M. .19 73 269 The City Commission of the City of Sanford, Florida, met in Regular Session at the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on May 14, 1973. Present: Mayor-Commissioner Lee P. Moore Commissioner A. A. McClanahan Commissioner John G. Morris Commissioner Julian L. Stenstrom City Attorney C. Vernon Mize, Jr. City Manager W. E. Knowles City ~lerk H. N. Tan~n, Jr. Police Chief Ben E. Butler Absent: Commissioner Gordon T. Meyer The meeting was called to order by the Chairman. The first order of business was a Public Hearing to consider annexation of property in accordance with notice authorized by the City Commission on April 23, 1973, to be mailed to owners of property described as follows: Lots 13 through 16 and Lots 18 through 27, Blk 13, Dreamwold Subdivision AND That portion of Lots 13 through 17, Blk 20, Dreamwold, lying south of the c/1 of 26th Street extended Westerly AND Lots 1 through 8, 8 A, and Lots 11 thrOugh 17, Blk 23, Dreamwold Subdivision~ AND Lots 8 through 27 and Lots 30 and 31, Blk 24, Dreamwold Subdivision AND Lots 1 through 11 and Lots 24 through 35, Blk 25, Dreamwold SubdiVision. The Chairman announced that the Commission would hear from those persons in favor of, or against, the prpposed annexation. Mrs. Amelia Williamson, 711 Briarcliffe Street, owner of Lots 18,~19 and 20, Block 13, Dreamwold, property abutting~the proposed annexation, appeared to submit a petition in opposition. Mr. Eugene D. Dimmock III, 701 Briarcliffe Street, owner of Lots 26 and 27, Block 13, appeared in opposition. After discussion, Commissioner McClanahan mOved to authorize the City Attorney to prepare the proper-~ordinance to amnex said property, upon certification by the Seminole County Tax Assessor. Seconded by Commissioner Morris and carried. Mr. Joe Bojanowski, Rt. 1, BOx 254 B, Sanford, appeared to oppose the proposed annexa- tion. ~ Mrs. Francis Phillips Bank, 111 Crystal Drive, Sanford, appeared to support the an-] nexation. After discussion, Commissioner McClanahan moved to table action for further discussion with other property owners in the area. Seconded by Commiss~ net Morris and carried. Statement next submitted from Dan Acito in amount of $900.00 for interior design work on the Police Security Complex. On motion of Commissioner Morris, seconded by Commis- sioner McClanahan, payment was authorized. Recommendation next submitted from the Zoning & Planning Commission to amend the Zoning Ordinance, sC-3, to require off-street parking, except for retail commercial uses with 1,000 square feet o3 less of sales area within 300 feet of a City Parking Lot. Commissioner Morris moved to authorize a Public Hearing to be held on June 11, 1973 to consider same. Seconded by Commissioner McClanahan and carried, Commissioner Morris moved to authorize the City Attorney to report on the legality of a policy recommended by the Zoning & Planning Commission to require set-backs from roads in newly annexed property. Statement next submitted i~mmount of $100.00 from the City Attorney for professional services rendered in the case Raphael vs. City of Sanfomd. On motion of Commissioner McClanahan seconded by Commissioner Morris and carried, payment was authorized. Requests next submitted to close portions of streets and alleys as follows: (a) E 25 feet of Glenway Drive abutting Lots 46, 47 and 48, Cottage Hill Subdivision; and (b) N-S alley between Lakeview and Locust and N of Rose Street. On motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, a Public Hearing was authorized to be held June 11, 1973 and the City Clerk was authorized to advertise same. On motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, Minutes of April 9, April 27 and May 9, 1973 were approved. On motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, current vouchers and payrolls were next approved as evidenced by: MINUTES City CommiSsion, Sarfford, FlOrida May 14, ~t 7:00 P. M. 19. 73 MIDSTATELEGAL SUPPLY COMPANY Firemen's Relief and Pension Fund, Florida State Bank, VoUcher NOs. 248 thru 250; General Fund, Sanford Atlantic National Bank, Voucher Nos. 2042 thru 2096; Construction Trust Fund, Florida State ~Bank, Voucher Nos. 21 thru 24; Utilities Service Taxes Fund, Sanford Atlantic National Bank, Voucher No. 52; Water and Sewer, 1953 Sinking Fund Interest, Account Nos. 53 and 54; Utility Trust Fund, United State Bank, Voucher No. 1; Public Project Fund,. John Dragash, Gutman, Dragash and Matz, Architects for the Law Enforcement Center (Police Security Complex) appeared to submit the revised cost figures from the contractor for construction of said structure. The City Manager reported that if the~..utility building were constructed of metal, instead of concrete panels, the cost of said building would be cut by more than one-half. After discUssion, the City Manager stated that a Clerk of the Works would not be hired, as the Police Chief, the City Engineer and he could see that specifications were followed On motion of Commissioner Morris, seconded hy Commissioner Stenstrom and carried, the City Attorney was authorized to prepare contracts in amount of $465,800.00 and to authorize the architects to proceed with plans. - .