M. 197-3 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 27, 1973. The first order of business was a public hearing, tabled at meeting of August 13, 1973, to consider amendments in certain districts and boundaries of the Zoning Ordinance in accordance with notice publiphed in the Sanford Herald on July 26, 1973, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby giVen that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 O'clock P. M. on August 13, 1973, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property lying South of and abutting Mayfair Country Club is proposed to be rez°ned from SR~IAA (Single-Family Residen- tial) District to MR-1 (Multiple-Family Residential Dwelling) District. Said property being more particularly described as follows: Beg 40 ch S and 30 ch W of NE cor, Run E 20 ch, S 45 deg, E 4 ch, S 392 ft, S 45 deg, W 116.11 ft, W 1486.78 ft, N 10 ch to beg. Gary Martin, GMC Builders and Developers, Inc., presented a preliminary plan of proposed construction for the "Mayfair Condominiums Complex" with 10 units per acre. These structures will be two and three story units on both sides of Country Club Road, same being the ingress and egress to the project. Each unit to consist of approximately 1,200 to 1,500 square feet and to sell for approximately $35,000 to $40,000..i/~ Those persons appearing in opposition to said rezoning were as follows: a. Robert Morris, Attorney representing owners of 13 lots abutting the Cleveland- ToOke property; and submitting a petition of 165 signatures opposing the re- zoning. b. Edwards, 112 Par'~Place Frank Kish, 104 Highland Court After consideration and on recommendation of the Zoning and Planning Commission, Commissioner McClanahan moved to authorize the City Attorney to prepare an ordinance to rezone said property from SR-1AA (Single-FamilY Residential) District to MR-iL (Multiple Family Resi- dential Limited Dwelling) District with a maxzmum densitY of 8 units per acre. Seconded by Commissioner Morris and~carried. Commissioner Stenstrom abStained frOm vote because his brother' father-in-law is an owner of the property. The next order of buginess was a public hearing to consider condemna- tion of twenty-one buildings or structures on Report 'Nos~ 73-484 through 73-504, Group 26, in accordance with notices authorized at the meeting of August 13, 1973. The Chairman announced that the Commission would hear from any property owner or representative thereof. Hall Eva Brooks Williams After consideration, Commissioner McClanahan moved that finding the buildings under Report Nos. 73-484 through 73-504 to be unsanitary, unsafe and dilapidated, that'said struc- tures be condemned and the owners given a notice of ninety :(90) days in which to repair or demolish, or to give just cause why same has not been repaired or demolished; and after 90 days to authorize the City to demolish the structures and levy a lien against the property for said removal. Seconded by Commissioner Morris and carried. Sidney L. Vihlen, Jr., Chairman, Seminole County Board of Commissioners, appeared to report that Herndon Ambulance Service will not be phased out until October 31, 1973, and that the County Commission will continue to revaluate the county ambulance service subsidy. Bob Turney, President, Physicians and Surgeons Ambulance Service, Longwood, appeared to present a proposal for furnishing ambulance service to the City of Sanford and same to be taken under consideration after October 31, 1973. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 27, 1973, to ConSider changes and amend- ments to the Zoning;Ordinance of the City of Sanford, Florida, to wit: Article V shall be amended by the addition an MR-iL (Multiple- Family Residential Limited Dwelling) District, to read as follows: MR-1L MuLTIPLE-FAMILY RESIDENTIAL LIMITED~D~LLING DISTRICT. Within an MR-iL MUltiple-Family Residential Limited Dwelling Dis- trict as shown on the Official Zoning Map of the City of Sanford, the following regulations shall apply: Ae Uses Permitted. Land and structures shall be used only for the following purposes: (1) Any use permitted in the SR-1 Single Family Residential Dwelling District except factory built housing. (2) Two-Family dwellings. (3) Multiple family residential structures including con- dominiums. Be Conditional Uses Permitted. When, after review of an appli- cation and plans appurtenant thereto, the' Planning and Zoning Commission finds as a fact that the following proposed use or uses are consistent with the general zoning and other appurtenant municipal ordinances and with the public interest, the Planning and Zoning Commission is hereby authorized to approve special permits for the following uses as permitted uses in the MR-1 District. (1) Conditional uses permitted in the SRml District. (2) Cemeteries. Ce Approval of Site Development Plan. (1) No building or structure, or part thereof, shall be erected, altered or used, or land or water used shall any building permit or certificate of occupancy be issued ,therefor, unless and until a Site Development Plan for such building, structure or ~ shall have been approved as provided hemein. (1) For single Eamily dwellings, the Rensity Controls in