Tamm, Jr. The meeting was called to order by the Chairman. The first order of business was a Public Hearing to consider amendments in certain districts and boundaries of the zoning ordinance in accordance with notice published in the Sanford Herald on July 26, 1973, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the CommisSion Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 13, 1973, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property lying South of and abutting Mayfair Country Club is proposed to be rezoned from SR-1AA (Single-Family Residen- tial) District to MR-1 (Multiple-Family Residential Dwelling) District. Said property being more particularly described as follows: Beg 40 ch S and 30 ch W of NE cor, Run E 20 ch, S 45 deg E 4 ch, S 392 ft, S 45 deg, W 116.11 ft, W 1486.78 ft, N 10 ch to beg. Section 4-20-30. Ail parties in interest and citizens shall have an opportunity tO be heard at said hearing. By order of the City Commission of the City of Sanford, Florida. H. N. The next order of business was a Public Hearing to consider the adoption of a San- ford City Code in accordance with notice published in the Sanford Herald on July 27, 1973, as follows: NOTICE OF PUBLIC HEARING FOR THE PROPOSED ADOPTION OF AN ORDINANCE ENACTING A NEW CODE OF ORDINANCES OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in' the city Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 13, 1973, to consider adopting a new code of ordinances, establishing same; providing for the repeal of certain ordinances not included therein; providing an effective date and penalty for violation thereof; providing for the manner of amending such code. No one appeared to oppose same. Commissioner Meyer moved to authorize the City Attorney to prepare an ordinance to adopt the recodification in accordance with the foregoing notice of public hearing. Secon- ded by Commissioner Stenstrom and carried. ~ On motion of Commissioner Morris, seconded by Commissioner Stenstrom and carried, Ordinance No. 1163, entitled: AN ORDINANCE ADOPTING AND ENACTING A NEW CODE OF ORDINANCES OF THE CITY OF SANFORD, FLORIDA: ESTABLISHING THE SAME: PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN, EXCEPT AS HEREIN EXPRESSLY PROVIDED: PROVIDING FOR THE EFFECTIVE DATE OF SUCH CODE AND A PENALTY FOR THE VIOLATION THEREOF: PROVIDING FOR THE MANNER OF AMENDING SUCH CODE: AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. was introduced and placed on its first reading and read in full. After consideration, Commissioner Meyer moved to authorize the City Attorney to pre~.. pare an ordinance to amend the Zoning Ordinance in accordance with the foregoing notice of public hearing. Seconded by Commissioner Morris and carried. On motion of Commissioner McClanahan, seconded by Commissioner Morris and carried, Ordinance No. 1164, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLANWITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICTS DELINEATED BELOW. was introduced and placed on its first reading and read in f~ll. On motion of Commissioner Morris, seconded by Conm~issioner Meyer and carried, Ordinance No. 1165, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA ESTABLISHING REGULATIONS GOVERNING THE ERECTION, LOCATION, RELOCATION, CONSTRUCTION, REPAIR AND MAINTENANCE OF SIGNS WITHIN THE CORPORATE LIMITS OF THE CITY OF SANFORD, FLORIDA. PROVIDING DEFINITIONS THEREFORE AND PENALTIES FOR VIOLATION THEREOF. was introduced and placed on its first reading and read in full. After consideration, Commissioner Meyer moved to authorize to waive the require- ment of payment of an occupation license fee in amount of $50.00 for a Going Out of Business sale for Gilberg's Fabrics, Sanford Shopping Plaza, and to authorize a refund. Seconded by Commissioner Stenstrom and carried. After~consideration, Commissioner Morris moved to authorize a 90-day time extension on Condemnation Report #72-434, for structure located at 1101 East 7th Street. After being read in full, Commissioner Meyer moved on its passage and adoption. Seconded by Commissioner Morris and carried. Thereupon, the Chairman announced that the ~City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1161, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING A PORTION OF A CERTAIN STREET IN THE CITY OF SANFORD, FLORIDA, AS DELINEATED BELOW. On motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, John Y. Mercer and John Fitzpatrick were reappointed to the Sanford Airport Authority for terms of four years each, effective October 1, 1973. Letter next submitted from Thomas Wilson, executive director of the Housing Authority of the City of Sanford, stating that no employee nor officer of the City may be appointed as a Commissioner on the Authority. Commissioner McClanahan moved to rescind the appointment of Hezekiah Ross, City Fireman, to the Sanford Housing Authority and to appoint D. C. McCoy to the respective board to fill the vacancy of Dr. Vann Parker. Seconded by Commissioner Morris and carried. Letter of resignation from A, L. Wilson as a member of the General Sanford Memorial Library Board of Trustees next submitted and on motion of Commissioner Morris, seconded by Commissioner Meyer and carried, same was accepted with regrets. On motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried, the minutes of July 9, 1973, were approved. Troy Ray, Seminole County Tax Collector, requesting a refund of taxes on Lot 8, Sanford Riverfront Project, for the years 1970 and 1971 in the total amount of $4,150.94; same with reference to Civil Action Nos. 69-233 and 69-1164; and after consideration, Commissioner Meyer moved to authorize payment of same from Contingency Account No. 8150. Seconded by Commissioner Stenstrom and carried. Request next submitted by H. Gordon Wyllie, Executive Vice President, Real Estate, Jeno F. Letter next submitted from Fitzpatrick and HartSock, Certified Public Accountants, and City Auditors, requesting an increase of $500.00 for the audit for the fiscal year ending September 30, 1974; a total cost of $5,000.00. After consideration and on motion of Commis- sioner Meyer, seconded by Commissioner Morris and carried, same was approved. Contract estimates next submitted f~r payment, as follows: 1. Reginald Williams Construction Company, Winter Park, Estimate #2'covering period of June 30 to July 31, 1973, in the amount of $16,128.00; for construction of the Sanford Law Enforcement Center, 815 French Avenue. 