Florida ~ March 3 at 4: 00 P.M. 19 7__5 ~,!D_~T_A~GAL SU_PPLY COMPANY The City Commission of the City of Sanford, Florida, met in regular session in the City Hall in the City of Sanford, Florida, at 4:00 o'clock P. M. on March 3, 1975. Present:Mayor-Commissioner Lee P. Moore Commissioner John G. Morris Commissioner A. A. "Mac" McClanahan Commissioner Julian L. Stenstrom Commissioner Gordon T. Meyer City Attorney C. Vernon Mize, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Absent: Police Chief Ben E. Butler The meeting was called to order by the Chairman. John Whelchel, owner of the Club Lui, Inc., submitted a request to permit the sale of alcoholic beverages until 2:00 A. M. without the requirement of serving foods. On recom- mendation of the City Manager, Commissioner Mor~ s 'moved to authorize the City Attorney to prepare an ordinance to amend the City Code to extend the hours of sale of alooholic beverages until 2:~00 A. M. Seconded by Commissioner Meyer and carried. Tom Freeman, contractor, representing the Sanford-Seminole Jaycees, appeared to request permission for his association to conduct a study of the structural condition of the City Hall, to determine the feasibility of reconstruction and restoration of same. On ~motion of Commissioner Morris, seconded by Commissioner Stenstrom and carried, the request was approved John Krider, representing the Atlantic National Bank of Sanford, appeared to support a request to close an alley and utility easement between 15th Street and 18th Street and be- tween French Avenue and Laurel Avenue, Amended Plat of Orange Heights. Commissioner Morris moved to authorize a public hearing to be held March 24, 1975, to consider same. Seconded by Commissioner McClanahan and carried. Commissioner Meyer introduced Resolution No. 1180 and after being read in full, ~moved on its passage and adoption. Seconded by Commissioner Stenstrom and carried. Said resolution being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA WITH REFERENCE TO SERVICES PROVIDED BY SEMINOLE COUNTY WHICH ARE RENDERED SPECIALLY FOR THE BENEFIT OF PROPERTY OR RESIDENTS IN UNI?NCORPOR- ATED AREAS OF SEMINOLE COUNTY, FLORIDA, AND FINANCED FROM COUNTY-WIDE REVENUES: REQUEST TO BOARD OF COUNTY COMMISSIONERS OF SEMINOLE COUNTY TO DEVELOP AN APPROPRIATE MECHANISM TO FINANCE ACTIVITIES FOR SUCH SERVICES BY TAXES, SPECIAL ASSESSMENTS OR SERVICE CHARGES TO BE LEVIED SOLELY UPON RESIDENTS OR PROPERTY IN THE UNINCORPORATEDAREAS OF SEMINOLE~COUNTY, FLORIDA, OR TO REMIT THE IDENTIFIED COST OF SAID SERVICES PAID BY THE TAXES LEVIED UPON PROPERTY SITUATED WITHIN THE CITY OF SANFORD, FLORIDA, TO THE CITY OF SANFORD, FLORIDA. M. .1975 county-wide revenues and petition the Board of County Commissioners to develop an appropriate 'mechanism to finance such activity which may be either by taxes, special assessments or service charges levied solely upon residents or property in the unincorporated area by the establishment of a municipal service taxing or benefit unit or by remitting the identified cost of service paid by taxes levied upon property situate within the municipality to the municipality, and WHEREAS, numerous and varied services are provided by Seminole County, Fbrida, specially for the benefit of the property or residents of the unincorporated areas of Seminole County, Florida, said services including but not necessarily limited to the following services which are reflected in the present budget of Seminole County, Florida, and identified as divisions as follows: Arbor Section Arthropod Control Building County Commission County Planner Data Processing Engineering and Industrial Board Maintenance Microfilm Parks and Recreation PollUtion Control Rabies Control Road Department Extension Service-County Agent Soil and Water Commission Extension Service-Home Economics Sheriff Fire Prevention Utility Control Zoning WHEREAS, the increase in the budget for all of the above designated services for the taxable year 1974-1975 is due in large part to additional services required because of increased population and development in the unincorporated areas in Seminole County, Florida, and WHEREAS, Section 125.01 (6) further provides that the Board of County Commissioners shall file a response within ninety days to a petition as set forth herein, which said response shall either reflect action to develop appropriate 'mechanisms or reject said petition and state findings of fact demonstrating that the service identified does not specially benefit the property or residents of the unincorporated areas, and WHEREAS, the ~ty