M. 73 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on July 23, 1973. Present: Mayor-Commissioner Lee P. Moore Commissioner A. A. McClanahan Commissioner Gordon T. Meyer Commissioner John G. Morris Commissioner Julian L. Stenstrom City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Absent: City Attorney C. Vernon Mize, Jr. Police Chief Ben E. Butler The meeting was called to order by the Chairman. Clifford Nelson, Semin~.le Zoological Society, appeared to give a status and financial report of the Central Florida Zoological Park, probable completion date, and transfer of the animals; and, further, to request the Commission to fund the Municipal Zoo operation in the 1973 74 budget to allow a phase-out of the municipal zoo. After discussion, Commissioner Meyer moved to authorize the City Manager to include the Municipal Zoo operation for a maximum period of six months to March 31, 1973, in the pro- posed 1973-74 Budget; with same to be voted on by the Commission in adopting the 1973-74 annual Budget. Seconded by Commissioner McClanahan and carried. Gib Blake, President, Seminole Zoological Society, requested the Commission to trans- fer funds earmarked for said society as follows: 1. $41,666.67 pledged February 21, 1972 from the sale of 14 acres of City property on Seminole Boulevard, and 2. $26,069.61 balance in Public Projects Fund. Commissioner Meyer moved to authorize the funds to be transferred upon the Zoological Society receiving and depositing in a trust fund for capital improvements federal grant monies; and, further that the {ransfer of the $41,666.67 be delayed until development stipulations of the sale are met. Commissioner Morris moved to table the above motion, seconded by Commissioner McClana- han and carried. The next Order of business was a Public Hearing to consider amendments in certain districts and boundaries of the Zoning Ordinance in accordance with notice published in the Sanford Herald on July 3, 1973, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Co~muission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on July 23, 1973, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as - follows: That 'the~:prope~ty~?~:!y~n~between Georgia Avenue and Hartwell Avenue and between 25th Street-and Santa Barb~ra Drive is proposed to be rezoned from SR-1AA (Single Family Residential) District to MR-1 (Multiple-Family Residential Dwelling) District. No one appeared in opposition. Phillip Zeuli, developer, and Jim Fulcher, Architect, submitted a proposed plan for 96 units, with a club house, p0ol and recreation area. After discussion, Commissioner Morris moved to authorize the City Attorney to prepare an ordinance to amend the Zoning Ordinance in accordance with the foregoing notice of Public Hearing. Seconded by Commissioner Meyer and carried. The next order of business was a public hearing to consider amendments in certain districts and boundaries of the Zoning Ordinance in accordance with notice published in the Sanford Herald on July 11, 1973, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOU~MRRIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. M. on July 23, 1973, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property lying SOuth of State Road 46-A and West of Ran- toul Lane is proposed to be rezoned from SR-1AA (Single Fami- ly Residential) District to AD (Agricultural) District. M. 1973 321 After consideration, Commissioner Meyer moved to authorize the City Attorney to pre- pare an ordinance to amend the Zoning Ordinance in accordance with the foregoing notice of public hearing. Seconded by Commissioner Morris and carried. Consideration next given to request submitted by Norman H. Schiff, Newburgh Develop- ment Corporation, at meeting of June 25, 1973, and tabled, for water and ~ewer utilities to approximately 40 acres on SR-427 for development of 136 single family dwelling units. Commissioner McClanahan moved to deny the request. Seconded by Commissioner Meyer. Motion failed to carry over the dissenting votes of Commissioner Morris, Commissioner Stenstrom and Mayor Moore. After further discussion, Commissioner Stenstrom moved to approve the request, based on the condition of payment of the required utility development tap fees. Commissioner Morris moved to second the motion with an amendment that the utility extension would be to this developer only. Commissioner Stenstrom accepted the amendment. Motion carried over the dissenting votes of Commissioner Meyer and McClanahan. The Commission authorized a written contract between Mr. Schiff and the City to be prepared for the utility tap fees payment, density control factor, and that water consumption of the respective develop- ment not exceed 89,000 gallons per day. After discussion, Commissioner Meyer moved on the appointment of Hezekiah Ross, city fireman, to the Commission of the Sanford Housing Authority. Seconded by Commissioner Sten- strom and carried. Consideration next given to a request submitted by Jesse Chambers for transfer of a taxi license from Bennie Boozer and tabled at meeting of July 9, 1973. On recommendation of the Police Chief, Commissioner Meyer moved to authorize the request. Seconded by Commissioner Stenstrom and carried. Victor E. Gischler, President, Sanford-Seminole Jaycees, appeared to report on the activities of his organization and to advise of certain renovations to their buildings at the Jaycee Park on French Avenue and 4th Street. After discussion, Commissioner McClanahan moved to authorize the City Parks Depart- ment to perform the grounds maintenance at the Jaycee Park, and to restrict parking where necessary. Seconded by Commissioner Meyer and carried. Consideration next given to a request submitted by J. H. Lee, 510 East 14th Street, to purchase City property described as Lots 11, 12, 13, and 14, Block B, Celery Avenue Addition located between Cypress and Pine Avenues and between 14th Street and Celery Avenue. Commis- sioner Meyer moved to authorize the City Clerk to obtain two appraisals of the fair market selling price, and to include in the selling price the-cost of the appraisal. Seconded by Commissioner Stenstrom and carried. Invoice No. 10 next submitted in amount ofi$438,74 by. Gutman, Dragash and Matz, Architects, Inc., for arahitectural services rendered through June 30, 1973, on the Sanford Law Enforcement Center, and on motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, payment was authorized for same. On motion of Corr~nissioner Meyer, seconded by Commissioner Morris and carried, minutes of June 11 and June 25, 1973, were approved. On recommendation of the City Manager, Commissioner McClanahan~moved to authorize the payment of a claim in the amount of $400.00 submitted by Phillip C. & Violet Callahan, 2607 Mohawk Avenue, for damages to carpet as a result of a sewer back-up from Seminole High School sewer lift station. Seconded by Commissioner Meyer and carried. The City Commission authorized the City Manager to submit to the Seminole County Board of Public Instruction a statement for said claim and to include the costs for the city work crews. AL .~TTPPLY COMPANY Commissioner Meyer moved to authorize a public hearing to be held on August 13, 1973, to consider the adoption of the new municipal code, and to authorize the City Clerk to advertise same. Seconded by Commissioner Morris and carried. Commissioner Morris moved to approve a change order on the contract for construction of the secondary Sewer Treatment Plant, to provide handrails at hazardous locations, at a cost of $6,000.00. Seconded by Commissioner Meyer and carried. Commissioner Stenstrom moved to approve the installation of nine street lights in newly annexed area from 27th Street, south on 17~92, at a cost of $828.00, to be expended from Account No. 4645. Seconded by Commissioner Meyer and carried. Commissioner Meyer moved to approve the installation of 16 street lights in the newly annexed area of Dreamwold Subdivision.. Secon'ded by Commissioner McClanahan and carried. Seconded by Commissioner Meyer and carried. Request next submitted for an exemption of payment of the 10% municipal utility tax by the Seminole Red Cross, and on motion of Commissioner Morris, seconded by Commissioner Mc- clanahan and carried, same was denied.
