MR9 73 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 12, 1973. The first item of business was a Public Hearing to consider the annexation of two parc~ts of property in accordance with notice published in the Sanford Herald on October 11, 18, 25 and November 1 and 8, 1973, and copieS mailed and posted in accordance with 1973 HB 1914, said notice as follows: NOTICE OF PUBLIC HEARING TO CONSIDER ANNEXATION Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 12, 1973, to con- sider the annexation of property described as follows: me Beginning at a point of the present western City Limits line of the City of Sanford, which line is parallel with and 278 feet westwardly, measured at right angles from the center line of'Persimmon Avenue; said point being distant 8 feet southwestwardly, measured at right angles from the center line of SCL's Sanford - Aloma Tract; running thence southwardly along said City Limits line 509 feet more or less; thence west- wardly at right angles from the preceding course 600 feet more or less to a point 22 feet eastwardly, measured at right angles radially from the center line of SCL's Jacksonville - Tampa main track; thence north- wardly and northwestwardly parallel and/or concentric with the last mentioned center line 1,430 feet more or less to a point 8 feet southwestwardly, measured at right angles from the center line of said SCL's Sanford- Aloma main track; said point being distant 22 feet southeastwardly, measured along the last mentioned center line from Mile Post A-766; thence southeastwardly parallel to the last mentioned center line 1,435 feet more or less to the point of beginning; containing 13.3 acres more or less. M. 1973 The Chairman announced that the Commission would hear from those persons in favor of, or against, the proposed annexation. No one appeared in opposition. Garnett White, Realtor, representing William Kirk, owner, appeared to support the proposed annexation of property described in Item "A". He stated that Bowe Septic Tank Com- pany would relocate at this site. After consideration, Commissioner Meyer moved to authorize the City Attorney to prepare an ordinance to annex the properties in accordance with the foregoing notice of public hearing. Seconded by Commissioner Stenstrom and carCied. The next order of business was a Public Hearing to consider amendments to the Zoning Ordinance as recommended by the Zoning and Planning Commission and in accordance with notice published in the Sanford Herald on October 23, 1973,.as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND ~AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 12, 1973, to consider'changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as fol~ lows: Ae Article V, Use Provision, Section 5, MR-i, (Multiple-Family Residential Dwelling) District, Subsection B. Conditional Uses Permitted, Paragraph (3), be added as follows: (3) Colleges, vocational and technical schools, high schools, and public buildings. After discussion, Commissioner Stenstrom moved to authorize the City Attorney to prepare an ordinance to amend the Zoning Ordinance in accordance with the foregoing notice of public hearing. Seconded by Commissioner Morris and carried. Field ReubenWhite Aletha Smith Eva Brooks Williams Leola Roberts After consideration, Commissioner Morris moved that finding the buildings under Report Nos. 73-5D5 through 73-522 to be unsanitary, unsafe, and dilapidated, that said struc- tures be condemned and the owners given a notice of ninety (90) days in which to repair or demolish, or to give just cause why same has ~not been repaired or demolished; and after 90 days to authorize the City to demolish the structures and levy a lien against the property for said removal. Seconded by Commissioner Meyer' and carried. City Commission,. sanford, Florid~. November 12 a~ 7: 00 P.M. 19.73 to express its sympathy to the family of Richard J. Wirz for the untimely death of Richard J. Wirz, and WHEREAS, the City Commission of Sanford, Florida recognizes the valuable public service that the said Richard J. Wirz contributed to the City of Casselberry as a member of the Zoning Board of the City of Casselberry for a period of three years and as a member of the City Commission of the City of Casselberry during the years 1969, 1970 and 1973, and WHEREAS, the City Commission of the City of Sanford, Florida, further recoginzes the valuable services of the said Richard J. Wirz as a member of the Democratic Executive Committee of Seminole County, Florida. NOW, THEREFORE, BE IT RESOLVED that the City Commission of the City of Sanford, Florida hereby adopts the above.and foregoing Resolution'expressing its~deePest sympathy..to the family of Richard J. WHEREAS~ the Florida Suns Booster Club is involved in the effort to obtain a National Football League Franchise for the Central Florida area, and WHEREAS, it is the expressed concern of the City of Sanford, Florida, that major, well planned and well organized economic development be encouraged to locate in Central Florida, and~.. WHEREAS, it is recognized that major league' football would be of tremendous economic benefit to the entire area. BE IT HEREBY RESOLVED that the:ii'City of Sanford, Florida endorses and lends its full support to the efforts of the Florida Suns organization and its Booster Club to attract to this area a. Said Resolution No. 1142 being in words and figures, as follows: RESOLUTION OF INTENT OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, TO CONSIDER ANNEXATION OF CERTAIN TERRITORY HEREINAFTER DESCRIBED AS REQUIRED BY CHAPTER NO. 73-620, LAWS OF FLORIDA, 1973. WHEREAS, Chapter 73-620 Laws of Florida, 1973, relating to municipal annexation in Seminole County, Florida, requires, in Section 3 thereof, that any municipal governing body desiring to annex territory shall first pass?:a resolution stating the intent of the m~nicipality to consider said annexation of the stated