M. on December 26, 1972. Present: Mayor-Commissioner'Lee P. Moore Commissioner A. A. McClanahan Commissioner Gordon T. Meyer Commissioner John G. Morris Commissioner Julian L. StenStrom City Attorney W.:C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N.~Tamm, Jr. Absent: Police Chief Ben E. Butler The meeting was called to order by the Chairman. Mrs. Stella Woodhouse, 104 Hays Drive, Sanford, appeared to submit a petition of 170 signatures requesting that prior to any sale of the city property on the lakef=ont, the City CommiSsion obtain a master plan for orderly development of said property. On motion of Com- missioner Meyer, seconded by Commissioner McClanahan and carried, the petition was a~cepted. Letter dated December 12, 1972, next submitted from Gulf Life Insurance Company, proposing an amendment to Policy No. 2232, covering group life insurance for City employees. After discussion, Commissioner Stenstrom moved to authorize an increase from $1,000.00 to $3, for life insurance coverage to be furnished by the City for each employee, effective January 1, 1973; and, further, to authorize the City Manager to submit recommended transfers in amount of $2,425.50 to provide for said expense. Seconded by Commissioner Meyer and carried. After consideration of recommendation submitted by the Board of Trustees of the Gen- eral Sanford Memorial Library, Commissioner Meyer moved to accept resignations of members who can no longer serve, as fOllows: George Touhy, Douglas Stenstrom, R. W. Deane, William Ao Leffler, B. F. Whitner, Roy Wright, Jr., George A. Speer, Jr., and Mike Bowes; and to appoint persons to serve on said Board as follows: Irene Hinton Carmeta Ray G. Troy Ray, Jr. Peg Chase Ann Sieczkowski Julia Chase Julian L. Stenstrom General J. C. Hutchinson Seconded by Commissioner McClanahan and carried. Recommendations next submitted by the Zoning and Planning Coimnission, as follows: I Appeals continue to be submitted to the Board of Adjustment II III Subdivision Regulations be amended to include that transmission lines be install~ to the best engineering technology available, with an attempt to keep these lines in the rear of the development, if technology allows them to be underground. Item II: Commissioner McClanahan moved that any deviation from the Subdivision Regulations requirement for installation of electrical wiring underground be presented to the City Commission for their consideration and approval. Seconded by Commissioner Stenstrom and carried. Item III: Commissioner McClanahan moved to table any action on rezoning property of Royal Line Builders, Inc., until such time as the annexation certification for said area is received from the Seminole County Tax Assessor. Seconded by Commissioner Stenstrom and carried. Items I and IV: Commissioner Meyer moved to authorize the City Attorney to prepare the proper or- dinance to amend the Zoning Ordinance to include Item IV, and 'to approve Item I. Seconded by Commissioner McClanahan and carried. On recommendation of the Municipal Judge, Commissioner Meyer moved to set aside bonds estreated in Municipal Docket cases as follows: 1. Docket #104191, Eart Hendry, $27.00 bond estreat~d on June 6, 1972. 2. Docket #107330, Robert G. Stokes, $27.0.0 bond estreated on December 5, 1972. Seconded by Commissioner McClanahan and carried. After consideration, Commissioner McClanahan moved to authorize the purchase of a paint sprayer and to transfer $300.00 from Building Repairs & Maintenance Account #4621, to Equipment-General, Account #4626, to provide for same. Seconded by Commissioner Meyer and carried. After consideration, Commissioner McClanahan moved to authorize the City Attorney to prepare an ordinance to amend the ordinance adopting the Southern Standard Building Code, 1969 Edition, Chapter IX, Section 901.6-General, to include the requirement of a sprinkler system in all buildings, constructed after this date, that exceed 45 feet above the finished ground elevation. Seconded by Commissioner Meyer and carried. Consideration next given to tabulation of bids submitted on December 11, 1972 on items as follows: - ITEM #1 Police cars, tabled at meeting of December 11, 1972. On motion of Com- missioner ~Stenstrom, secbnded ~by Commissioner~Meyer and carried, bid was accepted from Mid-Florida Dodge, Inc.,~1801.West First Street, Sanford, in the amount of $25~916~71 for'furnishing seven Dodge Polara high per- ~. ~.