M. 1973 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of sanford, Florida, at 7:00 o'clock P. M. on February 12, 1973. The first order of business was a Public Hearing to consider amendments in cer- tain districts and boundaries of the Zoning Ordinance in accordance with notice published in the Sanford Herald on January 26, 1973, as follows: NOTICE OF 'PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is herebYTgiven that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on February 12, 1973, to consider changes and amendments to,the Zoning Ordinance of the City of Sanford, Florida, as follows: That property North of 29th Street and abutting Magnolia Avenue is proposed to be rezoned from SR-1AA (Single-Family Residential~ District to SR-1 (Single Family Residential Dwelling) District. Tatum, Jr. City Clerk of the City of Sanford, Florida Publish January 26, 1973 The Chairman announced that the Commission would hear from those persons in favor of, or against, the proposed rezoning as recommended by the Zoning and Planning Commission. No one appeared in support or opposition of'same. After consideration, Commissioner Meyer moved to authorize the City Attorney to pre- pare the proper ordinance to rezone the property as described in the foregoing notice of public hearing. Seconded by Commissioner McClanahan and carried. The City Commission then recessed at 7:10 P. M. to attend a State Legislative Dele- gation public hearing inthe County Commission Room of the Seminole County Courthouse for pur- poses of presenting 1973 P~oposed bills for introduction to the State Legislature. The City Commission reconvened and the Chairman called the meeting back into session at 9:00 o'clock P. M. Commissioner Gordon Meyer reported to the Commission that the bill to redefine the boundaries of the city limits annexing certain pockets surrounded by city had been voted down. Construction of a bulkhead around said fill in Lake Jennie. Mr. Davis submitted all of the exhibits necessary to make application to the State Agencies requesting permission for said fill and stated that the City's approval would be sub- ject to the approval and standards set forth by the reapective state agencies. After consideration, Commissioner Stenstrom moved to approve the request subject to approval of responsible State Agencies; and further, the City Commission reserves the right to approve the construction details of the bulkhead and drainage facilities. Seconded by Com- missioner Meyer and carried over the dissenting vote of Commissioner McClanahan. Ordinance No. 1104, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION 27.6 (a) (2) OF ORDINANCE NO. 1065, SAID SECTION RELATING TO THE :,AMOUNT 0F'~WATER, ~SEWER.AND~ DRAiNAGES:CONNECTION AND CONTROL CHARGES, SAID AMENDMENT CHANGING THE CLASSIFICATION RELATING TO APARTMENTS, TOWNHOUSES, PATIO HOMES, CONDOMINIUMS AND ALL OTHER TYPE OF MULTIPLE'FAMILY DWELLINGS. placed on its first reading and read in full at the meeting of January 22, 1973, was next placed on its seco~d~:and-final:reading. After being read in full, Commissioner:~Meyer moved on~-~its passage and adoption. Seconded by Commi'ssioner Morris. Same failed to carry by the unani- mous NAYE vote of the Commissinn. Ordinance No. 1105, entitled: AN ORDINANCE OF THE CITY OF SAN~ORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER IN AC- CORDANCE WITH THE PROVISIONS OF CHAPTER 5~-1815, LAWS OF FLORIDA, ACTS OF 1957. placed on its first reading and read in full at the meeting of January 22, 1973, was next place~ on its second and final reading. After being read in full, Commissioner Meyer moved on its passage and adoption. Seconded by Commissioner Stenstrom and carried over the dissenting vote of Cow~issioner McClanahan. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1105, entitled: AN ORDINANCE OF THE CITY OF SANFORD,' FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF-THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER IN AC- CORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. Consideration next given to request submitted by Monroe Harbour, Inc. for a license for sale of beer and wine for consumption off premises at the Marina and tabled at meeting of January 31, 19~3. Commissioner Morris moved to approve the request for sales at the main dry storage building. Seconded by Commissioner Meyer and carried over the dissenting vote of Commissioner McClanahan. Commissioner Stenstrom moved to authorize payment of balance of $500.00 to Fitzpatrick and Hartsock, Certified Public Accountants, for preparation of the City's 1971-72 Audit. Hutchison, Jr., Attorney for Lakefront Development, L~d.,.