M. .19 75 The City Commission of the City 0f Sanford, Florida, met in regular session in the City Hall in the City of Sanford, Florida, at 4:00 o'Clock P. M. on February 17, 1975. Present: Absent: Mayor-Commissioner Lee P. Moore Commissioner A. A. McClanahan Commissioner Julian L. Stenstrom Commissioner Gordon T. Meyer City Attorney C. Vernon Mize, Jr. City Manager W. ~. Letter of resignation from the CommisSion of the Sahford Housing Authority submitted from John R. Smith. Commissioner Meyer~moVed to accept same with regrets, and to authorize a letter of appreciation for his services. Seconded by Commissioner Stenstro'm and carried. Commissioner~Meyer moved to.appoint Edward Blacksheare to fill the vacancy on the Commission of the Sanford Housing Authority created by the resignation of John R. Smith. Seconded by Commissioner McClanahan and carried. On recommendation of the City Manager and the Minimum Housing Code Inspector, Com- missioner Stenstrom ~moved to authorize a 90 day time extension on Condemnation No. 72-434, 1101 East 7th Street, Jean Glenn, owner. Seconded by Commissioner Meyer and carried. On recommendation of the Division Superintendent C. S. Teston, Department Head Jim Jernigan and the City Manager, Commissioner Meyer 'moved to authorize continued employment after age 65 for Parks Department employee, Clarence Troutman. Seconded by Commissioner McClanahan and carried. Commissioner McClanahan 'moved to authorize a public hearing to be held March 10, 1975 to consider closing a portion of a north-south alley behind 2603 Park Drive. Seconded by Commissioner Meyer and carried. Seconded by Commissioner Stenstrom and carried. Commissioner Stenstrom introduced Resolution No. 1176, and after being read in full, moved on its adoption. Seconded by Commissioner Meyer and carried. Said resolution being in words and figures as follows: RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, EXPRESSING SUPPORT TO THE POSITION OF THE MUNICIPAL JUDGES ASSOCIATION OF THE STATE OF FLORIDA IN ITS EFFORTS TO AMEND ARTICLE V OF THE CONSTITUTION OF THE STATE OF FLORIDA T© PROVIDE FOR A MUNICIPAL COURT SYSTEM. WHEREAS, Article.Five of the 1968 Constitution of the State of FlOrida requires the abolition of all municipal courts by January 3, 1977, by transferring all'municipal cases to the county court in and for the County in which the muni- cipality is located; and WHEREAS, the City of Sanford abolished its ~municipal court effective January 1, 1973, and has found from its experience that the transfer of 'municipal cases to the county court of Seminole County creates a hardship upon the defendants and the Sanford Police Department, and further creates an undue burden upon the court officials and the state attorney's office of Seminole County, Florida; and WHEREAS, the expense of transferring and adminiStering 'municipal court cases in the county court is so ·much greater than administering those cases inil] the 'municipal courts of the 'municipality in which they arise; and WHEREAS, the City Commission of the City of Sanford is of the opinion that based on its experience for the past two years citizens of the 'municipalities throughout the State of Florida will be better served if 'municipal court cases are tried tin the various munici'~alities in a municipal court operated by ~municipal officials. NOW THEREFORE, BE IT RESOLVED that the City Commission of the City of Sanford does hereby endorse the Municipal Judges Association of the State of Florida in the Implementation of Article Five of the 1968 Constitution of the State of Florida, by adopting a new Municipal Circuit Judicial System whereby the Municipal Judge~ employed by and paid from State Funds, would hear ~municipal cases in municipal court with the same procedures as currently in operation and, whereby, all other court officers would be employed by the ~municipality and, whereby,, all fines and forfeitures would be payable to the City Treasuries, and BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the Municipal Judges Association, the Police Chief's Association, the City Managers Association, the State Attorneys Association, other Judges Associations, and the Local Legislative Delegation. , MIeN U T E S 19.75 City Comm~sion,, Sanford, Florida~ .. ~F:ebruary~ 17, at 4: 00 P. Stenstrom s/ Gordon Meyer As the City Commission of the City of Sanford, Florida Commissioner Stenstrom introduced Resolution No. 1177, and after being read in full, · moved on its adoption. Seconded by Commissioner Meyer and carried. Said resolution being in words and figures as follows: RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, REQUESTING THE COUNTY COMMISSION OF SEMINOLE COUNTY, FLORIDA, TO INSTALL A SIDEWALK IN THE CITY OF SANFORD, FLORIDA, ON 27TH STREET FROM SANFORD AVENUE TO U~.S. HIGHWAY 17-92. WHEREAS, the City Commission has become increasingly aware of the large amount of traffic on 27th Street between Sanford Avenue and U. S. Highway 17-92, and WHEREAS, in view of the location on 27th Street of a large grammer school there is definite need for a sidewalk for the safety of the school children and residents of the area in the vicinity of 27th Street, and WHEREAS, 27th Street is the.only street from Sanford Avenue to U. S. Highway 17-92 