~formance police pursuit cars.. ~. . .... ~ ~ ITEM #7 Commissioner McClanahan moved to rescind action taken on December 11, 1972, to award the bid on one rescuevan to Jack Prosser Ford Company at a cost of $3,951.70 and.to'reject all bids and~to 'authorize the City Manager to readvertise. Seconded by Com- MINUTES City Commission, San£ord, F10rida,, Degember 26, at 7:00 P.M. 1972 Any construction on an unpaved street by a developer or owner, said party will be required to place in escrow with the City an amount determined to be one-third (1/3) cost of the paving of the street; with said payment to be made at the time that the building permit is acquired. and further moved that the policy is hereby established to include the following: Any new construction on an unpaved street by a developer or owner, said party will be requimed to place in escrow with the City of Sanford an amount determined to be fifty perc. ent (50%) of the cost of the paving of the street; with said payment to be made at the time the building permit is acquired. Seconded by Commissioner McClanahan and carried. After discussion, Commissioner Meyer moved to authorize the City Manager to write a letter requesting the State Legislative Delegation to sponsor local legislative action to incorporate into the City those areas surrounded by the City of Sanford. Seconded by Commis- sioner Stenstrom and carried over the dissenting vote of Mayor Moore. Consideration next given to an appraisal submitted and action tabled at meeting of December 11, 1972, on property as follows: East ~ of Lot 5, Block 10, Tier C, E. R. Trafford's Map of Sanford. The City Manager reported that the abutting property owner, Elsie Menendez, had made an offer to purchase said property at the appraised value of $475.00, plus $25.00 appraisal fee. After discussion with the Trustees of the St. Paul Missionary Baptist Church, the Commission tabled action until January 8, 1973, to permit said Trustees to determine if they had an interest in the property at that price. Consideration next given to the drainage of Valencia Court, West, San Lanta Subdivi- sion, being developed by Austin Development Company. The City Commission authorized the City Manager to write a letter to the Federal Housing Administration to inform them that occupancy of certain homes are in violation of city ordinances; and, to determine if relief from flooding could be obtained from either the FHA or the developer, William Austin, Austin Development Company. Letter dated December 20, 1972 submitted from HenryM. Kittleson, Holland and Knight, Attorneys for Sanford Auto Theatres, Inc., Movieland Drive-In Theatre, registering objection made orally at public hearing on November 27, 1972 to the proposed annexation of said property. On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, minutes of November 27, 1972, and December 6, 1972~were approved. Garfield Walker appeared to report on the proposed purchase from Herman and Rose Jacobson, of eleven structures condemned on October 9, 1972, and given a 90-day period to Janu- ary 12, 1973 to repair or demolish same as follows: Group 23 Report No. 72-393 Location 703~ Orange Avenue MINUTES City Commission, Sanford,~ Florida. ' December 26 at 7:00 P.M. ]9 72 Gr.0up. 2.3~ Cont'd Report No. 72-399 400 401 402 403 Location 905 East 7th Street 711 Orange Avenue 709 Orange Avenue 705 Orange Avenue 703 Orange Avenue Mr. Walker stated that the structure at 709 Orange had been demolished and proposed to demolish 703~ and 711 Orange Avenue, and to move one or more buildings to provida open space, and fur- ther requested sufficient time to repair the remaining structures to comply with the City Codes After consideration, Commissioner McClanahan moved to authorize a 90-day time exten- sion to April 12, 1973, with consideration to be given to future extensions based on review of the progress of the repairs; however, the total time not to exceed nine months from January 12, 1973. Seconded by Commissioner Meyer and Carried. On motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried, the Mayor, City Clerk and City Attorney were authorized to .enter Safety Deposit Box No. 177 at the Sanford Atlantic National Bank. Letter next submitted from Greg Drummond, Chairman, Seminole County Board of County Commissioners, requesting reservation of seven parking spaces on Hood Avenue in front of the east entrance to the new Courthouse for the purpose :of:emergency use by county department heads not housed within the new courthouse. After