Sanford, Flomd . ~ ~r ........... .. · The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on September 10, 1973. Present: Mayor-Commissioner Lee P. Moore Commissioner A. A. McClanahan Commissioner Gordon T. Meyer Commissioner John G. Morris Commissioner Julian L. Stenstrom City Attorney C. Vernon Mize, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler The meeting was called to order by the Chairman. William C. Hutchison, Jr., Attorney for the City re: Aurdella Davis, et al;. vs. City of Sanford, Federal District Court No. 70-172-ORL-CIV, appeared to submit stipulations received from the attorneys for the plaintiff, summarized as follows: 1. Every six months, the City will ~submit a progress report to the court. 2. Plaintiff's attorneys may select an expert to meet with City engineers to con- sult with them and to make decisions on phases of the program. 3. Recognition of no discrimination wording to be removed and wording substituted to the effect that the program is to upgrade the community. After discussion, Commissioner McClanahan;moved to authorize the acceptance only of Item #1 of the proposed stipulations. Seconded by Commissioner Morris and carried. The next order of business was a Public Hearing held by the City Commission in accordance with Section 16-7 of the City Code and in accordance with the notice served by the Sanford Police Department on September 1, 1973, to consider'revocation of municipal occupa- tional licenses, as follows: License Nos. 299 and 1534, issued September 22, 1972 Licensee: O. W. and Richard Hall d/b/a The Cue Family Recreation and Entertainment Center, 212 East First Street, Sanford, Florida. Richard Hall appeared to take an oath of truth administered by the City Clerk and to answer charges and questions of the complaints of persons as follows: Leonard Francoeur, President, Downtown Business Association, took the oath and appeared to affirm petitions submitted and requested that the businessmen present be permitted to relate their specific causes regarding The Cue. me Ralph T. Cowan, Cowan's Department Store, 214 East First Street; took the oath and related instances pertaining to obscene language, bicycle riding on the sidewalk and blocking of same; horseplay and rowdiness inside and outside; and prime trouble being large gatherings on the front sidewalk. -~J. M. Garrett, Garrett's ~Department Store, 200 East First Street, took the oath and spoke of obscene language; bicycles and large gatherings blocking the sidewalk; and particularly, that he hardly ever saw Mr. Hall, the owner, at the establishment. e Herman Jacobson, Ro-Jay's Women's Apparel, 228 East First Street, took the oath and spoke of obscene language, b rocken bottles; bicycles in numbers con- gesting ahe sidewalk; and calling the police department in regards to break- lng up a fight between whites and blacks using bricks from the planter broken on the sidewalk. Roger Kingdon, d/b/a Kingdon's Sewimg Center, 210 East First Street, took the oath and spoke of obscene language in front of ladies coming into his sewing MINUTES City Commission, SanfOrd, FlOrida September 10 at 7: 00 P. After discussion by the Commission, Commissioner Meyer moved to revoke the afore- said municipal 'occupational licenses of the Cue Family. Recreation and Entertainment Center, 212 East First Street, and to authorize a refund of the unused portion of the license fee. Seconded by Commissioner McClanahan, and carried over the dissenting vdms of Commissioner McClanahan and Commissioner Morris. Ordinance No. 1173, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097, SAID AMENDMENT ADDING A SECTION PROVIDING FOR THE ESTABLISHMENT OF A MULTIPLE-FAMILY RES%DENTIAL LIMITED DWELLING DISTRICT. placed on its first reading and read in full at the meeting of August 27, 1973, was next placed on its second and final reading. After being read in full, Commissioner McClanahan moved on its passage and adoption. Seconded by Commissioner Stenstrom and carried. Thereupon, the Chairman announced that the City Conm~ission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1173, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097, SAID AMENDMENT ADDING A SECTION PROVIDING FOR THE ESTABLISHMENT OF A MULTIPLE-FAMILY RESIDENTIAL LIMTTED DWELLING DISTRICT. The next order of'business was a Public Hearing, tabled at meeting of August 27, 1973, and held in accordance with notice published in the Sanford Herald on August 17, 1973, to consider amendments in certain districts and boundaries of the Zoning Ordinance a~ recom- mended by the Zoning and Planning Commission, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock~P. M. on August 27, 1973, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property lying North of State Road 46-A, West of Tee 'n Green Subdivision, Sanford, Seminole County, Florida is proposed to be rezoned from SR-1AA (Single-Family Residential) District to MR-1 (Multiple-Family Residential Dwelling) District. Alexander, realtor, appeared in behalf of Dorothy Winston to propose the development of Winston-Sanford with 112 garden type apartments on 14 acres with a density of eight units per acre and 168 patio homes on 28 acres with density of 6 units per acre, also 36.4 acres of open and recreation space. The developers also pro- posed acceleration and deceleration lanes for entrance ~oads on SR 46-A, and to donate right of way for SR 46-A and Oregon Avenue up to 50 feet from the centerline of each of those roads. No one appeared to pppose same. After consideration, Commissioner Meyer moved to authorize the City Attorney to prepare an ordinance to rezone from SR-1AA (Single Family Residential Dwelling) District, to MR-iL (Multiple Family Residential Limited Dwelling) District the property described in the aforesaid notice of public hearing. Seconded by Commissioner Morris and carried. On motion of Commissioner Meyer, seconded by Commissioner Morris and carried, Ordi- nance No. 1174, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN THE DISTRICT DELINEATED BELOW. was introduced and placed on its first'reading and read in full. Commissioner Meyer then moved on the waiver of the requirement of the second read- ing of Ordinance No. 1174, and that same be placed on its final passage and adoption. by Commissioner Morris. After discussion, Commissioner McClanahan moved to authorize the City Attorney to prepare an ordinance to rezone ~he property in accordance with the foregoing notice of pub- lic hearing. Seconded by Commissioner Morris and carried. After consideration, Commis- sioner Morris moved to authorize same. Seconded by Commissioner Meyer and carried. The next order of business was a Public Hearing to consider an amendment to Article V, Section 3C (6) of the Zoning Ordinance in accordance with notice published in the Sanford Herald on August 30, 1973, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby giVen that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 O'clock P. M. on September 10, 1973, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, to wit: Article V, Section 3, Subsection C (6) (a) shall be amended to read as follows: (6) Minimum required living area: a. single family residence, 700 sq. ft. M. in the city of Sanford in the countyof Seminole, the City intends to levy upon the assessment roll of the year 1973 taxes for the fiscal year beginning on the first day of October, 1973, at the rate of $8.50 per $1,000 valuation. Certification has been made by the Assessor of the county of Seminole that a tax rate of $8.07 per $1,000 valuation will yield the same amount of tax revenue as that levied during the current year. Resolution No. 1133 being in words and figures,as follows: RESOLUTION SETTING FORTH THE REDEMPTION MROVI- SIONS AND MATURITY SCHEDULE FOR $700,000 PUBLIC IMPROVEMENT REVENUE BONDS, SERIES 1971 OF THE CITY OF SANFORD, FLORIDA AND RATIFYING AND CON- FIRMING NOTICE OF SALE OF SUCH BONDS. WHEREAS, the City Commission of the City of Sanford, Florida has heretofore, by Ordinance No. 1054 enacted on Janu- ary 10, 1972, authorized the issuance of $700,000 Public Im- provement Revenue Bonds, Series 1971 of the City of Sanford, Florida, dated September 1, 1971. M. 1973 RESOLUTION OF INTENT OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, TO CONSIDER ANNEX- ATION OF CERTAIN TERRITORY HEREINAFTER DESCRIBED AS REQUIRED BY CHAPTER NO. 73-620, LAWS OF FLORIDA, 1973.