the SR-1 Single Family Residential Dwelling District shall be applicable. (2) For two-family dwellings: a. Minimum required lot area: b. Minimum required lot width: 7,500 square feet 75 feet c. Minimum required front yard: 25 feet d. Minimum required rear yard: 20 feet Minimum required side yard: 7.5 feet of 10%of the lot width, whichever is greater. f. .Minimum required living area: 700 sq. ft. per family g. Rotundo Deputy City Clerk City of Sanford, Florida Publish August 17, 1973 The Chairman announced that the Commission would hear from those persons in favor of, or against, the proposed zoning amendment as recommended by the Zoning and Planning Com- mission. No one appeared in opposition or support. After consideration, Commissioner McClanahan moved to authorize the City Attorney to prepare an ordinance to amend the Zoning Ordinance to add MR-1L (Multiple-Family Residen- tial Limited Dwelling) District as described in the foregoing notice of public hearing. Seconded by Commissioner Morris and carried. Recommendation next submitted by the Zoning and Planning Commission to permit the Airport Authority to approve site plans within the confines of the Airport property, except locations within 200 feet of its boundary, and on motion of Commissioner McClanahan, seconded by Commissioner Morris and carried, same was denied. 1973 MINUTES City Commission, Sanford, Florida .August 27 at 7: 00 P. Davis, Attorney for developers, Commissioner Morris moved to table the public hearing to September 10, 1973. carried. Seconded by Commissioner McClanahan and Tim Bannick, President, Seminole County Drug Action Cor~aittee,~appeared to present a 1973-74 Budget for this organization and requested the City Commission to consider contri- buting City fUnds for the operation of said organization. After discussion, the request was held for further consideration. Letter next submitted by Leonard Francoeur, President, Downtown Business Associ- ation, enclosing petitions of complaints against the operation of the Cue Family Recreation and Entertainment Center, 212 East First Street, Sanford, operated by O. W. and Richard Hall, license Nos. 299 and 1534. Commissioner Morris moved to authorize a public hearing to be~held on September 10, 1973, to consider the revocation of said licenses in accordance with Section 16-7 of the Sanford City Code and to authorize notices as set forth in said section. Seconded by Commissioner Stenstrom and carried. Mr. Norman Schiff, and Mr. Singleton, Attorney, officials-of Newburgh Development Co. appeared to discuss with the Commission the reconsideration of their request to extend City water and sewer services to the pmoposed development of 48 acres located outside the City, south of Sunland Estates. Mr. Schiff stated that engineering plans were 50% completed but were stalled until the development went either "package sewer plant" or with an agreement with the City for future annexation, when feasible, and with city water and sewer services. Mr. Schiff and Mr. Singleton were in agreement that the developers would pay all costs re- lated to the utility line extensions to the site, and same was held for further discussion. Ordinance No. 1165, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA ESTABLISHING REGULATIONS GOVERNING THE ERECTION, LOCATION, RELOCATION, CONSTRUCTION, REPAIR AND MAINTENANCE OF SIGNS WITHIN THE CORPORATE LIMITS OF THE CITY OF SANFORD, FLORIDA. PROVIDING DEFINITIONS THEREFORE AND,PENALTIES FOR VIOLATION THEREOF. placed on its first reading and read in full at the meeting of August 13, 1973, was next placed on its second and final reading. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1165, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA ESTABLISHING REGULATIONS GOVERNING THE ERECTION, LOCATION, RELOCATION, CONSTRUCTION, REPAIR AND MAINTENANCE OF SIGNS WITHIN THE CORPORATE LIMITS OF THE CITY OF SANFORD, FLORIDA. PROVIDING DEFINITIONS THEREFORE AND PENALTIES FOR VIOLATION THEREOE. Said Resolution being in words and figures, as follows: RESOLUTION OF!INTENT OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, TO CONSIDER ANNEX- ATION OF CERTAIN TERRITORY HEREINAFTER DESCRIBED AS REQUIRED BY CHAPTER NO. 73-620, LAWS OF FLORIDA, .1973. WHEREAS, Chapter 73-620, Laws of Florida, 1933, relating to municipal annexation in Seminole County, Florida, requires, in Section 3 thereof, that any municipal governimg body desiring to annex territory shall first pass a resolution stating the intent of the municipality to consider said annexation of the stated territory, and WHEREAS, application for annexation to the corporate limits of Sanford, Florida, has been made by the record owners Of said territory, said territory being described as follows: Lots 37, 38, and 39, 2nd Addition to Park View, according to the Plat thereof as recorded in Plat Book 4, Page 5, of the Public Records of Seminole County, Florida, the same being the premises located at the Southeast corner of 28th Place, (formerly known as Hill Street), and Palmetto Avenue. Hall in the City of Sanford, Florida, for the purpose of determining the question of annexation of the territory described above into the corporate limits of Sanford, Florida.
