan and Carried, same was approved. Request submitted for a transfer of permit for sale of intoxicating liquor for consump- tion off premises, from John Alexander, Executor, to John M. Fitzpatrick and Richard M. Harvin, dba C & C Liquor Package Store, 326 Sanford Avenue, and on motion of Commissioner McClanahan, seconded by Commissioner Meyer and carried, same was approved. After discussion, Commissioner McClanahan moved to establish a policy and to amend the Subdivision Regulations to include the following: Any construction on an unpaved street by a developer or owner, said party will be required to place in escroW with the.City an amount determined!~to be one-third (1/3) cost of the paving of the street; with said payment to be made at the time the building permit is acquired. Seconded by Commissioner Morris and carried over the dissenting vote of Commissioner Meyer. After discussion, Commissioner Meyer moved to re-appoint Mayor Lee P. Moore and Com- missioner Julian L. Stenstrom as the City Commission members to serve on the Greater Sanford Chamber of Commerce "Executive Committee". Seconded by Commissioner McClanahan and carried. On recommendation ~of Municipal Judge Berry,'Commissioner Meyer moved to authorize to set aside bond estreated on October 19, 1971, in the amount of $22.00, in the case of Clarence Leroy Wallis, Docket No. 100283. State Bank, to be designated as depositories for City funds for the Year of 1973, and on motion by Commissioner Meyer, seconded by Commissioner Stenstrom and carried, same were approved. On recommendation of the City Manager, Commissioner Meyer moved to approve a par- rial payment in amount of $4,000.00 to Clark, Diet. z and Associates-Engineers, Inc., Sanford, for services rendered on construction of the Sewage Treatment Plant, under agreement dated Janu- ary 26, 1970.. Seconded by Commissioner Stenstrom and carried. Commissioner McClanahan moved to authorize a transfer of funds in ~the amount of $179.00 from Contingency Account #8150 to Parks and Cemetery, Building Repairs and Maintenance, Account #4121, to provide material for fencing around the office trailer located on the City Hall site. Seconded by Commissioner Meyer and carried. After review and on recommendation of the Zoning and Planning Commission, the C~ty Commission approved the revised plat of Hidden Lake, Unit I-A, and authorized the Mayor and City Clerk to execute same.