2. Lee Construction Company, Sanford, Estimate #15, period of June 29 to July 31, 1973, amount of $25,640.03; covering construction on the Secon- dary Sewage Treatment Plant. 3. Bumby & Stimpson, Inc., Orlando, Estimate No. 1, period of June and ending July 25, 1973, in the amount of $54,792.90; covering construction of a Gravity Interceptor Sewer Line. On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, payment of same were authorized. Roger Allerman, representing William R. Frizzell, Trustee, purchaser of the 14~acres of City property on Seminole Boulevard, west of French Avenue, appeared to outline delays in initiating construction of proposed $1,500,000.00 improvements as agreed in the purchase con- tract. A Written letter of August 13, 1973, outlined a new plan, as follows: Under a new master plan: 1. Reduce the foundation areas to a maximum of 3 buildings and increase the height to four floors. 2. Change the entire concept from rental apartments to that of an office park in an effort to reduce development costs and allow a more desirable operating proforma for financing purposes and a realistic dollar return. Mr. Allerman presented a formula to provide revenue to the City based on 8~ mills and improve- ments value of $1,500,000.00 Would result in estimated tax in the area of $12,750.00 annually. He submitted an offer of payment of one-half of the amount, $6,375.00 immediately and payment of $12,750.00 due on January 1, 1974; provided the City agree that a time extension be granted to December 31, 1974; and if construction has.not begun by December 31, 1974, the City would be permitted to purchase back the land at the original contract amoumt. After discuSsion, Commissioner McClanahan moved to reconsider the previous action taken relating to extending utilities to the Newburgh Development Corporation, outside the city limits, proposed development on 48 acres located southeast of Sunland Estates. Secon- ded by Commissioner Morris and carried over the dissenting votes of Mayor Moore and Commis- sioner Stenstrom. Request next submitted by the Director of Recreation and Parks, and after consider- ation, Co~m~iissioner Meyer moved to transfer $1,650.00 from Contingency, Account #8150, to Parks accounts to cover cost of lighting, picnic tables and benches, irrigation system, grass seed and shrubbery, for the Jaycee Park at 4th Street and French Avenue. After discussion, Commissioner Morris moved to authorize the City Manager to correspon with the County Commission pointing to the fact that the County is obligated to provide continued "ambulance service" to the City of Sanford and all incorporated areas. Commissioner Morris moved to authorize payment of $262.46 to the firm of Gutmann, Dragash and Matz, Architects, Inc. as evidenced by Invoice No. 11, dated August 1, 1973, for architectural services rendered.on the Sanford Law Enforcement Center. Seconded by Commissioner Meyer and carried. The City Manager next submitted a tabulation of Bids opened publicly at 2':00 P. Request submitted from Earl Higginbotham, Standard Oil Company Distributor, 409 Laurel Avenue, to provide off-street.parking on the parkway on. the east side of Laurel Avenue, abutting the Jaycee Park; and on motion of Commissioner Morris, seconded by Commissioner Mc- Clanahan and carried, same was denied. The Commission .offered to entertain a proposal to pro- vide the area pored to City specifications at a cost to the businesses. Commissioner Stenstrom moved to authorize payment of $50.00 each to Earnest South- ward and William Kirk~ for appraisal of city property described as Lots 11, 12, 13 and 14, Block B, Celery Avenue Addition. Seconded by Commissioner Meyer and carried. On motion of Commissioner McClanahan, seconded by Commissioner ~Stenstrom and car- ried, property donated to the City for recreation purposes in Blocks A, B, C, and D, Celery Avenue Addition, were declared no longer a public necessity and to be offered for sale. Commissioner Morris moved to authorize the City Attorney to prepare an ordinance to amend the Subdivision Regulations, Page 28, Section 310, Paragraph l(e) and Section 310, Paragraph 2, to addaa requirement of maintenance bonds on water and on sewer at 20% of the construction cost. Seconded by Commissioner Meyer and carried. After discussion and on recommendation of city engineers, Commissioner Morris moved to authorize the City to participate with a developers group to oversize the Dreyfds project sewer force main from the southern part of the city with City's cost not to exceed $30,000.00 from Reserve for Renewal and Replacement Fund; and further, said participation to be a written agreement approved bytthe City Attorney. Seconded by Commissioner Meyer and carried. Commissioner McClanahan moved to authorize a public hearing to be held on September 1973 to consider amending the Zoning Ordinance, Article V, Use Provisions, Sec. 3, SR-1, Sin- gle Family Residential Dwelling District, Subsection C. - Density Controls, Paragraph (6) to read: Minimum required living area to be 700 square feet, and authorize the City Clerk to advertise same. Seconded by Commissioner Meyer and carried. Commissioner Meyer moved to authorize a public hearing to be held September 10, 1973, to consider the adoption of a budget for 1973-74 and to set the millage for 1973.