between 25th Street and Airport Boulevard causing 'more traffic than would normally be occuring on said street. NOW THEREFORE, BE IT RESOLVED that the County Commission of Seminole County, Florida, be requested to install and'maintain a sidewalk on 27th Street to run from Sanford Avenue to U. S. Highway 17-92, said sidewalk being necessary for the safety and welfare of the children in the area attending Pinecrest Grammer School. M, ~ ~I~DSTA~E LEGAL iSUrr~ hb--~k~ 197.5 wit: RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, EXPRESSING THE NEED FOR CORRECTION OF THE TRAFFIC PROB- LEM~AT THE INTERSECTION OF STATE ROAD 46 AND THE SEABOARD COASTLINE RAILROAD WEST OF SANFORD, FLORIDA. WHEREAS, the City Commission of the City of Sanford, Florida, is cognizant of~ the ~traffic problem at the railroad crossing identified as: Section 77020, S.R. 46, S.C.L.R.R. Crossing at S.R. 46 West of Sanford, Florida, (U.S.D.O.T. - A.A.R. Crossing Inventory Number 621-329B), and WHEREAS, the problem at the railroad crossing is compounded not only because of increased 'motor vehicular traffic in recent years, but because of the location of a 'major railroad freight yard on the North side of the highway and location of a depot, railroad shops and the Auto Train terminal on the South side of the highway, and WHEREAS, the highway involved, S.R. 46, is a four-lane divided arterial highway on the Federal aid system connecting Federal Interstate Route 4 with the City of Sanford, Florida, and U.S. Route 17-92 3.92 miles to the East of Inter- s'tate 4, and -~ ~ ' WHEREAS, State Road 46 is a direct connecting route from Lake County, Florida, and from Interstate Highway 4 ~bringing a large amount of traffic through the City of Sanford, and is further utilized by emergency, law enforcement, fire and ambulance vehicles, and WHEREAS, the position of the freight yard and terminals on opposite sides of the highway create numerous problems pertaining to this crossing that are not commonly encountered at other railroad-highway at-grade crossings, to (1) Train speeds are exceedingly Slow crossing the highway and at times trains are halted or reversed while across the highway. (2) Traffic is halted by signals and gates for numerous · movements of single locomotives and further, at ti'mes the signals and gates obstruct traffic when no trains are crossing the highway. (3)Several freight trains per day are extremely long, : .'causing crossingdel-ays that are excessive. (4) Traffic volumes are increasing. February. ~. ~ 17 at 4:00 P.M. 1975__ SUPPLY COMPANY ':' · train operations because of the highway crossing, and is forced to utilize special work ruleS and other extraordinary measures because of the crossing, and WHEREAS, the ~most feasible solution to all of the enumerated problems and .to provide uninterrupted traffic flow and .freedom of train opera- tions would be the construction of'a grade separation project providing'for a highway overpass over the railroad tracks at this location, and WHEREAS, it is not possible within the foreseable future to. affect such an improvement without significant damage-to the regular budgeted road improvements of high .priority contained .in the official Five Year Work Program of the:Florida Department~ of Transportation, and '. . WHEREAS, projected revenues to be received by-the Florida Department of Transportation and the County of Seminole would make it impossible for either agency to undertake this project alone withoutT:~ serious adverse impact on other County, District, of S~ate highwayp~rojects. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF- SANFORD, FLORIDA, that the Florida Department of Transportation be requested to utilize appropriate procedures to qualify the crossing referred to herein with the Federal.Department of Transportation and the Congress of the United States for inclusion as a Special Demonstration Project in a future US Highway Act similar in scope and nature to Section 163 of the 1973 Highway Act in coordination with the appropriate Senators and~Congressman of the State of Florida and the manage- ment of the Seaboard Coastline Railroad Company, and BE IT FURTHER RESOLVED that the Florida Department of Transportation be requested to utilize every possible source to document the need of a solution to the traffic problem at the crossing referred to herein to ~he Federal Depart- ment of Transportation and~the Congress of the United States of America. The Commission authorized the City Manager to require developers to post a cash bond for uncompleted portions of developments based on City estimates prior to issuance of a Certi- ficage of Occupancy. On recommendation of the City Manager, Commissioner McClanahan ~moved to authorize reclassification of Ron Partridge, Utility Plants, from Certified Operator C to D, $9,193.60. Seconded by Commissioner Meyer and carried. Commissioner Stenstrom 'moved to authorize transfer of funds in the Building Depart- ·ment as follows: From Acct. Statement in amount of $639.00 submitted from W. C. Hutchison, Jr., for attorney's fees in the case Willie Mae Davis v. City of Sanford. On recommendation of the City Manager, Commissioner McClanahan ~moved to authorize payment of same. Seconded by Commissioner Stenstro'm and carried.
