A public hearing was held in accordance with notice published in the Evening Herald on August 12, 1974, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS'IN. THEZONINGORDINANCE OF THE CITY OF SANFORD, FLORIDA Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 26, 1974, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: Article VI, Off-Street Parking and Loading Regulations; Section 2, Off-Street Parking Requirements; Paragraph (18) shall be amended to read as follows: (18) Drug Stores and Super Markets: Ten spaces for each 1,i000 square feet of retail floor area. Seconded by Commissioner Morris and carried .... The Mayor presented a plaque to Mrs. Rosa M. Rotundo for 25 years service to the city as Purchasing Agent, Deputy City Clerk and Assistant Finance Director. Recommendation submitted from the Planning and Zoning Commission to deny the request. Don Cox, pastor of the First Assembly of God, petitioner, appeared to support the request and stated this is the first step in their long range plans, and they propose to !establish a day care center in a three bedroom, two bath house located next to the church. Commissioner Stenstrom moved to approve the request to rezone the property to RC-1 (Restricted Commercial) District. Seconded by Commissioner Meyer and carried over the dis- senting votes of Commissioner Morris and Commissioner McClanahan. On-motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried, the City Attorney was authorized to prepare an ordinance to rezone same. M. on August 26, 1974, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: Item 1: Article V, Use Provisions; Section 5, MR-I, Multiple- Family Residential Dwelling District; Paragraph D, Density Controls; shall be amended by the addition of sub-paragraph (4) as follows: (4) Townhouses and Cluster Homes Minimum required lot area shall be 3,600 square feet b. Minimum required lot and unit width: 20 feet c. Minimum required front yard: 20 feet Minimum required rear yard: family dwellings. same as for multiple- Minimum required side yard: none where units joined by common walls. Where not joined by common walls, side yard shall be at least 10 feet. f. Minimum required living area: August 26 at 7:00 P. Complete site plans shall be submitted with rezoning application. Such site plans shall indicate the location of buildings, parking space, driveways, streets, service areas, walkways, recreation, and open space areas, and all areas to be in common ownership. The living area of each unit will be indicated with other important data necessary for evaluating the project. bb. The townhouse or cluster project shall be in single ownership at the time the application is presented. CC. Each townhouse or cluster home building shall contain no less than three (3), nor more than ten (10) units; dd. Each townhouse or cluster home unit shall be a separate living unit with independent entrances, (common stairwells shall be prohibited), utilities, and garages. Each unit attached to another unit shall be separated by a two-hour firewall which extends to the roof. ee. Swimming pools, tennis courts, playgrounds and other recreation uses 'may be permitted within townhouse and cluster home projects, provided the recreation uses are located in areas retained in common ownership. Nothing in this provision will prevent an individual owner from owning and 'maintaining any similar use on his or her individual lot, provided the City's setback standards are followed. ff. Deed covenants and restrictions shall be developed to insure the maintenance and upkeep of areas and facilities retained in common ownership. These covenants and restrictions shall be submitted for review to the Planning and Zoning Commission before building permit is issued. Article VIII, SUPPLIMENTARY REGULATIONS: Section 1, Planned Unit Development District; Paragraph A, Permitted Uses; sub-paragraph 6, shall be amended to read as follows: (6) Commercial or retail uses, including offices and clinics, provided that they meet the following criteria: The location is appropriate in relation to other land uses. The proposed commercial or office uses reflect the need for commercial and/or office needs according to the City of Sanford's General Development Plan. The planned.unit development includes an area of at least twenty contiguous acres if both residential and commercial uses are to be included in the planned unit development. The commercial uses do not utilize 'more than ten percent (10%) of the gross acreage of the planned unit development unless there are no residential uses-in the development. Mr. Alfred DeLattibeaudiere appeared to represent the