(the Bankers' group)i, to purchasecitg:property adjacent to Standard Oil property on the south side of Seminole Boulevard east,of French Avenue at the appraised price of $36,675.00 After consideration, Commissioner McClanahan moved to decline the~offer as submitted and to advertise that firm proposals would be considered for purchase of the property on March 12, 1973 with a minimum acceptable bid of $49,217.00 and with stipulations as follows: 1. The net'price of the land to be paid to the City .of Sanfor'd. 2. Ail fees shall be paid by the buyer--none by the City of Sanford. 3. List the proposed use and extent Of improvements in detail. 4. State the completed value of the improvements. 5. State the anticipated starting date and completion date of the construction of improvements. 6. Include a certified check for ten (10) percent of the land price as a binder. Seconded by Commissioner Stenstrom and carried with Mayor Moore abstaining from vote. LIQUORS MAY BE SOLD, SAID AMENDMENT ADDING AN ADDI- TIONAL AREA TO SAID ZONE. was introduced and placed on its first reading and read in full. Commissioner Morris then moved on the waiver of the requirement of the second reading of Ordinance No. 1106, and that same be placed on its final passage and adoption, oSeconded by Commissioner Stenstrom. The City Manager reported on a meeting held on January 31, 1973, with taxi cab opera- tots and Attorney McIntosh. Consideration given to requiring additional insurance coverage; the condition of taxicabs; and to requiring more frequent cab inspections, and after discuss Commissioner McClanahan moved to table the matter for additional information. M. 1973 (b) To provide for a part-time laborer in the Zoo division for the balance of the fiscal year in amount of $2,132.00; Commissioner Morris moved to authorize a transfer from Public Projects Zoological Gardens Improvements Account to Zoo Division, Salary Account ~4301 to provide for item (b). Seconded by Commis- · r slone Stenstrom and carried. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize the salary reclassification of Hezekiah Ross, from Fireman Class D to Fireman Class E, at an annual salary of $7,716.80. Seconded.by Commissioner Morris and carried. Periodic Estimate No. 9 in the amount of $139,336.36, next submitted from Lee Con- struction Company, covering work on the secondary sewer treatment plant for period of December 28, 1972 throBgh January 29, 1973; and on recommendation of the project engineer and the city manager, Commissioner Meyer moved to approve payment of same. Seconded by Commissioner Sten- strom and carried. After discussion, Commissioner McClanahan moved to authorize a salary increase to the City Manager in amount of $420.00, retroactive to October 1, 1972. Seconded by Commis- sioner Meyer and carried over the dissenting votes of Mayor Moore and Commissioner Morris. After consideration, Commissioner McClanahan moved to authorize a save pay provision in the position classification pay plan of the City, wherein when an employee receives a promo- tion and the new classification places the employee in a lower wage scale, the old rate of pay will prevail. Seconded by Commissioner Stemstrom and carried. The City Attorney submitted an amendment to an agreement entered into on January 22, 1973 with Austin Development Corp. providing for alternate plans for construction of drainage of Section III, and on motion of Commissioner Meyer, seconded by Commissioner Morris and car- ried, the Mayor and City Clerk were authorized to execute same. On recommendation of the CityAttorney, Cow~issioner McClanahan moved to authorize payment in the amount of $114.50, in accordance with Final Judgement of the Small Claims Court, Seminole County, Florida, Docket No. 71-9564, City of Sanford vs. Margaret Elizabeth Ball, Thomas Bowling Ball and Michigan Millers Mutual Insurance Company for claim in amount of $397.88, for damage to city street light and'pole on May 24, 1970.
