The first order of business was a Public Hearing to consider amendments in certain districts and boundaries of the Zoning Ordinance in accordance with notice published in the Sanford Herald on March 15, 1973, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA '~ ~.~Notice iS hereby given that a Public Hearing will be held at the COmmission Room in the City Hall in the'City of~Sanford, Florida, at 7:00 o'clock P. Hutchison, Jr., Attorney, appeared to support the closing and recommended that a utility easement be. reserved~by-the.~City; and fCrther~, if a future utility easement were needed that his client would be receptive to working.out~a feasible location with the City. He also indicated that h~s client woutd,'bear the cost of,r~lOCating~the'utilities in the street right-of-way. After consideration, Commissioner Meyer moved to authorize the City Attorney to prepare the proper ordinance-to close, vacate, 'and abandon that certain p~rtion of Maple Con- course as described in the foregoing notice of public hearing. Mr. Hutchison reported that the Sanford Center Apartment complex was planned for construction on the 14 acres in the Lake Monroe Industrial Park Amended Plat with maximum density of 19.16 units per acre. After completion of the plans and financing, the City had adopted a new Zoning Ordinance, ~':~therefOre he was :requesting this' project to be grandfathered under the old ordinance denslty requirements, and onrmotion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, same was approved. The next order of bu~ness was a Public Hearing to consider vacating, closing, and abandoning portions of certain alley right-of-ways in accordance with notice published in the Sanford Herald on March 8, 1973, as follows: . John Mero, Stenstrom Realty, appeared to support the request and stated the closing was necessary to permit construction in one block by the Salvation Army and construction in the other block of a furniture store; and further, there were. no water, or sewer, utilities in these rights-of-ways and removal of the existing power lines was being worked out with the Florida Power and Light Company. Reverend Elliott reported that Clarence Wynn, owner of other property on said street, did not oppose the street closing. Ted Williams, owner of property abutting Grandview Avenue, appeared and opposed the clos- ing at this time and stated he had applied to have his property rezoned and if this request is approved he would withdraw his objection. After discussion, Commissioner McClanahan moved to table the request to close Grandview Avenue until April 9, 1973, to permit consideration of Mr. Williams' rezoning request. Se- conded by Commissioner Stenstrom and carried. Recommendation. next submitted by the Zoning and Planning Board to deny the request to rezone property described as follows: 1. W~ of Lot iA, Seminole Heights and Lots 19-24, Block 2, Palm Terrace, from SR-1 (Single Family Residential Dwelling) District to GC-2 (General Commer- cial) District. 2. E~ of Lot iA, Seminole Heights, and Lots 34-36, Block 2, Palm Terrace, from SR-1 (Single Family Residential Dwellimg) District to MR-2 (Multiple Family Residential) District. Commissioner McCIanahan moved to authorize a Public Hearing to be held on April 9, 1973, to consider said rezoning and to authorize the City Clerk to advertise same. Seconded by Com- missioner Stenstrom and carried. On motion of Commissioner McClanahan, seconded by Commissioner Meyer and carried, Ordinance No. 1115, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXIN-~ TO AND INCLUDING WITHIN THE CORPORATE AREA OF..THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. was introduced and placed on its first reading and read in 'full. Commissioner Meyer moved to authorize a Public Hearing to be held on April 23, 1973 to consider an amendment to Article V, Section 4, Paragraph D l(a) of the Zofling Ordinance to reduce the Mobile Home Park Minimum Site Area Requirement from 20 acres to 10 acres and to authorize the City Clerk to advertise same. Seconded by Commissioner McClanahan and carried. Consideration next given to request to close and vacate the East 20 feet of Glenway Drive from Washington Street to Clinton Street, and on motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, a Public Hearing was authorized to be held on April 23, 1973 and the City Clerk authorized to advertise same. After discussion, Commissioner Meyer moved to authorize a Public Hearing to be held on April 23, 1973 and to authorize the City' Clerk to advertise same to consider rezoning from MR-1 (Multiple Family Residential Dwelling) District to MI-2, (Medium Industrial) Dis- trict, that property described as follows: Blocks 53, 54, 55, 62 and 63, M. M. Smith's Subdivision. After discussion, Commissioner Meyer moved to table the request until 4:00 P. M. John Mero appeared to sup- port the request for rezoning. After consideration, Commissioner Meyer moved to authorize a public hearing to be held on April 23, 1973, to consider said rezoning, and to authorize the City Clerk to advertise same. Seconded by Commissioner Meyer and carried. The City Attorney reported that the engineering firm for Gordon Nutt, developer.. of Washington Oaks was to have proposed corrective plans available in the City Manager's office on March 30,~1973, with another meeting proposed to be ~eld on April:2, 1973 with Mr. Nutt and his Attorney. On motion of Commissioner Meyer, seconded by Commissioner McClanahan and