Commission feels' that it is in the interest of all of the citizens of Seminole County that this 'matter be resolved prior to budget deliberations for the fiscal year 1975-1976. ,. Comraission~ :Sanj~ord,: Florida,; ~, · :, , · MIDSTATE LEGAL SUPPLY COMPANY 19, 75 County Commissioners of Seminole County, Florida to. develop an appropriate mechanism to finance..the activities specified in this Reso!utipn either, by taxes, special assessments or service charges levied solely upon residents or property in the unincorporated areas of Seminole County, Florida, by the establishment of a municipal service taxing or benefit unit, or in the alternative to remit the identified cost of the services specified in this Resolution and paid by the taxes levied upon property situate within the City of Sanford, to the City of Sanford. BE IT FURTHER RESOLVED that a copy of this Resolution be served on the Board of County Commissioners of Seminole County, Florida, and that demand be 'made upon said Board of County Commissioners to file a response within ninety days, which :said response shall either reflect action to develop appropriate mechanisms or reject said petition and state findings of fact demonstrating that the services specified in this Resolution do not specially benefit the property or residents of the unincorporated areas in Seminole County, Florida. Said reso- lution being in words and figures as follows: : A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, URGING THE CREATION OF A JOINT MUNICIPALITIES- COUNTY STUDY GROUP TO CONSIST OFREPRESENTATIVES OF SEMINOLE COUNTY AND THE MUNICIPALITIES THROUGH- OUT SEMINOLE COUNTY TO.PROVIDE~GUIDELINES FOR AN .~ EVALUATION OF THE BUDGET OF SMMINOLE COUNTY IN ACCORDANCE WITH THE TERMS AND PROVISIONS OF CHAPTER ~. 74-191, LAWS OF FLORIDA, RELATIVE TO' THE ISSUE OF DOUBLE TAXATION. WHEREAS, ,Chapter 74-191, Laws of Florida, became effective January 1, 1975, which said Law amended Section 125.01, Florida Statutes, to provide for the identification of services provided by counties specially for the benefit of the property or residents of unincorporated ,areas and further provides for the establishment of a 'municipal service taxing or benefit unit by the counties, and WHEREAS, it is the opinion of the City Commission of the City MI, NUTES ........ ............ NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that the County C°mmiSsion'of Seminole County, Florida, be requested t° form a joint Municipalities-COUnty study group to consist of repreSentatives of Seminole County and of-all the municipalities throughout SeminOle County to provide guidelines for the evaluation of the budget of Seminole-County in order to i~:!~bring about compliance with the provisions of Chapter 74-191,` L~Ws of Florida. ~THIS REsoLUTIoN ADOPTED this 3rd day of March, 1975. Stenstrom s/ Gordon Meyer Commissioner Stenstrom 'moved to authorize the City Manager to submit copies of Reso- lutions Nos. 1180 and 1181 to the Seminole coUnty COmmission. seconded by Commissioner Morris and carried. Request submitted from John Martin, for a variance to the sign ordinance to remove the Finance America sign from a Building at second Street and Magnolia Avenue and install same at the southwest corner of First street and Park Avenue. The Building Official submitted a report that the sign would p'~jeet six feet over public property, which is one foot more than permitted in the sign ordinance. On recommendation of the Building Official, Commissioner Morris moved to approve a Variance. Seconded by Commissioner Meyer and carried. ~ Request submitted from Lannie Green, Innkeeper of Holiday Inn, for a variance to place a ground sign on the north side of West First Street, opposite Persimmon Avenue. The Building Official submitted a report that a RMOI Zone permits wall signs only. Commissioner Morris moved to approve the request. Seconded by Commissioner Meyer and carried. On 'motion of Commissioner McClanahan, seconded bY commissiOner Morris and cart.led minutes of February 17, 1975, were approved. The City Manager sUbmitted a report on the Regional Concept for Libraries. The Commission authorized the City Manager to extend the City's interest in this area. The Commission authorized the City Manager to proceed with the idea of a joint ,f effort with the City of Lakeland to use the law firm of Granville Alley to obtain the local option from the state Public Employees Relations Commission. On recommendation of'th~' City Manager, Commissioner Meyer.~'m'oved to authorize pay- iment in amount of $12,051.00 to William S.
