The first order of business was a Public Hearing to consider amendments in certain districts and boundaries of the Zoning Ordinance in accordance with notice published in the Sanford Herald on May 16, 1973, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on May 28, 1973, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: A. That property lying at the NE corner of the intersection of Pop- lar Avenue and First Street is proposed to be rezoned from RMOI (Multiple-Family Residential, Office and Institutional) District to MI-2 (Medium Industrial) District. Said property being more particularly described as follows: Beg at the N line of First Street and the E line of Poplar Avenue according to E. R. Trafford's Map of Sanford, Seminole County, Florida, thence run E 150 feet, N 638 feet, W 150 feet, S 638 feet to the point of beginning. B. That property lying between 5th Street and 6th Street and between Maple Avenue and Cedar Avenue is proposed to be rezoned from MR-2 (Multiple Family Residential) District to RI-1 (Restricted Indus- trial) District. Said property being more particularly described as follows: Ail of Block 7, Tier 10, and Block 7, Tier 11, less Lots 5, 9 and t0. E. R. Trafford's Map of Sanford, Seminole County Florida. On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, Ordinance No. 1134, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICTS DELINEATED BELOW. was introduced and placed on its first reading and read inf:f~ll. Commissioner Morris moved on the waiver of the requirement of the second reading of Ordinance No. 1134, and that same be placed on its final passage and adoption. by Commissioner Meyer. Meyer " Commissioner.Morris Commissioner Stenstrom " Thereupon, the Chairman announcedthat the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1134, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA AMENDING ORDINANCE NO, 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICTS DELINEATED BELOW. TheChairman announced that the Commission would hear from those persons in favor of, or against, the proposed zoning amendment, recommended by the Zoning and Planning Com- mission as GC-2 (General Commercial) District as to .Item B. : Robert B. Goetzinger, Manager of Gregory Lumber Company, appeared to support the change in zoning and'outlined that a 60 X 100 ~oot building~would be constructed at the cot- net of 5th Street and~Holly Avenue as an addition to the existing building for the storage ofjlumber. No one appeared to oppose the rezoning. Bob:McKee/. appeared to support the rezoning and submitted a preliminary landuse map indicating construction of a 23 unit condominium on 4.7 acres with a tennis court, pool and recreation area. After consideration, Commissioner Meyer moved to authorize the City Attorney to prepare an ~rdinance to rezone from SR-1AA, (Single Family Residential Dwelling) DiStrict to MR-1 (Multiple Family Residential Dwelling) District that property described in ffm fore- going notice of public hearing. Woodrow Pope, Trustee of the Elks Club, appeared to support the request and stated that the old building had been demolished and a new building was to be constructed on the site. After consideration, Commissioner Meyer moved to authorize the City Attorney to prepare an ordinance to rezone to RMOI, (Multiple Family Residential, Office and Institutional) District, that property described in the foregoing notice of public hearing. Seconded by Commissioner Stenstrom and carried. The~.:Chairman announced that the Commission would hear from those persons in favor of, or against, the proposed zoning amendment as to Item C. Mrs. J. N. Azzarello, petitioner, appeared to support the rezoning and~to appeal the recommendation to deny the rezoning by the Zoning and Planning Commission. M. O. Hardy, 1700 West Third Street, owner of lots 11 and 12 in the area, appeared to support the rezoning request. No one appeared in opposition. Commissioner Morris moved to deny the rezoning request. Seconded by Commissioner McClanahan and carried over the dissenting vote of Commissioner Stenstrom; On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, Ordi- nmnce No. 1135, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICTS DELINEATED BELOW. was introduced and placed on its first reading and read in full. The City Clerk informed the Commission that Attorney John Maynard, petitioner, had requested action to be tabled