M. .1973 'The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 22, 1973. Present: Mayor-Commissioner Lee P. Moore Commissioner A. A. McClanahan Commissioner Gordon T. Meyer Commissioner John G. Morris Commissioner Julian L. Stenstrom City Attorney C. The first item of business was the acceptance of proposals for sale of City property, tabled on October 8, 1973, and advertised in the Sanford Herald on. September 25, 1973, as follo~ s: INVITATION FOR PROPOSAL The City of Sanford will accept firm proposals for the sale of city property located between Celery Avenue and East 14th Street and between Sanford Avenue and Locust Avenue described as follows: Parcel 1. Parcel 2. Parcel 3. Parcel 4. Parcel 5. Parcel 6. Parcel 7. Lots 6, 8, 10, 12 and 14, Block A. Lots 6 and 8, Block B. Lots 9, 11 and 13, Block B. Lots 12 and 14, Block B. Lots 9, 11 and 13, Block C. Lots 10, 12 and 14, Block C. Lots 9 and 11, Block D. Ail lots in Celery Avenue Addition to Sanford as recorded in Plat Book 1, Page 125, Seminole County Records. The proposal should be in a sealed envelope and clearly marked as such on the outside. It should be submitted to the City Commission of the City of Sanford no later than 7:00 o'clock. P. M. on Monday, Octo- ber 8, 1973. Proposal shall, include the following: The net price of the land to be paid to the City of Sanford. Bids may be submitted on any or all parcels. No bids will be accepted on a portion of any parcel. Bid shall be listed separately for each parcel. 2. Ail fees shall be paid by the buyer - none by the City of Sanford. Be Include a certified check for ten (10) per cent of the land as a binder. This proposal is open to anyone. The City Commission reserves the right to accept or reject any or all proposals in the best interests of the City of Sanford. Commissioner McClanahan moved to take the above described property off the market. Seconded by Commissioner Meyer and carried. A T, gI1T)PT,'T"' NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 22, 1973, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property lying at the SW corner of the intersection of French Avenue and Twentieth Street is proposed to be rezoned from RC-1 (Restricted Commercial) District to GC-2 (General Commercial) District. Said property being more particularly described as follows: Lots 1, 2 and 3, Boyd's Subdivision, PB 1, Pg 85, Seminole County Records. Tamm, Jr. City Clerk Publish: October 12, 1973 The Chairman announced that the Commission would hear from those persons in favor of, or against, the proposed change in zoning. No one appeared in opposition. Everett Harper, realtor, appeared to represent Tom Riggs, lessee, and Doy Royer, owner of property, to support the request. On recommendation by the Zoning and Planning Commission and after discussion, Commissioner Morris moved to authorize the City Attorney to prepare an ordinance to amend the Zoning Ordinance in accordance with the foregoing notice of public hearing, and further to authorize the sale of beer and wine for consumption on the premises. Seconded by Commis- sioner Stenstrom and carried. Commissioner McClanahan abstained from vote due to his residence being in the area. The next item of business was a public hearing to consider closing, vacating and abandoning portions of Myrtle Avenue in accordance with notice published in the Sanford Hemald on October 5, 1973, as follows: NOTICE OF PROCEEDING FOR VACATING AND CLOSING PORTIONS OF A STREET TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Fbrida, at 7:00 o'clock P. M. on October 22, 1973, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to portions of a street as follows: The Easterly 11 feet and the Westerly 11 feet of that portion of Myrtle Avenye lying between Fulton Street and Seminole Boulevard. Persons interested may appear and be heard at the time and place specified. No one appeared in opposition. W. Scott Burns, Manager of the Sanford office of the Florida Power and Light Company, appeared to outline plans to construct a new office building on the northeast corner of the intersection of Fulton Avenue and Myrtle Avenue. · The City Manager st~md that on the west side of said right of way there is a 24 inch storm sewer located 13.5 feet from the property line and a 2 inch water line 9 feet from the property line and submitted recommendations as followS: 1. Vacate only the 11 feet on the east side. 2. Vacate all 22 feet on the east side. 3. Vacate 11 feet on each side, but retain the 11 feet on the west side as a utility easement. After discussion, Commissioner Meyer moved to authorize the City Attorney to prepare the proper ordinance following the recommendation of the City Manager as outlined in Item 2 above. Seconded by Commissioner Stenstrom. Motion failed to carry. Commissioner Morris moved to authorize the City-Attorney' to prepare the proper ordi- nance to close certain portions of Myrtle Avenue following recommendation of the City Manager as outlined in No. 3 above. Seconded by Commissioner Stenstrom and carried over the opposing vote of Commissioner McClanahan. The next item of business was a Public Hearing to consider amendments in certain districts and boundaries of the Zoning Ordinance in accordance with notice published in the Sanford Herald on October 4, 1973, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 22, 1973, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property