~ . ~ On'motion of Commissioner Morris, seconded by Commissioner Stenstrom and carried over the dissenting vote of Commissioner McClanahan, the Public Safety Administrator was autho- rized to obtain bids for a metal utility building. ~. On motio~ of Commissioner McClanahan, seconded by Commissioner Morris and carried, transfers to cover costs of utility extensions in annexed areas of Dreamwold were authorized as follows: To: Water Distribution Account No. 9329 Sewer Account No. 9529 $2,200.00 $7,000.00 From: Contingency Account No. 9850 $9,200.00 After discussion, Commissioner Stenstrom moved to authorize an increase of $10,000.00 in funds to be borrowed for the "big inch", a total of $35,000.00, to provide for Water and Sewer extensions in Dreamwold. Seconded by Commissioner Morris and carried. After discussion, the Commission tabled consideration °£~ the County Dog Control Ordinance until Workshop Session on May 21, 1973. Request next submitted from the University of Florida for the City to participate in an intern program and after discussion the request was declined. On recommendation of the City Manager, Commissioner McClanahan moved to authorize the use of the parkway on the West side of Maple Avenue in accordance with a proposed parking plan of Gregory Lumber Company using 45 degree stalls. Seconded by Commissioner Stenstrom and carried. Consideration next given to the proposed agreement with the County for detention of City prismners at the County Jail and the City Attorney was authorized to request the County MINUTES City Commission, Sanford, Florida~?~ j:~~ May 14 at 7:00 P. The City Attorney pointed out that the County would not be able to take City prisoners until expansion is complete; or until July 1, 1973, whichever occurs later. On motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, the City Attorney was authorized to send to the legislative delegation a telegram to support the passage of HB2008 - allowing deputy county clerks to issue arrest warrants for violations of municipal ordinances. After discussion and on motion of Commissioner Morris, seconded by Commissioner McClanahan and carried, the City Manager was authorized to be reimbursed for the two weeks vacation due him from last year. After discussion of Senate Bills 788, 789 and 790, to establish a State Bnnd Fund, Commissioner Morris moved to authorize the City Attorney to send telegrams to the legislative delegation in opposition to these bills. Seconded by Commissioner Stenstrom and carried. Requests for time extensions on Condemnations submitted as follows: Bldg. Seconded by Commissioner McClanahan and carrie&. After discussion, Commissioner Morris moved to table until Workshop Session on May 21, 1973, discussion of amending~the Planning & Zoning fe~. Seconded by Commissioner McClanahan and carried. Consideration next given to bid submitted by Max Mogul on April 23, 1973 to purchase city property at Maple Avenue and Seminole Boulevard and the report that the good faith binder has not been received. Commissioner Morris moved that the property bidding.be declared void and the property be removed from the market and be declared of public use. Seconded by Com- missioner MCClanahan and carried. Commissioner Morris moved to authorize the City Manager to explore with Florida State Bank an exchange of land with view for additional land for expansion and parking. Seconded by Commissioner Stenstrom and carried over the dissenting vote of Commissioner McClana- hen. Commissioner McClanahan moved to rescind action of the Commission to extend Water and Sewer to this area to be repaid on a pro-rata basis. Seconded by Commissioner Morris and carried. M. 19.73 On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, the City Manager was authorized to negotiate an emergency purchase to replace a police car totally destroyed in a wreck and to authorize a transfer of funds for same. On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom, Ordinance No. 1133, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER IN ACCORDANCE WITH THE' PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. was placed on its first reading and read in full. Commissioner Morris next introduced Resolution No. l128"and after being read in full, moved on its: passage and adoption. Seconded bY COmmissioner MCClanahan-and carried by the unanimous vote of the Commission. Said Resolution'No.~ 1128 being in words and~figures as-follows:'- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA RELATING TO THE FLORIDA 'STATE COMPREHENSIVE PLANNING ACT OF 1972, ITS COMPANION LEGISLATION, AND REGIONAL GOVERNMENT. WHEREAS, the Florida State Comprehensive Planning Act of 1972 authorized the establish ment of certain geographical boundaries in the State of Florida for the purpose of planning and the creation of the Division of State Planning to coordinate these regiOns, and WHEREAS, the said Florida State Comprehensive Planning Act of 1972 and the Florida Environmental Land and Water Management Act of 1972, known as the Florida State Multi-County Planning Commissions Act of 1973 will establish regional government throughout the State Florida, and WHEREAS, the creation of such a system will usurp the p~wer from the municipal and county governments and vest said power in the regional government system which is contrary to the traditional local government concepts. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA that the Florida State Comprehensive Planning Act of 1972 and the Florida Environmental Land and Water Management Act of 1972 be repealed. BE IT FURTHER RESOLVED that the Florida State Legislature be urged to defeat the Florida State Multi-County Planning Commissions Act of 1973 and any other legislation relative to regional government in the State of Florida. BE IT FURTHER RESOLVED that a joint committee of the Florida House of Representatives and the Florida Senate be created to conduct a thorough investigation into regional govern- ment, and the constitutionality of the actions of the Federal agencies in relation thereto. BE IT FURTHER RESOLVED that the City Manager be and he is hereby authorized and directed to communicate this Resolution to the Orange-Seminole Legislative Delegation and to all appropriate authorities at such times and in such manner as the said City Manager shall deed it most appropriate and proper.