until June 11, 1973, and on motion of Commissioner Meyer, seconded by Commissioner Morris and carried, the request was approved. No one appeamed in opposition. Don Howe, petitioner, appeared to support the re- quest, stating he plans to erect low rental effeciency type apartment units on the site. The Commission informed Mr. Howe of the requirement to pave the abutting dirt streets and Mr. Howe was agreeable. After consideration, Commissioner Stenstrom moved to authorize the City Attorney to prepare an ordinance to rezone to MR-2, (Multiple Family Residential Dwelling) District that property as advertised in,he foregoing notice of public hearing. Seconded by Commissioner Meyer and carried. The next order of business was a public hearing to consider vacating, closing, and abandoning ~f a street right-of-way in accordance with notice published in the Sanford Herald on May 11, 1973, as follows: NOTICE OF PROCEEDING FOR VACATING AND CLOSING A PORTION OF A STREET TO WHOM IT MAY CONCERN: MINUTES City Commission, Sanford, Florida May .2,8 at 7:00 P. M. .19 73 City will close, vacate and abandon any rightcof the City and the public in and to a portion of EAST STREET lying East of Pine Avenue, being more particularly described as follows: That part of EAST STREET lying between Block 21 and Block 22, Chapman ~and Tucker's A~di.ti'on to Sanford. After consideration, Commissioner McClanahan moved to authom~ze the City Attorney to prepare an ordinance to close, vacate and abandon a portion of East Street right-of-way as advertised in the foregoing notice of Public Hearing, and-to retain a 15-foot utility ease- ment along the centerline. Seconded by Commissioner Meyer and carried. The next order of business was a public hearing~ to consider, the annexation of prop- erty in accordance with notice authorized by the Ci~/Commission on May _14, 1973, to be mailed to owners of property described as follows: . Lots 1 through 7 and Lots 17 through 26;~ Block 21, Dreamwold. The Chairman announced that the Commission would~ hear from. those persons in favor of, or against, the proposed annexation. ..~: ~ ~_ No one appeared in opposition. After consideration, Commissioner McClanahan moved to table action on the proposed annexation. Seconded by Commissioner Meyer and carried. The next order of business~was a public hearing to consider the annexation of prop- erty in accordance with notice authorized by the City Commission to be mailed to owners of property described as follows: Seminole County Records Lot 56, M. M. Smith's Subdivision, PB 1, Pg 55 and Lot A, 1st Section,~ -~.F.G. Industrial Tract, PB 5, Pg 22 and Blocks A & C, A.F.G. Vegetable Tract, PB 7, Pg 14. The Chairman announced that the Commission would hear from anyone in favor of, or against, the proposed annexation. No one appeared to oppose. Development Company appeared to support the request. Further, that buildings under Reports Nos. 73-462, 73-464, and 73-466, having been found collapsed, be condemned and the owners given a notice to completely demolish and clear the debris im- mediately, or give just cause why same has not been done; and to authorize the City to com- pletely demolish and remove all debris and levy a lien against the property for said removal under authority invested by Ordinance No. 268. Dimmock, III, 701 Briarcliffe Street, owner of Lots 25 and 27, Block 13, Dreamwold, appeared to oppose the annexation and adopting an ordinance to include his prop- erty inside the boundaries of the City Limits. Mrs. Belle E. McDonough, owner of Lots 8, 9 and 10, Block 25, Dreamwold, appeared to oppose annexation of her property to the City. On motion of Commissioner Meyer, secpnded,b~ Commissioner Stenstrom and carried, Dr. John F. Darby was reappointed to the Civil Service Board for a term for two years to ~7 June 30, 1975. After consideration, Commissioner Stenstr°m moVed to approve the transfer Of $225.00 from Fire Department, Salary Account No. 2301 t° Office Furniture and'Equipment, Account No. 2312 for the purchase of a typewriter. Seconded by Commissioner Meyer and carried. On motion of Commissioner Morris, seconded by Commissioner Stenstrom and carried, minutes of May 14, 1973, were a~roved. Connelly at 1205 West 12th Street; and further, to authe~lze acceptance of a note from the Trustees.of A.M.E. Church for a period of 12 months without interest for paving escrow account for said lot.