Seminole Neighborhood'United Council and questioned the progress of the work on the street paving and drainage in the Goldsboro and Georgetown areas, and further submitted a petition with approximately 550 sig- natures requesting a ti'metable for the paving. Mayor Moore explained the procedures undertaken and the engineering status and reassured the petitioners of the Commission's support; On recommendation of the Building Inspector and the City Manager, Commissioner Meyer 'moved to authorize a 90 day ~time extension on Condemnation Report No. 74-550; 802 Palmetto Avenue, Jeannette E. Seconded by Commissioner Morris and carried. Commissioner Stenstrom introduced Resolution No. 1159, and after being read in full moved on its passage and adoption. Seconded by Commissioner McClanahan and carried. Said resolution being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, WITH REFERENCE TO SERVICES PROVIDED BY SEMINOLE COUNTY WMICHARE RENDERED SPECIALLY FOR THE BENEFIT OF PROPERTY OR RESIDENTS IN UNINCORPOR- ATED AREAS OF SEMINOLE COUNTY, FLORIDA AND FINANCED FROM COUNTY-WIDE REVENUES;~REQUEST TO BOARD OF COUNTY COMMISSIONERS OF SEMINOLE COUNTY TO DEVELOP AN APPROPRIATE MECHANISM TO- ' FINANCE ACTIVITIES FOR SUCH SERVICES BY TAXES, SPECIAL ASIGNMENTS OR SERVICE CHARGES TO BE-~ LEVIED SOLELY UPON RESIDENTS OR PROPERTY IN THE UNINCORPORATED AREAS OF SEMINOLE COUNTY, FLORIDA. WHEREAS, Section 125.01 (6) (a), Florida Statutes will become effective on January 1, 1975, which is during the 1974-1975 taxable year that will permit a municipality to identify services rendered sPecially for the benefit of the pro- perty or residents in unincorporated areas and finances by County-wide revenues and to petition the Board of County Commissioners to finance such services by levying against persons or property within the unincorporated area or to petition said Board to remit to the municipality the cost of such service paid by taxes levied upon property situate within the municipality; and WHEREAS, the City of Sahford provides numerous and varied services for the benefit and protectio~ of its citizens, the cost of which is by taxes levied upon property situatedsolely within the corporate limits of the City of Sanford; and WHEREAS, numerous andvaried services are prOVided by Seminole County, Florida exclusively for the benefit of' the property'and residents of the unincorporated areas of Seminole County, Florida, said services including but not limited to the following divisions of the county government: Arbor Section, Arthropool Control, Building, County Commission, County Planner, Data Pro- cessi~g, Engineering, Extension Service - County Agent, Extension Service - Home Economics, Fire Prevention, Industrial Board, Maintenance, Microfilm, Parks and Recreation, Pollution Control, Rabies Control, Road Department, Soil and Water Commission, Sheriff, Utility Control, Zoning; and WHEREAS, the increase in the proposed budget for all of the above designated services for the taxable year 1974-1975 is due in large part to additional services required because of increased population and develop= 'ment in the unincorporated areas in Seminole County,. NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida that the City Commission bring this 'matter to the attention of the Board of County Commissioners of Seminole County, that it intends to petition the Board of.County Commissioners of Seminole County, Florida in accordance with the terms and.provisions of Section 125.01 (6) (a), Florida Statutes, to afford relief to the citizens of Sanford, Florida for that portion of real property taxes, paid that are allocated to services per- formed solely in unincorporated areas in Seminole County, Florida. BE IT FURTHER RESOLVED that the Board .of County Commission- ers of Seminole County, Florida are hereby requested to give consideration to this 'matter and to develop an appropriatemechanism to assess taxes for services rendered to the citizens of unincorporated areas of Seminole County, Florida to the citizens.residing in those unincorporated areas and to relieve the citizens of the City of Sanford for payment of such services. · THIS, RESOLUTION ADOPTED THIS 26th day of August, 1974. s/ Lee P. Seconded by Commissioner Stenstrom and carried. On recommendation of the City Manager, Commissioner Meyer moved'~to authorize the purchase of a repossessed 1972 Ford, Series 880, 14 yard dump truck, from Ford Motor Credit Co. and further, to authorize to negotiate a 60 day note in the amount of $5,688.84 to pro- vide for same, with payment to be 'made from 74-75 budget. Seconded by Commissioner McClanahan and carried.