lying between 25th Street and 25th Place and between Mellonville Avenue and the Seaboard CoaSt Line Railroad right of way lying between Orange Avenue and Yale Avenue is proposed to be rezoned from RI-1 (Restricted Industrial) District to RC-1 (Restrict- ed Co~m~ercial) District. Said property b~ing more particularly described as follows: Lots 1 through 87 and Lots 92 through 105, Oak Hill Addition. M. 73 On recommendation from the Zoning and Planning Commission that the rezoning be denied, Commissioner Meyer moved that the zoning remain RI-1 and that the request be denied. Seconded by Commissioner Stenstrom and carried. Mrs. Janice Springfield, Vice Chairman, Women's Civic and Community Affairs Committee of the Chamber of Commerce, appeared to request the Commission to set up a P~rks Department under a full time Parks Manager qualified in landscaping, separate from the Recreation Depart- ment. Commissioner McClanahan moved to consider the request at the time of the 1974-75 budget hearings. Seconded by Commissioner Stenstrom and carried. Consideration next given to request submitted by Harold H. Kastener, President, Greater Sanford Chamber of Commerce, for additional funds to cover the salary expense of in- coming Executive Manager, Jack Homer, from November 19, 1973 to January 1, 1974; and on mo- tion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, $1,400.00 was authorized to be allocated out of the Industrial Appropriations account to the Chamber for the new manager's salary during the orientation period. On motion of Commissioner Morris, seconded by Commissioner Meyer and carried, Ordi- nance No. 1191, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 73-620, LAWS OF FLORIDA, 1973. was introduced and placed on its first reading and read in full. Commissioner Meyer introduced Resolution No..1137 and after being read in full, moved on its passage and adoption. Seconded by Commissioner Stenstrom and carried. Said Resolution No. 1137 being in words and figures as follows: RESOLUTION OF INTENT OF THE CITY COMMISSION OF THE CITY DF SANFORD, FLORIDA, TO CONSIDER ANNEXATION OF CERTAIN TERRITORY HEREINAFTER DESCRIBED AS REQUIRED BY CHAPTER NO. 73-620, LAWS OF FLORIDA, 1973. WHEREAS, it is the desire of the City Commission of the City of sanford to consider such annexation. NOW THEREFORE, be it resolved by the City Commission o~ the City of Sanford, Florida, that a public hearing shall be held on the 26th day of November, 1973, at 7:00 P. M. at the City Hall in the City of Sanford, Florida, for the purpose of determining the question of annexation of the territory described above into the corporate limits of Sanford, Florida. Ordinance No. 1187, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ENTITLED "ANIMAL CONTROL ORDINANCE", PROVIDING FOR THE REGU- LATION, LICENSING, VACCINATION, IMPOUNDMENT, AND DISPOSITION OF DOGS AND CATS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE AND PROVIDING AN EFFECTIVE DATE. placed on its first reading and read in full at the meeting of October 8, 19~ , was next placed on its second and final reading. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1187, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ENTITLED "ANIMAL CONTROL ORDINANCE", PROVIDING FOR THE REGU- LATION, LICENSING, VACCINATION, IMPOUNDMENT, AND DISPOSITION OF DOGS AND CATS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE AND PROVIDING AN EFFECTIVE DATE. Mrs. Sarah Grayson, owner of Whitehouse Antiques, 918 French Avenue, appeared to pro- test the restrictive control of outside display of merchandise as set forth in Ordinance No. 1170, adopted September 10, 1973. After discussion, the Commission informed Mrs. Grayson that the operation of her establishment would have to comply with the regulations as set forth in the respective ordinance. On motion of Commissioner Meyer, seconded by Cormnissioner Stenstrom and carried, pay- ment in amount of $1,200 was authorized to the Florida League of Cities, Inc. for annual mem- bership dues. On recommendation of the Recreation Director and after consideration, Commissioner Morris moved to authorize the transfer of $150.00 from Contingency, Account No. 8150 to Recre- ation, Account No. 4221, Building Repairs and Maintenance, to cover the cost to replace the compressor in the ice machine at the Civic Center. Seconded by Commissioner Meyer and carried. On recommendation of the Division Superintendent, Department Head, and City Manager, Commissioner McClanahan moved to approve the continued employment for a period of one year of city employee Hugh Wynne, Street Division, over 65 years of age. Seconded by Commissioner Meyer and carried. Statement next submitted in amount of $1,574.88 from Gutmann, Dragash and Matz- Architects, Inc. for the month of September, 1973 and on recommendation of the City Manager, Commissioner Meyer moved to authorize payment of same. Commissioner Stenstrom next moved to approve the use of the Civic Center with alco- holic beverages on December 15, 1973, at the standard fee of $250.00 for the annual Police- men's Ball. Seconded by Commissioner Meyer and carried. Leo SalVail appeared to request a waiver of the required 50% paving costs for streets in front of his property located at 2523 and 2525 Orange Avenue; and after consideration, Commissioner McClanahan moved to table the request until Workshop Session on November 5, 1973. at 4:00 P.