carried, consideration of the matter was tabled until April 2, 1973, at 4:00 P. M. Jesse Graham, Attorney for Dick Bond, developer of Hidden Lakes subdivision appeared to request authority to post a maintenance bond in the amount of '$100,000.00 to be in force at all times; and after consideration and on motion of Commissioner Meyer, seconded by Commissioner McClanahan and carried, the developer was authorized to post an irrevocable bank letter of credi to cover maintenance performance on Hidden Lakes Subdivision, Section I and II. After consideration, Commissioner Stenstromraoved to authorize the payment of $900.00 to Dan Acito, Dan Acito Interior Decorators, Inc., Winter Park, on contract for interior design of the proposed Police Security Complex. March 26,, at 7:00 PM 19 73 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 11, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, AS AMENDED, SECTION 11-12.1 THEREOF, AS AMENDED, SUCH SECTION IMPOSING A FEE FOR THE COLLECTION OF REFUSE AS DEFINED THEREIN PRESCRIBING THE AMOUNT OF SUCH FEE AND DEFINING USAGES UPON WHICH SAID FEE IS BASED AND PROVIDING FOR THE METHODS OF BILLING, SAID AMENDMENT CHANGING THE FEES FOR REFUSE COLLECTION AS TO MULTIPLE FAMILY RESIDENCIES. was introduced and placed on its first reading and read in full. After consideration, Commissioner Meyer moved to authorize the transfer of permit for sale of alcoholic beverages for consumption on premises, from John Whelchel and Mike Whel- chel, d/b/a Club Lui, Inc. to Gerald H. Balz, d/b/a Lui Lounge. Seconded by Commissioner McClanahan and carried. Statement next submitted in amount of $1,242.00 from Attorney William C. Hutchison, Jr. in case of Monroe Harbour vs. City of Sanford re: sunken docks at the marina. On motion of Commissioner McClanahan, seconded by Co,m~issioner Meyer and carried, payment of same was authorized. After consideration, Commissioner Meyer moved to authorize to waive the development fee applicable to Shenandoah Village, Phase I. Seconded by Commissione~ Stenstrom and car- ried. On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, the City Manager was authorized to attend the 22nd Southeastern Management Institute at the University of Georgia, April 18-20, 1973. William L. Kirk, recent purchaser of city property on Seminole Boulevard and Myrtle Avenue appeared to inform the City Commission that the property was not sufficient in size for the required 155 parking spaces for the proposed construction and therefore he was returning the unrecorded deed and requested a refund. After consideration, CommisSioner McClanahan moved to accept the deed in accordance with the reverter clause contained therein; and to further authorize a refund of $31,500.00. Seconded by Commissioner Meyer and carried. Application next submitted by James D. McGough for a permit for the sale of beer and wine, for consumption off premises at 606 West llth Street; and on recommendation of the Chief of Police, Commissioner Meyer moved to approve same. Seconded by Commissioner McClanahan and carried. Section 2. There is hereby excluded from this resolution any authority to include in any agreement entered into under Section 3 hereof any service, position, employee, or ~fficial now covered by or eligible to be covered by an existing retirement system sponsored by the City of Sanford except social security only after holding a referendum, in which all employees and officials in the affected~ units have the right to participate. Only those employees and officials electing coverage under the Florida Retirement System by affirmative vote in said referendum shall be eligible for coverage, and those not participating or electing not to be covered by the Florida Retirement System shall remain in their present system and shall not be eligible for coverage. After said referendum is held, all future employees shall be com- pulsory members of the Florida Retirement System. Section 3. The Mayor is hereby authorized and directed to execute all necessary agreements and amendments thereto with the Department of Administration for the purpose of extending the benefits provided by the Florida Retirement System to the employees and officials of the City of Sanford as provided in Section I and 2 hereof, which agreement shall provide for such methods of administration of the plan by said City of Sanford as are found by the Administra- tion of the Florida Retirement SyStem to be necessary and proper, and .shall be effective with respect to services in employment covered by such agreement performed on and after the 1st day of May, 1973. Section 4. Withholding from salaries, wages, or other compensation of employees and of- ficials for the purpose provided in Section 1 hereof are hereby authorized to be made, and shall be made, in the amounts and at such times as may be required by applicable State laws or regulations, and shall be paid over to the Administrator designated by said laws or regu- lations to receive such amounts. SeCtion 5. There shall be appropriated from available funds, derived from revenue from the City of Sanford operations such amounts and at such times as may be required to pay promptly the contributions and assessments required of the City of Sanford, Sanford, Florida, as em- ployer, as applicable State laws or regulations,~wh:~h~i~ha~t~:~e, paid over to the lawfully designated Administrator of the Florida Retirement System at the times and in the manner provided by law and regulations.
