The first item of business was a Public Hearing to consider the annexation of property located north of Lake Mary Boulevard and west of U. S. Highway 17-92 in accordance with notice published in the Sanford Herald on February 25, March 4, 11, 18 and 25, 1974, and copies mailed and posted in accordance with 1973 HB 1914, said notice being as follows: NOTICE OF PUBLIC HEARING TO CONSIDER ANNEXATION Notice is hereby given that a Public Hearing will be held at the Commis- sion Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. After discussion, Commissioner McClanahan moved to authorize the City Attorney to prepare an ordinance to annex said property in accordance with the foregoing notice of public hearing. Seconded by Commissioner Stenstrom and carried over the dissenting votes of Mayor Moore and Cor~ffssioner Meyer. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1212, entitled: AN ORDINANCE OF THE cITY OF~SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIII~, THE AREA DESCRIBED HEREINAFTER IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 73-620, LAWS OF FLORIDA, 1973. Mr. Albert C. Phelps, owner of Phelps Restaurant, 2920 South Orlando Drive, was present and related to the Commission that the 10 foot high brick wall constructed on the south property line of the United State Bank of'Seminole and on his north property line is a definite traffic and safety hazard and a detriment to his property~and business. Mr. Phelps further related that the wall abutted his north, narrow, 13-foot driveway entrance and he felt that patrons, braking their autos to enter, could be involved in rear end collisions; and, that patrons exiting from his north driveway did not have a clear line of sight looking north due to the wall obstruction. The City Manager outlined to the Commission that three site plan sheets were prepared by the bank's architect. The set of plans reviewed and approved for issuance of a building permit were for the construction of the bank building only. The set of plans reviewe~ by the building official did show a brick wall. The Manager pointed out that site plans are .' approved only by the Zoning and Planning Commission of the City of Sanford. The contractor had a set of plans showing the brick wall. On November 1, 1973,-the site plan was submitted to the Zoning and Planning Commission for approval and did not show a wall but showed a plant- ing. The plan was not accepted by the Zoning and Planning Commission in that they requested changes be made in the traffic and parking layout. Another site plan was resubmitted to the Zoning and Planning Commission on February 21,~ 1974. It showed the 10 foot high brick wall and the wall was already constructed. The site plan was accepted by the Zoning and Planning Commission on condition that the brick wall be 'cut ~ackto the firSt joint or approximately MINUTES City Commission. After consideration, Commissioner Meyer moved to table the matter until April 8, 1974, to give all parties an opportunity to work out the problems. Seconded by Commissioner Morris. Commissioner Stenstrom;.moved that the City Commission rescind its action of Feb- ruary 25, 1974, to allow the wall to remain and that the actions of the Zoning and Planning Commission of the City of Sanford that the wall be cut back 18'-8" from the front property line shall prevail. Seconded by Commissioner McClanahan. Motion carried over the dissenting votes of Mayor Moore and Commissioner Morris. The Chairman announced that Richard Pugh of Campbell, Foxworth and Pugh, Inc., would appear on April 1, 1974, at 4 P. M. to submit his firms' Sanford Traffic Study report. After consideration, Commissioner Meyer introduced Resolution No. 1148, and after being read in full, moved on its passage and adoption. Seconded by Commissioner Stenstrom and carried. Said Resolution No. 1148 being in words.and figures, as follows: RESOLUTION NO. 1148 RESOLUTION ADOPTING "THE FREINDLY CITY" AS AN OFFICIAL DESIGNATION.FOR A NAME IDENTIFYING THE CITY OF SANFORD, FLORIDA. WHEREAS, it has been brought to the attention of the City Co~is- sion of Sanford, Florida, that there is a need to identify the City of Sanford with a designation that would be appropriate to the reputation and atmosphere of the City, and WHEREAS, for many years the City of Sanford has been known as "The Celery City", which said name is no longer appropriate in view of the fact that the production of celery in the Sanford area has been greatly curtailed in recent years to the extent that the production of celery no longer has sub- stantial impact on the City, and WHEREAS, the~ ~City Commission is of the opinion that the name "The Friendly City" would be an appropriate designation for the City of Sanford, the City Commission being advised that visitors and newcomers to the City are referring to Sanford as a friendly city. To amend Zoning Ordinance, Article VII, General Regulations Provisions, Section 10, Utility Poles, Fences and Walls used as fences, by adding paragraph (3) as follows: (3) On commercially and industrially zoned property, fences and walls used as fences may be erected or maintained as a conditional use when approved by the Planning and Zoning Commission. Letters next submitted from Philip H. Logan and David N. Berrien, tendering resig- nations as members of the Planning and Zoning Commission, and on motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, same were accepted with regrets. Recommendation next submitted by the Building Official as follc~s: Delete Sections 8-6, 8-17 through 8-24 and Article II, in its entirety from the Sanford City Code and that Section 8-5 be amended to read as follows: Qualification of Electricians: No person shall engage in the business or trade of electrician in the City, unless he is qualified to do so as .evidenced by a current certificate issued by the Central Contractors Examining Board created by Section 6-31 of this code. Commissioner Meyer moved to authorize a public hearing to be held on April 8, 1974,to consider said recommendations and to authorize the City Clerk to advertise same. Request next submitted from Mrs. Bowin, 101 Mayfair Circle, for installation of a street light on Hardy Avenue south of Country Club Road, and after consideration same was denied After consideration and on recommendation of the City Manager, Commissioner Meyer moved to approva a salary reclassification for Linda Brown, police department, from clerk typist III-E to clerk typist III-F at an annual salary of $6,883.76. Seconded by Commissioner Morris and carried. Consideration next given to a request from Edward Weaver to waive the subdivision requirements for 8 lots east of Southwest Road between 14th and 15th Streets, and 3 lots on Bay Avenue between 4th and 6th Streets, and after consideration, same was denied. After consideration and on recommendation of the City Engineer, Commissioner Meyer moved to authorize payment of $14,995.00 to Central Florida Water Systems, Inc., Longwood, for estimate No. 4 for period from February 5, 1974 through March 15,1974, for work on the So~ath Sanford Force Main.