territory, and WHEREAS, application fOr~annexation to the corporate~limits of Sanford, Florida, has~.been made by the record owners of a parcel of property, said parcel of property being described as follows: Lot 80 of M. MINUTES City Commission, Sanford, Florida November 12 at 7: 00 P. M. 1973 Be it resolved by the City Commission~of the City of Sanford, Florida, in regular meeting assembled that the Mayor-Commissione~ of said City be, and he hereby is, authorized to enter into an agreement'with the SEABOARD COAST LINE R~ILROAD COM- PANY, and to sign same on behalf of said City whereby said Railroad Company grants unto said City the right or license to install and maintain, for the purpose of a sanitary sewer main, a line of 30-inch pipe (part cast iron and part vitrified clay) across the right of way and under tracks of said Railroad Company at or near Sanford, Florida; as more particularly described in said agreement, which agreement is dated September 24, 1973, a Copy of which agreement is filed with this City Commission. Report next submitted from K. Moncrief, Attorney, stating that the contract for the paving of Georgia Avenue had been delivered by Wilco Construction Company to Philip Zeuli for approval. After consideration, Commissioner Meyer moved to authorize an extension of 10 months to James H. Triplett, owner of Central Furniture and Bedding Company, Inc., for paving 24th Street, west of French Avenue, and abutting his south property line; and further, to autho- rize the City Attorney to prepare an agreement for said paving and providing if street is not paved within said 10 months, Mr. T~plett will pay to the City an equal amount in lieu of the paving. Seconded by Commissioner Stenstrom and carried over the dissenting vote of Mayor Moore. The City Manager next submitted a report of three programs for paving 23 miles of unimproved streets to be financed b~ federal revenue sharing funds, as follows: If the entire 23 miles project was let to contract on Oct. 1, 1974, there would be $426,505.00 available for actual construction Costs. This means the sum of $1,573,495.00 Would need to be borrowed. However, through the life of the federal act, Sanford can anticipate receiving only $1,293,751.92 leaving $279,744.00 as a defiCit~ plus interest payments. These interest payments over five years at six percent would total $224,808.00. The total deficit then becomes $504,552.00, requiring a sixth year and part of a seventh year of federal revenue sharing funds to complete. The unit cost would be: $20.40/ MINUTES City CommisSion, sanford, Florida___November 12 at 7:00 P. Iq. 19. 73 would become $1,025,283.00 and require a sixth, seventh, and part of an eighth year of federal revenue sharing funds. The unit cost would be $24.69/foot. Coupled with the engineering, surveying, and contingency costs, this would produce a unit cost ~f $21.83/foot.. This would require a sixth and seventh year of federal revenue sharing funds. CONCLUSION: plan "C" is recommended as best serving the City of Sanford. After discussion, Commissioner Morris moved to authorize the fOllowing: 1. proceed immediately with the paving project plan as submitted in Item "A" of the CitY Manager's Report. 2. Proceed with total engineering plans and Survey work. 3. Assess property owners a pro-rata share of the deficit based on the front footage with payment to be made under a-special assessment program over a period of 10 years. Seconded by Commissioner Stenstrom and carried. The City Manager next submitted a report of the court decision on the Workmen's Compensation claim of Eddie Lee Smith and after discussion, Corm~issioner Meyer moved to auth- orize the City Attorney to associate with a firm specialized in Workmen's Compensation legal work and to proceed to appeal said decision. Seconded by Commissioner Morris and carried. After consideration and on recommendation of the City Manager, Commissioner Meyer move, to authorize Change Order No. 11 for construction of the Sewage Treatment Plant to provide for 340 feet of chain link fencing and a gate around the grit chamber.area at a cost of $650.00. Seconded by Commissioner Stenstrom and carried. After discussion, Commissioner Morris moved to authorize initiating and funding cap- ital improvement projects, as follows: Fort .Mel~on/basketball court Beautification/north end of 17-92 Beautification/south end of 17-92 Fire hydrant installation in newly annexed areas Seconded by Commissioner Meyer and carried. Amount $4,250.00 5,000..00 5,000.00 3,800.00 Recommendation next submitted by Clark, Dietz & Associates-Engineers, Inc., to accept the bid in amount of $221,598.34 from Central Florida Water Systems, Inc. for construction of a sewer force main at the south end of the city, under a cooperative program with developers in that area and after consideration, Commissioner Meyer moved to authorize the Mayor to execute the contract for same. Seconded by Commissioner Stenstrom and carried. Recommendation next submitted from the City Manager to close, vacate and abandon cer- tain unopened street right-of-ways' located in muck areas; however, to retain same as a utility and drainage easement. The Commission requested that the Manager submit information as to costs for opening said streets as compared to costs for opening standard right-of-ways. A letter was read from the Sanford-Seminole Jaycees outlining renovation to the JAYCEE PARK site and stating plans to operate again an Information Center for Tourists". One,motion of Commissioner Morris, seconded by Commissioner Meyer and carried, Ordi- nance No. 1195, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PlAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT CHANGING THE ZONING OF THAT CERTAIN PROPERTY LYING AT THE SW CORNER OF THE INTERSECTION OF FRENCH AVENUE AND TWENTIETH STREET TO GC-2 (GENERAL COMMERCIAL) DISTRICT. was introduced and placed on its first reading and read in full.