discussion, Commissioner McClanahan moved to autho. rize reserving seven parking spaces on the west side of the Municipal Parking Lot, east of Hood Avenue, with the stipulation that the seven spaces to be available for the county department heads on a temporary basis until such time as the old courthouse has been razed; and, further, that Hood Avenue parking spaces will remain open and available for general use by the public. Seconded bY Commissioner Stenstrom and carried over the dissenting vote of Mayor Moore. After discussion, Commissioner Stenstrom moved to authorize the Mayor and City Clerk to execute plats of Lake Mary Estates and Lake Mary Estates Recreation Area upon the final approval by the Zoning and Planning Commission. Seconded by Commissioner McCtanahan and carried Consideration next given to appraisal of Parcel I submitted on November 27, 1972 and proposals submitted DeCember 11,. 1972~ to purchase and develop property loca~ted.on-the south- east corner of the intersection of Seminole Boulevard and Myrtle Avenue. Proposals dated December .18, 1972, submitted from William L. Kirk, increasing his offer to purchase to $31,500.00. · ' ' : ' . . . 'i i . ' · '~ ' Herbert E. Stenstrom, Realtor, submitted a notice of withdrawal of his offer to pur- chase in behalf of his client, Stenstrom, Davis & McIntosh. Letter submitted from Dr. J. W. Hickman recommending to vacate Myrtle Avenue and thereby add 42 feet to said city property. The Chairman submitted a letter, dated December 21, 1972, from C. Howard McNulty, President, Florida State Bank, calling attention to the use for parking of 32 cars on bank property adjacent to the Police Station and recommending consideration be given to the problem MINUTES Commission, ..sanford, Florida December~ 26' at 7: 00 ?'~ M. 1972 After consideration, Commissioner Morris moved to accept the proposal submitted by William L. Kirk in the amount of $31,500.00 to purchase the aforesaid property with the stipu- lation that construction of a 22,000 square foot building will begin no later than April 1, 1973 or the property reverts to the City. Seconded by Commissioner McClanahan and carried over the dissenting vote of Commissioner Meyer. Request submitted from H. Miller, owner of Yellow Cab, to revise rates and operations of taxi-cabs in the City and on motion of Commissioner Morris, seconded by Commissioner McClana- han and carried, this request was scheduled.for study at Work Session on January 15, 1973,~ at 4:00 P. M., and all taxi operators invited to attend. On motion of Commissioner Morris, seconded by C~mmissioner McClanahan and carried, Ordinance No. 1100, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING CERTAIN STREETS IN THE CITY OF SANFORD, FLORIDA, AS DELINEATED BELOW. was introduced and placed on'its first reading and read in: full. Commissioner Morris then moved on the waiver of the requirement of the second reading of Ordinance No. 1100 and that same be~placed on its~final passage and adoption; Seconded by Commissioner McClanahan. OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING CERTAIN STREETS IN THE CITY OF SANFORD, FLORIDA, AS DELINEATED BELOW. On motion of Commissioner Meyer, seconded by Commissioner McClanahan and carried, Ordinance No. 1101, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1039, WHICH SAID ORDINANCE AMENDED SECTION 23-8, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, AS AMENDED, ESTABLISHING A TAX OF TEN PERCENT ON CHARGES TO UTILITY USERS, SAID AMENDMENT PROVIDING EXEMPTIONS T~HEREFROM.. was introduced and placed.on its first reading and read in full. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote, had passed and adopted Ordinance No. 1101, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1039, WHICH SAID ORDINANCE AMENDED SECT%ON 23-8, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, AS AMENDED, ESTABLISHING A TAX OF TEN PERCENT ON CHARGES TO UTILITY USERS, SAID AMENDMENT PROVIDING EXEMPTIONS THEREFROM. After further discussion, Commissioner Meyer moved to accept with regrets the resig- nation of William C. HUtchison, Jr., as City Attorney, effective December 31, 1972 and to table action on the appointment of a City Attorney until January 8, 1973. Seconded by Com- missioner Stenstrom and carried. The City Commission authorized the City Manager to investigate the fees and proposals for the services of a professional traffic analyst for a survey and recommendations for the downtown traffic patterns.
